CITY COUNCIL
AGENDA REPORT
DATE: DECEMBER 16, 2024
SECTION: PUBLIC HEARINGS
ITEM NO.: A
FILE I.D.: GPL225
DEPT.: COMMUNITY DEV.
PREPARER: M.DIAZ
SUBJECT: SECOND READING – CONSIDER ADOPTION OF ORDINANCE NO. 24–1009 REPEALING
THE NORTH MONTCLAIR SPECIFIC PLAN AND ADOPTING THE ARROW HIGHWAY MIXED–USE SPECIFIC PLAN (CASE NO. 2024–55)
SECOND READING – CONSIDER ADOPTION OF ORDINANCE NO. 24–1010 ADOPTING THE MONTCLAIR CORRIDORS CODE, AMENDING PORTIONS OF TITLE 11 (ZONING AND DEVELOPMENT) OF THE MONTCLAIR MUNICIPAL CODE; REPEALING THE HOLT BOULEVARD SPECIFIC PLAN AND THE MONTCLAIR PARKWAY PLACE SPECIFIC PLAN;
AND UPDATING THE OFFICIAL ZONING MAP OF THE CITY OF MONTCLAIR REASON FOR CONSIDERATION: The City Council is requested to consider adoption of the following:
1. Ordinance No. 24–1009 – Repealing the North Montclair Specific Plan and adopt the Arrow Highway Mixed–Use Specific Plan (2024–55); and
2. Ordinance No. 24–1010 23 adopting the Montclair Corridors Code, amending portions of Title 11 (Zoning and Development) of the Montclair Municipal Code; repealing the Holt Boulevard Specific Plan and the Montclair Parkway Place Specific Plan; and updating the Official Zoning Map of the City of Montclair.
The City Council’s adoption of these proposed ordinances would constitute the final action required to complete the City’s 2020 General Plan Update. A copy of each proposed ordinance is attached for the City Council’s review and consideration.
BACKGROUND: On December 2, 2024, the City Council conducted a public hearing on the 2020 Montclair General Plan Update and its implementing Specific Plans and documents. At the meeting, the City Council took the following actions:
Adopted Resolution No. 24–3463 certifying Final Environmental Impact Report (SCH No. 2020110481), adopting environmental findings of fact pursuant to the California Environmental Quality Act (CEQA), adopting a Statement of Overriding Considerations, and adopting the Mitigation Monitoring and Reporting Program; Adopted Resolution No. 24–3461adopting the 2020 City of Montclair General Plan, its mandatory and optional elements, and a General Plan Land Use Map; Adopted Resolution No. 24–3462 adopting the Montclair Climate Action Plan; Conducted the first reading of Ordinance No. 24–1009 repealing the North Montclair Specific Plan and adopting the Arrow Highway Mixed–Use Specific Plan (2024–55); and
Conducted the first reading of Ordinance No. 24–1010 adopting the Montclair Corridors Code, amending portions of Title 11 (Zoning and Development) of the Montclair Municipal Code; repealing the Holt Boulevard Specific Plan and the Montclair Parkway Place Specific Plan; and updating the official Zoning Map of the City of Montclair.
MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 5 of 120 The EIR, General Plan Update (including the Housing Element), and Climate Action Plan have been adopted. The implementing plans (AHMUD and Corridors Code) require second readings and adoption and will become final within thirty (30) days.
Adoption of Ordinance Nos. 24–1009 and 24–1010 is the final step in completing the 2020 Montclair General Plan Update project. The Ordinances are necessary to implement the land use and regulatory goals of the General Plan Update. Both the AHMUD and Corridors Code documents contain regulations and standards that are expressed through detailed text, maps, and diagrams that are consistent with the goals and policies of the General Plan Update. While the AHMUD and Corridors Code re– designate certain land uses to be consistent with the adopted General Plan Update, they also provide much more flexibility in the application of development regulations. For example, both documents include provisions that would allow for mixed–use development that currently does not exist for these respective planning areas.
Moreover, new standards regarding existing and new land uses, setbacks, building heights, parking, landscape, and signage, are intended to result in high–quality, distinctive, and attractive streetscapes.
Just as important, adoption of the AHMUD and Corridors Code completes the requirements imposed by the California Department of Housing and Community Development (HCD) for certification of the City’s Housing Element.
Relationship of Proposed Ordinances to Housing Element Requirements The Housing Element (6th Cycle, 2021–2029), was prepared and sent to HCD for review, in accordance with state law. On July 27, 2022, the City received a letter from HCD informing that they found the City’s Draft Housing Element met the statutory requirements of state housing law. HCD’s letter clarified that the Housing Element would substantially comply with Housing Element Law (Gov. Code § 65580 et seq.) when adopted. However, the HCD letter informed that the certification of the Housing Element is dependent on the adoption of the AHMUD Specific Plan and Montclair Corridors to ensure the 25 Housing Opportunity Sites identified in the Housing Element are zoned appropriately to accommodate the City’s Regional Housing Needs Assessment (RHNA) allocation established by the State.
Benefits of Housing Element Certification
Cities with a certified housing element maintain certain significant benefits. These include:
1. State Funding. If the housing element is certified, the City will become eligible to apply for certain state housing funds that require a compliant housing element as a prerequisite, including, but not limited to, the following:
Permanent Local Housing Allocation Program
Local Housing Trust Fund Program
Infill Infrastructure Grant Program
Senate Bill 1 Caltrans Sustainable Communities Grants Affordable Housing and Sustainable Communities Program
2. Reduces the Risk of Lawsuits. Certification of the City’s Housing Element reduces the risk that housing lawsuits will be filed against the City, including the following:
MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 6 of 120 A. Zoning Consistency with General Plan. California Government Code, 65860 requires the City to amend its zoning to be consistent with the general plan.
