DESCRIPTION:
Hearing to consider approving the renewal of five (5) non-retail commercial cannabis permits for a two-year period ending June 30, 2028. (Funding Source: Annual Commercial Cannabis Permit Fee)
STRATEGIC PLAN ELEMENT:
This action supports the City of Modesto’s 2025-2026 Strategic Plan Area of Focus Goal E: Driving the success of a vibrant and economically sustainable business climate.
BACKGROUND:
In December 2017, the Modesto City Council adopted Ordinance 3684-C.S. (“Ordinance”) legalizing certain commercial cannabis business operations in particular zoning districts.
Since the development of the Ordinance, the City has approved eight (8) cannabis dispensary (retail) permits, and twelve (12) non-dispensary (“non-retail”) cannabis permits.
On April 13, 2021, by Resolution No. 2021-132, the Council established the Cannabis Permit Review Committee (“Committee”) and delegated the authority to approve nonretail and non-delivery cannabis businesses to that Committee. On March 1, 2022, by Resolution No. 2022-109, the Council expanded the role of the Committee to advise the #1.

Cannabis Program and Permit Review Committee, June 23, 2026 Non-Retail Commercial Cannabis Permit Renewals
Council on all cannabis-related issues, in addition to reviewing and approving nonstorefront and non-delivery commercial cannabis permits, and renamed the Committee, the Cannabis Program and Permit Review Committee.
On May 22, 2023, by Resolution No. 01-2023, the Cannabis Program and Permit Review Committee approved an extension of seven (7) non-retail commercial cannabis permitted businesses to June 30, 2024. This action created a single permit renewal date for all nonretail businesses while also aligning the renewal period with the City of Modesto’s fiscal year which runs from July to June. In addition to the extensions of the previously issued non-retail permits, on June 12, 2023, by Resolution No. 02-2023, the Cannabis Program and Permit Review Committee approved a commercial cannabis microbusiness permit for Fiji Weed Company, LLC to engage in cultivation, non-volatile manufacturing, and distribution at 1420 Granite Lane. Subsequently, on June 17, 2024, by Resolution No. 01- 2024, the Cannabis Program and Permit Review Committee approved the renewal of six (6) non-retail Commercial Cannabis Permits.
On November 19, 2024, by Resolution Nos. 2024-02, 2024-03, 2024-04, 2024-05, the Committee approved four (4) commercial cannabis permit applications for non-retail operations with the City of Modesto that were owned by individuals that participated in the City of Modesto’s Cannabis Program Providing Local Equity Development Grants and Education (PLEDGE). These four (4) businesses received a variety of benefits through the PLEDGE program including direct technical assistance and grant funding to assist with opening their businesses.
Non-Retail commercial cannabis permits have been issued to the following businesses since development of the Ordinance legalizing certain commercial cannabis business operations in particular zoning district within the City of Modesto:

DISCUSSION:
Since the issuance of the 12 non-retail permits, three (3) businesses are currently operational, while two (2) businesses are currently non-operational. Four (4) non-retail permit holders have voluntarily surrendered their permits, one (1) non-retail permit was revoked by the City due to noncompliance with the Modesto Municipal Code, and two (2) non-retail permits were not renewed due to the permittee’s failure to submit required renewal application materials.1
Valley Fire House, CLD, Nuggy, and Big Dipper Brands voluntarily surrendered their nonretail permits due to the significant costs associated with establishing operations, extended project timelines, and other operational challenges. Farm 209 Manufacturing, LLC and Power High 99, LLC are currently non-operational as they work toward meeting regulatory requirements, including completing tenant improvements or buildouts of their permitted locations.
Exclusive VIP, LLC’s permit, was revoked due to continued noncompliance with the City’s Municipal Code, including ongoing violations and the failure of the business to renewal the required State license. Exclusive VIP failed to comply with multiple provisions of the Article 7 of the Modesto Municipal Code (MMC) that governs Commercial Cannabis Uses within the City and has failed to correct the repeated cited MMC violations. These MMC violations include failure to maintain a compliant video surveillance system capable to retaining required recorded activity, which is in violation of MMC Section 10-
3.706(b)(2)(iv), and failure to meet required security standards, including the absence of self-closing and self-latching doors and improper placement and anchoring of a safe, which is in violation of MMC 10-3.706(b)(2). This business also failed to maintain a valid State license for commercial cannabis operations. Pursuant to Modesto Municipal Code Section 10-3.705(a)(2), the expiration of the State license constitutes a violation and 1 Voluntary surrender means the business has formally relinquished its City of Modesto Commercial Cannabis Permit and has ceased operations within the City. #1.

