MONTCLAIR CITY COUNCIL MEETING – 03/17/2025 Page 3 of 39

CITY COUNCIL

AGENDA REPORT
DATE: MARCH 17, 2025
SECTION: PUBLIC HEARINGS
ITEM NO.: A
FILE I.D.: CFD050
DEPT.: ECONOMIC DEV.

PREPARER: M. FUENTES
SUBJECT: SECOND READING — CONSIDER ADOPTION OF ORDINANCE NO. 25–1011

AUTHORIZING THE LEVY OF A SPECIAL TAX FOR COMMUNITY FACILITIES DISTRICT NO. 2025–1(THE VILLAGE AT MONTCLAIR)
REASON FOR CONSIDERATION: The amended North Montclair Downtown Specific Plan (NMDSP) encompasses a diverse array of public enhancements, including parks, public open spaces, median islands, parkways, and specialized street lighting. The City holds the responsibility for ensuring the construction and ongoing maintenance of these public enhancements. However, the financial capacity of the City’s General Fund is insufficient to support both the initial development and the subsequent maintenance of these improvements. The City Council has directed staff to finance maintenance of public improvements and a portion of the costs for public safety services related to development projects within the boundaries of the NMDSP area through the establishment of Community Facilities Districts (CFD).

A copy of Ordinance No. 25–1011 is attached for City Council review and consideration.

BACKGROUND: On March 3, 2025, the City Council conducted a public hearing related to the formation of CFD No. 2025–1(The Village at Montclair) and took the following actions:
 Adopted Resolution No. 25–3471 establishing CFD No. 2025–1 (The Village at Montclair), and the boundaries thereof;
 Adopted Resolution No. 25–3472 calling a Special Election and submitting to the voters of CFD 2025–1 (The Village at Montclair) a proposition for the annual levy of special taxes within said CFD to pay the costs of certain services to be provided by the CFD and establishing an appropriations limit for said CFD;  Adopted Resolution No. 25–3473 declaring the results of the Special Election for CFD No. 2025–1 (The Village at Montclair) for the propositions concerning (I) the annual levy of special taxes to pay the costs of certain services to be provided by the CFD and (II) establishing an appropriations limit; and  Conducted the first reading of Ordinance No. 25–1011 levying special taxes to be collected during Fiscal Year 2025–26 to pay the annual costs of the maintenance and lighting of parks, parkways, streets, roads, and open space and the operation and maintenance of storm drainage systems and public safety services including fire protection and suppression services and police protection with respect to CFD No. 2025–1 (The Village at Montclair).

MONTCLAIR CITY COUNCIL MEETING – 03/17/2025 Page 4 of 39 Conducting a second reading and adopting Ordinance No. 25–1011 is the final step in completing the formation of CFD No. 2025–1 (The Village at Montclair). Adoption of Ordinance No. 25–1011 would authorize the City Council to levy special taxes within the newly formed CFD to pay for the identified maintenance costs and public safety costs as included as Exhibit “A” to Ordinance No. 25–1011.

FISCAL IMPACT: Formation of CFD No. 2025–1 has been proposed to mitigate the financial impacts of public works maintenance and public safety services on General Fund revenues.

Proposed CFD No. 2025–1 would finance the maintenance costs and lighting of parks, parkways, streets, roads, and open space and the operation and maintenance of storm drain systems serving the proposed CFD. In addition, the proposed CFD would finance fire and police protection services. The estimated cost of these services is approximately $158,510 annually, inclusive of a $15,000 annual cost to administer the CFD.

As previously indicated, the special tax imposed by the CFD be increased by the cost of the CPI with a maximum annual increase of six percent and a minimum annual increase of two percent each year.

RECOMMENDATION: Staff recommends that the City Council conduct the second reading, by number and title only, and adopt Ordinance No. 25–1011 authorizing the levy of a special tax for CFD No. 2025–1 (The Village at Montclair).

