AGENDA REPORT
(AR)
Item Title: Approve and Authorize the City Manager to Execute the Improvement Agreement with Sango Court L.P, for the completion of the Offsite Public Improvements Located at 355 Sango Ct.
Category: Consent Calendar-Community Development
Meeting Date: 2/1/2022
Staff Contact: Steve Erickson, Engineering Director/City Engineer, 408-586-3301 Recommendation: Approve and Authorize the City Manager to Execute the Improvement Agreement with Sango Court L.P, for the completion of the Offsite Public Improvements Located at 355 Sango Ct.
Background:
On September 19, 2017, The Developer (Sango Court L.P.) submitted to the City an application for approval of a Site Development Permit (the “RCD Housing Project”) for real property located within City, a legal description of which is attached hereto as Exhibit “A” (“Property”).
On May 23, 2018, the Milpitas Planning Commission approved an application for a Site Development Permit (SD17-0017), Density Bonus (DB17-0001), and Environmental Assessment (EA18-0001) to allow the construction of a 102-unit multifamily apartment building with associated site improvements. The Project is located on an existing 1.26-acre site at 355 Sango Court, Milpitas, CA 95035.
The proposed offsite public improvements to be constructed and accepted by the City include the installation of a new 8-inch recycled water main line along Sango Court to Montague Expressway; 10-foot wide pedestrian and bicycle trail along Penitencia Creek; new Sango Court to Tarob Court street extension per TASP residential street standard and guideline with curb and gutter, sidewalk, driveway approach, utility services, landscaping and other miscellaneous items of work identified on the improvement plans.
Analysis:
The Developer has agreed to enter into an Improvement Agreement (Attachment 1) with the City for the construction of off-site public improvements for the project which will be completed with the on-site work and accepted by the City after completion. The improvements will be completed within 2-years from the date of the Agreement, and the work is guaranteed by bonds or similar securities to be posted by the Developer in the amount of $1,585,103.00. The City Engineering Director/City Engineer has reviewed the public improvement plans (2-1386) and is recommending the City Council approve the Improvement Agreement to allow for the construction of public improvements to proceed.
Policy Alternatives:
Alternative 1:
Deny approval of Improvement Agreement for the installation of offsite improvement for the.
Pros: None
Cons: Denying the approval of the Improvement Agreement will cause the proposed offsite public improvements that support the 355 Sango Ct Project to not be constructed.
25 Reason not recommended: The proposed offsite public improvements are designed to support the 355 Sango Ct Project and staff recommends the City Council approve the Improvement Agreement for construction.
Fiscal Impact:
Required public improvements will be paid for and constructed by the Developer. The Developer will also pay for staff costs for plan review and construction inspections. Following the completion of the public improvements and acceptance by the City, the City will assume maintenance responsibilities after the 1-year warranty period is over.
California Environmental Quality Act:
Approval of the Improvement Agreement implements this project for which CEQA review has already been completed through the City Council’s adoption of Resolution No. 18-009 exempt through the City Council’s adoption of Resolution No. 20-006.
Recommendation:
Approve and Authorize the City Manager to Execute the Improvement Agreement with Sango Court L.P, for the completion of the Offsite Public Improvements Located at for at 355 Sango Ct.
