A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MERCED, CALIFORNIA,
ACCEPTING A GRANT AWARD FROM THE
CALIFORNIA DEPARTMENT OF ALCOHOLIC
BEVERAGE CONTROL ALCOHOL POLICING
PROGRAM
WHEREAS, the City of Merced desires to undertake a certain project designated as Department of Alcoholic Beverage Control Grant Assistance Program to be funded in part from funds made available through the Alcohol Policing Program (AAP) administered by the Department of Alcoholic Beverage Control (hereinafter referred to as "ABC").
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MERCED DOES HEREBY RESOLVE, DETERMINE, FIND, AND ORDER
AS FOLLOWS:
SECTION 1. That the City of Merced accept grant funds from the California Department of Alcoholic Beverage Control Alcohol Policing Program in the amount of $50,000 for the Merced Police Department to address underage drinking and disorderly conduct around licensed premises.
SECTION 2. That the City Manager or designee of the City of Merced is authorized to execute the Department of Alcoholic Beverage Control Standard Agreement (Agreement 25-APP25) attached hereto, including any extension or amendments thereof and any subsequent agreement with the State in relation thereto.
SECTION 3. That it is agreed that any liability arising out of the performance of this Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and ABC disclaim responsibility for any such liability.
SECTION 4. That the grant funds received hereunder shall not supplant expenditures controlled by this body.
SECTION 5. That this award is not subject to local hiring freezes.