Failure to do so within a reasonable time, exposes the City to litigation.
B. Housing Law Compliance. Non–compliance with the State’s Housing Element requirements can be challenged directly in court by developers, third parties or individuals. Beyond private parties, HCD can also notify the California Attorney General (“AG”) of the City’s failure to comply with state housing element law. After receiving a referral from HCD, the AG can seek a court order directing the City to bring its Housing Element into compliance with state law. The AG can also ask the court to impose other penalties, including fines and court supervision over the City’s issuance of building, zoning, and subdivision approvals. However, certification of the Housing Element creates a “rebuttable presumption of validity” that the Housing Element complies with State law, which would be difficult to overcome and supports the City’s legal defense in any such lawsuit. (California Government Code Sec. 65589.3) Most severe, however, is that not having certification means that any land use application that relies on making findings of consistency with the City’s General Plan, may also be challenged. That is because every land use entitlement issued by the City (conditional use permit, variance, map, etc.) requires the Planning Commission or City Council to make findings. Those findings may be challenged as defective because the City’s Housing Element is not certified and does not have the “rebuttable presumption” of compliance.
C. Builder’s Remedy. Since 1990, the Housing Accountability Act (“HAA”) has included the so–called Builder’s Remedy, which can provide a path for developers of qualifying affordable housing projects to bypass city zoning regulations and General Plan requirements while the Housing Element is uncertified. A developer proposing an affordable housing project while the Housing Element is uncertified could rely on the builder’s remedy statute to bypass application of City zoning regulations and General Plan.

On December 2, 2024, the City Council certified the Final EIR, adopted the Mitigation Monitoring and Reporting Program for the project (SCH #2020110481), and adopted CEQA Findings of Fact and Statement of Overriding Considerations. A Notice of Determination was filed with both the County of San Bernardino Clerk of the Board on December 4, 2024, and with State Office of Planning and Research on December 5, 2024.
MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 7 of 120 Summaries of the proposed Ordinances were advertised in the manner specified in Government Code §36933(a).
Staff also sent electronic (e–mail) and mailed public hearing notices to all individuals who mailed and sent electronic requests to receive notice of actions taken by the City relative to the General Plan Update (Public Hearing Subscribers, General Plan Interest List, and CEQA Distribution List).
In addition, the meeting agenda was posted at designated posting locations at City Hall and on the City’s website.
FISCAL IMPACT: Long term, the General Plan Update will have a positive significant fiscal impact on the City, primarily through future revenue gains from potential new development spurred by the updated land use designations outlined in the plan and related land use documents, while also potentially creating additional costs for necessary infrastructure improvements to accommodate that growth.
RECOMMENDATION: The City Council is requested to conduct the second readings, by number and title only, and take the following actions:
1. Adopt Ordinance No. 24–1009 repealing the North Montclair Specific Plan and adopting the Arrow Highway Mixed–Use Specific Plan (2024–55); and
2. Adopt Ordinance No. 24–1010 23 adopting the Montclair Corridors Code, amending portions of Title 11 (Zoning and Development) of the Montclair Municipal Code; repealing the Holt Boulevard Specific Plan and the Montclair Parkway Place Specific Plan; and updating the Official Zoning Map of the City of Montclair.

of the North Montclair Specific Plan and the Holt Avenue Specific Plan, in accordance with the California Environmental Quality Act (Public Resources Code, §§ 21000 et seq., “CEQA”), the regulations promulgated thereunder (14 Cal. Code of Regulations, §§ 15000 et seq., the “CEQA Guidelines”). The Draft EIR was made available for public review for 45 days between July 26, 2022 through September 8, 2022. The document was made available online at the City of Montclair website and available for review at City’s Planning Division and Montclair Public Library in hard copy form. In response to comments received on the Draft EIR, the City prepared a Final EIR and released it to the public on November 7, 2024. The Final EIR (SCH No. 2020110481), adoption of findings under CEQA, and adoption of the Mitigation Monitoring and Reporting Program and the Statement of Overriding Considerations, and among other things, properly assesses the environmental impact of the Project in accordance with CEQA. This Ordinance incorporates by reference the environmental findings and analysis set forth in Planning Commission Resolution No. 24–2000 for the Final EIR (SCH No. 2020110481) as if fully set forth herein.
Section 2. Based on the entire record before the City Council, all written and oral evidence presented, and the findings made in this Ordinance, the City Council hereby repeals the North Montclair Specific Plan, in its entirety, and adopts the AHMUD Specific Plan as set forth in the attached Exhibit "A".
Section 3. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the AHMUD Specific Plan to be consistent with the 2020 General Plan Update of the City of Montclair ("General Plan Update") and systematically implements the goals and objectives of the General Plan Update for the following reasons:
A. The AHMUD Specific Plan includes diagrams that specify and promote an appropriate distribution, location, and extent of land uses, including open space, which is consistent with the diagrams contained in the General Plan Update. The AHMUD Specific Plan envisions a transformation of the existing area dotted with individual commercial and warehouse uses into a cohesive complete pedestrian–oriented neighborhood that builds on existing industrial uses. The plan also allow for the opportunity to introduce a mix of new and remodeled buildings to support small–scale manufacturing and supporting retail and office space, housing types, civic buildings, and recreational facilities to the area. The permitted uses and development standards adopted as part of the AHMUD Specific Plan would not be detrimental to present and potential surrounding uses, but would have a beneficial effect, which are not achievable under the provisions of the existing North Montclair Specific Plan that it replaces. For those reasons, the City Council finds the North Montclair Specific Plan should be repealed and replaced by the AHMUD Specific Plan as a land use document that more specifically promotes consistency with the General Plan Update.
