DISCUSSION:
In December 2022, staff received emergency approval from the City Manager to proceed with plans to demolish the clubhouse as the building posed a risk to public safety due to the condition of the building and the frequent vandalism and break-ins.
Staff obtained two quotes for the demolition of the building. W.C. Maloney’s quote was the lowest at $65,107 and staff determined it appropriate to move forward with W.C. Maloney. The demolition began January 30, 2023, and was completed on February 13, 2023.
To ensure that there is sufficient authority to cover all necessary emergency expenses, staff is requesting an additional $9,766 (15%) of currently anticipated expenditures. The total estimated cost of all emergency work, including the additional 15%, is $74,873. Only necessary emergency work will be completed at this time, and if that work exceeds the estimated budget, staff will return to Council for approval. Should the work be less than the estimated budget only actual emergency expenses will be paid.
Modesto Municipal Code Section 8-3.203 generally requires all purchases, which meet or exceed $50,000 for material, equipment or contractual services to be formally bid. However, exceptions to the formal bidding process are granted in MMC 8-3.204(c) “Where the Purchasing Manager, in his or her discretion, determines that calling for bids on a competitive basis as set forth in Section 8-3.203 is undesirable due to exigent circumstances.” This project meets these requirements, as staff received emergency authorization from the City Manager’s Office to demolish the Dryden Clubhouse due to the public safety risk.
FISCAL IMPACT:
Funding for this project is budgeted in the CIP project 101294 – Dryden Clubhouse Renovation Project located in the Golf Fund (4600). The majority of the funding in this project is revenue from the insurance company. No additional funding beyond what is currently budgeted is being requested at this time.
Anticipated Expenses for the Emergency Work in Project 101294:
W.C. Maloney (estimated) $ 65,107
15% estimated additional costs $ 9,766
Total Anticipated Expenses $ 74,873
COMMITTEE RECOMMENDATION:
This item was reviewed by the Safety and Communities Committee on February 13, 2023, and the Committee recommended the item be forwarded to Council for approval.
CEQA/NEPA REQUIREMENTS:
A Notice of Exemption No. EA/PR&N 2022-03 was prepared for the project which is exempt from CEQA because Section 15302 of the CEQA Guidelines allows for replacement or reconstruction of existing structures and facilities where the new structure or facility will be located on the same site and will have substantially the same purpose and capacity. #11..

Notwithstanding the foregoing, nothing herein shall be construed to require any Party to indemnify any other Party from any claim arising from the sole negligence or willful misconduct of another Party.
Nothing in this section shall be construed as authorizing an award of attorney fees in any action on or to enforce the terms of this Agreement. This indemnity shall apply to all claims and liability regardless of whether any #12..

