CITY OF MODESTO

COMMITTEE AGENDA REPORT
DATE OF MEETING:

May 24, 2023
Date: May 12, 2023
TO: Appointments Committee
Rosa Escutia-Braaton, Chair
Chris Ricci, Vice Chair
Jeremiah Williams, Member

THROUGH: Joseph P. Lopez, City Manager
FROM: Stephan Christensen, Budget Manager
SUBJECT: Measure H Oversight Board Member Appointments
CONTACT: Stephan Christensen, Budget Manager, [email protected], 209-577-5390
DESCRIPTION:

Consider recommending appointments to fill nine City of Modesto Public Member vacancies for the Measure H Oversight Board and forwarding to Council for approval. (Funding Source: Not Applicable)
STRATEGIC PLAN ELEMENT:

This item advances the City of Modesto 2020-2025 Strategic Plan Area: Governance and Service Delivery: “build community trust in City government through responsive, transparent and efficient service delivery”; Goal J: “build a high-performance organization”.

BACKGROUND:

On November 8, 2022, the Modesto voters approved Measure H, a one-cent sales tax for general City services, and on November 29, 2022, by Resolution No. 2022-453 the Modesto City Council certified the election results. Measure H is expected to provide the City with approximately $41 million annually in additional sales tax revenue into its General Fund.

One important part of Measure H, which is codified in Modesto Municipal Code section 8-2.1215, was the requirement that Council appoint a nine-member Oversight Board by June 30, 2023. This Measure H Oversight Board will have the following responsibilities:
1) Meet at least semi-annually to review all revenues and expenditures of funds from the authorized Measure H sales tax.
2) Review annual audit reports related to the Measure H sales tax. #1..

Appointments Committee, May 24, 2023

3) Provide at least one written annual report to the City Council at a public meeting summarizing the Measure H Oversight Board findings.

DISCUSSION:

The Measure H ordinance defined the makeup of the Measure H Oversight Board. The Oversight Board will consist of a representative from each Council district and three “at-large” Modesto residents. Strong preference will be given to members that represent a cross-section of the community, possibly including, but not limited to, representatives of the following types of organizations:
1) Schools
2) Local Trade Associations
3) Chambers of Commerce
4) Nonprofit Organizations
5) Senior Citizen Groups
6) Non-partisan Political Organizations
7) Tax-payer Association
8) Neighborhood Organizations
To be considered as a potential member of the Measure H Oversight Board, applicants must meet the below criteria to qualify:
1) Must be a registered voter and resident of City of Modesto 2) Must complete the online application for Boards, Commissions & Committees for the Measure H Oversight Board
City staff coordinated with the Communication team to outreach the solicitation of applications for the Measure H Oversight Board positions. The outreach efforts included the following:
 Posted on social media on the City’s Facebook and Instagram accounts on 1/19/23, 1/28/23, and 3/19/23
 Posted on LinkedIn on 1/19/23 and 3/19/23
The ordinance requires the Measure H Oversight Board be made up of nine members, six of whom are representatives of the Council districts. As part of this process, each Councilmember from the six districts across the City of Modesto has made a recommendation based upon applications received in their respective districts, to the Appointments Committee. Those recommendations are listed below:
 District 1 – Alexandra von Stade
 District 2 – Galen Carroll
 District 3 – Kirstie Boyett
 District 4 – Chris Guptill
 District 5 – Mike Kelly
 District 6 – Jesse Franco
The remaining three “at-large” recommendations for members of the Measure H Oversight Board will be made by the members of the Appointments Committee. Their selections will be made from #1..

What is it about this
position that interests you?
I've supported Measure H from the beginning. I'm typically not for increased taxes but as a transplant to Modesto and a an enthusiastic mother of two teenagers, I want to make sure that they are proud of Modesto and what we can offer. I want them to go away to college and consider moving back to Modesto. A lot of kids don't come back because of the crime,
homelessness, and overall infrastructure. I live on Smith Ave. in the college area, beautiful neighborhood, great schools, high home prices yet is listed as one of the un-safest places to live.

What can we do to fix that?
I'm very engaged in our community, I have two kids in
Highschool and I'm always looking to make Modesto a better #1..

For the last 10 years I have coordinated cleanup efforts and volunteered in the Tuolumne River Regional Parka and Dry Creek Regional Park systems via Operation 9-2-99. I am
currently the chair of the Tuolumne River Regional Park Citizens Advisory Committee and I serve as a member of the blight committee. In the past I served on the Code Enforcement Hearing Board. I am an advisor to the Tuolumne River Trust.

