X. RESPONSE
A. Consider Receiving and Filing a Response to City Council Inquiry Related to Producing City Council Meeting Agenda Packets Earlier in Order to Provide Additional Time for City Council Review Consider Providing Direction to Staff Related to the Agenda Packet Production Schedule
Council Member Mendez expressed a preference for Scenario No. 2, which proposes rescheduling council meetings to either Tuesdays or Wednesdays to allow for additional review time.
Mayor Pro Tem Martinez noted that modifying the Agenda process would primarily benefit the City Council and acknowledged that staff may be negatively impacted by the adjusted timeline.
Joint City Council/Successor Agency Board/Montclair Housing Corporation Board/Montclair Housing Authority Commission/ Montclair Community Foundation Board Meeting Minutes – September 2, 2025 Page 4 of 5 City Manager Starr indicated that Tuesdays are generally not feasible for City Attorney Robbins due to her role as City Attorney for Loma Linda, which holds its meetings on Tuesdays. He noted Wednesdays would impact Montclair’sCommunity Activities Commission meetings.
He advised of staff’s preference forScenario No. 3 over No.2.
Council Member Lopez inquired about the possibility of presenting urgent items as emergency items requiring four–fifths vote of the City Council if necessary.
City Manager Starr stated it is an option for emergency matters; however, in cases of urgent matters that are simply not ready in time for the scheduled agenda posting, agenda packet distribution could be delayed until the following week if necessary.
Council Member Ruh stated he has arranged his work schedule with his employer to enable his attendance at City Council Meetings, so changing the meeting schedule to a different day of the week would not be feasible for him.
City Manager Starr proposed the City Council select a scenario and implement a six–month trial period to assess its effectiveness and assess any impacts on internal operations.
Mayor Pro Tem Martinez indicated a desire to receive feedback from and consider negative impacts to staff before finalizing a decision.
Mayor Dutrey discussed potential changes to the Brown Act currently advancing through the state legislature, which would introduce new requirements for agendas, including more public participation options and the provision of agendas in other languages. He determined Scenario No.3 would best prepare staff to accommodate the additional steps required should the legislation succeed, and publishing the packet a week earlier would offer substantially more time for City Council review; therefore, he considered it to be the most suitable option.