insurance policies are applicable. Any policy limits shall not act as a limitation upon the amount of indemnification to be provided.
b. At its sole discretion, the indemnified Party may participate at its own expense in the defense of any claim, action or proceeding, but such participation shall not relieve the indemnitor of any obligation imposed by this Agreement. The Parties shall notify each other promptly of any claim, action or proceeding and cooperate fully in the defense. The Parties agree to defend themselves from any claim, action or proceeding arising out of the concurrent acts or omissions of each Party. In such cases, the Parties agree to retain their own legal counsel, bear their own defense costs, and waive their right to seek reimbursement of such costs. Where a trial verdict or arbitration award allocates or determines the comparative fault of the Parties, the Parties may seek reimbursement and/or reallocation of defense costs, settlement payments, judgments and awards, consistent with such comparative fault. The provisions of this section shall survive the termination of this Agreement.
20. Amendments. DATE OF MEETING:
March 7, 2023
Date: February 1, 2023
TO: Mayor and City Council
THROUGH: Joseph P. Lopez, City Manager
FROM: DeAnna Christensen, Director of Finance
SUBJECT: Public Hearing and Approval of California Municipal Finance Authority Revenue Bonds for the benefit of Marple Manor Project
CONTACT: DeAnna Christensen, Director of Finance, [email protected], 209-577-5387
DESCRIPTION:
Hearing to consider approving the issuance of Bonds by the California Municipal Finance Authority (CMFA) for the benefit of Marple Manor RHF Partners, L.P., a California limited partnership (the “Borrower”), and an organization described in Section 501(c)(3) of the Internal Revenue Code of 1986, to provide for the financing of the Project, for the purposes of satisfying the requirements of the Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA), the Internal Revenue Code and California Government Code Section 6500, et seq. (Funding Source: Not Applicable)
STRATEGIC PLAN ELEMENT:
This item advances the City of Modesto 2020-2025 Strategic Plan Area: Governance and Service Delivery: “build community trust in City government through responsive, transparent and efficient service delivery”; Goal J: “build a high-performance organization”.
BACKGROUND:
CALIFORNIA MUNICIPAL FINANCE AUTHORITY (CMFA):
The CMFA was created on January 1, 2004 pursuant to a joint exercise of powers agreement to promote economic, cultural and community development, through the financing of economic development and charitable activities throughout California. The CMFA was formed to assist local governments, non-profit organizations and businesses with the issuance of taxable and tax-exempt bonds aimed at improving the standard of living in California. The CMFA’s representatives and its Board of Directors have considerable experience in bond financings. To date, over 300 municipalities, including the City of Modesto, have become members of CMFA.
The Tax and Equity Fiscal Responsibility Act (“TEFRA”) requires a public hearing for the proposed issuance of revenue bonds by the California Municipal Finance Authority (the “CMFA”), in an amount not to exceed $30,000,000, (the “Bonds”), for the purpose of financing #14..

City Council, March 7, 2023
Public Hearing and Approval of California Municipal Finance Authority Revenue Bonds for the benefit of Marple Manor Project
the acquisition, rehabilitation, improvement and equipping of a multifamily rental housing development known as Marple Manor located at 530 Coffee Road, Modesto, California.
DISCUSSION:
Marple Manor RHF Partners, L.P., requested that the CMFA serve as the municipal issuer of the Bonds in an aggregate principal amount not to exceed $30,000,000, which will be used for multifamily rental housing development known as Marple Manor Project in Modesto which will help to meet the needs of persons and families of low or moderate income. The total number of units at Marple Manor is anticipated to be 146 (including one manager unit) for this specific project.
In order for all or a portion of the Bonds to qualify as tax-exempt, the City must conduct a public hearing (the “TEFRA Hearing”) providing members of the community an opportunity to speak in favor or against the use of tax-exempt bonds for the financing of the Project. Prior to such TEFRA Hearing, reasonable notice must be provided to the members of the community.
Following the close of the TEFRA Hearing, an “applicable elected representative” of the governmental unit hosting the Project must provide its approval of the issuance of the Bonds for the financing of the Project.
FISCAL IMPACT:
The Bonds to be issued by the CMFA for the Project will be the sole responsibility of the Borrower, and the City will have no financial, legal, moral obligation, liability or responsibility for the Project or the repayment of the Bonds for the financing of the Project. All financing documents with respect to the issuance of the Bonds will contain clear disclaimers that the Bonds are not obligations of the City or the State of California but are to be paid for solely from funds provided by the Borrower.
The Board of Directors of the California Foundation for Stronger Communities, a California nonprofit public benefit corporation (the “Foundation”), acts as the Board of Directors for the CMFA.
As the conduit for issuance activities, the CMFA shares a portion of the issuance fees it receives with its member communities and donates a portion of these issuance fees to the Foundation for the support of local charities. With respect to the City, it is expected that that a portion of the issuance fee will be granted by the CMFA to the general fund of the City in the estimated amount of $3,250.
COMMITTEE RECOMMENDATION:
This item was not presented to a Committee.
RECOMMENDED COUNCIL ACTION:
Staff Recommendations:
Resolution of the City Council of the City of Modesto pursuant to Section 147(F) of the Internal Revenue Code of 1986 approving the issuance of Multifamily Housing Revenue Bonds by the California Municipal Finance Authority to finance or refinance the acquisition, rehabilitation, improvement and equipping of the Marple Manor Project and certain other matters relating thereto.