Cannabis Program and Permit Review Committee, June 23, 2026 Non-Retail Commercial Cannabis Permit Renewals
provides grounds for immediate suspension and revocation of the City-issued Commercial Cannabis Permit.
Considering these findings, on January 8, 2026, the City issued a Notice of Immediate Suspension and Notice of Intent to Revoke Exclusive VIP, LLC’s permit pursuant to Municipal Code Section 10-3.705. The notice provided the permit holders with the right to appeal the proposed revocation within ten (10) days of the notice date. The City received no appeal by January 18, 2026 deadline. Accordingly, and pursuant to Municipal Code Section 10-3.705, Exclusive VIP, LLC’s Commercial Cannabis Cultivation Type 1A Permit was revoked and terminated.2
Pursuant to Modesto Municipal Code section 10-3.704 (f)(5), commercial cannabis permits shall be valid for two (2) years. The City has established a permit renewal application process to provide guidance and supplement the payment of the annual fee with a structured permit renewal process. The renewal applications serve as a document updating procedure that requests the following pieces of information from each business that is up for renewal:
• Completed and signed Commercial Cannabis Business Permit Renewal Application.
• State license information to confirm the business is in compliance with State requirements including a copy of the State license with the Department of Cannabis Control and a copy of the most recent CA State license application. • Proof of a current lease or property ownership to verify that the location is secured throughout the permit period.
• Current employee roster which is used to check for potential discrepancies in approved City background check applications required before any individual can be employed in the cannabis industry.
• Proof of current insurance coverage.
• Business organization documents to confirm the current ownership structure of each business.
• Proof of a zero-balance due in City cannabis taxes and fees.
An updated permit renewal application was sent to business owners on January 22, 2026.
Updates to the application included requests for State licenses, State license applications, proof of valid lease or property ownership, a current list of employees, proof of current insurance, proof of zero balance due for City taxes and fees, business organization documents, as well as an optional demographic questionnaire. City Staff reviewed each application for completeness, and it was found that each business provided the required documentation necessary to move forward with the formal approval of the permit renewals by the Cannabis Program and Permit Review Committee. 2 A permit revoked under MMC Section 10-3.705 is permanently cancelled and no longer valid. #1.

