CITY COUNCIL
AGENDA REPORT
DATE: SEPTEMBER 15, 2025
SECTION: PUBLIC HEARINGS
ITEM NO.: A
FILE I.D.: LDU457
DEPT.: COMMUNITY DEV.
PREPARER: M. DIAZ
SUBJECT: FIRST READING — CONSIDER ORDINANCE NO. 25–1015 AMENDING THE NORTH
MONTCLAIR DOWNTOWN SPECIFIC PLAN (NMDSP) TO ALLOW MEDICAL USES WITHIN THE STATION DISTRICT LAND USE ZONE (CASE NO. 2025–06)
CONSIDER SETTING A PUBLIC HEARING FOR SECOND READING AND TO CONSIDER ADOPTION OF ORDINANCE NO. 25–1015 ON MONDAY, OCTOBER 20, 2025, AT 7:00 P.M. IN THE CITY COUNCIL CHAMBERS
REASON FOR CONSIDERATION: The City Council is requested to consider Ordinance No. 25–1015 amending the North Montclair Downtown Specific Plan (NMDSP) to allow medical uses within the plan’s Station District land use zone. On Monday, August 11, 2025, the Montclair Planning Commission, by a vote of 5–0, approved Planning Commission Resolution No. 25–2010 recommending City Council adoption of the proposed specific plan amendment.
Amending the Official Zoning Map requires a City Council ordinance, which must undergo two separate readings at different meetings. The ordinance is introduced at a public hearing, during which the first reading may occur. Adoption can take place at least five days after the first reading, during a subsequent regular meeting following the second reading. If substantial changes are made after the first reading, the revised ordinance must be re–introduced at a new public hearing as a first reading. A copy of proposed Ordinance No. 25–1015 is attached for City Council review and consideration.
BACKGROUND: The proposed specific plan amendment was initiated at the request of Village Partners Ventures LLC, the developer of the Village at Montclair, a mixed–use development project, located on the north side of the Arrow Highway and Fremont Avenue intersection. The project is located in the Station District zone of the NMDSP and is nearing completion (Exhibit A). The developers want to fill a portion of their mixed–use lease space with a dental practice, which is currently not permitted in the Station District of the NMDSP.
Proposed Ordinance No. 25–1015 would amend the land use section of the NMDSP to allow “Medical Services – Doctor/Dentist Office” as a permitted use within the plan’s Station District (SD) zone. The amendment would revise Table 5–2, Allowable Land Uses and Permit Requirements, located in Chapter 5 of the document from Not Permitted (––) to Permitted (P), as indicated in Exhibit B.
Further, the request would amend the existing definition of “Medical Services – Doctor Office” (located in the Glossary on p.5:68 of the NMDSP) to read as follows:
Medical Services – Doctor/Dentist Office: A facility other than a hospital where medical, dental, mental health, surgical, and/or other personal health care services are provided on an outpatient basis, and that accommodates no more than four licensed primary practitioners (for example, chiropractors, medical doctors, psychiatrists, dentists, orthodontists, periodontist etc., other than nursing staff) within an individual office suite. Counseling services by those MONTCLAIR CITY COUNCIL MEETING – 09/15/2025 Page 4 of 118 other than medical doctors or psychiatrists are included under "Offices – Professional/Administrative." Doctor offices are defined as those professional offices that allow doctors and dentists to provide duly licensed professional services.
The proposed change, if approved, would allow medical uses, per the modified definition, as permitted uses in the SD zone, as currently allowed in the Town Center (TC) zone of the NMDSP.
The NMDSP is a “form–based” code created to create a walkable, pedestrian–oriented, retail and residential ‘‘place’’ close to the Montclair Transcenter. It is comprised of four land use zones: the Station District (SD), Town Center (TC), Corridor Residential (CR), and Neighborhood Residential (NR). In 2017, the City amended the NMDSP to expand the boundaries of the plan and to update development standards of the document to guide future development in the area tied to the anticipated extension of the Foothill Gold Line rail line to the City. As part of the 2017 update, the planning area, including mixed–use opportunities, was expanded and key locations selected to provide future residents with local services, food choices, and modest retail options as a means of supporting the vision of the plan.