Notwithstanding the above, pursuant to Section 53321(d)(3) of the California Government Code, under no circumstances shall the Special Tax levied in any Fiscal Year against any Assessor’s Parcel in CFD No. 2025-1 for which an occupancy permit for private residential use has been issued be increased as a consequence of delinquency or default by the owner or owners of any other Assessor’s Parcel(s) within CFD No. 2025-1 by more than 10% above the amount that would have been levied in that Fiscal Year had there never been any such delinquencies or defaults. To the extent that the levy of the Special Tax on Assessor’s Parcels of residential property is limited by the provision in the previous sentence, the levy of the Special Tax on all of the Assessor’s Parcels of non-residential property within CFD No. 2025-1 shall continue to increase in equal percentages at up to 100% of the Maximum Special Tax.

E. EXEMPTIONS
Neither the Special Tax A nor the Special Tax B shall be levied on Assessor’s Parcels of Property Owner Association Property, Public Property, Exempt Welfare Exemption Property, or Parking Property.

The CFD Administrator shall review the appeal, meet with the appellant if the CFD Administrator deems necessary, and advise the appellant of its determination. If the CFD Administrator agrees with the appellant, the CFD Administrator shall eliminate or reduce the Special Tax on the appellant’s property and/or provide a refund to the appellant. ITEM NO.: 9
FILE I.D.: CAC080
DEPT.: HUMAN SVCS.

PREPARER: A. PERALES
SUBJECT: CONSIDER APPROVAL OF FISCAL YEAR 2024–25 SCHEDULE OF RECOMMENDATIONS

FROM THE COMMUNITY ACTIVITIES COMMISSION FOR COMMUNITY BENEFITS

FUNDING
REASON FOR CONSIDERATION: Annually, the Human Services Department presents the City Council with a list of organizations that the Community Activities Commission (CAC) are recommending to receive a portion of funds appropriated in the Community Benefits Account. The City Council is requested to consider the CAC recommended organization requests listed on the Fiscal Year 2024–25 Community Benefits Assistance Program Agency Funding Requests at the end of this report and consider approval of the funding recommendations.

BACKGROUND: The City Council established an annual policy of appropriating funds to social service agencies that provide special services to Montclair residents. At the direction of the City Council, the CAC conducts a public hearing each year to provide CAC members with the following opportunities:
 Become acquainted with the requesting organizations and their programs of service,
 Inquire about requesting agencies' operating budgets and revenue sources in order to evaluate their financial needs,
 Determine the appropriate use of funds that may have been previously allocated by the City to requesting agencies.

The CAC heard presentations at its regular meeting on Wednesday, March 5, 2025, from thirteen organizations related to their requests for community benefits assistance, which are summarized below:

1. AgingNext. AgingNext was founded in 1975 to support and educate older adults as well as their families to maintain independence and to age well at home and in the community. In 2024, AgingNext supported 128 Montclair Senior and disabled participants with their programs. The funds received would be used to ensure that older adults, caregivers, and families continue to have access to programs and resources.

2. Anthesis. Anthesis serves the City of Montclair by providing vocational and social opportunities for adults with developmental and intellectual disabilities, improving their quality of life. Funding would be used to develop their “BLOOM Retail Skills Learning Lab” located at the Anthesis Thrift Store in Montclair. Their plan is to purchase a point of sale “POS” system to assist with training their participants as well as shelving units and bins.

MONTCLAIR CITY COUNCIL MEETING – 03/17/2025 Page 24 of 39

3. Assistance League of the Foothill Communities. The Assistance League of the Foothill Communities is a chapter of the National Assistance League® and an all–member volunteer philanthropic organization with a history of service in this area since 1953. Their mission is to transform the lives of children and adults through community programs. During the 2023–24 school year approximately 212 students from Montclair Schools from low to very low–income families were invited to participate in Operation School Bell®. This program provided new clothing at the cost of $100–$150 depending on the grade level. Funding this year would continue to support Operation School Bell®.

4. Care & Company. Care & Company is a faith–based, nonprofit organization located in the City of Montclair that aids low–income individuals, senior citizens and families with necessary hygiene items through their Hygiene Pantry program. Over 720 households, most of those senior citizens from Montclair, were served last year. Care & Company purchases approximately $300 worth of hygiene products each month and asks patrons of the Hygiene Pantry for a suggested $2 donation, however, no one is turned away due to their inability to pay. Funds received would be used to support the Hygiene Pantry by covering half of the cost of hygiene items for 2025.

