DATE OF MEETING:

March 5, 2025
Date: February 25, 2025
TO: Appointments Committee
Eric Alvarez, Chair
Rosa Escutia-Braaton, Vice Chair
Jeremiah Williams, Member
THROUGH: Joseph P. Lopez, City Manager
FROM: Allison Van Guilder, Deputy City Manager
Christina Alger, Director Human Resources
Diane Nayares-Perez, City Clerk
SUBJECT: Annual Report and Overview for Citizen Advisory Boards, Commissions, and Committees
CONTACT: Allison Van Guilder, Deputy City Manager
[email protected], 209-577-5228
DESCRIPTION:

Consider accepting the 2024 Annual Report of the City’s Citizen Advisory Boards, Commissions, and Committees, and forwarding to Council for acceptance. (Funding Source: Not Applicable) STRATEGIC PLAN ELEMENT:

The recommended action supports the City of Modesto’s 2020-2025 Strategic Plan Initiative:

Service and Delivery Goal I: Promote trust and engagement between the community and the City; and Goal J: Build a high-performance organization.

BACKGROUND
In early 2024, the City implemented a new appointments process program to ensure consistency, enhance understanding of committee member roles, and promote uniformity across the City’s boards, commissions, and committees. The City oversees 23 advisory bodies that provide valuable input and guidance on various issues affecting the community. Recognizing the importance of these groups, staff identified a need for a structured approach to evaluate and document their contributions.

One of the key components of this new process is the requirement for an annual report prepared by each board, commission, and committee with the assistance of their staff liaisons. This report is designed to provide a comprehensive overview of each advisory body’s mission, work, and accomplishments while maintaining transparency and accountability. #1..

Annual Report and Overview for Citizen Advisory Boards, Commissions, and Committees

Page 2 of 3 ends

DISCUSSION:

The annual report will serve as a critical tool for understanding the impact of the City’s citizen advisory bodies. Each report will include the following elements:

Mission Statement: A clear and concise description of the advisory body’s purpose.

Member Composition: A list of the members, and vacancies.

Historical Background: An overview of the advisory body’s history, including its establishment and purpose.

Highlight of Activities: A summary of key achievements and contributions over the past year.

Meetings Held and Canceled: Information on the frequency of meetings and any notable trends in cancellations over the past year.

Member Attendance: Attendance records for each member, highlighting their level of participation.

The annual reports will be presented to the Appointments Committee each March. After review and acceptance, the Committee will forward the reports to the City Council for formal acceptance.

This ensures that both the Committee and the Council have a clear understanding of the work and effectiveness of the City’s advisory boards, commissions and committees.

In addition to the annual report, staff will now provide an overview of the appointments process twice a year:

March: A summary of upcoming terms expiring, including information on members’ interest in continuing their service or vacancies that may need to be filled.

September: An overview of upcoming terms expiring, including similar details to aid in preparation for the upcoming term expirations.

This structured reporting and process will enhance the City’s ability to effectively manage its citizen advisory groups and ensure they are meeting their intended goals. The program also reinforces the City’s commitment to transparency, efficiency, and informed decision-making.

FISCAL IMPACT:

There is no fiscal impact related to this action.

City of Modesto Boards, Commissions and Committes Annual Report Introduction
and Overview
Serving on a City Board, Commission, or Committee is an important way for the public to engage with their City government.

Citizen advisory groups are established by the City Council to assist in addressing specific issues and to promote direct community involvement in the decision-making process. These Boards, Commissions, and Committees (BCCs) provide valuable insights and recommendations that help shape policies, programs, and initiatives that affect our community.

In our City, a diverse range of BCCs contribute to local governance. Some of these groups provide recommendations on policies, while others have quasi-judicial responsibilities, such as the Planning Commission. These advisory bodies address critical topics including health and social services, public safety, land use, economic development, parks and recreation, and housing.

This combined Annual Report represents the collective efforts of all City advisory groups over the past year. Each BCC has prepared a summary of its activities detailing the number of meetings held, attendance records, key accomplishments, significant projects completed, and an updated roster. This report serves not only as an accountability measure to align with their mission and purpose but also as an opportunity to highlight the meaningful contributions made by each group.