As indicated above, the NMDSP is comprised of four land use zones, with the SD and TC zones with the highest residential potential, and the areas where the highest benefits of urban life could be achieved: walkability, access to regional transportation, commercial retail and services, and entertainment. The SD zone is anchored by the Montclair Transcenter, the planned future terminus of the Gold Line Light Rail Line. Currently, the SD zone allows a wide variety of uses and services; however, professional medical uses are excluded. Allowing the proposed medical uses in the SD zone would be consistent with what is allowed in the TC zone, where such uses already exist with little to no impacts.
Further, the proposed specific plan amendment would not impact existing medical uses within the boundaries of the NMDSP that have been duly permitted and have current business licenses. Such existing medical uses may continue to operate no matter which zone they may be located in. If and when a transitional use is discontinued or replaced, then the provisions for Transitional Uses in the NMDSP would be apply and be implemented.
Staff finds the proposed specific plan amendment to include non–emergency out–patient professional medical and or dental uses in the SD zone to be appropriate as these types of uses are a regular and essential feature of office or retail–based commercial areas within urban communities and are generally quiet operations that make for good neighbors in proximity to residential uses. Medical Doctor/Dental office uses are typically well managed and maintained, posing little to no adverse impacts on adjacent properties. The SD and TC zones are the key urban zones of the NMDSP.
The vast majority of non–emergency outpatient medical uses are smaller–scale operations that occupy existing commercial lease spaces in projects developed by other parties. On rare occasions, a medical use might seek to construct its own building on a freestanding parcel. In such cases, the project becomes a development project that requires a separate review process subject to the applicable development standards of the NMDSP. The initial beneficiary of the proposed specific plan amendment would be the Village at Montclair. Upon approval, the Village at Montclair project was required to provide ground commercial lease space in Buildings 1, 2, and 4 to ensure the project would eventually become mixed–use, as intended. A dental group has indicated interest MONTCLAIR CITY COUNCIL MEETING – 09/15/2025 Page 5 of 118 in a long–term lease within a portion of the available ground floor space of one of the buildings in the project. The proposed amendment would allow the developer to continue with their negotiations to complete the lease.
Allowing medical uses in the SD zone would be consistent with the General Plan and the Regulatory Framework as amended in 2016. Moreover, it would not hinder or prohibit the walkability, transportation, access to commercial, entertainment, and retail establishments and all the social and institutional advantages of living in a mature town like Montclair. Thus, the proposed amendment would be consistent with the goals, objectives, and design guidelines in the NMDSP.
Based on the foregoing information, the proposed amendment would not result in any new significant impact, nor would a substantial increase in the severity of impacts from that described in the 2016 NMDSP Supplemental Environmental Impact Report (SEIR) occur.
Finally, based on a review of the additional analysis conducted by City staff and a review of the previously certified and adopted environmental documents, the NMDSP, as amended, complies with all of the requirements of, and is of approximately the same type and intensity of land use that is allowed in, the 2016 NMDSP, as analyzed in the 2016 NMDSP SEIR. The proposed amendment would not result in new impacts or changed circumstances that would require a new environmental document as described in the following sections.
Specific Plan Amendment Findings:
1. Public Welfare. Approval of the specific plan amendment will not create conditions materially detrimental to the public health, safety and general welfare. The proposed specific plan amendment to include non–emergency out–patient professional medical and or dental uses in the SD zone is appropriate as these types of uses are a regular and essential feature of office or retail based commercial areas within urban communities and are generally quiet operations that make for good neighbors in proximity to residential uses. “Medical Services – Doctor/Dental Office” uses are typically well managed and maintained, posing little to no adverse impacts on adjacent properties.