B. The AHMUD Specific Plan promotes an appropriate distribution, location, and extent and intensity of major components of public and private transportation, sewage, water, drainage, solid waste disposal, energy, and other essential facilities proposed to be located within the Specific Plan area and needed to support the land uses within the Subject Site. The AHMUD Specific Plan builds off existing viable infrastructure already in place and as will supplemented by both public investment (e.g. open space, public street enhancements/facilities, etc.) and other improvements associated with private development projects. In addition, the AHMUD Specific Plan is consistent with the goals and objectives of the General Plan Update to enhance the City’s economic base by allowing a variety of compatible land uses.
C. The AHMUD Specific Plan is internally consistent and consistent with the General Plan Update’s standards and criteria for development, and standards for the conservation, development, and utilization of natural resources, where applicable. The AHMUD Specific Plan is set up to complement the General Plan Update and the goals and design standards and strategies of existing and recently adopted Specific Plans adjacent to its boundaries – the North Montclair Downtown Specific Plan (NMDSP) and the Montclair Place District Specific Plan (MPDSP). All these documents share common form–based code design standards and an emphasis on high–quality design and appropriate materials that will ensure consistency and guide the formation of a distinctive and attractive “downtown” streetscape and development pattern for the area.
D. The AHMUD Specific Plan includes and promotes the implementation measures including regulations, programs, public works projects, and financing measures necessary to carry out the policies of the AHMUD Specific Plan and General Plan Update. The success of the AHMUD requires the City’s economic development organizational structure to accommodate the management and monitoring of all associated initiatives. Under the guiding themes of transit–connected place making, MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 10 of 120 SECOND

diverse uses, and local entrepreneurship, the AHMUD Specific Plan can leverage economic development in coordination with citywide goals. The City will prepare for implementing changes in the AHMUD planning area by identifying and evaluating key sources of funding that can support specific initiatives, including the establishment of an Economic Development Fund to assist in jumpstarting economic development activities in the AHMUD. Such initiatives can include façade improvements, public programs (food trucks, street festivals, etc.), and district branding/marketing efforts.
The AHMUD also encourages the City to consider the opportunity to establish an Enhanced Infrastructure Financing District (EIFD)/ Community Revitalization & Investment Authorities (CRIA) to fund AHMUD infrastructure investments. In the longer term, a District–wide EIFD or CRIA can be used to reinvest increases in land values (from future development and a value premium created by transit) into infrastructure improvements in the AHMUD. This should be done in tandem with plans for the other areas, as referenced within the General Plan Update.
E. The AHMUD Specific Plan promotes greater design flexibility and encourages more economical and efficient use of land. The AHMUD seeks to create a distinct employment destination in proximity to the Metro Gold Line expansion to Montclair. A prosperous AHMUD is one that supports a variety of uses, fosters new and creative businesses in high–growth industries such as manufacturing and healthcare, and leverages transit connectivity to establish a unique experiential identity. The AHMUD outlines how the City can take steps to turn this economic development vision into reality through policies and prioritized investments that maintain consistency with the policies contained in the General Plan Update.
F. The AHMUD Specific Plan is consistent with the local Airport Land Use Plan and local Surface Mining and Reclamation Act policies. The nearest airport is Cable Airport in the City of Upland, which is adjacent to the northernmost portions of the AHMUD planning area. Although the Cable Airport Land Use Compatibility Plan (CALUCP) Noise Contour Map identifies possible noise impacts and safety hazards, the potential harm is considered to be less than significant and requires no mitigation (Source: Montclair 2020 General Plan Update and Arrow Highway Mixed–Use District Specific Plan DEIR, 2022). Further, development policies and opportunities are compatible with any such plans.
Concerning Mineral Resources, the AHMUD planning area is identified as a location where aggregate resources are present. However, the area is already developed and contains existing commercial and intensive industrial uses. Access to mineral resources in this area is highly constrained to the point that they are effectively unavailable. Most new development in the AHMUD will be adaptive reuse or smaller scale infill projects and the loss of access to mineral resources in the area would not be substantially increased. As a result, development policies in the AHMUD will be compatible with any existing mineral resource areas.
Section 4. The location and custodian of the documents and any other material which constitute the record of proceedings upon which the Planning Commission based its decision is as follows: Director of Community Development, Community Development Department, City of Montclair, 5111 Benito Street, Montclair, California 91763, or by telephone at (909) 625–9477.
Section 5. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MONTCLAIR HEREBY ORDAINS AS FOLLOWS:
SECTION 1. Recitals. The City Council hereby specifically finds that all of the facts set forth in the Recitals of this Ordinance are true and correct.
SECTION 2. Findings. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Corridors Code promotes the goals and objectives of the 2020 General Plan Update for the following reasons:
A. The Corridors Code provides for land uses that are compatible with the General Plan Update. Uses contemplated by the Corridors Code help promote and achieve the development of residential, mixed–use, and commercial projects according to the proposed policies and design guidelines of the Corridors Code. More specifically, the Corridors Code will be consistent with General Plan objectives for establishing and directing new growth for revitalizing the Central Avenue (south of the I–10 Freeway), Holt Boulevard, and Mission Boulevard corridors, into places where:
1. A mixture of land uses including shops, workplaces, and residences are within walking distance of one another and produce an urban form that is inviting, comfortable, safe, and ecologically resilient;
2. Streets and open spaces promote a vibrant, safe, healthy, and prosperous place; and
3. New infill and remodeled buildings work together with existing buildings to define the pedestrian–oriented space of the public streets within the Corridor Area.
