DESCRIPTION:
Consider a First Amendment to the Agreement with Mark Thomas & Company, Inc. for additional tasks related to Construction Documentation and Bidding & Construction Support for the Tuolumne River Regional Park (TRRP) Riverwalk Trail – Gateway to Neece Project, for a new total amount not to exceed $364,941 and forwarding to Council for approval. (Funding Source: Parks Capital Facility Fee Fund, Recreational Trails and Greenways Grant Program – Proposition 68)
STRATEGIC PLAN ELEMENT:
This item is consistent with the following 2025-2026 Strategic Plan Area of Focus: Quality of Life.
BACKGROUND:
The Tuolumne River Regional Park (TRRP) consists of 500-acres of riparian land within the City of Modesto and Stanislaus County. The park runs approximately 7-miles along the river’s edge stretching from the Mitchell Road bridge on the eastern boundary to just west of the Carpenter Road bridge on the western boundary.
In 1999, the TRRP Commission updated the original land use plan, which included preparation of a TRRP Master Plan and Master Environmental Impact Report (MEIR). The Master Plan and MEIR were developed over a two-year period and were certified by the TRRP Commission and adopted by Ceres City Council, Modesto City Council and County Board of Supervisors in 2001. #1..

Safety and Communities Committee, September 15, 2025
First Amendment to the Agreement with Mark Thomas & Company, Inc. for the Design of the Tuolumne River Regional Park (TRRP) Riverwalk Trail – Gateway to Neece Project
Construction of the Gateway Parcel development (the area on the north side of the river from the confluence of the Tuolumne River and Dry Creek to Highway 99) commenced in 2006.
Riparian habitat restoration activities have included construction of backwater channels, riparian terraces, wildlife areas, and river structure dam removal. Recreational construction activities have included an outdoor classroom, river observation deck, multiple Class 1 trails and pedestrian bridge installation.
The TRRP Riverwalk Trail – Gateway to Neece Drive Project will provide a new paved trail connection between the existing trail just below Highway 99 at the Gateway Parcel to the corner of Neece Drive and Rouse Avenue. The project will extend the active recreational use of the river frontage to the Neece Drive Boat Launch and is compatible for commuting uses between City employment centers and neighborhood destinations.
On January 10, 2023, by Resolution No. 2023-18, Council approved an Agreement with Mark Thomas & Company, Inc., for $263,257 plus 10% additional services of $26,326, for a total not to exceed $289,583 for the preparation of construction documentation for the TRRP Riverwalk Trail – Gateway to Neece Project.
DISCUSSION:
The original Agreement amount with Mark Thomas & Company, Inc., is for $289,583. Since the start of design in 2023, there has been one additional service request approved by the Department Director, as allowed in the Agreement, in an amount of $21,100. The additional service request included additional site topographic surveying.
In March of 2025, at the City’s request, Mark Thomas & Company, Inc., submitted a budget augmentation for additional tasks exceeding the $289,583 authorized in the Original Agreement.
The estimated additional tasks resulted in increased costs, totaling $62,584, to the following:
1. Additional Construction Documentation (including Geotechnical Investigation and Reporting).
2. Additional cost for Bidding and Construction Support beyond what was anticipated in the original Agreement.
Staff are recommending increasing the additional services budget to 12%, a total of $39,100, to allow the Department Director to approve any future additional services that are necessary. This will increase the total maximum compensation under this agreement to $364,941.
Modesto Municipal Code Section 8-3.203 generally requires all purchases, which meet or exceed $100,000 for material, equipment, or contractual services to be formally bid. However, exceptions to the formal bidding process are granted in MMC 8-3.204(f), “Where the Purchasing Manager, in his or her discretion, determines that it is appropriate to amend the services or goods provided under an existing agreement to include additional similar goods or services, of limited quantity or scope, in order to increase efficiency and avoid delays or disruptions to City projects or services.”

DATE OF MEETING:
September 15, 2025
Date: August 21, 2025
TO: Safety and Communities Committee
Jeremiah Williams, Chair
Chris Ricci, Vice-Chair
Rosa Escutia-Braaton, Member
THROUGH: Joseph P. Lopez, City Manager
FROM: Brandon Gillespie, Chief of Police
SUBJECT: Non-Emergency Transport Application for Quality Care Transportation CONTACT: Kalani Souza, Lieutenant, [email protected], 209-572-9500 DESCRIPTION:
Consider the application and issuance of a Permit to operate as a Non-Emergency Medical Transport Company to Quality Care Transportation in the City of Modesto and forwarding to Council for approval. (Funding Source: General Fund)
STRATEGIC PLAN ELEMENT:
This item is related to the 2025-2026 Strategic Plan Goal A Quality of Life of improving community safety and quality of life through a combination of prevention and intervention efforts that address safety and its underlying issues.
BACKGROUND:
The City of Modesto allows non-emergency medical transport companies to apply for a nonemergency transport permit. In addition to the application, the transport company is required to pay a filing fee of $1,000 and provide all the necessary documents and information as outlined in Modesto Municipal Code Sections 3-9.01 to 3-9.20. Once the application, documentation, and necessary fees have been received by the Modesto Police Department (MPD), a background investigation must be completed by the department. Upon a successful completion of the background investigation, the application proceeds to a hearing before the City Council to determine whether the public convenience and necessity require the proposed service. The Council must grant the applicant a permit upon making the following findings:
(a) That the vehicles described in the application and proposed to be used are appropriate for the purpose of nonemergency transport;

