property owner annexing to the City’s sewer line.
Community Development Director Diaz clarified that the
annexation will not take place at this time; however, the failure of the septic tank constitutes an emergency situation, and the property will be permitted to connect to the City’s sewer system on the condition that the owners agree to the future annexation of the property to the City of Montclair—which is binding on all future owners should the property be sold before then.

C. Agreements
2. Consider Approval of Agreement No. 25–10, with the Animal Resource Center of the Inland Empire (ARC) Joint Powers Authority (JPA) to Become a Member Agency of the ARC JPA for the Operation and Delivery of Animal Control, Licensing, and Sheltering Services, Subject to Any Revisions Deemed Necessary by the City Attorney
Consider Authorizing a $2 Million Allocation from the 2021 Lease Revenue Bond Fund for Payment Toward the
Estimated $4.3 Million in Capital Cost Contributions
Required from the City for Land, Animal Shelter Facilities, Administrative Offices, and Other Start–Up Costs Related to the Delivery of Animal Control and Sheltering Services
Consider Authorizing Quarterly Allocations of Approximately $57,500 from General Fund Revenues Beginning FY 2025–26 for Payments Toward the Remaining Balance of
$2.3 Million in Capital Cost Contributions Until the Interest– Free Obligation is Paid Off in Approximately Forty Quarterly Payments, or Ten Years
Consider Designating Mayor Javier John Dutrey as Director and a Council Member as Alternate Director to Serve on the ARC JPA Board of Directors
Council Member Ruh emphasized his commitment to animal
advocacy, and stated he believes Montclair would benefit from joining the Animal Resource Center of the Inland Empire (ARC) Joint Powers Authority (JPA), and asked if the agency’s jurisdiction would be bound by the San Bernardino County line.
City Manager Starr advised the service area is not confined to County boundaries, and services will be available to all member cities. He noted he is unable to disclose the names of other agencies interested in joining ARC due to recent threats from the Inland Valley Humane Society (IVHS) concerning contract termination for agencies considering membership in ARC.
Council Member Ruh asked if ARC will be able to accommodate large animals, such as horses, noting many horses are currently being held at the Pomona Fairplex due to the recent fires in Los Angeles.
City Manager Starr noted it will take time to procure and develop the necessary facilities, but confirmed that ARC will provide services for large animals.
Mayor Pro Tem Martinez expressed concern over the lack of consideration by IVHS to extend the City’s contract by one year before transitioning to ARC and asked if the temporary shelters would accommodate Montclair’s current animal service needs.
City Manager Starr stated the increasing unlikelihood that IVHS will extend the contract. He advised ARC has leased a
warehouse to use as a temporary shelter, and has appointed an Executive Director who is actively working on developing ARC’s programs and hiring administrative staff.
Council Member Lopez inquired whether IVHS had terminated their contract, given Montclair's interest in joining ARC.
City Manager Starr advised IVHS has not yet indicated it will terminate the City’s contract; however, he believes IVHS recognizes a City’s fiduciary duty and right to seek more cost– effective service delivery.
Council Member Lopez asked if ARC has a timeline to begin operations, expressing concern about anticipated challenges for residents during the transition, like finding lost pets in shelters.
Joint City Council/Successor Agency Board/Montclair Housing Corporation Board/Montclair Housing Authority Commission/ Montclair Community Foundation Board Meeting Minutes – February 18, 2025 Page 6 of 8 City Manager Starr indicated that, if approved, the City’s contract would begin July 1, 2025, and it is estimated that it will take approximately one year to fully operationalize the shelter and refine the associated programs
Council Member Mendez reflected on IVHS’s inflated costs for animal services since he was a Public Works Superintendent. He asked if ARC would have an emergency veterinarian on staff and if spay and neutering services would be available.
City Manager Starr assured that the same services offered through IVHS would be provided by ARC.
Mayor Dutrey asked how costs and ARC JPA Board votes would be determined and altered over time.
City Manager Starr explained that all member cities would have equal voting power on financial matters, such as approving a budget, and Montclair’s voting power would be ten percent for all other matters based on the current four–agency membership of Ontario, Chino Hills, Montclair, and San Bernardino County.
He advised the calculation of the City’s voting power and contract costs are determined by factors such as changes in agency membership, population, and capital costs.
Mayor Dutrey expressed concern over IVHS's lack of
responsiveness and transparency and indicated his support for transitioning to ARC and proposed nominating Council Member Ruh as Montclair’s Alternate Director of the ARC JPA Board.
Council Member Ruh accepted the nomination to serve as the City’s Alternate Director of the ARC JPA Board.
