Ordinance and Policies CC01 Review bingo ordinance with Council Gary Barbadillo Lead Department/Office Supporting Department(s)/Office(s) City Attorney’s Office Recreation and Community Services Council Priority Areas Estimated Completion Date Estimated Cost $12,000 (staff time)
Funding Needed
Governance and
Administration
Spring 2026
$0
Description of Required Work Effort
The California Constitution categorizes bingo generally as a prohibited lottery but allows the State Legislature by statute to authorize cities to provide bingo games, but only for charitable purposes. The Legislature through the Penal Code has set forth a stringent and comprehensive set of regulations specifying when and on what terms a city may allow charitable bingo within its jurisdiction.

Chapter 7 of Title III of the Milpitas Municipal Code mirrors the Penal Code and establishes the requirements for the conduct of bingo games within the City of Milpitas. The Municipal Code chapter outlines several requirements for conducting of bingo, including, but not limited to, the following: (1) Staffing and operations; (2) Limitations on profits; (3) Locations; (4) Record keeping; (5) Prizes; (6) Hours, (7) licensing and more.

In order to review the bingo ordinance, staff would take approximately 80 hours in total, spread over several weeks, to do the following: (1) interview current licensees to receive feedback on the current ordinance; (2) research and compare Milpitas’ ordinance to 3 to 5 additional cities; (3) research on best practices; (4) discuss internally with departments involved such as the City Clerk’s Office, Police Department and Finance Department.

Following this review, staff would bring a discussion item to the City Council regarding any changes that could be recommended.

This item will not require additional staffing, but the schedule would be delayed until at least Spring 2026 completion due to current staff workload and other priority research efforts.

Status Update
This item has not been prioritized. This item was requested on April 1, 2025.

Council Clarification/Further Direction Requested
Are there specific items regarding the current ordinance that the Council would like staff to focus on?

Page 114 of 138 ends

City Council Referral
(requires more than 4 hours of staff time)
Other Considerations
There may be limited avenues of change as much of the current ordinance is fixed and mandated by state law. State law also caps the fees the City can charge for bingo licenses at $50 annually, plus the cost of law enforcement and public safety costs directly related to bingo activities. Those fees are paid out of the proceeds from bingo games, which already must go solely to the payment of prizes, operating expenses, and charitable purposes.

Ordinance and Policies CC02 Consider support of a policy/program regarding fentanyl
Gary Barbadillo
Lead Department /Office Supporting Department(s)/Office(s) Fire Department City Attorney’s Office
Council Priority Area Estimated Completion Date Estimated Cost TBD
Funding Needed
Neighborhoods & Housing TBD
N/A
Description of Required Work Effort
The 2024 Milpitas FD Opiod Report indicates that in comparison to Local, State and National Opioid overdose statistics, the City of Milpitas is currently experiencing less than average opioid overdose incidents. In 2024, emergency calls for opioid related incidents represented 1.2% of total EMS calls. Age- adjusted opioid deaths in Milpitas per 100,000 are currently trending at 8.79 deaths per year. In comparison, the age-adjusted death rate in San Francisco is 54.79 per 100,000 residents. The less than average opioid related overdose deaths currently observed in Milpitas can be attributed to the proactive steps the fire and police departments have implemented to include, carrying and deploying naloxone on all front-line fire apparatus and police patrol cars, along with increased public education consistent with industry best-practice.

The final additional workload for this effort would depend upon the direction provided by the City Council. However, an estimated 20 hours of staff time is estimated to provide an additional report that analyzes various options that could be considered to increase awareness and/or enforcement.

Status Update as of January 2025
On March 13, 2025, Chief Schoonover shared the 2024 Milpitas FD Opioid Overdose Report with City Council via email. This item has not been prioritized. This item was requested on February 18, 2025.

Council Clarification/Further Direction Requested
The Milpitas fire and police departments collectively meet or exceed industry standards relative to providing for the rapid deployment of Naloxone by trained professionals to the community of Milpitas.

This is accomplished through the standard practice of ensuring every fire apparatus and police patrol car in the City carries a supply of Naloxone. Additionally, the fire department has integrated fentanyl awareness into its overall public education and life-safety presentations that are delivered throughout the year. Lastly, the fire department website is frequently updated to provide opioid awareness education and instructions regarding how to obtain Naloxone from local health institutions and pharmacies.

Page 116 of 138 ends

City Council Referral
(requires more than 4 hours of staff time)
If this item is prioritized, staff would like further direction on the additional programming and/or policy work that the City Council envisions. Examples could include additional community outreach, coordination with the school district and/or other policy level work.

Other Considerations
From an emergency response and public education perspective, the Milpitas Fire Department is meeting or exceeding industry standards relative to minimizing the impacts of opioid overdoses in the community of Milpitas. Additionally, the current data indicates that these actions are having a positive impact on the community resulting in a substantially lower percentage of opioid deaths in comparison to the local, state and national trends.
