SUBJECT: Oracle Application Upgrades and Professional Migration Services to move the City’s On-Premises E-Business Suite to Oracle Cloud
CONTACT: James Dotson, Information Technology Manager
[email protected], 209-571-5508
DESCRIPTION:
Consider the purchase of Oracle Application Upgrades and Professional Migration Services to move the City’s On-Premises E-Business Suite to Oracle Cloud using Mythics, Inc. of Virginia Beach, VA for a combined total amount not to exceed $1,219,859 over five years and forwarding to Council for approval. (Funding Source: Information Technology Fund) STRATEGIC PLAN ELEMENT:
The recommended action supports the City’s 2020-2025 Strategic Plan Initiatives: Build community trust in city government through responsive, transparent, and efficient service delivery.
BACKGROUND:
The City of Modesto currently uses the Oracle E-Business Suite (EBS) Enterprise Resource Planning (ERP) software application for most of our financial processing needs including General Ledger, Cash Management, Purchasing, Payables, Payroll, Stores Inventory, Human Resources, and Projects & Grants.
On May 25, 2010, by Council Resolution No. 2010-219, the City began work on installing the Oracle EBS system and successfully implemented it from April through September 2011 using 20 on-premises servers residing in the City’s data center. On March 28, 2017, by Council Resolution No. 2017-012 a major application version and database upgrade was performed by a professional services provider which included a migration to new server hardware.
Since 2017, no major upgrades have been performed and several key application modules of the Oracle EBS system are in danger of no longer being supported. The server hardware is also in need of replacement as that equipment is close to end-of-life and will no longer be supported beginning June of 2024.

Oracle Application Upgrades and Professional Migration Services to move the City’s OnPremises E-Business Suite to Oracle Cloud
To forego the costs of hardware replacement and make our environment secure, fully supported and state of the art, we can move our on-premises Oracle EBS system applications from our data center to the Oracle cloud – This is called a “Lift and Shift”.
DISCUSSION:
On November 9, 2023, the City Manager authorized the Purchasing Manager to solicit the procurement for Oracle Application Upgrades and Migration of On-Premises E-Business Suite to Oracle Cloud. On May 18, 2018, Maricopa County, AZ issued Request for Proposals (RFP) 180233-RFP for Oracle Products and Services and was advertised on BidSync, Pamplin Media Group, US Communities Publication, and Capital City Press. On June 26, 2018, proposals were opened at Maricopa County, 320 W. Lincoln St., Phoenix, AZ. Eight (8) proposals were received and based on the committee evaluation and criteria outlined in the RFP, two (2) contracts were awarded for this commodity which includes Oracle Products and Services. Based on the responsive and responsible proposer offering the respondent’s proposed solution/compliance with specifications (including the ability to sell all Oracle products), respondent qualifications, including national capabilities, and price, City staff recommends awarding to Mythics, Inc., Virginia Beach, VA to purchase Oracle Application Upgrades and Oracle Cloud Storage for an estimated annual amount of $162,646 over a 5-year term for a total amount not to exceed $813,230.
On June 12, 2019, Region 4 issued RFP 19-08 for Oracle Products and Services and was advertised on multiple newspaper’si. On August 15, 2019, proposals were opened at Region 4 ESC Office 7145 West Tidwell Road, Houston, TX. Two (2) proposals were received and based on the committee evaluation and criteria outlined in the RFP, one (1) contract was awarded for this commodity which includes Oracle Products and Services. Based on the responsive and responsible proposer offering the products/pricing, performance capability, qualifications & experience, and value add, City staff recommends to award to Mythics, Inc., Virginia Beach, VA to purchase Professional Migration Services to move our On-Premises E-Business Suite to Oracle Cloud in Year 1 for an amount of $387,266 plus a 5% Contingency of $19,363 for a total amount not to exceed $406,629.
With multiple components of our current on-premises Oracle EBS system along with the hardware upon which the system resides becoming unsupported in June 2024, we must move quickly to mitigate pending security and application failure risks of this critical financial system. Staff sees two alternative paths toward effective risk mitigation:
Alternative 1: Move things to the Cloud - Due to the complexity of the Oracle EBS system, IT will work with the professional services vendor to upgrade the current unsupported key modules. IT will also work with the vendor to convert the Oracle EBS system into a virtual platform, no longer dependent on physical on premises hardware, and migrate the system to be hosted in Oracle’s cloud infrastructure (OCI).
Moving from on-premises server hardware in the City’s datacenter to OCI offers the following benefits:
Eliminates recurring capital hardware costs at roughly $400,000 every five years. Eliminates required maintenance performed by City staff on this hardware. Delivers accurate annual operating costs for the subscription costs associated with OCI. #4..

