CITY COUNCIL CHAMBER, 455 E. CALAVERAS BLVD, MILPITAS, CA The City Council of the City of Milpitas convened on the Special City Council meeting day in a Special Meeting of the Militas City Council on January 9, 2024, in the City Council Chamber, 455 E. Calaveras Blvd, Milpitas, CA, and via teleconference/Zoom webinar.
CALL MEETING TO ORDER by Mayor and ROLL CALL by City Clerk Mayor Montano called the Special City Council meeting to order at 11:03 AM. Roll Call was taken by City Clerk Guzzetta.
PRESENT: Mayor Montano, Councilmember Lien, Councilmember Phan ABSENT: Vice Mayor Chua, Councilmember Barbadillo
PLEDGE OF ALLEGIANCE
Mayor Montano led the pledge of allegiance.

Councilmember Lien provided the invocation.

There were the following public speakers:

ANNOUNCEMENT OF CONFLICT OF INTEREST AND CAMPAIGN CONTRIBUTIONS Assistant City Attorney Creech asked the Mayor and City Councilmembers if they had any personal conflicts of interest. By roll call, there were no conflicts of interest (Absent: Councilmember Barbadillo, Vice Mayor Chua) Assistant City Attorney Creech asked the Mayor and City Councilmembers if they had any reportable campaig contributions. By roll call, there were no reportable campaign contributions (Absent: Councilmember Barbadillo, Vice Mayor Chua).
READING OF THE CITY COUNCIL CODE OF CONDUCT
Mayor Montano read aloud the City Council Code of Conduct.
APPROVAL OF AGENDA
Councilmember Phan requested to pull item C2 from the Consent Calendar.
After discussion, motion: to approve the agenda, pulling Item C2 from the Consent Calendar.

Received City Council Calendar of Meetings for January 2024.
3. Consider Continuing Council Direction on Public Comment at City Council, Planning Commission, and other Brown Act Body Meetings (Staff Contact: Matt Cano, Assistant City Manager, 408-586-3012)
Approved the continuation of the policy that public comments at City Council, Planning Commission, and other Brown Act Body meetings be delivered in person or in writing until further City Council direction is received, except as otherwise required by law.
4. Authorize and Approve Travel Requests for Mayor Montano to Washington, D.C., and for both Mayor Montano and Councilmember Lien to Monterey, CA (Staff Contact: Ned Thomas, City Manager, 408-586-3053)
(1) Authorized and approved the out-of-state travel to Washington, D.C., for Mayor Carmen Montano to attend the United States Conference of Mayors 92nd Winter Meeting to be held on January 17 - 19, 2024, for an estimated total not-to-exceed amount of $3,600 budgeted under the Individual Elected Official allocation for Conferences/Meetings/Trainings; and (2) Authorized and approved the travel to Monterey, CA, for Mayor Carmen Montano and Councilmember Hon Lien to attend the League of California Cities Mayors and Council Members Academy to be held on January 24 - 26, 2024, for a combined estimated total not-to-exceed amount of $3,400 budgeted under the Individual Elected Official allocation for Conferences/Meetings/Trainings.
ANNOUNCEMENTS AND FUTURE AGENDA ITEMS
City Manager Thomas wished everyone a Happy New Year and announced changes coming to the City Hall lobby.
ITEMS PULLED FROM CONSENT CALENDAR
Consider the Recommendation from Mayor Montano for Appointments to the Planning Commission (Contact: Mayor Montano, 408-586-3024)
City Manager Thomas presented introductory remarks.

Councilmember Phan opined on the standards for appointing commissioners and noted that Planning Commission appointments especially need to be generally agreed on by the City Council due to how close the commission works with the them. He requested voting separately on each recommended commissioner appointment.
Mayor Montano made a motion: to appoint Michael Caulkins to fill the Planning Commission seat formerly occupied by Lawrence Ciardella.
The Mayor noted that she would work with staff to make the remaining appointment to the Planning Commission.
Assistant City Attorney Creech restated the motion.
