CITY OF MILPITAS
AGENDA REPORT
(AR)
Item Title: Consider the Recommendation from Mayor Montano for Appointments to the Planning Commission (Contact: Mayor Montano, 408-586-3024) Category: Consent Calendar-Leadership and Support Services Meeting Date: 1/9/2024
Recommendation: Receive the recommendation from Mayor Montano and approve appointments to the Planning Commission, to be transmitted separately.
Background:
The City of Milpitas has 13 Commissions (including the Measure F Oversight Committee), with members appointed by the Mayor and confirmed by the City Council. The Commissions advise the Milpitas elected officials on a variety of community interests and policy areas.
Any resident interested in serving on a City Commission must complete a Commission Application and submit the form to the City Clerk. Copies of the applications are provided to the Mayor for her consideration. Per Government Code 40605, in a general law city where the office of Mayor is an elective office, the Mayor with the approval of the City Council, shall make all appointments to boards, commissions, and committees unless otherwise specifically provided by statute.
Current Commissioners may seek to be reappointed upon the expiration of their current term, but reappointment to a new term is not automatic. Those Commissioners seeking reappointment must contact the City Clerk and the Mayor to convey their request. Re-appointment must be recommended by the Mayor and confirmed by the City Council.
Analysis:
The appointments recommended by Mayor Montano will be transmitted separately prior to the January 9, 2024, City Council meeting.
All recommended Commissioner appointments are reviewed and confirmed by the City Clerk’s office.
Fiscal Impact:
There is no fiscal impact associated with this item.
California Environmental Quality Act (CEQA):
The action is an organizational or administrative activity of the City government that will not result in direct or indirect physical changes in the environment and is not a project pursuant to Cal. Code of Regs., tit. 14, § 15378.
Recommendation:
Receive the recommendation from Mayor Montano and approve appointments to the Planning Commission, to be transmitted separately.

AGENDA REPORT

Item Title: Consider Continuing Council Direction on Public Comment at City Council, Planning Commission, and other Brown Act Body Meetings (Staff Contact: Matt Cano, Assistant City Manager, 408-586-3012)
Category: Consent Calendar-Leadership and Support Services Meeting Date: 1/9/2024
Recommendation: Approve the continuation of the policy that public comments at City Council, Planning Commission, and other Brown Act Body meetings be delivered in person or in writing until further City Council direction is received, except as otherwise required by law.
BACKGROUND:
On October 10, 2023 the City of Milpitas issued a press release (attached) that indicated that all public comments at City Council meetings would need to be delivered in person or in writing through the end of the year. The purpose of this decision was to avoid the City Council meetings being hijacked by zoom bombing attacks and hate speech as has occurred in other jurisdictions.
ANALYSIS:
City staff surveyed over 50 cities in California and well over half of the cities surveyed have discontinued public comments over zoom on a temporary or ongoing basis. Given the continued threat of City Council meetings being hijacked by zoom bombing attacks and hate speech, it is recommended that the policy of requiring public comments at City Council meetings to be delivered in person or in writing should be continued until the Mayor and City Council determine otherwise.
POLICY ALTERNATIVE(S):
As an alternative, the Mayor and City Council could vote to allow public comments to be delivered via zoom for future City Council meetings. This alternative would allow more convenient access to the public but would also increase the risk of a City Council meeting being overtaken by zoom bombing and hate speech.
FISCAL IMPACT:
There is no fiscal impact to the City’s operating budget.
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):
This item is not a project under the California Environmental Quality Act (CEQA) Guideline 15378(b).
RECOMMENDATION:
Approve the continuation of the policy that public comments at City Council, Planning Commission, and other Brown Act Body meetings be delivered in person or in writing until further City Council direction is received, except as otherwise required by law.

Milpitas City Council Discontinues Zoom Public Comments
Milpitas, CA – October 10, 2023 – FOR IMMEDIATE RELEASE
The Milpitas City Council has joined an increasing list of jurisdictions requiring public comments to be delivered in person or in writing through the end of the year. In recent weeks, hate speech has spread through the hijacking of government public meetings such as Sacramento, Monterey, El Cerrito, Walnut Creek, Berkeley, South San Francisco, Livermore, and others. A virtual tool that allowed residents to participate, influence decisions, and hold elected officials accountable has quickly become a platform for hate and harassment.
“We stand firmly against any form of bigotry, racism, or prejudice. Such views have no place in Milpitas, and we are committed to fostering an environment where all our residents feel safe, valued, and included,” said Mayor Carmen Montano.
According to Vice Mayor Evelyn Chua, “ We encourage open and respectful dialogue, where differing opinions can be shared and discussed constructively. However, we draw the line at speech that seeks to divide, demean, or harm Milpitas community members.”
The determination to temporarily discontinue virtual public comments was made in light of recent reports of Zoom-bombing attacks in other communities. Members of the public will be required to attend meetings in-person if they want to comment on an agenda item. They will also continue to have the option to share comments through email and/or regular mail , but these will not be v erbalized during the City Council meeting. However, every comment submitted will be provided to the City Council and will be considered a public record.