2. General Plan Consistency. The specific plan amendment is consistent with the goals, objectives, and policies of the General Plan that led to the approval of the form–based and transit–oriented NMDSP with the intent of improving the areas surrounding the Montclair Transcenter. The addition of “Medical Services – Doctor/Dentist Office” as a permitted use within the Station District is consistent with the goal of creating a compact, walkable mixture of housing and community– oriented retail, including health/fitness facilities, residential uses, general retail uses, neighborhood markets, professional and business services, banks, offices, and restaurants.
3. Land Use Compatibility. The specific plan amendment is compatible with the zoning and land use on nearby properties and leaves the specific plan internally consistent.
The SD currently allows a wide variety of a compact, walkable mixture of housing and community–oriented retail, including health/fitness facilities, residential uses, general retail uses, neighborhood markets, business services, banks, offices and restaurants.
Professional business, service and government offices are also permitted in the SD.
The addition of “Medical Services – Doctor/Dentist Office” as a permitted use within the SD zone of the NMDSP is appropriate and consistent with other uses permitted in the same zone.
MONTCLAIR CITY COUNCIL MEETING – 09/15/2025 Page 6 of 118
4. Property Suitability. The specific plan amendment is suitable for the location, access, visual character and topography of the subject properties. The vast majority of non–emergency outpatient medical uses, as defined herein, are smaller scale operations that occupy existing commercial lease space in projects developed by other parties. On rare occasions, a medical use might seek to construct its own building on a freestanding parcel. In such cases, the project becomes a development project that requires a separate review process subject to the development standards of the NMDSP that would apply to ensure compatibility with the surrounding environment.
Public Notice and Comment: On July 18, 2025, a notice of a public hearing on proposed specific plan amendment was published in the Inland Valley Daily Bulletin per State law, for the August 11, 2025, Planning Commission meeting. There were no comments submitted to the Commission regarding the proposal.
On August 22, 2025, a notice of a public hearing on the proposed specific plan amendment via Ordinance No. 25–1015 was published in the Inland Valley Daily Bulletin per State law, for the September 15, 2025 City Council meeting. As of the writing of this report, no comments from the public have been received.
Environmental Assessment: The City has completed a consistency evaluation for the proposed Amendment to the NMDSP Project pursuant to Public Resources Code (PRC) §21166 and State CEQA Guidelines §15162.
This evaluation was performed to determine if conditions specified in PRC §21166 and State CEQA Guidelines §15162 would require subsequent environmental review for the proposed Medical Services – Doctor Office use in the SD land use zone. As outlined in this evaluation, the City has determined that the proposed medical use is adequately covered by the original NMDSP Amendment Project Final SEIR (SCH No. 2009091021) (2016 NMDSP SEIR) certified by the City Council on March 20, 2017; and would not result in new impacts or any substantial changes to any significant effects previously identified.
FISCAL IMPACT: Adoption of Ordinance No. 25–1015 would have no direct impact to the General Fund. The applicant paid for the proposed specific plan amendment process and will pay for the cost of public notifications in the Inland Valley Daily Bulletin.
Potential future “Medical Services – Doctor/Dentist Office” uses would be required to obtain zoning clearance and business licenses which are renewed each year with fees based on gross receipts from the previous year.
RECOMMENDATION: Staff recommends the City Council take the following actions:
1. Introduce and conduct the first reading of Ordinance No. 25–1015 amending the NMDSP to allow medical uses within the Station District land use zone (Case No. 2025–06).
2. Set a public hearing for second reading and to consider adoption of Ordinance No. 25–1015 on Monday, October 20, 2025, at 7:00 p.m. in the City Council Chambers.

SECTION II.
