Hi Jay & Randy,
I am sending this email to express our strong opposition against the appeal/ application for Head/Smoke/Tobacco shop permit at 1225 Jacklin Road- P-UP23-0013.
This location is very close to Milpitas High, Russel Middle School, Burnett Elementary School and right adjacent to the dense residential areas. It could bring a lot of bad influences, problems and crimes to the young generations and the community. We want to avoid the terrible consequences altogether before hand.
The potential shop location is at a very heavy traffic convenient stores strip. A lot of the young kids/ students will pass by it every day. The bad influences of smoking/ tobacco, loud noises, congested traffic, crimes are definitely bad for the younger generations or pose serious safety concerns. These potential problems should be prevented before they occur.
We live in a very peaceful and quiet community. We don't want any of the potential noises, troubles and crimes from the the smoke shop to come to us. They could seriously affect or ruin the quality of the peaceful lives of our community.
Some advanced countries are trying to ban smoking outright. We should not go backwards and should reduce the number of the smoke shops, not to grant a new one.
We are strongly against the approval of a new smoke shop at the proposed location. Thanks very much for posting our comments and read them at the hearing.
Your kind help is very much appreciated.
Best regards,
James Luo & Family

Hi,
I am a homeowner, and the Head/Smoke/Tobacco shop is in our vicinity. I’m writing to provide my comments whether to permit the aforementioned smoke shop on 1225 Jacklin Road.
Below is a list of issues for opening the shop in proximity to a residential area.
1. It will encourage people to buy cannabis, vaping, and tobacco products directly and readily available in one location. The shop is located in a residential and school district.
2. The shop is very close to residential areas where residents can smell the smoke or vapor coming from cannabis, vaping, and tobacco products. It is very hard to control people consuming the aforementioned products in public areas because police forces are not always stationed everywhere.
3. There are a lot of school age children walking to school in the area and they can buy the products easily.
4. School age children can be addicted to cannabis/vaping/tobacco products, and it will be hard for them to stay clear of it. It is known that there are school age children vaping in elementary, middle and high school.
5. The effects of smoking have obvious negative effects on children whose brains are still developing, and the long-term effects cannot be ignored.
6. The shop is only 1 mile from Milpitas High School, Thomas Russell Middle School and Pomeroy Elementary School, and 0.8 mile from William Burnett Elementary School, making it easily reachable for school children.
7. According to recent studies, smoke shop robberies are on the rise, and it may increase the crime rate in surrounding areas, making it difficult for school children and others to walk past the area.
Please consider the facts listed above before issuing permit for the shop. Instead of giving permission to open the Head/Smoke/Tobacco Shop in a residential and school area, they can do the sales of such products online.
Thanks,
Neighborhood homeowner.

Dear Randy Baez,
I am writing to oppose the application for a Conditional Use Permit (CUP) allowing tobacco sales at 1225 Jacklin Road. The potential health impact and environmental concerns associated with this proposal need thorough consideration. Please prioritize community well-being and assess public input before making a decision.
Thank you for your attention to this matter.
