PUBLIC COMMENT PERIOD
• A member of the public addressed the City's mask Ordinance and the federal court's preliminary injunction preventing its enforcement. The speaker argued the Ordinance infringes on First Amendment rights, referenced arrests at a 2025 protest that were later dismissed, contended the City ignored repeated warnings that the Ordinance was unconstitutional, and urged the City to acknowledge those concerns rather than continue defending the Ordinance.
• Anne Marie stated that previous public concerns about the City's mask Ordinance were validated by the federal court's ruling, asserting the Ordinance is unconstitutional and violates First Amendment rights. Anne Marie urged the City to repeal the Ordinance rather than continue litigation, expressing concern that doing so would unnecessarily expend taxpayer funds.
• Steve spoke in opposition to the City's mask Ordinance, stating he was assaulted while wearing a mask and arguing the Ordinance contributes to hostility toward protesters.

He also criticized the Modesto Police Department's actions in the death of Paul Chavez Jr., raised concerns about police accountability, and voiced opposition to the City's policies and ongoing defense of the mask Ordinance. • Bianca Lopez urged the City to discontinue litigation over the mask Ordinance and repeal it, arguing that continuing the case wastes taxpayer funds. She referenced portions of the federal court proceedings, asserting the judge questioned the City's enforcement of the Ordinance and expressed concerns about selective enforcement. • Greg Miranda requested that the City establish a 50% discount on golf fees and cart rentals for golfers age 90 and older. He stated the program would recognize longtime golfers, encourage seniors to remain active, and provide an incentive for golfers to continue playing into their 90s.
• Anthony Drobnick expressed support for the return of remote public comments, urged the City to repeal the mask Ordinance and discontinue further litigation, stating that continuing the case would waste taxpayer funds. He concluded his remarks by observing a period of silence to emphasize his point about wasted time. • Kevin McClarty asked for clarification regarding the reason for a reported 15% reduction in bus service funding and questioned whether litigation costs related to the City's mask Ordinance contributed to the reduction. He also asked whether the Modesto Police Department would protect residents from alleged misconduct by ICE agents and how that aligns with the department's mission to "protect and serve." - 4 -
7/14/2026 5:30:00 PM
• Harlan Diven thanked the City for restoring remote public comments and discussed the federal court's preliminary injunction against the City's mask Ordinance. Speaking as an attorney, Harlan stated the injunction indicates the court believes the legal challenge is likely to succeed, expressed concern that continued litigation would significantly increase costs, and urged the City to discontinue defending the Ordinance.