Prior to Covid I helped coordinate a park event called Modesto RecFest and for the past two years I have helped to coordinate bringing NICA Norcal mountain bike race events to TRRP.

What is it about this
position that interests you?
I am interested in seeing the tax revenue make it way into our park system as well as police and fire resources to help improve life in Modesto. In working closely with all three of these agencies I know how a lack of resources keeps our city from realizing the potential we have to be a better city for residents in the future. People in Modesto deserve to have safety and protection but also excellent amenities that make our quality of life rise here. I want to help steer us in that direction with this committee. I am personally deeply invested in these issues.

What qualities, experience,
and expertise would you
bring to it?
I think communication skills are vital for any group conducting business along these lines and I pride myself on being a good communicator an listener. Punctuality and respecting people's valuable time is important also. Being open to the ideas and opinions of others is important as well. Good leadership skills are necessary for successfully navigating this process to produce the results our city needs. I believe I have the qualities, experience, and expertise to serve on this board. I recently began participating with the College Area
Neighborhood Alliance which is affiliated with Modesto
Neighborhoods Inc. With CANA, I am working with other
residents in support of my passion for the City’s urban forest. I also frequently attend City Council meetings online.

What is it about this
position that interests you?
I want to make a visible contribution to the City of Modesto. I actively supported Measure H and it’s vision. My passion is for the City’s urban forest. I realize there are higher priorities i.e., Police and Fire Departments. After those needs are met, I believe our urban forest can contribute to the quality of life in Modesto. I want to participate in the fiscal planning to be an advocate for the Forestry Division and funding to care for City trees in a sustainable manor.

What qualities, experience,
and expertise would you
bring to it?
I have always been responsible with money, using it as a tool to accomplish goals while saving for the future. In business, I have seen irresponsible practices lead to failure and have avoided being involved. I believe that this reflect good judgement. I may be a rare individual who does not resent paying taxes. I recognize that these taxes provide services which allow our society to function. I want to participate in the Measure H process and confirm that the City is being a good steward with taxpayer’s money. I always work with others with a respectful, positive and constructive attitude and will be honored to be selected to serve on the Oversight Board. (Section Break)

I have run for nonpartisan, political office twice, once for County Board of Supervisors and once for the Modesto
Irrigation District Board. I helped cofound the Stanislaus Homeless Advocacy & Resource Enterprise. I was a committee member of G.I.F.T., a Graceada Park playground
enhancement in mid-1990's. I served on the advisory board for a Doctors Medical Foundation endeavor known as Kids Works.

I have also served on the United Way Children & Youth Impact Council and Boys & Girls Club Operations Committee and
Advisory Council. Volunteered through the years as an
assistant coach in MYSA, Little League, Blue Tide Aquatics and Enslen PTA.

What is it about this
position that interests you?
I have grown with and experienced Modesto the past 55 years, savoring the quality of life it afforded as my wife and I chose to raise our children locally. I am familiar with its challenges and the promise it has for the future if properly directed and managed. Part of the challenge is invigorating the citizenry's confidence in management of city affairs within its budget.

What qualities, experience,
and expertise would you
bring to it?
I believe the breadth of my experience engaging and listening to a wide swath of this community for decades gives me an excellent perspective which is trusted widely. I enjoy and excel at the collaborative efforts, but offer a healthy measure of cynicism to ask critical questions, pay attention to detail why maintaining the greater perspective. I do not have an ego or hostility that would be disruptive to the oversight board's efforts.

And, I am passionate for Modesto's continued success for now and our posterity. I have watched and offered insights as StanCOG put forth Measure L and the Downtown Partnership developed scope and accountability.

Oversight of poorly managed funds in Modesto. Leadership is not accountable for improvements needed locally. As a veteran of the US Marine Corps, leadership is a quality that I possess and while I care about public opinion, it does not sway my commitment to the better good.

8 years on the Planning Commission helped to see the needs of the County and City often ignored by current administration.

Modesto is a complaint-driven city with little connection to its citizens and their desires. Real problems need to be addressed rather than issues that catch public opinion. Modesto should make decisions with their minds I stead of only with their heart. (Section Break)

What is it about this
position that interests you?
I care about our community and the people who live in it. I believe that the overwhelming support provided by voters for Measure H deserves genuine WINS for the people of Modesto.