Non-Emergency Transport Application for Quality Care Transportation
(b) That the color scheme, insignia, name, monogram or other distinguishing characteristics proposed to be used upon such nonemergency transport vehicles is not in conflict with and do not imitate any color scheme, insignia, name, monogram or other distinguishing characteristics used by any other person, in such manner as to mislead or tend to mislead, deceive, or defraud the public;
(c) That the applicant is fit, willing and able to perform nonemergency transport service and to conform to the provisions of this chapter, and such rules and regulations as may be promulgated by the Council. In making such findings, the Council shall take into consideration the character, experience, and responsibility of the applicant; (d) That the proposed nonemergency transport service is required by the public convenience and necessity. In making such finding, the Council shall take into consideration the number of nonemergency transport vehicles already in operation, whether existing nonemergency transport service is adequate to meet public need, and the probable effect of increased nonemergency transport service on local traffic conditions; and (e) None of the factors enumerated in Section 3-9.07 of the Modesto Municipal Code exist, such as misleading color schemes, disqualifying background factors, and proof of insurance.
After approval from Council has been provided, the permit will be issued by the Modesto Police Department.
Currently there are fifteen permitted ambulance companies in Modesto to provide non-emergency transport: Allstar Ambulance, America West, Amwest Ambulance, Bay Medic Transportation, Citizens Medical Transport, Heavenly Medical Transport LLC, MacIntosh Transport LLC, Medics Plus, NorCal Ambulance, Mediwest Non-Emergency Medical Transportation, Provident Senior Solutions, Inc, Quality Care Transport Inc, Rose Medical Transportation, Star Nonemergent Transportation and Trauma Life Care & Medical Transport.
DISCUSSION:
Quality Care Transportation has applied to operate a non-emergency medical transportation service in the City of Modesto. Quality Care Transportation has paid the $1,000 filing fee to cover administrative, investigative, and other incidental costs associated with the application and have provided all necessary information as outlined in Sections 3-9.01 to 3-9.20 of the Modesto Municipal Code. Photos of the proposed vehicles were provided. They depict vehicles that are appropriate for their intended use, and the vehicle color and markings are not misleading. In reviewing the application and subsequent background, it appears the applicant can perform the proposed services, and these services benefit the public convenience and necessity based on the number of licensed providers currently operating in the city. There are no disqualifying factors at this time. The MPD concluded the required background investigation on Quality Care Transportation indicating the applicant has complied with the requirements contained in Modesto Municipal Code Sections 3-9.01 through 3-9.20 and recommends issuing the operational permit. #2..

CONTACT: Nathan Houx, Parks Planning and Development Manager, [email protected], 209-571-5526
DESCRIPTION:
Consider a follow-up report on upcoming Parks Planning and Development Division Playground Replacement Projects planned for bidding and construction. (Funding Source: Measure H) STRATEGIC PLAN ELEMENT:
This item is consistent with the following 2025-2026 Strategic Plan Area of Focus: Quality of Life.
BACKGROUND:
In 2017, Council requested that individual Capital Improvement Program (CIP) Projects from the various departments be presented to a standing committee prior to being presented to Council for consideration of award. To reduce the number of committee reports and improve efficiency, staff prepares a report about every six months to provide an update on upcoming Parks Planning and Development CIP Projects that are anticipated to be bid and presented to Council for award within the next six to twelve months.
On August 11, 2025, staff presented a report regarding upcoming Parks Planning and Development CIP Projects that are anticipated to be bid and presented to Council for award within the next six to twelve months. As part of the update, there were two playground replacement projects: Measure H 2024 – Playground Replacement at Coleman Brown Park and Measure H 2025 – Playground Replacements at Three Parks. The Committee examined the projects and requested that staff return to the Committee with more information regarding existing shade and considerations for increasing the shade for these playground replacement projects. #3..

Park Playground Replacement Follow Up Report
DISCUSSION:
As a follow up to the August 11, 2025, Safety and Communities Committee item the following parks playground replacement projects are anticipated to be bid and presented to Council for award within the next six to twelve months.
Measure H 2024 - Playground Replacements at Coleman Brown Park (101517) This project involves the replacement of the playground at Coleman Brown Park. This was part of the eight playgrounds that were funded by Measure H in the 2024 budget, six of which are completed. This project is expected to be out to bid by the end of fall 2025 and is expected to use the remaining budget in the Measure H Playground Replacements account for 2024.
Design: $50,000
Construction Budget: $541,000
Contingency: $54,100
Construction Administration: $54,100
Bid Support/Engineering Support During Construction-City: $20,800 TOTAL: $720,000
Measure H 2025 - Playground Replacements at Three Parks (101603) This project involves the replacement of playgrounds at three City parks: Eisenhut Park, Sutter Park and Brewer’s Rose Park. This project is expected to be out to bid in summer 2025. There is currently $1,350,000 budgeted for this project and staff anticipate that an additional $50,000 of funding will be necessary to award a construction contract for this project. Staff will identify additional funding options prior to this item being forwarded to City Council for consideration.
Design: $10,000
Construction Budget: $1,214,003
Contingency: $78,910
Construction Administration: $78,910
Bid Support/Engineering Support During Construction-City: $18,210 TOTAL: $1,400,033
The existing playgrounds have very limited shade. During design of these four playgrounds staff worked with the play equipment manufacturers to provide some custom playground designs that increase the shade available at these four neighborhood parks. Staff will provide a presentation at the meeting to detail how the shade available will be increased at each of these parks and will also present some options on additional efforts and the associated costs that could be incorporated into these projects if desired.
A quick summary of the efforts to date is that staff has been able to increase the amount of shade on the play structures in the middle of summer (July 1st at 1pm) in a cost-effective way from limited to a minimum of 20% of the playground surfaces. The percentages of shade are higher as you move closer to spring and fall and as you move early or later in the day. Staff will provide graphics to illustrate the efforts to date and will provide details of what could be done to increase shade options on these four playgrounds.
FISCAL IMPACT:
Once bids are received and evaluated for responsiveness, staff will present these items to Council #3..