5. Christian Development Center (CDC). Christian Development Center, a grassroots ministry, would use the funds to support their Food/Clothing Giveaway Program, which does food giveaways of fresh produce to feed over 500 families every month.

Sixty percent of their participants are Montclair residents.

6. Foothill Family Shelter. The Foothill Family Shelter provides services for at–risk, homeless individuals and families. In 2024, Foothill Family Shelter provided 120–day transitional housing and extended housing for homeless and low– income families; 3 of those families being from Montclair, they also aided 1,453 Montclair families with food, clothing, diapers, wipes and hygiene products through their Help Desk, and provided 93 Thanksgiving baskets to homeless and low–income families in Montclair. The funds received would be used to help provide shelter, food, and clothing for at–risk, homeless and low–income families in Montclair.

7. Hope Through Housing Foundation (HTHF). HTHF is a social service organization whose mission is to break the cycle of generational poverty by providing services to the National Community Renaissance’s affordable housing communities. There are four affordable housing units located in Montclair: one property for seniors, one property for developmentally disabled residents, and two properties for families. All services and programs are provided free of charge to the residents; individuals and families not residing at one of the properties are also encouraged to take advantage of the services offered on–site. The HTHF offers programs, such as the Building Bright Futures youth development program. Their goal is to help young people do well in school, assist families in improving their financial situations and allowing senior citizens to age with dignity in their own homes.

8. Love for Humanity. Love for Humanity is a volunteer based non–profit organization dedicated to alleviating hardships and easing difficult times by helping people in need by supplying food, toiletries, and clothing, and assisting with education and job networking. The funds received would be used towards the general operating support for the programs that benefit Montclair residents such as the Food Pantry MONTCLAIR CITY COUNCIL MEETING – 03/17/2025 Page 25 of 39 and Provisions Program which provides groceries for low income families every month and restocks the food pantry at Our Lady of Lourdes Catholic Church in Montclair, the Food Backpack Program which gives children a backpack on Friday afternoons filled with enough pre–packaged food to last through the weekend, and the School Supplies Program which provides pouches full of essential school supplies to schools in Montclair for children in need.

9. Montclair Meals on Wheels. Montclair Meals on Wheels is an all–volunteer organization. Services include the home delivery of lunches to Montclair residents who are unable to shop for themselves or prepare their own meals. The program also focuses on eliminating isolation. The funds received would pay for the fixed costs needed to support the program such as an opportunity to pay partial or full meal costs to screened receipients who are experiencing temporary financial issues.

10. OMSD Health and Wellness Services. OMSD Health & Wellness Services coordinates services for struggling children and families in crisis. The goal of Health & Wellness Services is to help families access food, shelter, clothing, education, health–care, and transportation. The funds received would be used to support emergency assistance for Montclair residents in the Case Management Program.

11. OPARC. OPARC has served Montclair since 1950 with employment, training, day programs, and community integration services for people with developmental and intellectual disabilities. The funding received last year was used to build a sensory room for participants to retreat when they are stressed. This year, the funds would support the upcoming Creative Arts Program, specifically its Culinary Skill Development. The program teaches essential cooking skills, including techniques catering to dietary needs and ethnic cuisines and funding will help with purchasing essential supplies including food items for cooking classes and workshops.

12. Project Sister Family Services. Services are provided to survivors of sexual assault and include the following: a 24–hour crisis hotline, advocacy and accompaniment, individual counseling and support groups, community education, teen programs, and child–abuse prevention programs. In the 23/24 Fiscal Year Project Sister provided services to 128 Monclair residents. Funding would be used to provide a minimum of 50 residents of Montclair with 40 hours of service.

13. VNAcare. VNAcare provides home health–care and hospice services in our community. Funding will benefit the “Charitable Care” program, which provides assistance to underserved patient/families facing health challenges with limited financial resources. Funds will be allocated towards in–home nursing visits, the purchase of health–related services and grocery store/department store gift cards for patients/families needing food or household items.

FISCAL IMPACT: The recommended funding amounts have been limited to the approved Fiscal Year 2024–25 Budget amount of $45,000 utilizing the following criteria:
 Level of service to the Montclair community
 Level of service need in the community
 Amount of each request
 Previous year's allocation (if applicable)
 Available funds

On August 19, 2024, the City Council approved Resolution No. 24–3454 designating authorized agents for California Governor’s Office of Emergency Services (Cal OES) Public Assistance Grants.