The City issued multiple notices to both Modesto’s Finest, LLC and Que Tees, LLC regarding their outstanding renewal applications and supporting documentation. These notices were sent via certified mail and email on January 22, 2026, and February 27, 2026, followed by a final reminder and formal notice initiating the nonrenewal process on April 14, 2026. In response to the City’s initial notice, both permittees indicated that they did not intend to proceed with renewal and would instead submit an Affidavit for Surrender of City of Modesto Cannabis Permit (“Surrender Form”). However, neither completed renewal application nor a Surrender Form was received by the established deadlines of February 23, 2026, and March 20, 2026.
On April 14, 2026, the City issued a final notice reiterating the requirement to submit a renewal application and advising both permittees that failure to do so would result in the initiation of the nonrenewal process beginning April 17, 2026, pursuant to Modesto Municipal Code (MMC) Section 10-3.705. The notice also informed the permittees of their right to appeal the proposed nonrenewal within ten (10) days of the notice date. No appeal was received by the April 27, 2026 deadline. Accordingly, and consistent with MMC Section 10-3.705, the permittees have waived their right to appeal, and the nonrenewal of City of Modesto commercial cannabis permits issued to Modesto’s Finest, LLC and Que Tees, LLC is considered final.
The City also conducts annual financial audits of each operational business’ records.
The Cannabis consultant uses a standard set of data including accounting system data, California Department of Tax and Fee Administration (CDTFA) sales and use tax returns, Federal and State income tax returns, METRC data, financial statements, and bank statements. 3 The consultant utilizes this data to determine that the revenue each commercial cannabis business reports to the City is accurate and follows the Modesto Municipal Code.
Additionally, each operational business is inspected on an annual basis. On-site compliance inspections are conducted to ensure businesses are operating in compliance with Modesto’s Commercial Cannabis Ordinance and with State law. The City’s current cannabis consultant (HDL and Avenu Insights) performs an extensive observation of the business locations including, but not limited to:
• Ensuring proper storage of cannabis inventory in secured areas. • Verifying premises diagrams match the documents submitted to the State of California and the City.
3 METRC is Cannabis Compliance Tracking System and Software that uses RFID tags to monitor the legal cannabis supply chain from seed to sale, providing end-to-end supply chain visibility. Data is sourced from the METRC system and reported by licensed cannabis operators.

Cannabis Program and Permit Review Committee, June 23, 2026 Non-Retail Commercial Cannabis Permit Renewals
• Confirming proper visitor logs are kept and tracked for individuals who are not customers or employees.
• Observing whether the security requirements of the Modesto Municipal Code and Department of Cannabis Control (DCC) regulations are being followed. For example, the City requires non-dispensaries to maintain a security surveillance system which will retain a minimum of forty-five (45) days of footage which can be requested at any time by the Modesto Police Department. • Checking that all doors are secured with a self-closing and self-latching mechanism.
Compliance inspections and financial audits were completed for the operational non‑retail businesses. Farm 209, LLC is operational and successfully passed both its compliance inspection and financial audit. Fiji Weed also passed its compliance inspection but did not receive a financial audit because it recently became operational and has not yet generated sufficient reporting. Farm 209 (Manufacturing), LLC and Power High 99, LLC are not operational and therefore did not undergo a compliance inspection or financial audit. Legacy Nursery, LLC passed its compliance inspection, but a financial audit review is still pending completion with the anticipated completion date of Fiscal Year 2026-2027.
Accordingly, City staff recommends that the five (5) commercial cannabis permit under consideration are permitted a two (2) year term ending June 30, 2028.
On June 13, 2026, a public hearing notice was issued in the Modesto Bee in accordance with the MMC Section 10-9.201 regarding the consideration of five (5) non-retail commercial cannabis permits for a two-year period ending June 30, 2028. The permits under consideration were for Fiji Weed, LLC, Farm 209, LLC, Farm 209 Manufacturing, LLC, Legacy Nursery, LLC and Power High 99, LLC. In addition, on June 4, 2026, a public notice was also sent to all owners of real property shown on the latest equalized assessment roll within a radius of three hundred (300) feet of the exterior boundaries of the subject property in accordance with MMC Section 10-9.201. These notices included the hearing date, time, location, a description of the proposed project and subject property, and advised that interested person could review project materials and appear at the hearing to provide comment.
FISCAL IMPACT:
On May 13, 2025, by Resolution No. 2025-159, Council approved two (2) separate annual commercial cannabis permit fees which covers costs related to the administration and monitoring of the cannabis permits. Operational businesses remit $22,821 while nonoperational businesses are required to pay a lower fee of $3,991. The annual permit fee is reviewed and reconciled annually to capture increases or decreases related to administrative oversight of the cannabis permit program, and it is budgeted and recognized in the Cost Center 14471 in the Cannabis Fund. Per Modesto Municipal Code Article 11 (Cannabis Business Tax), a cannabis business tax is also paid based on total gross receipts which ranges from 1% to 4% for non-retail cannabis businesses. #1.