Based upon the entire record before the City Council during the above–referenced hearing on September 15, 2025, including written and oral staff reports together with public testimony, the City Council hereby finds as follows with respect to the recommendation of approval for the proposed specific plan amendment under Case No. 2025–06, based on the findings enumerated below:
Specific Plan Amendment Findings
1. Public Welfare. Approval of the specific plan amendment will not create conditions materially detrimental to the public health, safety and general welfare. The specific plan amendment changes the text of Table 5–2, Allowable Land Uses and Permit Requirements, in Chapter 5 of the NMDSP for “Medical Services – Doctor/Dentist Office” in the SD land use zone from “not permitted” to “permitted” as indicated in Exhibit “B,” and
SECTION IV.
The specific plan amendment modifies the definition of “Medical Services – Doctor Office” in the NMDSP’s Glossary Section (pg. 5:68) to be as follows:
Medical Services – Doctor/Dentist Office: A facility other than a hospital where medical, dental, mental health, surgical, and/or other personal health care services are provided on an outpatient basis, and that accommodates no more than four licensed primary practitioners (for example, chiropractors, medical doctors, psychiatrists, dentists, orthodontists, periodontist etc., other than nursing staff) within an individual office suite. SUBJECT: CONSIDER APPROVAL OF TENTATIVE PARCEL MAP NO. 20694 LOCATED AT 4100
MISSION BOULEVARD
CONSIDER AUTHORIZING PARCEL MAP NO. 20694 TO BE RECORDED WITH THE
OFFICE OF THE SAN BERNARDINO COUNTY RECORDER, SUBJECT TO FINAL
APPROVAL BY THE CITY ENGINEER
REASON FOR CONSIDERATION: Land subdivisions, including parcel maps and tract maps, are allowed by the Subdivision Map Act, subject to City Council approval. The City Council is requested to consider approval of Tentative Parcel Map No. 20694 located at 4100 Mission Boulevard, and authorize recordation of the parcel map with the San Bernardino County Recorder’s Office, subject to final approval by the City Engineer.
BACKGROUND: On March 13, 2023, the Planning Commission adopted Resolution No. 23–1981 approving Tentative Parcel Map No. 20694. Tentative Parcel Map No. 20694 is a new three–unit light industrial park development on a vacant 1.01–acre site at the intersection of Mission Boulevard and Pipeline Avenue.
Public improvements with the project include the installation of a new public sewer line to serve the site, the undergrounding of existing on–site overhead wires, and the removal of utility poles. Finally, since the developer intends to sell the lots individually, the need for the recordation of Covenants, Conditions, and Restrictions (CC&Rs) is necessary to establish an owners association to maintain all on–site property improvements, including parking areas, common areas, trash enclosures, gates, fences, walls, vehicular access ways, sewers, storm drain system, exterior light fixtures, fire prevention water systems, landscaping, irrigation systems, signs, and security cameras.
The developer has designed the private road width and parking areas to accommodate Fire Department, Public Works, and Burrtec trash truck access. The developer will construct a new drive approach off of Mission Boulevard and any necessary curb, gutter, and sidewalk improvements along the public right–of–way. Finally, the remaining residences at the north end of the private street will continue to have access via the private street to Mission Boulevard.
Landscaping is proposed throughout the site’s frontage, along the boundaries of the property, and within the parking lot landscaped planters. The plans propose drought– tolerant plant materials and trees such as Palo Verde, Forrest Pansy, Crape Myrtle, and Brisbane Box Trees. Foxtail Agave, Blue Glow Agave, Dwarf Coastal Rosemary, Japanese Sedge, Cassa Blue Fox Lily, Variegated Flax Lily, and Brakelights Yucca are among the proposed shrubbery. The developer will be using 6– to 8–inch sized cobblestone and Palm Springs Gold ¾” gravel as ground cover and accents within the planting beds.
Irrigation for the site is designed to conserve water in compliance with the City's Water Conservation Ordinance, and State conservation requirements.
MONTCLAIR CITY COUNCIL MEETING – 09/15/2025 Page 22 of 118 Finally, the tentative parcel map is consistent with the City of Montclair’s General Plan and Zoning Ordinance requirements. The Public Works Department has reviewed and approved the improvement plans.