I've observed and experienced many local committees (in communities around the country) that meet and meet and meet and don't accomplish much or bring about long-term
community change. This program has a chance to create
opportunities and benefits for the children, women and men of Modesto in a manner not seen for many, many years. I am passionate about our City and really want to see Modesto a community recognized as a fine place to live, work and play! What qualities, experience,
and expertise would you
bring to it?
Most importantly, I believe, my exposure to working with many different city governments and living in many communities around the United States (rural, resort, metropolitan) provides a unique perspective to share what I've seen/experienced that worked and what doesn't. Add to that my personal desire for international travel also lets me observe and experience profound community projects around the world. Plus...my constant hunger for knowledge makes me a research geek (so what I don't know, I'll admit and defer to others and/or resaearch the topic so I can have an intelligent opinion when needed).

My background as an executive for projects in excess of $50M (marketing, event management, public relations, procurement, budgeting, rfp/bids, fund raising, etc) provides an array of assistance I can offer the community and City staff on Measure H objectives.

Interestingly, my wife's family goes back over 120 years in Ag in the Modesto community and her cousin still operates the family farm founded in 1900. This makes me very passionate about our agricultural roots and understanding of the balance #1..

Describe your involvement
in community activities and
civic organizations. (Do not

During my employment as a certified public accountant with Grimbleby Coleman, CPAs, I learned the joys and benefits of being involved in the community. Once I owned my own
business, I understood quickly that the key to success in a community like ours is community support and involvement. I participated in many major fundraisers, such as Edible
Extravaganza, Community Brunch, and the annual Chamber of Commerce Gala. In 2014, Village Baking Company won Small Business of the Year for its philanthropy and involvement in the community. During my ownership, I became involved in the Modesto Rotary, of which I have been a member since 2013.

During my membership, I have been involved in several
committees, my favorite being the Scholarship Committee, where we interview the best and the brightest of our high school students. We then present them with a scholarship through the Rotary Foundation. In 2019, I was accepted onto the board of directors for The Boys and Girls Clubs of
Stanislaus County. I have always been involved in the Modesto Chamber of Commerce as well as the Hispanic Chamber of
Commerce. I am a graduate of Leadership Modesto and a
candidate for the upcoming class of American Leadership Forum. There are many other community events and
organizations that I have supported in the past and many I still do today. My employment with The Salvation Army requires me to attend all board meetings for the downtown Salvation Army board as well as the advisory Council for the Red Shield community center. In these meetings, I am informed of the many needs as well as the potential solutions available for these needs. It allows me a deep understanding of the biggest obstacles to our community thriving at the highest level.

What is it about this
position that interests you?
First and foremost, I love Modesto. Although I was not born here, this has been my home since 1989 and the place I chose to raise my family. The improvement of this community is very important to me. Modesto is a special place and deserves a reputation befitting of it. Although we have quite a ways to go, I believe this committee and the funds it will oversee have the #1..

opportunity to move our city significantly in the right direction. I feel I have a diverse résumé of knowledge and experience that will lend itself to a big picture understanding of what is important in our community. As a mother, a mother of an LGBTQ child, a professional, a business owner, board member and a leader in a non-profit, I have a very well rounded, nonbiased vantage point that will benefit this committee.

What qualities, experience,
and expertise would you
bring to it?
I have many years of experience in the financial field. I understand the financial impact of decisions made and
unmade. By working with small businesses in a consulting capacity, as well as owning my own small business, I know the struggles of being a small business owner. I understand that the stability of the community directly impacts the success of a business. Most importantly, the success of the small
businesses directly impacts the stability of a community.

Becoming part of one of the most respected nonprofit
organizations in the world, I now have a better view of how nonprofits serve a community. Being part of The Salvation Army in Modesto is a very rewarding experience. I can see up close, the needs of the most vulnerable in our community.

