Mayor Anders Fung called the meeting to order at 7:00 p.m.
ROLL CALL: Mayor Anders Fung, Vice Mayor Reuben D. Holober and Councilmembers Stephen Rainaldi, Sissy Riley, and Bob Nguyen.

1. public hearing at a Special Meeting to consider an Appeal of a Planning Commission decisio etermining the abandonment of a nonconforming warehouse and distribution use at 370 Adria Road on property zoned Retail Commercial (RC) in the Millbrae Station Area Specific Plan (MSASP) - ACTION
Mayor Fung announced that this is a judicial hearing and that City Council is acting in a judicial capacity to determine the facts and apply the law. City Attorney Lori Liu represents City staff and the City Council will be advised by a separate legal counsel, Ms. Joanne Tran via Zoom on procedural and legal matters.
California law requires the separation of these two roles to preserve the property owner's due process.
The City Council disclosed the following ex parte communications:
Councilmember Rainaldi disclosed a phone conversation with the appellant on December 1, 2025. • Vice Mayor Holober disclosed an in-person meeting with the appellant the prior week and a phone conversation with the City Manager.
• Mavor Fung disclosed a phone conversation with the appellant approximately 2-3 months earlier, prior to the Planning Commission hearing/appeal.
Mayor Fung announced the procedure for the Public Hearing.
Community Development Director presented the report.
The Council asked questions of staff.

Motion by Nguyen/Riley to close the Public Hearing. Motion carried by 5-0 vote.
Community Development Director and Appellant Kwuan provided rebuttals. pecial Counsel Tran advised the City Council on the definition/interpretation of "wholly discontinued" nd "abandoned" under the applicable Municipal Code provisions and was available to answer questions The Council deliberated on the item.
Motion by Holober/Nguyen to uphold the Planning Commission's Determination of Abandonment of a nonconforming use in the retail commercial zoning district in the Millbrae Station Area Specific Plan area at 370 Adrian Road and finding of exemption pursuant to CEQA Section 15061(B)(3). Motion carried by ADJOURN CITY COUNCIL Video Time: 1:30:28
With no further business to discuss, the City Council adjourned at 8:35 p.m. in memory of the 151 individuals who lost their lives in Tai Po, Hong Kong, including the mother of a Millbrae resident.
