Amendment #1 with Stanislaus Regional Transit Authority for Facility and Fleet Maintenance
DISCUSSION:
During the transition of operations to the Stanislaus Regional Transit Authority, certain updates to the facility and fleet maintenance agreements were discovered. These are necessary to maintain continued operations of the organization and its services.
These amendments propose the following changes:
Facility Maintenance
1. Grant the City Manager and Executive Director authority to approve minor amendments to the agreement without further approval from the governing board of the City or the Stanislaus Regional Transit Authority.
2. Decrease the hourly labor rate charged to Stanislaus Regional Transit Authority due to over budgeted utilities in FY2021/2022, and increase monthly insurance costs for the Transit Center and Amtrak Station due to an increase to the City’s insurance premium.
3. Discontinue pressure washing services due to Stanislaus Regional Transit Authority procuring a vendor contract for these services, and implement reductions to the monthly rates associated with these services.
Fleet Maintenance
1. Grant the City Manager and Executive Director authority to approve minor amendments to the agreement without further approval from the governing board of the City or the Stanislaus Regional Transit Authority.
2. Increase the hourly and fixed labor rates charged to Stanislaus Regional Transit Authority to capture increases in labor costs and discretionary expenses.
3. Allow the City of Modesto to recoup costs for expenses not fully captured by the hourly maintenance rate and fixed management and staff support rate, or issue payment to Stanislaus Regional Transit Authority if payments received exceed true costs at fiscal year-end.
FISCAL IMPACT:
There is no impact to the General Fund with these amendments. An analysis of the fiscal impact to each amendment is found below:
Facility Maintenance:
The revenue received from the Stanislaus Regional Transit Authority for facility maintenance services will fully compensate the City for the services, including management and overhead expenses. There will not be additional funds needed from the General fund Fleet Maintenance
The revenue received from the Stanislaus Regional Transit Authority for bus maintenance services will fully compensate the City for the services, including management and overhead expenses. There will not be additional funds needed from the General Fund.
COMMITTEE RECOMMENDATION:
This item was presented to the Finance Committee at their September 26, 2022 meeting, where it was recommended to forward to Council for approval.

CITY OF MODESTO
COUNCIL AGENDA REPORT
DATE OF MEETING:
October 4, 2022
Date: September 14, 2022
TO: Mayor and City Council
THROUGH: Joseph P. Lopez, City Manager
FROM: Laurie A. Smith, Director of Parks, Recreation & Neighborhoods SUBJECT: Third Amendment to Agreement with Grover Landscape Services, Inc.
CONTACT: Kelly Gallagher, Park Operations Manager, [email protected], (209) 342-2270
DESCRIPTION:
Consider approving the Third Amendment to the Agreement with Grover Landscape Services, Inc., Modesto, CA, for Landscape Services to extend the term period for up to an additional six months and increasing the amount of the Agreement by an amount not to exceed $1,331,868 for the extension period. (Funding Source: General Fund – Parks Operations, Community Facilities District Funds, Joint Powers Authority Tuolumne River Regional Park Fund, Various City and Enterprise Funds)
STRATEGIC PLAN ELEMENT:
This item supports the City of Modesto 2020-2025 Strategic Plan focus on Quality of Life, Goal D: provide safe, efficient, and reliable infrastructure through proactive community investment, maintenance and sustainability efforts.
BACKGROUND:
In Fiscal Year 2015-16, the City Manager authorized the Purchasing Manager to issue formal Requests for Proposal (RFP) for Landscape Maintenance Services of City parks, landscape median walls, City buildings and Community Facilities Districts (CFDs).
On October 25, 2016, by Resolution 2016-436, Council authorized Service Agreement No. 108650 with Grover Landscape Services, Inc. to provide landscape services to parks, right-ofway areas and medians, Community Facilities Districts, and Enterprise fund sites.
On February 5, 2019, by Resolution 2019-46, Council approved the First Amendment increasing the agreement amount with Grover Landscape Services by $1.2M to a new total of $9.58M for additional service sites, unanticipated and emergency repairs, and extra work. #11..