FISCAL IMPACT: Approval of Tentative Parcel Map No. 20694 will create an unknown but positive indirect fiscal impact to the City through property value and sales taxes.
RECOMMENDATION: Staff recommends the City Council take the following actions:
1. Approve Tentative Parcel Map No. 20694 located at 4100 Mission Boulevard; and
2. Authorize Parcel Map No. 20694 to be recorded with the Office of the San Bernardino County Recorder, subject to final approval by the City Engineer.

SUBJECT: CONSIDER DECLARING A 2005 FORD TAURUS (UNIT 121) AS A SURPLUS VEHICLE
AVAILABLE FOR PARTS OR FOR SALE AT AUCTION
REASON FOR CONSIDERATION: The City Council is requested to consider declaring a 2005 Ford Taurus (Unit 121) as a surplus vehicle available for parts or for sale at auction.
BACKGROUND: The 2005 Ford Taurus (Unit 121) is out of commission, and has not been utilized in recent years due to frequent breakdowns and the need for continuous repairs. Additionally, there is internal interior wear and tear on the vehicle and external damage including a broken windshield.
The vehicle was originally acquired as a detective vehicle for the Police Department and, after being decommissioned as a police vehicle, was subsequently reassigned to the Fire Department, then the Administrative Services Department, and was finally used as a back–up Code Enforcement Division vehicle.
Below is the information about the vehicle, which may be auctioned or used for parts.
Year and Model Unit No. Mileage VIN Estimated Value
2005 Ford Taurus 121 40,025 1FAFP56UX5A160391 $2,500
FISCAL IMPACT: Staff estimates the City could receive up to $2,500 dollars for declaring Unit 121 as a surplus and selling this vehicle at auction.
RECOMMENDATION: Staff recommends the City Council declare the 2005 Ford Taurus (Unit 121) as a surplus vehicle available for parts or for sale at auction.

SUBJECT: CONSIDER AUTHORIZING A $46,500 APPROPRIATION FROM THE EQUIPMENT REPLACEMENT FUND FOR THE PURCHASE OF A 2025 NISSAN PATHFINDER
FROM EMPIRE NISSAN FOR THE POLICE DEPARTMENT
CONSIDER AUTHORIZING THE REASSIGNMENT OF A 2013 FORD TAURUS (UNIT 454)
FOR ADMINISTRATIVE USE BY THE POLICE DEPARTMENT
CONSIDER AUTHORIZING THE REASSIGNMENT OF A 2011 CHEVROLET CAPRICE (UNIT 432) TO THE CODE ENFORCEMENT DIVISION
REASON FOR CONSIDERATION: The City Council is requested to consider authorizing the purchase of a 2025 Nissan Pathfinder “S” to replace a vehicle currently being used by Police Department personnel for investigations. The City Council is also requested to consider the reassignment of a 2013 Ford Taurus (Unit 454) for Administrative use by the Police Department, a 2011 Chevrolet Caprice vehicle (Unit 432) to the Code Enforcement Division.
BACKGROUND: The City Council approved the purchase of a 2025 Chevrolet Blazer SUV for investigations in the Police Department Fiscal Year 2025–26 Budget. After conducting additional research, staff has decided a 2025 Nissan Pathfinder S would be the most appropriate vehicle as an alternative to the Chevrolet Blazer SUV and is comparative in price and function.
The Nissan Pathfinder S would replace a 2013 Ford Taurus (Unit 454) in the Police Department’s fleet, which has in excess of 133,006 miles and is 12 years old. This vehicle has had several mechanical issues, including leaking engine seals and engine cooling and transmission problems.
