CITY OF MODESTO

COMMITTEE AGENDA REPORT
DATE OF MEETING:

March 3, 2025
February 4, 2025
TO: Economic Development Committee
Eric Alvarez, Chair
Sue Zwahlen, Vice Chair
Nick Bavaro, Member
THROUGH: Joseph P. Lopez, City Manager
FROM: Bill Sandhu, Director of Public Works
SUBJECT: First Amendment to Site-To-Site- Communications Services Agreement CONTACT: Max Navarro, Associate Engineer, [email protected], 209-571-5116 DESCRIPTION:

Consider the First Amendment to the Site-to-Site Communications Services Agreement with Ayera Technologies Inc., Modesto, CA, increasing the Agreement amount by $117,500 and extending the term of the Agreement from July 14, 2027, to July 14, 2030, and forwarding to Council for approval. (Funding Source: Congestion Mitigation and Air Quality) STRATEGIC PLAN ELEMENT:

This item is consistent with Council’s Strategic Plan Area of Focus “Quality of Life Goals and Strategies”; engage partners across the community to ensure the safety, resilience, and attractiveness of Modesto; Goal A: “Improve community safety and quality of life through a combination of prevention and intervention efforts that address safety and it’s underlying issues.”
BACKGROUND:

The City of Modesto Traffic Engineering and Operations Division applied for Congestion Mitigation and Air Quality (CMAQ) funds to install wireless radio communications at traffic signal locations. The traffic engineering staff already maintains an existing Advanced Traffic Management System (ATMS) which functions by communicating with traffic signals through a network of fiber optic cable and hardwired equipment. We currently have 53 of 159 traffic signals communicating. Some traffic signals are more isolated than others and it is more beneficial to connect these traffic signals by wireless devices until it is more feasible to hardwire a connection. Connecting and maintaining a live connection to traffic signals aligns with the Traffic Signal Masterplan to proactively evaluate and update time-of-day signal timing plans, evaluate overall performance of individual traffic signals and corridors for all modes of transportation including automobiles, transit vehicles, pedestrians, and bicyclists. #2..

First Amendment to Site-To-Site Communications Services Agreement

Page 2 of 3 ends

On January 28, 2020, by Resolution No. 2020-056, Council accepted the Traffic Signal Master Plan identifying traffic signal communications as a Local Street Management Strategy to enhance signal operations for all modes of transportation.

On July 14, 2020, by Resolution No. 2020-307, Council approved the award and proposal and agreement for site-to-site communications services to Ayera Technologies, Inc. of Modesto.

This agreement was established to communicate City facilities from site-to-site and the City’s Tenth Street Place for an estimated annual amount of $75,000 over seven years and a total amount not to exceed $525,000.

DISCUSSION:

The coordination and active evaluation of signal performance is a day-to-day task for the Traffic Engineering & Operations and Electrical Divisions. Our coordinated signal system allows motorists to progress in sequence so platoons of vehicles can proceed through a series of green lights. Adding the use of wireless radio communications will build on our existing investment in traffic signal management and circulation throughout the City of Modesto.

The installation and operation of radio communications is a near-term solution to get more traffic signals online. Fees and charges will come from buying equipment, installation fees, and fees for data use.

The additions included in this amendment were not anticipated as needed during the original agreement bid process. The Public Works Traffic Engineering staff received authorization to purchase radio equipment for signalized intersections on June 15, 2021, approximately one year after the agreement was approved. As staff was reviewing and preparing a separate solicitation and specifications for the required equipment it was identified that the Information Technology Department had already developed and had in place site-to-site communication equipment and protocols. Staff identified the benefit to having standardized equipment across our wireless communication network.