B. Based on the entire record, including the staff report and public hearing comments and all written and oral evidence presented, the City finds the Montclair Corridors Code is reasonably related to the public welfare of the citizens of the City of Montclair and the surrounding region. The Amendment of Title 11 (Zoning and Development) of the Montclair Municipal Code and adoption of the Corridors Code promotes and allows for additional and rational development and increased housing opportunities in the City of Montclair using policies and development standards that are consistent with the Guiding Principles contained in the 2020 General Plan Update for a well–planned and prosperous community.

C. The Amendment of portions of Title 11 (Zoning and Development) of the Montclair Municipal Code and adoption of the Corridors Code is required to eliminate future policy and land use conflicts with the provisions of the new Corridors Code that supersedes existing zoning regulations. The Corridors Code provides new zoning district designations that replace the current AP, C2, C3, MIP, M1, and M2 zoning district designations contained in Title 11 (i.e., Chapters
11.24, 11.26, 11.28, 11.30, 11.32, and 11.34 respectively). The Corridors Code will be a standalone policy and regulatory document that will guide decisions to achieve future growth of parcels within the Corridors Code planning area. These amendments are necessary to implement the policies of the General Plan Update.
SECTION 3. California Environmental Quality Act. The City prepared a Draft Environmental Impact Report (“EIR”) that analyzed the General Plan Update, as well as updates to the Housing Element, Climate Action Plan, and development of the Arrow Highway Mixed–Use District Specific Plan and Montclair Corridors Code (collectively referred to as the “Project”), in accordance with the California Environmental Quality Act (Public Resources Code, §§ 21000 et seq., “CEQA”), the regulations promulgated thereunder (14 Cal. This Resolution incorporates by reference the environmental findings and analysis set forth in Planning Commission Resolution No. 24–2000 for the Final EIR (SCH No. 2020110481) as if fully set forth herein.
SECTION 4. Repeal of Specific Plans; Municipal Code Chapters & Adoption of Corridors Code; Amendment of Zoning Map.
A. Repeal. The City Council of the City of Montclair hereby repeals the Holt Boulevard Specific Plan and the Montclair Parkway Place Specific Plan in its/their entirety.
In addition, the City Council hereby repeals Chapters 11.24, 11.26, 11.28, 11.30, 11.32, and 11.34 of Title 11 of the Montclair Municipal Code in their entirety.
B. Adoption of Corridors Code & Amendment to the Official Zoning Map. The City Council hereby adopts the Corridors Code and the Corridors Code Map as an Amendment to the Official Zoning Map of the City of Montclair as reflected in Case No. 2024–55 and attached hereto as Exhibit “C” to this Ordinance.
SECTION 5. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
SECTION 6. Certification; Publication. The City Clerk shall certify as to the adoption of this Ordinance and shall cause a summary thereof to be published within fifteen (15) days of the adoption and shall post a Certified copy of this Ordinance, including the vote for and against the same, in the Office of the City Clerk, in accordance with Government Code Section 36933.

PREPARER: R. HOERNING
SUBJECT: CONSIDER APPROVAL OF THE FILING OF A NOTICE OF COMPLETION WITH THE SAN BERNARDINO COUNTY RECORDER’S OFFICE FOR THE SUNSET PARK BEAUTIFICATION PROJECT CONSTRUCTED BY PUB CONSTRUCTION, INC.
CONSIDER AUTHORIZING RELEASE OF RETENTION 30 DAYS AFTER RECORDATION
OF NOTICE OF COMPLETION, REDUCTION OF FAITHFULL PERFORMANCE BOND TO
TEN PERCENT, AND RELEASE OF PAYMENT BOND AFTER NINE MONTHS REASON FOR CONSIDERATION: State law requires the filing of a Notice of Completion with the County Recorder’s Office upon completion and acceptance of a Public Works Project. The City Council is requested to consider authorizing the City Manager to accept the work, approve the filing of a Notice of Completion with the San Bernardino County Recorder, and take related actions concerning the Sunset Park Beautification Project.
BACKGROUND: The City obtained two separate grants associated with improvements to Sunset Park. On September 20, 2021, the City Council authorized staff to prepare an application for the California Department of Parks and Recreation, Per Capita Grant Program. Staff received notice that the application was successful and the City was awarded a total of $201,552 for design and construction of the Sunset Park playground improvements. The project is identified by the California Department of Parks and Recreation as the Revitalization of Recreation Elements at Sunset Park.
On January 31, 2022, staff prepared and submitted an application for grant funding through the Clean California Local Grant (CCLG) Program, sponsored by the California Department of Transportation (Caltrans). On March 4, 2022, the City was notified of a grant award totaling $4,174,097. The awarded funds are for the construction costs associated with the Sunset Park Beautification Project. The two Sunset Park improvement grants total $4,375,649.
On September 18, 2023, PUB Construction, Inc. was awarded a construction contract for the Sunset Park Beautification Project and entered into Agreement No. 23–64 with the City. The Sunset Park Beautification Project included the construction of a bicycle trail, walking pathways, exercise stations, playground equipment, restrooms, shade structures, picnic tables, fencing, parking lot improvements, lighting, a new landscape irrigation system, and landscape improvements. PUB Construction, Inc. was awarded a construction contract for $6,495,030.94, and the City Council authorized a construction contingency of $650,000, bringing the total award authority of $7,145,030.94.
During the course of construction, the contractor was directed to make adjustments to the design to address unforeseen conflicts and improve the final park improvements.
These adjustments included re–routing the on–site storm drainage system to avoid conflicts; the addition of grouted rock cobble to reduce maintenance; upgrading the channel fence fabric and hardware to increase safety; adjusting the recycled water system to serve the entire site; modifying the ADA ramp into the park; adding a conduit and connection to Frontier’s system to support the on–site surveillance system; MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 34 of 120 adjustments to the electrical point of connection to improve safety and prepare for future e–charging vehicles at the park, as well as some other miscellaneous adjustments.