Resolutions designating authorized agents should be renewed every three years and/or if there is a change in the authorized agents. The City’s emergency preparedness efforts have been delegated to the Fire Department, and the Fire Chief must be designated as an authorized agent in order to submit future reimbursement filings.

Stafford Disaster Relief and Emergency Assistance Act of 1988, as administered by the Federal Emergency Management Agency (FEMA); and/or (2) state financial assistance made available under the California Disaster Assistance Act, as administered by Cal OES. A Cal OES Form 130 is required of all applicants to be eligible to receive funding. Staff recommends that the form designate agents by title, instead of specific names, and be effective for all open and future disasters declared by the sate or federal government for up to three years following the date of approval by City Council so as to expedite processing of requests in the future.

FISCAL IMPACT: Adoption of the resolution will permit the City to obtain financial assistance for all open and future disasters declared by the state or federal government up to three (3) years following the date of approval.

RECOMMENDATION: Staff recommends the City Council take the following actions:

2. Authorize submittal of the approved Cal OES Form 130 to the State.

Cal OES 130 - Instructions
Cal OES Form 130 Instructions
A Designation of Applicant’s Agent Resolution for Non-State Agencies is required of all Applicants to be eligible to receive funding. A new resolution must be submitted if a previously submitted Resolution is older than three (3) years from the last date of approval, is invalid or has not been submitted.

When completing the Cal OES Form 130, Applicants should fill in the blanks on page 1. The blanks are to be filled in as follows:

Resolution Section:

Governing Body: This is the group responsible for appointing and approving the Authorized Agents.

Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc.

Name of Applicant: The public entity established under the laws of the State of California. Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California.

Authorized Agent: These are the individuals that are authorized by the Governing Body to engage with the Federal Emergency Management Agency and the Governor’s Office of Emergency Services regarding grants applied for by the Applicant. There are two ways of completing this section:

1. Titles Only: If the Governing Body so chooses, the titles of the Authorized Agents would be entered here, not their names. This allows the document to remain valid (for 3 years) if an Authorized Agent leaves the position and is replaced by another individual in the same title. IV. COUNCIL WORKSHOP
A. Fiscal Year 2024–25 Midyear Budget Review
Director of Finance Kulbeck reported the status of the City’s financial operations at midyear, discussing specific changes to the City’s Estimated Revenue and Appropriations Budgets; and reviewed the City Manager’s recommended changes to the City’s General Operating Fund expenditures, in conjunction with the showing of a PowerPoint presentation.

City Manager Starr discussed and fielded questions from the City Council related to lower–than–projected tax revenues, vacant positions, rising insurance rates, and delays with construction of the Gold Line—mainly due to the tariffs imposed on Mexico, China, and Canada under the Trump Administration. He advised that, with economists predicting a recession on the horizon, the likely loss of most or all federal grants, and increasing CalPERS unfunded liability costs, staff is making preparations for a reduced budget for the next Fiscal Year.

Mayor Dutrey announced this as the time and place set for a public hearing on the above listed matters, opened the public hearing, and invited comments from the public.

City Clerk Myrick confirmed all owners of the taxable property consented to holding the special election and concurred for the special election to be held following the public hearing.

There being no one wishing to speak and no written comments received by the City Clerk, Mayor Dutrey closed the public hearing and returned the matter to the City Council for its consideration.

Council Member Mendez asked if the annual minimum two percent increase would be required if costs did not increase.

Economic Development Director Fuentes advised they do not have to be implemented if costs do not increase.

Council Member Ruh questioned if there would be homeowner’s association (HOA) fees for future residents on top of the CFD taxes.

Economic Development Director Fuentes clarified the residential properties are rentals, therefore they would not have an HOA fee; however, a property management company would ensure the City’s requirements such as a Parking Management Plan are met.

Council Member Ruh received further clarification that the average monthly rental rate would be in the $2,500 range and the CFD tax would be directly paid by the property owner, not the renter. He expressed his opinion that, as a real estate professional, he believes that CFDs are a main contributor to the current affordable housing shortage in California.
