COMMITTEE AGENDA REPORT
DATE OF MEETING:
January 12, 2026
Date: October 13, 2025
TO: Safety and Communities Committee
Chris Ricci, Chair
Rosa Escutia-Braaton, Vice-Chair
Jeremiah Williams, Member
THROUGH: Joseph P. Lopez, City Manager
FROM: Brandon Gillespie, Chief of Police
SUBJECT: Authorization to Use Proceeds, Credits, or Reimbursements from Expended Shell Casings Toward the Purchase of Ammunition
CONTACT: Jessica Nicholson, Police Administrator, [email protected], 209-572-9500
DESCRIPTION:
Consider the use of proceeds, credits, or reimbursements, from the sale or recycling of expended brass shell casings, with any vendor providing such services, including the existing credit of $16,990 with Miwall Corporation, Grass Valley, CA, to be applied toward the purchase of new ammunition for the Modesto Police Department, and forwarding to Council for approval. (Funding Source: Not Applicable)
STRATEGIC PLAN ELEMENT:
This item is related to the adopted City Council 2025-2026 Strategic Plan for Governance and Service Delivery by building community trust in city government through responsive, transparent, and efficient service delivery.
BACKGROUND:
The Modesto Police Department operates a Tactical Gun Firing Range at 3000 West Main Street, Turlock, California where law enforcement personnel routinely conduct firearms training and proficiency exercises.
As part of this ongoing training, expended brass shell casings are collected and provided to third-party vendors or recycling facilities in exchange for monetary proceeds, credit, or reimbursement. These proceeds, credits, or reimbursements may be applied to offset the cost of future ammunition purchases.
For many years, the Department has utilized Miwall Corporation for recycling of expended brass. To the knowledge of staff, Miwall Corporation is the only organization that exchanges the #2..

Safety and Communities, Committee, January 12, 2026
Authorization to Use Proceeds, Credits, or Reimbursements from Expended Shell Casings Toward the Purchase of Ammunition
expended brass for live ammunition, other organizations are focused on recycling only.
Currently, the Department maintains a credit balance from prior brass exchanges valued at approximately $16,990 with Miwall Corporation, Grass Valley, CA; however, this balance cannot be used until the City Council authorizes its allocation outside of the General Fund, due to the Modesto Municipal Code requirements governing surplus property sales.
DISCUSSION:
Modesto Municipal Code Section 8-3.501(d) requires that proceeds from the sale of surplus property be deposited into the General Fund, except where established accounting procedures require the deposit of proceeds in some special fund of the City.
The Police Department is requesting authorization for an exception to this requirement to allow any proceeds, credits, or reimbursements received from the sale or recycling of expended shell casings, with any vendor providing such services, to be directly applied toward the purchase of new ammunition for the Department, rather than being deposited into the General Fund.
FISCAL IMPACT:
There is no fiscal impact to the General Fund, as the Department would be using credits, reimbursements, or proceeds earned through the recycling of spent materials to purchase ammunition.
RECOMMENDED COMMITTEE ACTION:
Staff Recommendations:
Motion recommending the use of proceeds, credits, or reimbursements, from the sale or recycling of expended brass shell casings, with any vendor providing such services, including the existing credit of $16,990 with Miwall Corporation, Grass Valley, CA, to be applied toward the purchase of new ammunition for the Modesto Police Department, and forwarding to Council for approval.