PUB Construction, Inc. is nearing completion of the park improvements. The Clean California Grant requires the work to be completed by the end of the calendar year. The work will extend beyond this City Council meeting date. As such, staff recommends the City Council allow the City Manager to accept the improvements when substantially complete and allow for the filing of the Notice of Completion with the San Bernardino County Recorder’s Office. Upon filing the Notice of Completion, the City will release retention after 30 days, and reduce the Faithful Performance Bond to ten percent. The City will retain the Payment Bond for nine (9) months and release it thereafter, provided no liens or stop notices are filed against the project. This project includes a 120 calendar day plant establishment and maintenance period by the Contractor.
FISCAL IMPACT: The project included two grants: The Clean California Reimbursement Grant ($4,174,097) and the California Department of Parks and Recreation per Capita Grant ($151,154). The remaining construction expenses are provided from the 2021 Lease Revenue Bond Funds. The overall construction contract cost for the Sunset Park Beautification Project as of November 27, 2024 was $6,886,595.42. There are additional costs pending, however, these will be within the awarded authority of $7,145,030.94.
RECOMMENDATION: Staff recommends that the City Council take the following actions related to the Sunset Park Beautification Project:
1. Approve the filing of a Notice of Completion with the San Bernardino County Recorder’s Office for the Sunset Park Beautification Project Constructed by PUB Construction, Inc.
2. Authorize release of retention 30 days after recordation of Notice of Completion, reduction of faithful performance bond to ten percent, and release of payment bond after nine months.

SUBJECT: CONSIDER APPROVAL OF THE FILING OF A NOTICE OF COMPLETION WITH THE SAN BERNARDINO COUNTY RECORDER’S OFFICE FOR THE ARROW HIGHWAY AND FREMONT AVENUE IMPROVEMENT PROJECT CONSTRUCTED BY GENTRY BROTHERS, INC.
The City Council is requested to consider authorizing the City Manager to accept the work, approve of filing the Notice of Completion with the San Bernardino County Recorder, and take related actions concerning the Arrow Highway and Fremont Avenue Improvement Project.
BACKGROUND: Arrow Highway is part of the North Montclair revitalization effort, which includes incorporating complete streets concepts and street beautification elements.
On November 20, 2023, Gentry Brothers, Inc. (Gentry) was awarded a construction contract for the Arrow Highway and Fremont Avenue Improvement Project and entered into Agreement No. 23–75 with the City. The Arrow Highway and Fremont Avenue Improvement Project included street, traffic signal, and storm drain improvements. Gentry Brothers, Inc. was awarded a construction contract for $1,588,920, and the City Council authorized a construction contingency of $158,892, bringing the total award authority to $1,747,812.
These improvements were needed in advance of the full Arrow Highway street improvements to coordinate with the Village Partners Development project that is currently under construction and located on the north side of Arrow Highway at the intersection of Fremont Avenue. During the construction, Village Partners Development requested the City’s Contractor to stop work to allow them to complete additional underground work. This delay was longer than anticipated, but Gentry Brothers is currently completing the remainder of the improvements. As required, the City has been holding the project retention of money due to Gentry. As such, staff is interested in filing the Notice of Completion at the earliest appropriate time.
During the course of construction, additional cost was incurred to purchase the traffic signal pole, replace a bank of conflicting conduits, and to stop the work to allow Village Partners to complete their underground utility work. Village Partners Development reimbursed the City, $20,000 for construction delay costs.
Gentry is nearing completion of the Arrow Highway and Fremont Avenue Improvements.
The work will extend beyond the December City Council meeting date. As such, staff recommends the City Council allow the City Manager to accept the improvements when substantially complete and allow for the filing of the Notice of Completion with the San Bernardino County Recorder’s Office. Upon filing the Notice of Completion, the City will MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 37 of 120 release retention after 30 days, and reduce the Faithful Performance Bond to ten percent.
The City will retain the Payment Bond for nine (9) months and release it thereafter, provided no liens or stop notices are filed against the project.
FISCAL IMPACT: Village Partners reimbursed the City $20,000 for the Contractor to pull off the project. The overall construction contract cost for the Arrow Highway and Fremont Avenue Project will be $1,719,645, within the awarded authority of $1,747,812.
RECOMMENDATION: Staff recommends that the City Council take the following actions related to the Arrow Highway and Fremont Avenue Improvement Project:
1. Approve the Notice of Completion with the San Bernardino County Recorder’s Office for the Arrow Highway and Fremont Avenue Improvement Project constructed by Gentry Brother, Inc.
2. Authorize release of retention 30 days after recordation of Notice of Completion, reduction of faithful performance bond to 10 percent, and release of payment bond after nine months.
3. Authorize City Manager Edward C. Starr to sign the Notice of Completion and related documents.

SUBJECT: CONSIDER APPROVAL OF TRACT MAP NO. 20656 FOR PROPERTY LOCATED ON THE
SOUTH SIDE OF MISSION BOULEVARD AND WEST OF MONTE VISTA AVENUE CONSIDER AUTHORIZING TRACT MAP NO. 20656 TO BE RECORDED WITH THE SAN BERNARDINO COUNTY RECORDER’S OFFICE, SUBJECT TO FINAL APPROVAL BY THE
CITY ENGINEER
REASON FOR CONSIDERATION: Land subdivisions, including parcel maps and tract maps, are allowed by the Subdivision Map Act, subject to City Council approval. The City Council is requested to consider approval of Tract Map No. 20656 for property located on the south side of Mission Boulevard and west of Monte Vista Avenue, and authorize recordation of the tract map with the San Bernardino County Recorder’s Office, subject to final approval by the City Engineer.
