DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW REASON FOR CONSIDERATION: The City Council is requested to consider adoption of Resolution No. 22–3383 certifying the results of the canvass of the November 8, 2022 General Municipal Election.
A copy of proposed Resolution No. 22–3383 is attached for the City Council's review and consideration.
BACKGROUND: The canvass of the November 8, 2022 General Municipal Election was completed on December 8, 2022. A summary of the results from the Registrar of Voters is attached and the Statement of Vote as Exhibit A to proposed Resolution No. 22–3383.
The following candidate was elected as Mayor for a term of four years:

Measure R
Shall the measure funding general Montclair services, including supporting 911/police/fire response; preventing thefts/property crime; recruiting/retaining firefighters, paramedics; retaining local business/jobs; repairing streets/potholes; addressing homelessness; by taxing cannabis retail, delivery, cultivation, manufacturing/testing businesses at a rate of not more than 7% of gross receipts, raising about $3,500,000 annually, until ended by voters, requiring audits, spending disclosure, funds used locally, cannabis businesses follow laws protecting public health/safety, be adopted?

RESOLUTION NO. 22–3383
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF MONTCLAIR RECITING THE FACT OF THE
GENERAL MUNICIPAL ELECTION HELD ON TUESDAY,
NOVEMBER 8, 2022, DECLARING THE RESULTS AND
SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of Montclair, California, on Tuesday, November 8, 2022, as required by law; and WHEREAS, notice of the election was given in time, form, and manner as provided by law, that voting precincts were properly established, that election officers were appointed, and that in all respects, the election was held and conducted and the votes were cast; received, and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, the Registrar of Voters has canvassed the returns of the election and has certified the results to this City Council; the results are received, attached, and made a part hereof as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Montclair, California, does hereby declare, determine, and order as follows:
Section 1. That the whole number of ballots cast for “Mayor,” was 5,496.
That the whole number of ballots cast for “Member, City Council,” was 8,381.
That the whole number of ballots cast for “Measure R,” was 5,659.
That the whole number of ballots cast for “Measure II,” was 5,692.
Section 2. That the names of the persons voted for at said election for “Mayor,” of said City were as follows:

That the names of the persons voted for at said election for “Member, City Council,” of said City were as follows:

Section 3. That the number of votes given at each precinct and the number of votes given at the City to each of the persons above named for the respective offices for which said persons were candidates are listed on "Exhibit A" attached.

Section 4. That the City Council does declare and determine that:
Javier “John” Dutrey was elected as Mayor of the City of Montclair for a full term of four years.
Bill Ruh was elected as Member of the City Council of the City of Montclair for a full term of four years.
Corysa Martinez was elected as Member of the City Council of the City of Montclair for a full term of four years.
As a result of the election, a majority of the voters voting on Measure R, related to a tax on gross receipts of cannabis businesses, did vote in favor of it and the measure was carried and shall be deemed adopted and ratified pursuant to Resolution No. 22– 3374.
As a result of the election, a majority of the voters voting on Measure II, an advisory measure related to the legalization of cannabis businesses in the City of Montclair, did vote in favor of it.
Section 5. That the City Clerk shall enter on the records of the City Council of the City of Montclair as Exhibit A to this Resolution a statement of the results of said election showing the following:
(a) The whole number of ballots cast in the City.
(b) The names of the candidates voted for.
(c) For what office each person was voted.
(d) The number of votes given at each precinct to each candidate. (e) The total number of votes given to each candidate.
(f) The names of the measures voted upon.
(g) The total number of votes given to each “yes” and “no” on the measures.
Section 6. That the City Clerk shall immediately deliver to each of the persons so elected a Certificate of Election, signed by the the City Clerk and duly authenticated, and shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe thereto and file the same in their office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected.
Section 7. That the City Clerk shall certify to the passage and adoption of this Resolution, shall enter the same into the book of original Resolutions of the City of Montclair, and shall make a minute entry of the passage and adoption thereof in the records of proceedings of the Montclair City Council in the minutes of the meeting at which the same is passed and adopted.