Modesto Municipal Code Section 8-3.203 generally requires all purchases, which meet or exceed $100,000 for material, equipment, or contractual services to follow the formal bid procedures. However, exceptions to the formal bidding process are granted in MMC 8-3.204(f) “Where the Purchasing Manager, in his or her discretion, determines that is appropriate to amend the services or goods provided under an existing agreement to include additional similar goods or services, of limited quantity or scope, in order to increase efficiency and avoid delays or disruptions to City projects or services.” An Amendment to this existing agreement is appropriate because the services and goods are similar for site-to-site communications for buildings and amending the existing agreement will allow less delay to the project. #2..

CITY OF MODESTO

COMMITTEE AGENDA REPORT
DATE OF MEETING:

March 3, 2025
Date: February 11, 2025
TO: Economic Development Committee
Eric Alvarez, Chair
Sue Zwahlen, Vice-Chair
Nick Bavaro, Member
THROUGH: Joseph P. Lopez, City Manager
FROM: Toby Wells, Director of Engineering Services/City Engineer SUBJECT: Sewer Reimbursement Agreement with KB Home
CONTACT: Jaspreet Mangat, Senior Civil Engineer, [email protected], 209-577-5253
DESCRIPTION:

Consider a Subtrunk Sewer Reimbursement Agreement with KB Home North Bay LLC for the construction of the Sonoma Sewer Trunk Extension Phase 3 & 4A Project and forwarding to Council for approval. (Funding Source: Wastewater Fund) STRATEGIC PLAN ELEMENT:

The recommended action supports the City’s 2020-2025 Strategic Goal “Ensure Safe, Efficient, and Reliable Infrastructure”.

BACKGROUND:

In 2016, the Wastewater Engineer’s Report was approved to provide a basis for establishing wastewater related charges, fees and identified needed Wastewater Capital Improvement Program Projects.

The Wastewater Collection System Master Plan identifies the Sonoma Trunk Extensions and Lift Station as a system that must be constructed to serve future development of the Roselle/Claribel Comprehensive Planning District located in the northeast area of the City. The area bounded by Oakdale Road, Sylvan Avenue, Roselle Avenue and Claratina Avenue is the Tivoli Specific Plan, there are two properties with approved Tentative Maps and will require construction of the Sonoma Trunk Extensions.

Phase 1 of the Sonoma Trunk Extension has been completed on Sylvan Avenue, stretching from Wood Sorrel Drive to Aria Way. The Phase 2, involving the Lift Station and sewer main improvements on Oakdale Road, is nearing completion, and is expected to be finished by the end #3..

of the year. Phases 3 and 4a, which are situated along the future Aria Way, must still be built, and coordinated with upcoming development projects.

The development of approximately 2,900 feet of 24-inch diameter sewer trunk for Phases 3 and 4a of the Sonoma Trunk project will commence on Aria Way, just north of Sylvan Avenue, and extend towards the projected alignment of Mable Avenue. The design and bid of the project were planned to ensure City infrastructure would not impede the timely development of the new subdivisions in the area.

DISCUSSION:

The developer KB Home North Bay LLC (KB Home) acquired two Tentative Map areas in the Tivoli Specific Plan referred to as the Snow and Arcadia properties. KB Home has received approved improvement plans and is now moving forward on the construction of the new subdivisions. To better coordinate the infrastructure in the area, the developer requested the ability to construct the proposed work as part of their construction activities. As is common for large subdivision projects, the developer will be constructing a number of items of public infrastructure related to the development. It will enhance efficiency for the developer to construct the Sonoma Sewer Trunk Phase 3 & 4a as part of their ongoing construction activities by eliminating duplicative activities and the need for a new contractor to mobilize.

FISCAL IMPACT:

Phases 3 and 4a of the Sonoma Sewer Trunk Extension are budgeted projects, funded through the Utilities Wastewater Fund for an amount not to exceed (NTE) $1,678,415.

RECOMMENDED COMMITTEE ACTION:

Staff Recommendations:

Motion recommending a Subtrunk Sewer Reimbursement Agreement with KB Home North Bay LLC for the construction of the Sonoma Sewer Trunk Extension Phase 3 & 4A Project and forwarding to Council for approval.