BACKGROUND: On March 25, 2024, the Planning Commission adopted Resolution No. 24–1992 approving Tentative Tract Map No. 20656. Tract Map No. 20656 is a 22–lot single–family residential development on a vacant 3.2–acre site. The project includes a Density Bonus request that allows the initial 18–unit single–family development be increased by four units for a total of 22 homes. Pursuant to Density Bonus law, the developer requested a concession for reduced minimum lot width from 50 feet to a typical lot width of approximately 42 feet; and a waiver for a reduced minimum lot size affecting five of the proposed (Lots 7–11). Additionally, Tract Map No. 20656 provides for the construction of new housing units in the City, two of which will be reserved specifically for lower–income purchasers, thereby increasing the City’s housing stock and providing additional subsidized housing opportunities in the City.
The proposed residential development would not face onto Mission Boulevard, but would instead face inward (south) onto an extended Rawhide Street. Rawhide Street would be extended in an east–west direction, thereby connecting the adjacent existing single– family neighborhoods, with the proposed 22–unit development positioned in the middle of the two. Eleven homes would be situated on the south side of the new street with the remaining eleven homes constructed on the north side of Rawhide Street with the rear yards abutting Mission Boulevard.
FISCAL IMPACT: Approval of Tract Map No. 20656 will create an unknown but positive fiscal impact to the City through increased property values and sales taxes.
RECOMMENDATION: Staff recommends the City Council take the following actions:
1. Approve Tract Map No. 20656 for property located on the south side of Mission Boulevard and west of Monte Vista Avenue; and
2. Authorize Tract Map No. 20656 to be recorded with the San Bernardino County Recorder’s Office, subject to final approval by the City Engineer.

SUBJECT: CONSIDER RECEIVING AND FILING FISCAL YEAR 2023–24 ANNUAL REPORTS FOR MONTCLAIR COMMUNITY FACILITIES DISTRICT NOS. 2011–1 (PASEOS/ALEXAN) AND 2011–2 (ARROW STATION)
REASON FOR CONSIDERATION: State law requires that a report be filed with the governing body of any agency levying special taxes for Community Facilities Districts (CFDs) on an annual basis. Currently, the City of Montclair has two CFDs that fall under this requirement: Community Facilities District No. 2011–1 and Community Facilities District No. 2011–2.
A copy of the FY 2023–24 Annual Reports for CFD Nos. 2011–1 and 2011–2 are attached for City Council review and consideration.
BACKGROUND: Pursuant to California Government Code Section 50075.3, the Annual CFD Reports are required to contain the amount of funds collected and expended for each CFD and the status of any project required or authorized to be funded by the established CFD.
CFD Nos. 2011–1 and 2011–2 each levy a special tax related to maintenance of Public Improvements within the boundaries of the established CFD, and costs related to Public Safety Services.
FISCAL IMPACT: There would be no cost associated with the City Councils review and acceptance of the Annual CFD Reports.
RECOMMENDATION: Staff recommends the City Council receive and file the Fiscal Year 2023–24 Annual Reports for Community Facilities District Nos. 2011–1 (Paseos/Alexan) and 2011–2 (Arrow Station).

MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 48 of 120 BACKGROUND: Typically, on an annual basis or as contracts near conclusion, the City of Montclair negotiates on the terms and conditions of employment with the various labor associations. This year, the City negotiated updated MOUs with two groups: MCCEA and Teamsters, which now represents the bargaining unit formerly known as the Montclair General Employees’ Association (MGEA). Once an agreement was reached with each, the City and the respective groups memorialized the terms in a signature agreement, which was presented to the Personnel Committee for approval of pay and benefit increases. The MOUs between the City and MCCEA and Teamsters have now been updated with all agreed–upon changes and are presented to the City Council for approval.

Additionally, and typically on an annual basis, the City of Montclair considers the terms and conditions of employment for unrepresented employees, which include Executive Managers, and Managers (Nonsafety and Safety). After some input from the unrepresented employees, the City will memorialize the new terms in a signature agreement, which is presented to the Personnel Committee for approval of pay and benefit increases. The labor agreements are also updated and presented to City Council for approval.

SUBJECT: CONSIDER APPROVAL OF AGREEMENT NO. 24–92 WITH BLAIS & ASSOCIATES, INC.
FOR GRANT WRITING SERVICES
CONSIDER AUTHORIZING $100,000 APPROPRIATION FROM THE LEASE REVENUE BOND FUND FOR COSTS RELATED TO AGREEMENT NO. 24–92
REASON FOR CONSIDERATION: The City Council is requested to consider approval of Agreement No. 24–92 with Blais & Associates, Inc. (Blais) for grant writing services.
BACKGROUND: In 2017, the City began utilizing Blais for their grant writing services.
The City has seen much success in working with Blais, with thirteen major grant awards that will transform the City totaling nearly nineteen million dollars. The most recent award since the last grant update is for staffing for the Fire Department through the Department of Homeland Security’s Staffing for Adequate Fire and Emergency Response (SAFER) grant program in the amount of $691,129.
Utilizing Blais and Associates grant writing services, the City of Montclair has applied for thirty-eight grants, thirteen of which are currently under review. Additionally, three grant applications are in process to be submitted. Some of the federal grants the City is applying for are extremely complex and require a high level of effort, which leads to higher grant writing costs. The return on investment to the City is twenty-nine dollars in funding received for every dollar spent on grant writing services. Earlier this fiscal year, the City Council previously approved agreements 24–59 and 24–67 with Blais to continue grant writing services this fiscal year.
The City would like to continue to pursue grant funding when possible to address a variety of needs in the community. There are current funding announcements that staff would like to pursue, along with announcements of future opportunities. Each of these funding opportunities requires an extraordinary amount of time and specific expertise.