Oracle Application Upgrades and Professional Migration Services to move the City’s OnPremises E-Business Suite to Oracle Cloud
The $162,646 annual payment replaces the City’s current annual payment of $135,000 for database licensing (a net annual increase of only $27,646 which now includes Cloud Storage)
Supports business agility by allowing IT staff to leverage the following:
o Scalability - easily spin up additional test environments. o Elasticity - seamlessly increases computing power and storage for the Oracle EBS system.
o Integration - more opportunities to integrate cloud apps with the Oracle EBS system.
Alternative 2: Keep the system on-premises - Due to the complexity of the Oracle EBS system, IT will work with the professional services vendor to upgrade the current unsupported key modules. IT will also work with the vendor to migrate the Oracle EBS system onto new physical servers within the City’s datacenter.
Staying with an on-premises hardware model is possible, but not desirable for the following reasons:
The application module upgrades must be performed prior to migrating to new physical server hardware.
o When migrating onto the new hardware, we will, in essence, be performing this activity twice
Staff estimates additional professional services costs of $200,000 to migrate to new hardware.
Must continue budgeting and collecting recurring capital hardware costs at roughly $400,000 every five years for replacement of server hardware. City staff must continue to patch, service and maintain the hardware to keep the system secure.
Continue with the current database licensing model which affords the City no savings.
Staff recommends Alternative 1 as a secure and supported upgrade and migration path.
Modesto Municipal Code Section 8-3.203 generally requires all purchases which meet or exceed $100,000 for material, equipment, or contractual services to be formally bid . However, exceptions to the formal bidding process are granted in MMC 8-3.204(d) “Where the Purchasing Manager, in her discretion, determines that a process other than the formal bid procedure set for in Section 8-
3.203 will result in a procurement for the City at the lowest possible cost commensurate with the desired quality.” In addition, MMC 8-3.202(h) encourages the Purchasing Manager to join with the State of California or other units of government in cooperative purchasing plans when the best cost savings interest of the City could be served. Both requirements were met based on the Competitive Bidding process selected by Maricopa County.
FISCAL IMPACT:
The table below shows the total anticipated costs over the next 5 years. The costs for year 1 will be absorbed within the Fiscal Year 2023-2024 current Information Technology Fund 5230 operating budget. For Years 2 through 5, the expense will be included as part of the annual budget #4..

process whereby the costs will be recovered through the Internal Service Fund (ISF) model for the Information Technology Department. The 5% Contingency of $19,363 associated with the Professional Migration Services in Year 1 is to cover any unforeseen issues experienced during the migration (projects of this type typically see 5-10% contingencies when invoked).
Year 1 Year 2 Year 3 Year 4 Year 5 Vendor Total
OCS $387,266 $387,266
5% Contingency = $19,363
OCI $162,646 $162,646 $162,646 $162,646 $162,646 $813,230 Subtotals $549,912 $162,646 $162,646 $162,646 $162,646
5-Year Total = $1,219,859
RECOMMENDED COMMITTEE ACTION:
Staff Recommendations:
Motion recommending the acceptance of the Competitive Bidding Process from Omnia Partners, Maricopa County, AZ, with Mythics, Inc. for Oracle Application Upgrades and Professional Migration Services to move the City’s On-Premises E-Business Suite to Oracle Cloud for a combined total amount not to exceed $1,219,859; and forwarding to Council for approval.

If, at the end of any month during the Services Period, You have exceeded the Funded Allocation Value, You must provide additional funding for Your usage, or You must cease to use the applicable Cloud Services. If you have exceeded the Funded Allocation Value and You have not ended Your use of the Services, You will be subject to overage fees. Oracle will invoice the Oracle Partner for the excess usage of the Oracle IaaS and PaaS Cloud Service at the Overage Unit Net Price specified in the rate card of Your order or as seen in the Cloud Portal; Oracle will send invoices for the additional usage to the Oracle Partner at the Billing Contact provided to Oracle by the Oracle Partner. The Oracle Partner is responsible for all additional usage fees and such fees shall be payable to Oracle as stated in the applicable Oracle invoice. If You placed Your order for Funded Allocation Value through an Oracle Partner and the corresponding order between Oracle and the Oracle Partner provides that You will be invoiced by Oracle, then You acknowledge that Oracle will invoice You for, Your excess usage. You shall ensure that Your order with the Oracle Partner indicates whether You agreed to be invoiced by Oracle for Your excess usage in this manner. You may set quotas, alerts and use other monitoring tools within the Cloud Portal to assist You in managing and tracking Your usage.
Additional Services
If Oracle adds additional service offerings to the list of eligible Oracle IaaS and PaaS Cloud Services within Your Cloud Services Account during the Services Period, You may activate and use those service offerings and the discount will be applied based on the Cloud Service category discount specified in the rate card attached to Your order or as seen in the Cloud Portal. The development, release, and timing of any future features, functionality or service offerings remains at the sole discretion of Oracle Corporation.
Replenishment of Account at End of Services Period
If you are continuing to use services after the end of the Services Period specified in Your order and You have not extended the Services period and increased the Funded Allocation Value for use of eligible Oracle IaaS and PaaS Cloud Services, You will be charged for the actual usage of all services that You activate and/or have activated within Your Cloud Services Account based on Oracle's then current price list for such services, which can be found at https://cloud.oracle.com/en_US/ucpricing. Upon extending the term of the Services Period and increasing the amount of the Funded Allocation Value through a new order or modification of Your existing order, You will receive the Cloud Services category discounts specified in the rate card attached to Your new order or modification of the existing order or as seen in the Cloud Portal.
Roving Edge Parts
Roving Edge Infrastructure parts are limited-availability parts. This order is not eligible for any Roving Edge Infrastructure products or services, even if a Roving Edge part number is specified in the Rate Card of this order or seen in the Cloud Portal.
