PUBLIC COMMENT IN PERSON
Gladys Williams spoke regarding the topic of equity, highlighting the case of an African-American individual working in the cannabis industry who has successfully completed the equity program. Despite this, they are facing challenges in securing a retail license, which she sees as contrary to the goals of the equity program. Williams emphasized the importance of preventing systemic racism and ensuring that AfricanAmericans have equal opportunities to succeed in the industry, particularly in owning dispensaries. She urged the leaders to consider fairness and equity for all. Wendy Bird addressed the Council, expressing gratitude for the support she received during her time away and noting she is doing much better. She acknowledged the progress made on the Equity Program, which the NAACP originally brought to the city’s attention. Wendy echoed Gladys Williams' concerns about the challenges African-Americans face, emphasizing the difficulty of being Black, including being the last to be hired and the first to be fired. She highlighted the need for the equity program to ensure that African-Americans have opportunities to become business owners, particularly in the cannabis industry. Wendy thanked City officials for their efforts but stressed that more discussions and work are needed to fully achieve equity. Loretta Carhart raised several concerns, starting with a question about whether there is a law in Modesto regarding building on property lines, noting she had not received a complete answer previously. She also mentioned issues with tree trimmings near her house, where the property owners did not clean up properly, and expressed frustration over a building constructed incorrectly on a property line, which she has complained about for years without resolution. Loretta then discussed her personal experiences, including mistreatment related to her health, her time in the military, and the effects of narcotic medications prescribed to her. She mentioned her decision to stop taking medications and criticized the way narcotics affect people. Loretta shared an incident in which she was arrested for allegedly stealing records, questioning how it would have been possible to walk out of a store with the items. She concluded by thanking the Council.
Kevin McCarthy expressed concern over the lack of updates from the Council regarding the status of the ACE train project. He explained that while the project, including the train station remodel, had been approved, progress stalled due to issues with underground cables. The City failed to obtain permission from the cable owners to lay tracks over them, leading to a stalemate in negotiations. McCarthy emphasized the importance of the ACE train for Modesto's future, believing it would greatly improve the local economy, similar to how the arrival of commuter rail transformed Walnut Creek. He argued that bringing train and airline services to Modesto would attract corporate investment, boost growth, and alleviate issues like poverty and homelessness.
McCarthy concluded by asking for an update on the project, expressing his desire for Modesto to become a destination and a central hub in California. - 3 -

COUNCIL COMMENTS & REPORTS
Councilmember Bavaro shared that, along with Council member Ricci, they attended a forum addressing the impact of illegal activities in smoke shops across Modesto. The forum, facilitated by California Board and Legal Cannabis Regulation Director Zack Javon and hosted by Stanislaus County Supervisor Chance Condit and San Joaquin County Supervisor Tom Patti, revealed troubling findings. Over the past three years, local cannabis stakeholders gathered evidence showing that 54 out of 61 smoke shops in Modesto were involved in illegal cannabis sales, gambling, weapons violations, and methamphetamine-related activities. This evidence was given to the Modesto Police Department, which, in collaboration with the California Department of Tax and Administration, conducted raids resulting in eight arrests and the seizure of illegal firearms, gambling machines, and other items. Bavaro highlighted that many smoke shops were selling cannabis products disguised as popular food and candy items to appeal to children, and even a 12-year-old was caught selling cannabis products. He emphasized that these shops are a public health and safety concern, as they are only required to have a basic business license to operate.
Councilmember Wright reported that in August, the Downtown Street Team volunteered 412 hours, removing nearly 10,000 pounds of trash from Modesto’s streets and parks.
Two team members secured housing, and one found employment. The Berberian Center served 151 new individuals, with housing support provided to several. The Gospel Mission assisted 66 women and children through its safe sleeping site. Additionally, 35 affordable housing units, including some for veterans and workforce housing, were opened on Third Street after years of planning.
Councilmember Ricci echoed Councilmember Bavaro's concerns about the out-of-control smoke shops in Modesto, noting that Governor Newsom recently signed an emergency provision banning the sale of cannabis and THC-infused products across the state. Ricci highlighted that most of the 70 smoke shops in Modesto are likely selling cannabis and expressed the need for the City to take action against illegal sales, as well as to protect children from drugs like mushrooms and meth being sold there. He also addressed the tragic accident on Highway 132, which claimed two lives, including a baby, and urged the Council to collaborate with the County and State to address the safety issues on the road.
Lastly, Ricci shared excitement about the City's 150th anniversary mural project, inviting local artists to submit bids, with the deadline being November 15.
Councilmember Williams shared updates on recent events. He attended Constitution Day at Sherwood School and Stanford School, where he spoke to students about the possibility of becoming lawmakers. He also highlighted an employee appreciation event in Modesto, where staff enjoyed activities and lunch. Williams noted the completion of seven supportive housing units on California Avenue, facilitated by StanCo, and praised their swift progress. He also announced an upcoming Law Enforcement Appreciation Day, organized by the Modesto Police Department and the clergy, as well as a suicide prevention event at MJC. Lastly, Williams acknowledged recipients of the American - 11 -
