There was no public comment regarding this item.

City Manager Tom Williams noted for the record that the City's affordable inclusionary housing ordinance requires 15% to be affordable, so 15% of 20 is 3 units. Now when a developer such as 130/140 El Camino Real builds affordable housing, they can also enact the state density housing bonus laws. In this particular development project, it's a 50% additional bonus. 50% of 20 units is 10 units. Therefore, that project can develop 30 housing units, but the 10 additional housing units were prohibited by state law from applying our local inclusionary affordability. That's where the effective rate of affordability of 30 units, 3 are affordable is 10%, so there was confusion at the last meeting. The effective affordability is 10%, we require 15%, but we are prohibited by state law from applying our 15% affordability to the density bonus units. It is very important to understand that is the case, and unfortunately, that would be 1.5. One and a half more units, we round up get two units of additional affordability off of this project, if we could apply the City's 15% affordable housing ordinance, but we can't.
