February 2024 Update: Staff is assessing Bingo equipment and will be starting a new Bingo license application in Spring 2024. Staff is assessing alternate ways to provide trips to seniors until and potentially after the new van has been purchased.

November 2023 update:

Bingo: Senior Center Bingo participation had reduced drastically before the pandemic with an average of 20 people per session. Contributing factors could have been the normal loss of participants due to moving away, moving into care homes, and/or the opening of Milpitas Charity Bingo. Staff has heard from some seniors that the buy-in costs at Charity Bingo are too expensive.

Recreation program staff is currently investigating the option of renewing the City’s Bingo License and potentially bringing back the program opportunity utilizing volunteers. Staff will report back to the City Council once this analysis is completed.

Trips: The Senior Center has monthly meetup trips at local destinations. There is also the “Foodie Club” which is an open club of senior center members that meet once a month at a Milpitas restaurant. The large Senior Center Bus that was previously used to transport Seniors to these destinations is has been decommissioned as it met the end of it’s useful life. The City has funding for a new van. Once this new van is purchased, staff will resume a hybrid trip program that will both meet up with seniors who can drive and transport seniors who cannot to destinations. Given overall nationwide fleet procurement challenges, it is anticipated that the purchase of this van would take up to 9 months.

Ordinances and Policies, CC01 Affordable Housing Ordinance Mayor Carmen Montano Lead Department/Office Supporting Department(s)/Office(s) Housing City Manager’s Office

Description of Required Work Effort
At the December 5, 2023, City Council meeting, Mayor Montano requested that staff explore the possibility of amending the Affordable Housing Ordinance to increase the level of affordable housing required from 15% to 20%.

To amend the ordinance’s affordability requirement from 15% to 20%, the City Council would need to consider development community input. Community roundtables, stakeholder interviews, and/or other outreach events would be necessary to gauge feedback of such an increase. Additionally, a creation of a financial feasibility document would be recommended.

Policy Evaluation and Timing
Should the Council desire to proceed with this priority item, a staff analysis would be required. Staff would need approximately 6 months to develop an outreach plan, gather community and stakeholder feedback, make the appropriate recommendations, and finalize the language in the amended ordinance for city council consideration.

In order to facilitate the 6-month timeline noted above, staff would require a subject matter expert or consultant who can focus on this project.

1. If approved, staff anticipates beginning work in August 2024 with an expected completion date of February 2025, this would require an additional staff member and a consultant for a financial feasibility report at an estimated cost of $50,000 to $75,000 for a 6-month period.

Status Update as of November 2023
The Mayor and City Council adopted Affordable Housing Ordinance 297 on June 19, 2018. The ordinance requires any new development of more than 10 units to provide 15% of those units as affordable. Affordable unit is defined as an ownership or rental dwelling unit, including senior housing, that is rented or sold at an affordable housing cost to households with very low, low, or moderate incomes.

In January 2022, Council approved a minor amendment to Affordable Housing Ordinance 297 to encourage more on-site affordable housing production and to add clarity and consistency throughout the ordinance.

Staff has also proposed additional changes to the Affordable Housing Ordinance relating to fractional units, design and distribution of affordable units, clarification of accessory dwelling units, allowing mixed tenure compliance, removing credit transfer option, extending ownership unit affordability from 45 to 55 years, and broadening the criteria for preferences, among others. These proposed changes are for the most part consistent with the existing ordinance and are primarily intended to add clarity and consistency to the ordinance.

No further action has been taken to date.

Council Clarification/Further Direction Requested
If the Mayor and City Council provide staff direction to proceed, feedback in the following areas would be beneficial in order for staff to better define the next steps and work products:
1) Do the Mayor and City Council have any feedback on the level and methods of stakeholder feedback that staff should solicit?
2) Are the Mayor and City Council open to considering alternatives beyond just increasing the threshold to 20%? An example would be reducing the requirement to 10% if those 10% are all extremely lowincome units.

Other Considerations
Comparison to other jurisdictions
Staff performed preliminary research into the level of affordable housing being required in other jurisdictions in the Bay Area. Preliminary data is as follows:
• San Jose, Campbell, Santa Clara, Mountain View: 15%
• Morgan Hill (15% for 2 or more units)
• Sunnyvale (15% for ownership, no requirement for rental) • No ordinance: Cupertino, Gilroy, Los Gatos, Monte Sereno, Palo Alto, Saratoga • Los Altos: 5-9 units = 15%, 10 or more – 20% at low income or 15% at very low income • San Francisco: 21.5% of apartments, 23.5% of condos – looking at 12-16% Other alternatives
As discussed in the “further clarification” section above, there are other alternatives that may be available for considerations. Some of these alternatives are listed below:

City Council could consider any of the following or a combination:

1. Increase the level of affordable housing required to 20% if affordability is based on moderate income, 15% if low income, and 10% if very/extremely low income

2. Enhance affordability by capping moderate income at 100% of the Area Median Income Limit instead of 120% (e.g. for a family of 4 that would be a cap difference of $217,550 to $181,300)

3. Keep Affordable Housing Ordinance at 15% and include a percentage requirement of 15% for extremely low income and/or very low-income households.