The City has implemented a structured annual reporting process to ensure consistent and comprehensive documentation of advisory group activities and review of their purpose, functionality and opportunities for improvements. Moving forward, these reports will be presented to the City Council every March, providing an overview of the previous year’s accomplishments.

The City currently oversees a total of 23 advisory groups. Below is a list of all City Boards, Commissions, and Committees, including those not directly formed by the City, but where the City Council appoints representatives. 1 #1..

Patricia Gillum, Member Tim Ragsdale, Member

MISSION STATEMENT
• “A Citizen's Transportation Sales Tax Commission, hereinafter "Commission," is hereby established for the purpose of providing oversight of the collection and spending of tax revenue from any local transportation sales tax. For purposes of this chapter, a "local transportation sales tax" is defined as a sales tax imposed on City residents for purposes of generating funds to specifically fund the City's transportation plan; any local tax used to fund general services in the City is not a "local transportation sales tax." The first such Commission shall be appointed by the Council no later than ninety (90) days from the effective date of the passage of any local dedicated tax imposed for transportation purposes. The Commission shall regularly meet and make recommendations to the Council to provide oversight of any transportation tax then in effect.”

BOARD ROLES
• “The duties of the Commission shall include, but not be limited to, the following:
• Reviewing the annual work plan and priorities for revenue derived from any transportation sales tax then in effect;
• Analyzing and commenting on any proposed items in the City budget that would lessen the City's commitment to road and street funding from sources of revenue other than any transportation sales tax then in effect;
• Reviewing any policies, standards or similar measures that the City uses to set priorities for where revenues from any transportation sales tax then in effect are to be spent; • Reviewing any proposals for the City to use bond or similar financing secured by revenues from any transportation sales tax then in effect;

• Reviewing any policies, standards or similar measures that the City uses to determine whether work funded by the tax shall be done "in-house" or through outside contracts; and, • Reviewing any other matter the Council deems appropriate related to any local transportation sales tax. The Council shall appropriate adequate funds for the work of the Commission.”

HISTORICAL BACKGROUND
• In November of 2016, Stanislaus County voters approved a county-wide, 25-year, half-cent sales tax increase known as Measure L. The tax increase went into effect on April 1, 2017 and the City began receiving quarterly payments commencing in July, 2017. As stated on the ballot put before the voters, Measure L funds are to “provide funding for local transportation improvements including: fixing potholes/maintaining streets; improving emergency response; providing safe routes to schools; providing senior, veterans and disabled shuttle services; and improving safety/reducing traffic congestion on Highway 99/major streets.” As part of the impartial analysis for Measure L provided by the Stanislaus County Counsel, it was noted that Measure L creates an “Oversight Committee to review and monitor use of all tax revenue and to ensure that all funds are spent in accordance with the Expenditure Plan.” The ballot materials that were before the voters, stated that the functions of the Oversight Committee were to “review and monitor use of all tax revenue and to ensure that all funds are spent in accordance with [StanCOG’s] Expenditure Plan.” StanCOG adopted Ordinance #16-01 on June 22, 2016. This ordinance, known as the “Measure L: Local Roads First Transportation Funding Measure” established and implemented a retail transaction and use tax. Section 18 of Ordinance #16-01 established a Measure L Oversight Committee. Pursuant to the StanCOG Ordinance, this Committee “is responsible for oversight of the proper use of sales tax funds and implementation of the programs and projects set forth in the Expenditure Plan and making recommendations to the Board of the Authority.” The Committee is made up of one representative from Stanislaus County and one from each of the nine cities within Stanislaus County, including a representative from the City of Modesto. On October 4, 2016, Council approved Ordinance No. 3656-C.S. adding Chapter 10 to Title 8 of the Modesto Municipal Code to establish a Citizens’ Transportation Sales Tax Commission (Commission). The Commission was established for the purpose of providing oversight of the collection and spending of tax revenue from any local transportation sales tax specifically focused on the Modesto projects and spending. Pursuant to Citizen’s Transportation Sales Tax Commission Ordinance 3656-C.S. and adopted Bylaws, the Commission shall consist of eleven (11) qualified city residents. Strong consideration shall be given to composing the Commission of:
• 2 members from any bona fide local taxpayer’s association, • 1 member from any bona fide local nonpartisan political organization, • 2 members from bona fide Modesto Neighborhood Associations, • 1 member from any bona fide association representing business, • 1 member from a large business located in the City,
• 1 member from a small business located in the City,
• 2 members from a bona fide labor union with members residing in the City, • 1 member from a former Stanislaus County Civil Grand Jury who has served in that role within the previous 5 years of his or her appointment.

