Planning Director Lee presented the report.

There were the following public speakers:

1. Anil Babbar

2. Voltaire Montemayor
Councilmembers elaborated on various concerns regarding the Metropolitan Transportation Commission's (MTC) Transit-Oriented Communities (TOC) policy. Vice Mayor Barbadillo raised specific issues, inquiring about a project in San Jose that reportedly received significant funding under TOC guidelines. He questioned whether accepting smaller grants might inadvertently bind Militas to unexpected future commitments or obligations that could arise from the TOC policy. Councilmember Chua expressed concern about committing to a resolution amid ambiguity surrounding the policy and the fear of relinquishing local control over land use decisions. Councilmember Lam voiced his uncertainty regarding why individual cities were tasked with undertaking the study instead of TC commissioning their own consultant to execute it, suggesting that the indirect process might complicate rather than simplify grant facilitation.

Planning Director Lee responded to these concerns by detailing recent communications with MTC. He reiterated that the resolution under consideration only affirms the city's intent to complete the specific scope of work outlined in the grant, such as studying increased commercial density in the BART station June 17, 2025 Milpitas City Council Minutes Page 9
area and developing transportation demand management strategies. He assured the council that accepting the grant would not equate to a commitment to the entire suite of TOC policies. Planning Director Lee emphasized that MTC had provided written confirmation that the grant funding is not contingent on the adoption of any specific deliverables developed through the grant's work, allowing Milpitas to retain full local control over land use decisions.

Council Member Chua made a motion: to deny adoption of the resolution accepting the MTC grant.

Councilmember Lien seconded the motion.

Upon a call for the question, the motion failed by the following vote:

AYES: Councilmember Chua, Mayor Montano.