Future costs to prepare grant applications depends on the level of complexity of each grant opportunity. Agreement 24–92 includes a monthly fixed fee of $3,071 for grant research, consultation, and monitoring. It is anticipated that aggregate expenses for grant writing services from Blais will be at least $100,000 through the end of the 2025 calendar year.
Before the execution of the original agreement with Blais, City staff went through a vetting process to make sure that Blais was the best value for the City. Therefore, proposals from other firms were not sought. Staff recommends it is in the best interest and value of the City to continue utilizing Blais to provide grant writing services.
However, the City is not obligated to exclusively work with Blais for grant writing services.
MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 53 of 120 FISCAL IMPACT: Staff estimates preparing future grant applications will cost at least $100,000 through the end of the 2025 calendar year. The term of the agreement for grant writing services is December 1, 2024 through December 31, 2025.

(b) Contractual Indemnity. To the fullest extent permitted under California law, Contractor shall contractually indemnify, defend and hold harmless the Indemnified Parties from and against any liability (including liability for claims, suits, actions, arbitration proceedings, administrative proceedings, regulatory proceedings, losses, expenses, amounts for good faith settlement, or costs of any kind, whether actual, alleged or threatened, including attorney’s fees and costs, court costs, interest, defense costs, and expert witness fees and costs), arising out of or related to, in whole or in part, the performance of this Agreement by Contractor or by any individual or entity for which Contractor is legally liable, including but not limited to Contractor’s officers, agents, representative, employees, independent contractors, subcontractors or affiliated or related entities and/or its or their employees, agents and representatives, caused by or arising out of all negligent acts or omissions, or intentional misconduct of Contractor, including its subcontractors, employees, agents and other persons or entities performing work for Contractor. The obligation to indemnify, defend and hold harmless the Indemnified Parties shall apply to all liability as defined above regardless of whether the Indemnified Parties were or are alleged to have been negligent, except that it shall not apply to claims arising from the sole negligence or willful intentional misconduct of the Indemnified Parties. Contractor’s obligation to defend the Indemnified Parties is not contingent upon there being an acknowledgement of or determination of the merit of any claims, liability, demands, causes of action, suits, losses, expenses, errors, omissions and/or costs. (c) Subcontractors and Indemnification. Contractor agrees to and shall obtain executed indemnity agreements in favor of the Indemnified Parties with provisions identical to those set forth from each and every Subcontractor, Sub consultant, or other person or entity involved by, for, with, or on behalf of Contractor in the performance of any aspect of this Agreement. obligations, Contractor shall be fully responsible for each and every Subcontractor, Subconsultant or other person or entity in terms of defense, indemnity and hold harmless obligations in favor of the Indemnified Parties as set forth above. This obligation to indemnify and defend the Indemnified Parties is binding on the successors, assigns, or heirs of Contractor and shall survive the full performance or termination of this Agreement. These indemnification provisions are independent of and shall not in any way be limited or superseded by the insurance requirements and insurance-related provisions of this Agreement.
(d) City Lost or Damaged Property – Theft. Contractor further agrees to pay or cause to be paid to the Indemnified Parties’ benefit, any and all damages, fines, penalties, and loss or theft of property of the City arising out of or related in any way to the negligent acts or omissions or intentional misconduct of Contractor or of Contractor’s officers, agents, representatives, employees, independent contractors, subcontractors or affiliated or related entities and/or its or their employees, agents and representatives, whether such actions, omissions to act, negligence or intentional conduct is or was authorized by this Agreement or not. City assumes no responsibility whatsoever for any property placed on the premises of City. Contractor further agrees to waive all rights of subrogation against the Indemnified Parties. (e) Non-Waiver and Non-Exhaustion of City’s Further Rights and Remedies.
No aspect of this provision shall in any way limit or effect the rights of the Indemnified Parties against the Contractor under the terms of this Agreement or otherwise. The indemnification provisions shall apply regardless of whether this Agreement is executed after Contractor begins the work and shall extend to claims arising after this Agreement is performed or terminated, including a dispute as to the termination of Contractor. The indemnity obligations of Contractor shall continue until it is determined by final judgment that the claim against the City and any Indemnified Parties is determined by final judgment and after exhaustion of any rights of appeal. Further, no aspect of this provision shall impact the City’s rights to contribution from Contractor, or for the City to dispute Contractor’s refusal to defend and indemnify City. (f) Limitations on Scope of Indemnity. Notwithstanding the foregoing, Contractor shall not be responsible for indemnification for claims or losses caused by the sole negligence or intentional wrongdoing of Indemnified Parties. Further, the indemnity provided shall be interpreted as broadly as permitted under California law and as to agreements between parties and shall if required be reformed to be consistent with those laws to protect and save this provision for the protection of the Indemnified Parties.
(g) The obligations of Contractor under this or any other provision of this Agreement shall not be limited by the provisions of any workers’ compensation act or similar act. The Contractor expressly waives any statutory immunity under such statutes or laws as to the Indemnified Parties. The Contractor’s indemnity obligation set forth in this Section 9 shall not be limited by the limits of any policies of insurance required or provided by the Contractor pursuant to this Agreement.

AGENDA REPORT
DATE: DECEMBER 16, 2024
SECTION: CONSENT - RESOLUTIONS
ITEM NO.: 1
FILE I.D.: SEW225
DEPT.: PUBLIC WORKS
PREPARER: M. HEREDIA
SUBJECT: CONSIDER ADOPTION OF RESOLUTION NO. 24–3465 CERTIFYING THE UPDATED
SEWER SYSTEM MANAGEMENT PLAN
REASON FOR CONSIDERATION: To comply with regulatory mandates, the City’s sewer permit requires critical updates to the City's Sewer System Management Plan (SSMP).