City Council, October 4, 2022
Third Amendment to Agreement with Grover Landscaping Services, Inc.
On May 4, 2021, by Resolution 2021-172, Council approved the Second Amendment increasing the agreement amount with Grover Landscape Services, Inc., Modesto, CA, for landscape services by $3,457,775 from $9,584,472, to a new total amount of $13,042,247, and extending the term of the agreement for one year from October 24, 2021, to October 24, 2022.
DISCUSSION:
The City is in its one-year extension of the current agreement with Grover Landscape Services.
This extension was to provide enough time to develop and issue a Request for Proposals for Landscape Maintenance Services for the City and execute a new agreement. During this period, the consumer price index has drastically increased to 8.5% over the last 12 months.
Staff discussed their concerns regarding the dramatic increase of the costs of goods and services and the potential impact on a new agreement. For example, a recent City of Modesto Request for Bids for Discing and Mowing Services resulted in an agreement totaling $756,675 for five years. In comparison, the 2015 agreement for these services totaled $210,000 for five years: a 260% increase. Staff also researched contracts for nearby municipalities and found that the City of Riverbank also recently bid its landscaping services, and their lowest bid was 48% higher than their 2016 Agreement. While it is likely that an RFP will result in significantly higher costs, staff requests a 6-month extension to finish researching the impact of inflation on related RFP’s issued by the City and other surrounding jurisdictions. Therefore, staff is requesting a 6-month extension through April 24, 2023.
In negotiations with the vendor, a 19% increase for this extension of the agreement was agreed upon; this was well below the 26% increase that the Western Urban Consumer Price Index (Western CPI) experienced since 2016 when the agreement began.
Pursuant to Municipal Code section 8-3.204(d), the City is not required to use the normal bidding procedures when the Purchasing Manager determines that a different process will result in a procurement for the City at the lowest possible cost commensurate with the desired quality. The proposed temporary extension will allow the City to maintain service levels, with a modest price increase, while staff researches the impact of inflation on a possible RFP for a long-term agreement to ensure that the City is able to obtain the best price possible.
FISCAL IMPACT:
Staff recommends an increase of $1,336,868 to the Agreement with Grover Landscape Services for this six-month extension while staff continue to research the fiscal impacts with issuing a new RFP. The table below breaks down the cost by department. If approved, each department will absorb their corresponding increases in their budget. #11..

CITY OF MODESTO
COUNCIL AGENDA REPORT
DATE OF MEETING:
October 4, 2022
Date: September 12, 2022
TO: Mayor and City Council
THROUGH: Joseph P. Lopez, City Manager
FROM: Bill Sandhu, Public Works Director
SUBJECT: Authorize staff to apply for the California Department of Resources, Recycling and Recovery Beverage Container Recycling Competitive Grant CONTACT: Rosene Salmo, Integrated Waste Program Manager, [email protected], 209-577-5453
DESCRIPTION:
Consider authorizing staff to apply for all California Department of Resources, Recycling and Recovery Beverage Container Recycling Grants available and authorizing the City Manager, or his designee, to sign grant applications and related forms, accept grant awards, and amend the budget as needed. (Funding Source: Not Applicable)
STRATEGIC PLAN ELEMENT:
The recommended action supports the City of Modesto’s 2020-2025 Strategic Plan Initiative:
Governance and Service Delivery, “Build community trust in City government through responsive, transparent and efficient service delivery”; Goal I: “Promote trust and engagement between the community and the City”.
BACKGROUND:
The California Department of Resources, Recycling and Recovery (CalRecycle) Beverage Container Recycling Grant is a competitive grant that offers a minimum of $75,000, up to a maximum of $275,000, to successful applicants1. There is no match requirement for this grant.
Additionally, according to the CalRecycle Beverage Container Recycling Program grant submission guidelines and instructions, the governing body must submit a resolution for periods of up to five years.
The goal of CalRecycle’s beverage container recycling grant is to reach and maintain an 80 percent recycling rate for all California Redemption Value beverage containers composed of aluminum, glass, plastic, and bi-metal. This grant program assists organizations with establishing convenient beverage container recycling and litter abatement projects, which encourage market development and expansion activities for beverage container materials. #12..

Council Meeting, October 4, 2022
Authorize staff to apply for the California Department of Resources, Recycling and Recovery Beverage Container Recycling Competitive Grant
The City of Modesto’s Solid Waste Division uses grant funds to implement many of the waste reduction and recycling programs offered to City residents and businesses. Over the last 10 years, the City has received more than $1.9 million in grant funds for programs to recycle used oil and filters, beverage containers and waste tires, enforce waste tire disposal, as well as install playground surfacing, and equipment, and provide assistance to local businesses with recycling efforts.
DISCUSSION:
If approved, the City of Modesto would apply for the beverage container recycling grant offered by CalRecycle, depending on available funding. The grant would be a great opportunity to increase the City’s current infrastructure in support of the City/County payment program received annually.
The following major goals would be included in the grant application:
Purchase and install water refill stations throughout City buildings, Modesto schools, and the Modesto Children’s Museum.
On January 1, 2023 the City will be adding a third container to its current solid waste system. The container will be dedicated to recycling materials only. With this grant funding, the City plans on purchasing indoor bottle recycling containers to distribute to City buildings, schools, parks, stadiums, and museums.
The City plans on partnering with Modesto Children Museum on developing an interactive recycling exhibit and recycling workshops. The exhibit will be available to the public for 18 months and it will educate visitors on the importance of recycling, reusing, and reducing. Workshops will be held at the museum and at different schools in Modesto.
Create education and outreach materials with the sole focus on recycling, reusing, and reducing.
The following budget outlines what the City expects to request in grant funding:
FISCAL IMPACT:
Submitting an application does not commit the City to a financial obligation or to accepting the grant if awarded. There is no match requirement for this grant, thus this item is administrative in nature and has no fiscal impact.
COMMITTEE RECOMMENDATION:
This item was reviewed by the Finance Committee on September 26, 2022, and the Committee recommended forwarding to Council for approval.
Strategy 1 Water Refill Stations $ 85,000
Strategy 2 Bottle Recycling Containers $ 20,000
Strategy 3 Modesto Children’s Museum Exhibit and Workshops $ 120,000 Strategy 4 Education and Outreach materials $ 50,000
Total $ 275,000