On April 11, 2023, City Council approved Resolution No. 2023-169 adopting the Bylaws for the Measure L Citizen’s Transportation Sales Tax Commission. The adopted Bylaws provide the terms of office and allow for the reappointment for up to two terms.

HISTORICAL BACKGROUND
• In 1954, the Library Board was established to advise on matter related to the McHenry Public Library. Both the City of Modesto and Stanislaus County were engaged in supporting the library. In the early 1960's after a campaign to attract and promote cultural and community activities, it was renamed the Library and Culture Commission and had the Central Valley Art League, and the Citizens’ Cultural Center Committee.

After the opening of the Modesto-Stanislaus Library in 1971 and the McHenry Museum in 1974, the name was shortened to Modesto Culture commission. Since its inception, and perhaps due to the earlier agency collaboration, the Culture Commission has included a mix of Modesto residents and Stanislaus County residents. The current ratio is five City and two County.

2024 CALENDAR YEAR
Each Commission is required to provide an update to the Appointments Committee and City Council about its activities through an Annual Report. The Annual Report for Citizen’s Advisory Groups is to be completed at the end of each Calendar Year. The following template includes suggested sections but is meant to be used as a guide and does not preclude a Commission from including additional Information.

Sarah Aaronson, Vice Chair Amanda Heitlinger, Member
Julie Betts-Albert, Member Esparanza Vargas, Member
Paul Adams, Member

MISSION STATEMENT
• Each year, the Modesto Downtown Improvement District (DID) will execute a small number of high-impact projects that are strategic for downtown businesses and the overall downtown. Additionally, the board and executive director will hold a fundraiser once per year. The fundraiser and high-impact projects will be determined at the board's annual offsite strategic planning session. The executive director shall be formally evaluated at the offsite session, with primary consideration given to the director's success in implementing the prior year's projects.

BOARD ROLES
• Advising the Council and making recommendations as to how the revenue derived from the additional levy of license tax imposed by Title 6, Chapter 3 of the Modesto Municipal Code this chapter shall be used within the scope of the purposes set forth in Section 6-3.09 of this chapter, and to have and perform such other powers and duties as the Council may determine.

HISTORICAL BACKGROUND
• The DID Advisory board was first established via ordinance in 1966 with the creation of the business improvement district which levies an additional mill tax on businesses operating within district boundaries.

For many years this body brought forward recommended expenditures for approval by the City Council, however in 2020 it was determined that the DID organization should function similarly to the Downtown Modesto Partnership and this resulted in the DID formally incorporating as a 501 (c)(3) non-profit organization, with a memorandum of understanding also being approved to provide annual payments of the DID tax to the newly formed organization. Appointments to the board are approved directly by the City Council based on the recommendation of the current DID board members. 49 #1..

CITY OF MODESTO

COMMITTEE AGENDA REPORT
DATE OF MEETING:

March 5, 2025
Date: February 3, 2025
TO: Appointments Committee
Eric Alvarez, Chair
Rosa Escutia-Braaton, Vice Chair
Jeremiah Williams, Member
THROUGH: Joseph P. Lopez, City Manager
FROM: Bill Sandhu, Director of Public Works
SUBJECT: Four Appointments to the Blight Abatement Advisory Committee CONTACT: Myriah Hill, Solid Waste Supervisor, [email protected], 209-577-5495 DESCRIPTION:

Consider the appointment of four vacancies to the City of Modesto Blight Abatement Advisory Committee for a four-year term with an expiration date of December 31, 2028, and forwarding to Council for approval. (Funding Source: Not Applicable)
STRATEGIC PLAN ELEMENT:

The recommended action supports the City’s Strategic Plan Area of Focus: Governance and Service Delivery: “build community trust in City government through responsive, transparent, and efficient service delivery”; Goal I: “promote trust and engagement between the community and the City.”
BACKGROUND:

The City of Modesto experiences blight in both public and private spaces. This includes illegal dumping of trash and large items such as mattresses, appliances, tires, green waste, vehicles, machine parts, illegal encampments, tagging, broken windows, unkempt properties, abandoned shopping carts, inoperable vehicles, and overgrown yards and properties. All contribute to blight in our community and can result in environmental, health, or safety issues for Modesto residents.