Once approved, staff will upload the SSMP to the City’s website and the State's online California Integrated Water Quality System (CIWQS) Sanitary Sewer System Database.
Therefore, the City Council is requested to consider adoption of Resolution No. 24–3465 certifying the updated SSMP. A copy of the complete updated SSMP has been provided to the City Council for review.
BACKGROUND: The State Water Resources Control Board adopted the Statewide General Waste Discharge Requirement (GWDR) on May 2, 2006, requiring all public agencies with a collection system greater than one mile in length to develop and implement a SSMP.
The SSMP is a document that describes the activities each agency uses to effectively manage its wastewater collection system. Effective management of a wastewater collection system can include the following:
1. Maintenance of existing collection system infrastructure and the development of a plan for the rehabilitation/replacement of infrastructure.
2. Prevention and reduction of Sanitary Sewer Overflows (SSOs) and creation of an Emergency Response Plan for such events.
3. Development and documentation of a FOG (Fats, Oils, and Grease) Program to prevent problems associated with the accumulation of grease in sewer lines.
4. Establishment of legal authority for enforcement of the requirements made in the Sanitary Sewer Order and to ensure liability coverage.
5. Ensuring the protection of public health and the condition of receiving waters that can be affected by a sewer spill.
6. Building public perception through public outreach and education events and establishing protocols for soliciting and responding to public input about collection system deficiencies.
The SSMP serves as a guidance document to help an agency anticipate needed improvements and maintenance requirements for the collection system to increase the effectiveness in which it serves its users. Improvements and changes should be made to the living document as conditions of the collection system change. Water Quality Order No. 2022–0103–DWQ, effective June 5, 2023, mandates that the SSMP must be updated to include significant program changes every five years.
MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 72 of 120 The required elements of an SSMP are:
Collection system management goals
Organization of personnel including the chain of command and communications Legal authority for permitting flows into the system, inflow/infiltration control of stormwater into the collection system
Enforcement of proper sewer design, installation, testing standards, and inspection requirements for new and rehabilitated sewers Documentation of operations and maintenance activities to maintain the wastewater collection system
Design and performance provisions
Spill Emergency Response Plan (SERP)
FOG (Fats, Oils, and Grease) Program to prevent problems associated with the accumulation of grease in sewer lines
Collection system evaluation and capacity assurance program Monitoring, measurement, and modification plan for SSMP Program effectiveness Periodic internal SSMP audits (every two years)
Establishment of an SSMP communication program
The SSMP assists in facilitating greater organization of existing assets and works toward achieving greater efficiency by outlining where improvements should be made to the collection system. A copy of the SSMP may be downloaded using the following link:
https://www.cityofmontclair.org/documents/2024-sewer-system-management-plan/ FISCAL IMPACT: Adoption of Resolution No. 24–3465 would create no fiscal impact for the City. However, failure to adopt an updated SSMP would likely result in monetary penalties being assessed against the City.
RECOMMENDATION: Staff recommends that the City Council approve Resolution No. 24–3465 certifying the updated Sewer System Management Plan.

SUBJECT: CONSIDER ADOPTION OF RESOLUTION NO. 24–3467 AUTHORIZING SALARIES AND
CLASSIFICATION TITLES FOR CITY EMPLOYEES ON A CONSOLIDATED SALARY
SCHEDULE
REASON FOR CONSIDERATION: California Public Employees’ Retirement Law, the Government Code, and California Code of Regulations Section 570.5 require public entities to maintain a single, duly approved and adopted pay schedule that identifies the positions for every employee classification. The City Council is therefore requested to annually review and authorize the wage provisions and classification titles for all employees of the City of Montclair.
A copy of proposed Resolution No. 24–3467 is attached for the City Council’s review and consideration.
BACKGROUND: The amended Consolidated Salary Schedule is included as Exhibit “A” to Resolution No. 24–3467. The schedule reflects salary adjustments and other changes made throughout the year for certain positions as described below. On June 21, 2021, the City Council approved Agreement No. 21–29, a Memorandum of Understanding (MOU) with the Montclair Firefighters’ Association (MFFA), including negotiated salary increases through FY 2025–26, the most recent of which went into effect July 1, 2024.
On December 19, 2022, the City Council approved Agreement No. 22–115, an MOU with the Montclair Police Officers’ Association (MPOA), including negotiated salary increases through FY 2024–25, the most recent of which went into effect July 1, 2024. On July 1, 2024, the Personnel Committee/City Manager approved the following:
o Salary adjustments in accordance with agreed–upon changes to labor agreements with Management and Executive Management employees for FY 2024–25, which went into effect July 1, 2024.
o Salary adjustments in accordance with agreed–upon changes to the MOU with Montclair City Confidential Employees’ Association (MCCEA) for FY 2024–25, which went into effect July 1, 2024.
On July 15, 2024, the Personnel Committee/City Manager approved salary adjustments for certain part–time positions consistent with full–time position adjustments effective July 1, 2024.
MONTCLAIR CITY COUNCIL MEETING – 12/16/2024 Page 75 of 120 Other revisions to the Salary Schedule approved by the Personnel Committee throughout the year include the addition of new positions, removal of eliminated positions, and adjustments to salary ranges of certain vacant positions to improve recruitment efforts for those positions.
City of Montclair employee salaries are also available for public access online at https://publicpay.ca.gov/ and at https://www.cityofmontclair.org/salary-schedule/.
FISCAL IMPACT: The City Council’s adoption of proposed Resolution No. 24–3467 would create no financial impact to the City’s General Fund.
RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 24–3467 authorizing the salaries and classification titles for City employees on a consolidated salary schedule.
