In addition to the sewer trunk segments on Grimes and Mercy, various trunks measuring between 12 and 27 inches in diameter will be rehabilitated on Woodland Ave. and Emerald Ave.
Furthermore, sewer mains and trunks consisting of 8-, 15-, and 18-inch diameter pipes will be upgraded on High St., Coffee Rd., and Scenic Dr., all in line with the Wastewater Collection System Master Plan.
DISCUSSION:
The project was advertised for bids on November 19, 2024. Bids were publicly opened on January 21, 2025, pursuant to City Charter Section 1307 and SAK Construction, LLC, of O’Fallon, MO, was the lowest responsive and responsible bidder.

Percent Low Bid is Below the Engineer’s Estimate 34.77% Modesto Municipal Code Section 8-3.203 generally requires all purchases, which meet or exceed $100,000 for material, equipment, or contractual services to follow the formal bid procedures. The award of a Contract for the construction of the Sewer Trunk Rehabilitation on Grimes, Mercy and Woodland to SAK Construction, LLC, of O’Fallon, MO, conforms to the Modesto Municipal Code because the City complied with the formal bid procedures and SAK Construction, LLC was the lowest responsive and responsible bidder.
The City’s “Change Order Approval Policy” enacted by Council Resolution No. 1994-443 on July 19, 1994, revised on July 9, 2019, by Council Resolution No. 2019-326 and revised a second time on September 12, 2023, by Council Resolution No. 2023-405 established a Contract change order authority of 8% for Construction Contracts of this dollar value. However, after reviewing the plans and specifications, and given the nature of this project where unforeseen utilities or buried structures, and other unaccounted for issues may arise, it is likely that this Project could exceed the Director’s Authority of 8% ($1,826,424) of the Construction Contract amount of $22,830,295. Therefore, staff is requesting that the Director’s Authority to issue change orders to be increased to 12% ($2,739,636) of the Construction Contract amount.
While the contingency policy is utilized for each Construction Contract awarded by the City, it is not written in each contract, nor is it a guaranteed amount included in the final compensation to the contractor.
FISCAL IMPACT:
The total estimated cost for the Construction Phase of this Project is $27,219,931. Expenses associated with this effort are housed in the following Non-Capital Project:

Project Description: The purpose of this project is to extend the useful life of the City of Modesto’s West Trunk and Emerald Trunk Sewer Lines. The scope of this project will include CIPP lining of approximately 17,395 LF of 54-inch sewer trunk line along Mercy and Grimes Ave with a small additional portion along Paradise Road, 5,421 LF of 27-inch sewer trunk line along North Emerald and Woodland Ave, and 1,982 LF of 18-inch sewer trunk line along Woodland Ave. The project will also rehabilitate eighteen (18) 48-inch manholes and eight (8) 60-inch manholes with an epoxy coating system. Lastly, eight (8) 72-inch manholes will be added to facilitate the CIPP lining process.