In 2019, during the Strategic Planning sessions with community members, a major theme was dissatisfaction regarding blight throughout the City. In December 2019, by Resolution 2019-555, City Council approved the Blight Abatement Strategy, which included the creation of a blight abatement taskforce comprised of public and private stakeholders that were charged with making recommendations to the City regarding program improvements, potential funding opportunities, and support increased volunteerism.

Four Appointments to the Blight Abatement Advisory Committee

Page 2 of 3 ends

On October 13, 2020, by Resolution 2020-428, City Council approved the formation of the Blight Abatement Advisory Committee (BAAC) and solicited membership of the committee’s nine voting members. According to the Blight Abatement Strategy and the BAAC bylaws, the group acts in an advisory capacity to the City Council and City Manager in matters pertaining to blight and blight abatement efforts, promoting public engagement, blight program improvements, and potential related funding and volunteer opportunities.

DISCUSSION:

The BAAC is made up of seven Committee members who reside in Modesto, two members who reside in Stanislaus County, and one non-voting member appointed from City Council.

Currently, the BAAC has four vacancies, two of which are for Modesto residents and two for Stanislaus County residents.

During a recent revitalization of the BAAC, the City’s Community and Media Relations Team led a 6-week online recruitment campaign beginning on July 14, 2024; staff posted information about the committee to social media and contacted community groups directly as part of this campaign. This was a strategy designed to generate interest and encourage community members to apply. Since this push, the City has received 14 applications of which 13 are eligible to hold the position for registered electors of Modesto. No applications were received for the two vacant positions for registered electors of Stanislaus County. On February 5, 2025, by Resolution 2025-54, City Council approved an update to the BAAC bylaws that states that “in the event that no applications are received for the County positions, a registered elector of the City may be elected to fill the positions for one term.” Of the 13 qualified candidates, two have been appointed to the Committee and 11 remain for consideration. Having no applications for County positions, these vacancies will be filled by the available candidates. These candidates were presented at the December 19th meeting to BAAC Members via the applications matrix. The Committee is recommending that the four vacancies be filled by the following candidates:

For the two vacant positions for registered electors of the City of Modesto, Kathryn Boyer-Hall and Joshua Navarro are being recommended by the BACC. Kathryn has been involved in community beautification for years and has attended BAAC meetings in the past. Joshua has been actively involved in the community and has exhibited great leadership in his work.

For the two vacant positions for registered electors of Stanislaus County, to be filled by registered electors of the City for one term, Jack Leguria and Jeremy Brown are being recommended by the BAAC. Jack has experience in cleanups of blighted areas and is a property owner in downtown Modesto. Jeremy has attended BAAC meetings in the past and has an extensive network and history within the community.

FISCAL IMPACT:

Appointing members to a committee is administrative in nature, and therefore, does not have a fiscal impact.

RECOMMENDED COMMITTEE ACTION:

Staff Recommendations:

Very involved in my children's schools but otherwise have kept to myself Our city is in dire need of up keep in certain areas. Taxes be damned, it's entirely unfair that nicer parts of town get upgrades before lesser parts of town. May as well tell the poor kids you won't have anything in life without money or living in a nicer area.

All I have is the passion. I have 0 experience other than serving on PTO boards. #2..

I have a great attention to detail from working in dispatching, while also being great at crisis management when the time comes and I'm need to fulfill my duties as a dispatcher. Also when it comes to articulating my points across to other I've accomplished great works in these fields.

I've helped clean the streets of Modesto before when I was younger, also helping with Love Modesto back in 2012 when I was still in school. Also when I get the chance I tend to help the homeless I would like to start up a group that helps provide essential materials to the community in need.