Because of my participation in Leadership Modesto, I have a much better understanding of all aspects of our community. (Section Break)

CITY OF MODESTO

COMMITTEE AGENDA REPORT
DATE OF MEETING:

May 24, 2023
Date: April 11, 2023
TO: Appointments Committee
Rosa Escutia-Braaton, Chair
Chris Ricci, Vice Chair
Jeremiah Williams, Member

THROUGH: Joseph P. Lopez, City Manager
FROM: DeAnna Christensen, Director of Finance
SUBJECT: Audit Committee Public Member Appointments
CONTACT: DeAnna Christensen, Director of Finance, [email protected], 209-577-5387
DESCRIPTION:

Consider recommending appointments to fill two City of Modesto Public Member vacancies for the Audit Committee for four-year terms with term expirations of June 30, 2027 and forwarding to Council for approval. (Funding Source: Not Applicable)
STRATEGIC PLAN ELEMENT:

This item advances the City of Modesto 2020-2025 Strategic Plan Area: Governance and Service Delivery: “build community trust in City government through responsive, transparent and efficient service delivery”; Goal J: “build a high-performance organization”.

BACKGROUND:

The City has a Standing Audit Committee made up of the Mayor and two City Councilmembers appointed by the Mayor, which was established under the Modesto Municipal Code 2-1.18. The purpose of the Audit Committee is to advise the City Council on items related to the work of the City Auditor and the City’s financial statement audits. These duties include the following:
1) Review the Auditor’s audit plan annually and submit annually to the City Council; 2) Provide suggestions and comments for the annual audit plan; 3) Review and consult with the Auditor on quarterly reports or updates of the City Auditor’s activities and findings;
4) Report irregularities raised by the Auditor to the City Council; 5) Ensure that audit reports are transmitted to the legislative body and to the public; 6) Monitor follow-up on reported findings to assure corrective action is taken by management;

7) Report to the legislative body on problems or problem areas at such times as deemed appropriate;
8) Provide input on, and participate in, the selection of the firm conducting the annual financial statement audits; and
9) Review and forward to the City Council materials related to the City’s annual financial statement audit conducted pursuant to Section 1306 of this Charter.

DISCUSSION:

As part of the November 2022 voters’ ballot, the Modesto voters approved “Measure G” which included amendments to the City Charter. One of the amendments included adding the Standing Audit Committee into the City Charter Section IX under Section 902.2 and capture the duties outlined above. Under this Charter amendment the Committee is now comprised of the Mayor, two (2) members of the City Council and the addition of two (2) members of the public to the Committee for a total of five Committee members.

Since Measure G amended the Charter to include members of the public on the Audit Committee, the committee is no longer a Council Committee, and is not governed by the procedures established in the Charter and Municipal Code for Council Committees. Accordingly, staff is preparing an ordinance to amend the Municipal Code to formally establish the procedures for appointing individuals to serve on the Audit Committee. The proposed ordinance will provide that the members of the public serving on the Audit Committee will be appointed by City Council for four-year terms. The Council will consider the ordinance concurrently with the recommendation from the Appointments Committee.

The two members of the public must meet the below criteria to qualify for this Committee position:
1) Must be a resident of City of Modesto
2) Must possess a minimum of two (2) years of experience in financial or performance auditing
3) Strong consideration shall be given to residents who are Certified Public Accountants (CPA)
4) No public member shall be a relative by blood or marriage for the third degree of the Mayor, member of the Council, any Charter Officer, or any department head or deputy department head
5) No public member shall be an employee of the City nor any bargaining unit for employees of the City, nor a person who receives compensation from the City or from bargaining units of the City in any manner, including retirement benefits 6) No public member shall be a lobbyist or other person with business before the City that represents an economic interest in excess of the limit for material financial effect established by local ordinance for the time periods established by local ordinance City staff coordinated with the Communication team to outreach the solicitation of applications for these two Audit Committee public member positions. The outreach efforts included the following:
 On 2/17/23, staff notified all Modesto businesses licensed with accounting and auditing services, tax preparation services and CPA.
 On 2/17/23, staff presented at the Chamber of Commerce Government Relations meeting and coordinated with Chamber of Commerce to communicate to their members. #2..

 Posted on LinkedIn on 1/23/23 and 3/8/23
Staff recommends considering applications received to fill the two available public seats.

However, the opportunity to apply for the Audit Committee will remain available until all seats are filled.

