Operations Superintendent Boyd gave a presentation regarding the continuation of the district by stating: “In accordance with the provisions of Government Code 53753 and Article XIIID of the California Constitution, the City of Mill Valley gave notice by mail to the record owner of each identified parcel in the District.” Operations Superintendent Boyd continued by stating:
“As required by law, each notice included an assessment ballot and a summary of the procedures for the completion, return, and tabulation of the assessment ballots.” Vice Mayor Carmel opened the Public Hearing to receive public testimony from all persons who wished to speak by stating: “The City Council will now receive testimony from all interested persons for or against the continuation of the District and the proposed levy of assessments against those parcels.”
Speakers: Burton Miller.
Communications (via eComment): None.
Seeing no one else who wished to speak, Vice Mayor Carmel stated: “I will soon entertain a motion to close the public input portion of this public hearing. Therefore, I would like to remind all owners of parcels within the District that assessment ballots must be returned to the City Clerk prior to the close of this portion of the hearing in order to be counted. Once the public input portion has been closed, the City will stop accepting ballots. Now is the time for any person wishing to cast an assessment ballot or withdraw an assessment ballot to do so with the City Clerk.”
Vice Mayor Carmel paused to see if anyone would approach the City Clerk. No one approached the City Clerk so Vice Mayor Carmel asked for a: “Motion to close the public input portion of the hearing and to direct the City Clerk, to tabulate the assessment ballots submitted, and not withdrawn, in support of or in opposition to the assessment.” It was MOVED by Councilmember Burke and SECONDED by Councilmember McEntee to close the public input portion of the hearing and to direct the City Clerk, to tabulate the assessment ballots submitted, and not withdrawn, in support of or in opposition to the assessment. The Motion was carried by a 4-0 vote. Mayor Wickham absent.
Vice Mayor Carmel then stated: “At this time the assessment ballots will be unsealed and tabulated. Upon completion of the assessment ballot tabulation, the City Clerk will present the results to this City Council for further action.”
The City Council took a recess from 6:54 p.m. to 7:01 p.m. for the City Clerk to tabulate the assessment ballots in the City Council Chambers.
4 Vice Mayor Carmel called the meeting back into order.
City Clerk/Management Analyst III Rogers gave the report of the City Clerk: “The assessment ballots submitted and not withdrawn in connection with the continuation of the Tamalpais Park Street Tree Assessment District have been tabulated. A total of 101 ballots were properly returned to the City Clerk. With ballots weighted according to the proportional financial obligation of each affected property, it has been determined that ballots representing 3,000 dollars in financial obligation were returned in support of the assessment and ballots representing 635 dollars in financial obligation were returned in opposition to the proposed assessment. Therefore, 83 percent of the ballots, as weighted, were cast in support of the assessment. Thus, there is not a majority protest against the continuation of the assessments within the District.
It was MOVED by Councilmember Perrey and SECONDED by Councilmember Burke to close the public hearing. The Motion was carried by a 4-0 vote. Mayor Wickham absent.
Vice Mayor Carmel asked if the City Council had any comments regarding the item.