(AR)
Item Title: Authorize and Approve Travel Requests for Mayor Montano to Washington, D.C., and for both Mayor Montano and Councilmember Lien to Monterey, CA (Staff Contact: Ned Thomas, City Manager, 408-586-3053) Category: Consent Calendar-Leadership and Support Services Meeting Date: 1/9/2024
Recommendation: (1) Authorize and approve the out-of-state travel to Washington, D.C., for Mayor Carmen Montano to attend the United States Conference of Mayors 92nd Winter Meeting to be held on January 17 – 19, 2024, for an estimated total not-to-exceed amount of $3,600 budgeted under the Individual Elected Official allocation for Conferences/Meetings/Trainings; and
(2) Authorize and approve the travel to Monterey, CA, for Mayor Carmen Montano and Councilmember Hon Lien to attend the League of California Cities Mayors and Council Members Academy to be held on January 24 – 26, 2024, for a combined estimated total not-to-exceed amount of $3,400 budgeted under the Individual Elected Official allocation for Conferences/Meetings/Trainings.
BACKGROUND:
The United States Conference of Mayors holds its Annual Winter Meeting in Washington, D.C. This highly attended annual conference day is scheduled for January 17 – 19, 2024. During the Conference’s Annual Winter Meeting, there will be opportunities for direct engagement with White House, Cabinet, and Agency officials, Congressional leaders, and key policy and thought leaders. Standing committees recommend policy positions they believe should be adopted by the organization. All policy positions adopted at the annual meeting collectively represent the views of the nation’s mayors and are distributed to the President of the United States and Congress. Additionally, mayors are grouped into task forces to examine and act on issues that demand special attention such as the surging mental health crisis, public safety, housing and homelessness, technology and innovation, workforce development, and infrastructure investment. Other priorities for discussion include a review of legislative priorities for the remainder of the 118th Congress; the continued implementation of historic legislation passed by the 117th Congress and signed into law by President Biden such as the $65.1 billion ARPA fund for all cities and added flexibility bill; the $12.1 trillion Bipartisan Infrastructure Law for over 10 years; the Bipartisan CHIPS and Science Act, and Safer Communities Act; the Inflation Reduction Act; and the largest climate investment in the U.S. history. Due to the event location, the Mayor is planning to travel on January 16 to attend the first event on January 17 and will leave a day later to provide flexibility to the City’s legislative consultant in scheduling meetings with members of the California Congressional delegation. The preliminary agenda is attached to this report as Attachment 1.
The League of California Cities holds its Annual Mayors and Council Members Academy in various California cities. This year, the Academy will be held in Monterey and is scheduled for January 24 – 26, 2024. This academy covers the legal, financial, and practical fundamentals to the mayors and council members job as an elected city official. Additionally, Mayor Montano and Councilmember Lien’s attendance at this academy will foster relationships with their peers. The sessions also include an update on key legislative issues and an overview of the League of California Cities services. Attachment 2 is the preliminary agenda for this academy.
ANALYSIS:
The City of Milpitas Travel and Expense Policy requires all travel for the elected officials and City Manager to be approved by the City Council. Council approval of the out-of-state request will allow Mayor Carmen
Montano to engage with the nation’s mayors and to bring back the information to share with the Council.
Attending the US Conference of Mayors will also allow Mayor Carmen Montano and the City’s legislative consultants to have dialogues with several California congressional delegations. Council approval of the Monterey travel request will allow Mayor Carmen Montano and Councilmember Hon Lien to gain additional knowledge from other California policymakers and to bring it back to share with their colleagues. Continued participation and attendance in conferences also ensures that the Milpitas community is fully represented at the regional, state, and national levels.
POLICY ALTERNATIVE(S):
Not Applicable
FISCAL IMPACT:
The estimated expense for the Washington, D.C. US Conference of Mayors 92nd Winter Meeting, including the registration fee, is $3,600; while the estimated expense for the Monterey, CA Annual Mayors and Council Members Academy, including the registration fee, is $1,700 per attendee. To date, Mayor Carmen Montano has an estimated balance of $7,055.67 in her Individual Elected Official allocation of $10,000 for Conferences/Meetings/Memberships. If the travel requests for Mayor Carmen Montano is approved, the estimated remaining balance for the rest of the fiscal year is $1,755.67.
To date, Councilmember Hon Lien has an estimated balance of $7,574.47 in her Individual Elected Official allocation of $10,000 for Conferences/Meetings/Memberships. If the travel request for Councilmember Hon Lien is approved, the estimated remaining balance for the rest of the fiscal year is $5,874.47.
California Environmental Quality Act (CEQA):
The action is an organizational or administrative activity of the City government that will not result in direct or indirect physical changes in the environment and is not a project pursuant to Cal. Code of Regs., tit. 14, § 15378.
RECOMMENDATION:
1) Authorize and approve the out-of-state travel to Washington, D.C., for Mayor Carmen Montano to attend the United States Conference of Mayors 92nd Winter Meeting to be held on January 17 – 19, 2024, for an estimated total not-to-exceed amount of $3,600 budgeted under the Individual Elected Official allocation for Conferences/Meetings/Trainings. 2) Authorize and approve the travel to Monterey, CA, for Mayor Carmen Montano and Councilmember Hon Lien to attend the League of California Cities Mayors and Council Members Academy to be held on January 24 – 26, 2024, for a combined estimated total not-to-exceed amount of $3,400 budgeted under the Individual Elected Official allocation for Conferences/Meetings/Trainings.