I am passionate about creating a positive impact on our community and addressing issues that affect our quality of life. After conducting my research and watching a couple of the meeting's this seems like a great committee to make the impact I would like to create for this community.

I have a great eye for attention to detail when it comes to pointing out better alternatives to already implemented solutions, with my great work ethic I feel I could make a great asset to this team.

I have known about Modesto's blight abatement efforts in the past (mostly from my time with MPD), but had not considered joining any city committees until I participated in the first ever Stanislaus County Political Leadership Academy. After the StanCoPLA, Megan Belair encouraged me to apply, stating I would be a good fit and be able to contribute in positive ways.

As a teenager, I had the opportunity to participate in numerous service projects in West Modesto focused on assisting our community neihghbors with projects they were unable to complete due to health issues or a lack of financial/material resources. In my adult life, my wife and I had the privilege of getting involved with an organization called Safe Families for Children which aims to keep families together through temporary periods of crisis by offering respite childcare. As a father raising my children in Modesto, I am looking for more opportunities to get involved in community activities and civic organizations in order to positively contribute to our community and demontrate the importance of civic participation and service to my children.

I am interested in participating the Blight Abatement Committee because I truly believe our city can continue growing while simultaneously working together to make Modesto a place where it's community neighbors thrive in peace and prosperity. Studies have shown the physical environment in which a person lives has a significant effect on that person's wellness and sense of belonging in a community. I want our city to be a place where people belong and are able to experience wholistic wellness. We need to do more to foster a city of beauty and peace.

First and foremost, I was born and have grown up in Modesto. My wife and I are now raising our three children here. As a long time resident, I know Modesto has experienced some pains associated with growth. The amount of trash and debris visible today is one obvious symptom. Yet, fond memories of Modesto and the pride it's citizens have had are still within reach. I also have the opportunity to regularly meet people from all walks of life as a Chaplain working at Doctors Medical Center. My role provides me with opportunities to learn about people from different cultures, enconomic levels, relgions, and everything in-between. As a result, I know what it takes to stop, listen, and learn from others in order to work towards an outcome which will benefit the most people possible. Additionally, for approximately four years (when I was much younger) I worked for the Modesto Police Department as a Police Assistant, and then later on as an Animal Control Officer. Needless to say, I spent many hours on the streets of Modesto interacting with our community neighbors, getting to know some of the challenges our city faces up close and personal. I believe our city still has so much potential to be a place where our neighbors, their loved ones, and families thrive in an environment which is clean, beautiful, and peaceful. I believe the challenges our city faces related to blight need solutions which are born out of relationship. Our community neighbors may not begin to care more for our city until they know how much they are care about.

I have been working with the Patterson Unified School District for 8 years in the after school program. While working in the after school program I have gathered students and we have participated in community service, collaborating with the City of Patterson and either planting trees, community cleanups, or taking in part of our Arbor Day celebrations. Aside from our collaboration with the city I formed a Green Initiative with the district and created a Green Team where we reduced our carbon footprint by 74% within a school year.

I have been actively involved in community activities and civic organizations, partnering with the city of Patterson Recreation Department to incorporate our community garden into local schools. Additionally, I have collaborated with Host House and the United Community Foundation in Grayson. As the Patterson Unified Green Team ambassador for the expanded learning program, I have established green teams at each school site within our district. These teams address environmental issues, work with site administrators, and contribute to campus beautification and cleanup efforts.

What interest me in this position is to be apart of a bigger mission and serving my community and its needs. I love living in Modesto and serving my community and if I can get the chance to be apart of a bigger effort in making sure Modesto is clean and a safe community for everyone, I’d love to be apart of that mission.

I’d bring a wealth of qualities, experience, and expertise to the Board, Commission, or Committee. My deep-rooted commitment to community engagement and environmental sustainability is evident through my partnerships with the city of Patterson Recreation Department, Host House, and United Community Foundation in Grayson. As the Patterson Unified Green Team ambassador, I have successfully led initiatives that established green teams across the district, focusing on environmental issues and campus beautification.

My leadership in these roles demonstrates my ability to collaborate effectively, implement sustainable projects, and engage with diverse stakeholders.