July, 2010 to present, one of my primary responsibilities at the Modesto Irrigation District (MID) is preparing and reviewing evidence for Federal regulatory standards approved by the Federal Energy Regulatory Committee (FERC) and enforced by the North American Electric Reliability Corporation (NERC) and the Western Electric Coordinating Council (WECC) for the Modesto Irrigation District. I have been one of the the lead Subject Matter Experts on four NERC/WECC triennial audits (2011, 2014, 2017, 2020). I am involved in MID's budgets preparing quotes from multiple vendors, submitting Purchase Orders, credit card statement receipts, etc. I have provided reports for MID's financial information systems for MID's annual financial audits. I have served on mock audit committees with other energy organizations, such as the San Francisco Public Utility Commission's Hetch Hetchy Reservoir, and the Turlock Irrigation District. Another of my primary responsibilities as the senior information analyst is maintaining and securing MID's electrical SCADA systems from cyber attacks. I have

I am a lead usher, security team member, and volunteer with the Men's Ministry at Shelter Cove Community Church. I am also a Facebook moderator for one of the largest Facebook groups in the county, the "Modesto/Stanislaus News & Incident Feed" with over 32,000 members. In years past I have been a volunteer radio operator and Volunteer Examiner with the Stanislaus County Amateur Radio Emergency Service
(StanARES), the Manteca Amateur Radio Club, and the Ripon Fire Department Technical Reserve Unit. While my four
children attended Fremont Open Plan (FOP) I volunteered weekly in the classroom and participated in the monthly FOP Parent Advisory Group (FOP PAG). I have participated in numerous community outreaches over the years, such as
Ninevah Ministries, Church in the Park, Love Modesto, and the Salvation Army Shelter. I was one of the lead coordinators of donation and outreach ministries at the Beard Brook Park Village until the county resources became involved and I assisted briefly in that transition.

What is it about this
position that interests you?
I wish the see transparency in the City of Modesto's finances. I believe I can be a good public member of the city's finance committee and bring trust to the community when the city is doing the right thing.

What qualities, experience,
and expertise would you
bring to it?
I believe I have a keen eye for reviewing data. I enjoy finding out the "why" behind how systems and functional groups work and how they are interconnected. While I am not an electrical engineer nor PE, I am able to understand and gather facts to support MID's electrical SCADA systems. I enjoy personal finance, and while I understand the scale of large organizations such as MID or the City of Modesto is different, the basics accounting principals are much the same. While running my own contracting service from 2008 - 2010, I attended basic financial bookkeeping classes, including at MJC, and
maintained my own business invoicing, financial and tax records such that my bookkeeper always said my records were in perfect order and very efficient with all of the correct reports required for quarterly and annual tax filings. Previously while working as an employee of IT consulting companies and then while working under my own 1099 IT consulting service, I have #2..

I have seen much of Modesto's public
government from the inside and how they interact as I needed to learn and understand these nuances to provide IT
connectivity between these various groups, while still
safeguarding and securing each group's IT resources as
appropriate.

Describe your involvement
in community activities and
civic organizations. (Do not

I am a member of Business Networking International in the Modesto Founders chapter. I am an active participant in the Modesto Community Action Group, which advocates for
policies to alleviate homelessness. I am also an Eagle Scout from Troop 43 in Oakdale, CA.

What is it about this
position that interests you?
I believe that being an active citizen in a democratic society requires more than simply voting. Getting active in how government works to develop a community, and where various activities take place in the community, is true community engagement. I am interested in the Planning Commission
because it helps allow more jobs to be created by zoning more areas for business to be placed. The commission can also make sure that Modesto has the room to grow, and still be affordable for future generations. It helps more housing to be built, so home our citizens and work and live in the same town.

What qualities, experience,
and expertise would you
bring to it?
I bring two perspectives to the Planning Commission. I bring personal experience that lays bare many of the community's needs, such as being priced out of buying home, and having to rent. Furthermore, more and more citizens become victims from a lack of medical facilities, The struggle for numerous citizens to find care facilities for chronic, and long term, illnesses is very real issue.

I also bring the experience of being a small business owner that hears on a daily basis the issues facing other small business owners. Simply starting a business is difficult enough, but dealing with zoning issues brings more struggles to business owners who simply want to operate. Finding safe and convenient places for business to open and serve their
customers is vital for any community.

second term. Attendance record information was provided in the agenda report. No action was taken on the reappointment.

It should be noted, that Commissioner Bedford served during unique times, which included multiple cancellation of meetings due to Covid, transition to virtual meetings and overcoming technical difficulties, and challenges to reach a quorum.

With the updated attendance record and his continued interest in serving, the Appointments Committee is asked to consider appointing former Commission member Dewey Bedford, a Modesto resident, to the Culture Commission for a partial second term from July 1, 2023 to December 31, 2026, and forwarding to Council for approval.