CITY OF MODESTO
COUNCIL AGENDA REPORT
DATE OF MEETING:
March 7, 2023
Date: February 15, 2023
TO: Mayor and City Council
THROUGH: Joseph P. Lopez, City Manager
FROM: Christina Alger, Director of Human Resources
SUBJECT: City Employee Hazard Pay
CONTACT: Christina Alger, Director of Human Resources
[email protected], 209-571-5126
DESCRIPTION:
Consider approving the use of American Rescue Plan Act (ARPA) funds to provide funding for Hazard Pay to employees in the total amount of $6,705,000 and to amend the Fiscal Year 2022- 23 Non-Capital Operating Budget to create a Non-Capital Project Budget in the American Rescue Grants Fund (Fund 1390). (Funding Source: ARPA funds) STRATEGIC PLAN ELEMENT:
This item supports the 2020-2025 Strategic Plan’s Service and Delivery Goals & Strategies - Building a High-Performing Organization by Attracting and Retaining High-Performance Employees.
BACKGROUND:
The American Rescue Plan Act is a $1.9 Trillion Emergency Relief Measure providing relief to address the impacts of COVID-19 on the American public including first responders, frontline health workers, teachers, local governments, and other providers of vital services. This plan included $130 billion to local government, divided between cities and counties, via a Community Development Block Grant (CDBG) funding formula. These funds were to be used within each community to assist with the recovery efforts of local businesses and individuals adversely affected by the pandemic.
On February 8, 2022, the City presented a relief spending plan that encompassed immediate relief of added expenditures regarding public health and safety and to support the community with essential programs needed to recover from the pandemic impacts. There were also shortterm and long-term plans to ensure the best sustainable use of the funds.
One allowable use for ARPA funds is to compensate employees who were required to continue providing essential services to the public. Many agencies have provided a stipend to their #16..

City Employee Hazard Pay
employees to recognize their hard work and sacrifice to ensure essential services are provided to the community while risking exposure to COVID-19.
DISCUSSION:
The City of Modesto continued to fully provide all essential services to the community throughout the pandemic. This required employees to interact with the public, exposing them to the possibility of contracting COVID-19 during a time of uncertainty regarding the full impact on a person’s health. They remained committed to their duty to serve the public in all aspects including public safety, water, infrastructure, and implementing programs allowed under ARPA.
The City of Modesto had allocated a majority of the ARPA funds to better the community and assist with the recovery of local businesses and individuals, however, approximately 18% of the funds were allotted for Reserve Funding in the amount of $8.2 million. While some of these remaining funds will be allocated to additional community programs, staff recommends utilizing a portion of the funds to recognize our dedicated employees.
Staff worked with our Union Association partners to determine an amount to be paid in the form of a stipend that fairly recognizes and rewards employees for their hard work and dedication.
The following structure is proposed for the consideration of the Council:
Employees that were employed on April 1st, 2020, and worked through March 31st, 2021, will receive a lump sum stipend of $3,000
Employees that were employed on April 1st, 2021, and worked through March 31st, 2022, will receive a lump sum stipend of $3,000
Employees that were employed on April 1st, 2022, and worked through September 30, 2022, will receive a lump sum stipend of $1,500
All employees, both represented and unrepresented, who meet the requirements in the agreement will be eligible for the stipends. These stipends are combinable, meaning that if an employee meets the requirements for each level, they receive each level. The Tentative Agreement with the full language of requirements is attached to this agenda report.
FISCAL IMPACT:
This item will be funded by American Rescue Plan Act (ARPA) funds. This amount is detailed in the below table by calculating the number of employees eligible for each payment.
Employed as of date 4/1/2020 - 3/31/2021 4/1/2021 - 3/31/2022 4/1/2022 - 9/30/2022 Total Cost Amount of proposed payment $3,000 $3,000 $1,500
