AGENDA REPORT
DATE: JULY 21, 2025
SECTION: CONSENT - RESOLUTIONS
ITEM NO.: 1
FILE I.D.: GRT200

PREPARER: A. COLUNGA
SUBJECT: CONSIDER ADOPTION OF RESOLUTION NO. 25–3489 AUTHORIZING THE

SUBMISSION OF A GRANT APPLICATION FOR LAND AND WATER CONSERVATION

FUND ASSISTANCE TO THE STATE OF CALIFORNIA NATURAL RESOURCES AGENCY AND AUTHORIZING THE EXECUTION OF APPLICATION–RELATED DOCUMENTS BY

THE CITY MANAGER OR HIS DESIGNEE
REASON FOR CONSIDERATION: The City Council is requested to consider adoption of Resolution No. 25–3489 authorizing the submission of a grant application for Land and Water Conservation Funds (LWCF) to the State of California Natural Resources Agency, Department of Parks and Recreation, and authorizing the execution of application– related documents by the City Manager or his designee.

BACKGROUND: On February 14, 1963, President Kennedy’s Administration proposed legislation to establish a "Land and Water Conservation Fund" to assist states in planning, acquisition, and development of recreation lands. With bipartisan support, President Johnson signed it into law on September 3, 1964.

The National Parks Service administers the LWCF program at the federal level. Funds allocated to California are administered by the California Department of Parks and Recreation. On August 4, 2020, the Great American Outdoors Act (GAOA) was signed into law, authorizing $900 million nationwide annually in permanent funding for LWCF.

When an LWCF project is completed, the land within the approved LWCF boundary map is placed under federal protection, preserving the public’s outdoor recreational use of the site in perpetuity for the benefit of our nation’s future generations.

The City plans to submit the LWCF application for the Saratoga Park Improvement Project, which will include this required resolution.

FISCAL IMPACT: Adoption of proposed Resolution No. 24–3489 would have no direct fiscal impact on the City's General Fund at this time, but may result in the award to improve the City’s recreation landscape. The requested funding amount is still being determined; however, matching funds will be used from the 2021 Lease Revenue Bond fund.

RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 24–3489 authorizing the submission of a grant application for Land and Water Conservation Fund assistance to the State of California Natural Resources Agency and authorizing the execution of application–related documents by the City Manager or his designee.

CITY COUNCIL

AGENDA REPORT
DATE: JULY 21, 2025
SECTION: CONSENT - RESOLUTIONS
ITEM NO.: 3
FILE I.D.: STB300–17
DEPT.: FINANCE
PREPARER: C. GRAVES
SUBJECT: CONSIDER ADOPTION OF RESOLUTION NO. 25–3491 AUTHORIZING PLACEMENT OF

ASSESSMENTS ON CERTAIN PROPERTIES FOR DELINQUENT SEWER AND TRASH

ACCOUNTS
REASON FOR CONSIDERATION: The City Council is requested to consider adoption of Resolution No. 25–3491 authorizing placement of assessments on certain properties for delinquent sewer and trash accounts. There are 517 outstanding liens on properties for collection of delinquent civil debts owed to the City for sewer and trash service.

Placement of assessments on these properties would assist in more timely collection of these delinquent accounts.

A copy of proposed Resolution No. 25–3491 is attached for City Council review and consideration.

BACKGROUND: The City Council authorized the placement of 651 liens on properties for delinquent sewer and trash charges on the following dates:

Date No. of Liens
July 22, 2024 111
October 10, 2024 99
November 7, 2024 112
February 6, 2025 114
March 6, 2025 126
June 5, 2025 89
Total 651
Of these 651 liens, 134 have been cleared.

It is recommended that assessments, which are collected with the property tax, be placed on the properties where the 517 unpaid liens remain. This would result in more timely collection of the delinquencies than the lien process, which generates payment only upon sale or refinancing of the property.

In addition to the regular bimonthly billings, the City has sent bimonthly letters to these property owners advising them of their delinquencies. They received notification when the liens were placed and were again notified on June 18, 2025, that the action proposed this evening would be considered by the City Council.

FISCAL IMPACT: Recoverable amount is $229,340.02
RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 25–3491 authorizing placement of assessments on certain properties for delinquent sewer and trash charges as listed on Exhibit A of said Resolution.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Montclair does hereby approve the placement of assessments on the properties and in the amounts specified in Exhibit A, entitled "August 2025 – Property Assessments." Joint City Council/Successor Agency Board/Montclair Housing Corporation Board/Montclair Housing Authority Commission/ Montclair Community Foundation Board Meeting Minutes – June 16, 2025 Page 4 of 13 Mayor Dutrey declared it the time and place set for public hearing related to the above matter, and invited comments from the public.

There being no one wishing to speak and no written comments received by the City Clerk, Mayor Dutrey closed the public hearing and returned the matter to the City Council for consideration Council Members Mendez and Lopez inquired about the reporting process if the 20 percent vacancy rate is surpassed in a unit.

Assistant City Manager/Director of Human Services Richter advised more thorough reporting would be required, including information about the duration of recruitments, advertisement methods, and barriers to fill unit positions in the prior year.

City Manager Starr noted AB 2561 became effective this year, making this the first report, and he presumes the law will likely be amended due to issues raised by public entities, which were not consulted for input on the bill. He stated staff finds the law's language vague on report format and lacking in provisions to adjust the 20 percent threshold for extenuating circumstances, like ongoing recruitments, staffing adjustments and departmental reorganizations since the last budget adoption, delays due to budget constraints, and contracting out of services—all of which affect vacancy rates.

Council Member Mendez pointed out that Measure L funds were allocated into bonds for public infrastructure projects rather than improving employee salaries for more competitive pay.

City Manager Starr advised that was the direction approved by the City Council.
