DISCUSSION:
The Coffee Road Pavement Rehabilitation Phase II Project was advertised for bids on February 6, 2026. Bids were publicly opened on March 3, 2026, and United Pavement Maintenance, Inc., of Hughson, CA, was the apparent low bidder. The bid tabulation is attached (Attachment 1).
The bid analysis is:
Number of responsive bids received 6
Number of bids within 10% of the engineer’s estimate 6
Number of bids above the engineer’s estimate 1
The bid from United Pavement Maintenance, Inc., is 7.35% below the engineer’s estimate. Staff determined that the bid is a reasonable bid for the project and bidder competition was evident, as the City received six (6) bids.
Modesto Municipal Code Section 8-3.203 generally requires all purchases, which meet or exceed $100,000 for material, equipment, or contractual services to follow the formal bid procedures. The award of contract for construction of the Coffee Road Pavement Rehabilitation Phase II Project, to United Pavement Maintenance, Inc., of Hughson, CA, conforms to the Modesto Municipal Code because the City complied with the formal bid procedures and United Pavement Maintenance, Inc., was the lowest responsive and responsible bidder.
While the contingency policy is utilized for each Construction agreement awarded by the City, it is not written into the agreement, nor is it a guaranteed amount included in the final compensation to the contractor.
The City’s “Change Order Approval Policy” enacted by Council Resolution No. 1994- 443 on July 19, 1994, and revised on July 9, 2019, by Council Resolution No. 2019-326, and revised a second time on September 12, 2023, by Council Resolution No. 2023-405 established a Contract change order authority of ten percent (10%) for Construction contracts of this dollar value.
FISCAL IMPACT:
Funding for this project is budgeted in Capital Improvement Project (CIP) accounts:
101314 – Coffee Rd. Pvmt Rehab Ph. II.
The project is being funded by Local Measure L funds.