Additionally, my lifelong residence in California and my dedication to addressing key state issues equip me with a comprehensive understanding of the community's needs and the innovative strategies required to address them. #2..

I worked for a non-profit for a many years in the past, I served on our long-term planning committee. I also attended every board meeting as well as public functions while working as a program manager for a Day program that served adults with developmental disabilities.

I'm very passionate about the people in our community in Modesto and Stanislaus county. I was a member of the Latino community round table for a few years in the past. I worked for Howard training center for many years and was greatly involved in the community while working there.

I was born and raised in Modesto, I've raised my children here and I'm currently a grandmother. So I've seen this city develop over the last 44 years, you know and I just can't complain about anything unless I am trying my best to make it better.

I'm dedicated, observant, unbiased and believe very much so in cultural diversity.

I grew up in the county maintained area so there was no sidewalks or city sewer, I have lived in some of the less desirable areas of Modesto, every morning I pass the homeless shelter on my way to work. I participate in the love Modesto is frequently as I can. And I try to be engaged in community activities, and want this city to be a cleaner better place not just for me and my family, but for everyone else in their family as well. And I know we need people that are dedicated to our community not just criticizing but enabling and uplifting for a better positive outcome.

CITY OF MODESTO

COMMITTEE AGENDA REPORT
DATE OF MEETING:

March 5, 2025
Date: February 3, 2025
TO: Appointments Committee
Eric Alvarez, Chair
Rosa Escutia-Braaton, Vice Chair
Jeremiah Williams, Member
THROUGH: Joseph P. Lopez, City Manager
FROM: Bill Sandhu, Director of Public Works
SUBJECT: Airport Advisory Committee, Appointment of Christopher Fox CONTACT: Marisol Navarro, Airport Manager, [email protected] 209-577-5319 DESCRIPTION:

Consider the appointment of Christopher Fox to the Modesto City-County Airport Advisory Committee for a four-year term with an expiration date of June 30, 2029, and forwarding to Council for approval. (Funding Source: Not Applicable)
STRATEGIC PLAN ELEMENT:

The recommended action supports the City’s Governance and Service Delivery Strategic Plan Initiative: Build community trust in City government through responsive, transparent, and efficient service delivery; Goal I: “Promote trust and engagement between the community and the City.”
BACKGROUND:

The Modesto City-County Airport (Airport) operates for the benefit of all businesses, industries, visitors and residents in the City of Modesto, Stanislaus County, and the surrounding areas. To ensure that the Airport is maintained and developed in such a manner that it will continue to be a high-quality aviation facility for its users and a good neighbor in the community, the Airport Advisory Committee (AAC) was formed. Interested citizens are appointed as members to the AAC by both the Modesto City Council and the Stanislaus County Board of Supervisors to advise on numerous matters, including policy and planning pertaining to the operation and management of the Airport.

DISCUSSION:

The Public-at-large position is currently vacant as the former member, James McKay, formally resigned on November 16, 2024. The AAC recently underwent an application process less than a year ago to fill the position of Small Aircraft Owner/G.A which was set to be vacant on May 30, 2024. We received applications from twelve candidates for this position. Due to the sudden #3..

resignation of James McKay and the recent number of AAC applications received, staff decided to ask the applicants who were not chosen for the position of Small Aircraft owner if they would consider the Public-At-Large role, and four applicants expressed interest.

At the last Airport Advisory Committee meeting on January 16, 2025, a redacted matrix detailing all applicant entries was provided to the committee and reviewed to be voted on. The AAC selected Christopher Fox as the most qualified candidate for the position.

Christopher has been a pilot and user of the Modesto Airport for the last five years. He is a frequent user of the services and businesses at the Airport as well. Christopher is enthusiastic and passionate about aviation with a deep appreciation for the aviation community in Modesto.

He is committed to fostering its growth and is eager to see the airport expand.

FISCAL IMPACT:

Appointing members to a committee is administrative in nature, therefore, does not have a fiscal impact to the General Fund.

RECOMMENDED COMMITTEE ACTION:

Staff Recommendations:

Motion recommending the appointment of Christopher Fox to the Airport Advisory Committee for the position of Public-At-Large for a four-year term with an expiration date of June 30, 2029, and forwarding to Council for approval.