Bid quotations for the purchase of a 2025 Nissan Pathfinder S vehicle were received from the following vendors:
Vendor Bid Amount
Empire Nissan $40,431.40
Metro Nissan $42,635.36
Puente Hills Nissan $41,156.30
Empire Nissan provided the lowest approximate bid and is the recommended vendor for this purchase. Since the above quotes are not specific to a vehicle currently within the dealerships’ inventory, staff recommends Empire Nissan Dealership, with a maximum appropriation of $46,500 to cover any potential cost increases prior to acquiring the vehicle, which is the approved cost in the Budget.
MONTCLAIR CITY COUNCIL MEETING – 09/15/2025 Page 27 of 118 While Unit 454 is not suitable as a dedicated unit for investigations due to its age, mileage, and previous mechanical issues, it would be suitable for use in administrative functions within the Police Department. Unit 454 would serve as a pool vehicle and would maintain its full complement of emergency and radio equipment.
Following the Police Department’s request for vehicle replacement for Fiscal Year 2025– 26, the Department learned that the Code Enforcement Division wanted to acquire additional vehicles for their personnel. Currently, the Police Department has a 2011 Chevrolet Caprice (Unit 432) being used for administrative purposes and available as a pool vehicle. On February 6, 2023, Unit 432 (previously identified as Unit 456) was declared as surplus and made available for parts by the City Council; however, it has been maintained in the Police Department’s fleet as a pool vehicle.
It is the Police Department’s recommendation that Unit 454 be utilized for administrative purposes and as a pool car, which would replace Unit 432 that is currently serving as a pool car in the Police Department, and that Unit 432 be reassigned to Code Enforcement.
FISCAL IMPACT: If authorized by the City Council, the purchase of a 2025 Nissan Pathfinder S vehicle for investigations would result in a maximum expenditure of $46,500 from the Police Department Fiscal Year 2025–26 Budget from the Equipment Replacement Fund Account No. 1750–4425–62020–400–00000.
No fiscal impact to the City would result from the reassignment of one Police Department vehicle (Unit 454) for administrative use, and a second (Unit 432) to the Code Enforcement Division.
RECOMMENDATION: Staff recommends the City Council take the following actions:
1. Authorize a $46,500 appropriation from the Equipment Replacement Fund for the purchase of a 2025 Nissan Pathfinder from Empire Nissan for the Police Department;
2. Authorize the reassignment of a Ford Taurus (Unit 454) for administrative use by the Police Department; and
3. Authorize the reassignment of a Chevrolet Caprice (Unit 432) to the Code Enforcement Division.

CONSIDER DECLARING A 2017 NISSAN PATHFINDER VEHICLE (UNIT 452) AS
SURPLUS AND AVAILABLE FOR PARTS OR FOR SALE AT AUCTION
REASON FOR CONSIDERATION: The City Council is requested to consider authorizing the purchase of a 2025 Honda Pilot to replace a vehicle currently used by Police Department personnel assigned to investigations. The City Council is also requested to consider declaring a 2017 Nissan Pathfinder (Unit 452) as surplus.
BACKGROUND: The City Council approved the purchase of a 2025 Honda Pilot vehicle for investigations in the Police Department Fiscal Year 2025–26 Budget. The Honda Pilot would replace a 2017 Nissan Pathfinder (Unit 452) in the Police Department’s fleet, which has nearly 200,000 miles and is eight years old. The unit has had several electrical– related issues and engine cooling components replaced. Due to the high mileage of this unit, some major components will soon reach their life expectancy and need to be replaced, which may include the engine and/or transmission.
Bid quotations for the purchase of a 2025 Honda Pilot were received from the following vendors:
Vendor Bid Amount
Metro Honda $42,165.02
Diamond Honda $47,294.85
Penske Honda $48,097.71
Metro Honda provided the lowest approximate bid and is the recommended vendor for this purchase. Since the above quotes are not specific to a vehicle currently in the dealerships’ inventory, staff recommends purchasing from Metro Honda, with a maximum appropriation of $48,500 to cover any potential cost increases prior to acquiring the vehicle, which is the approved cost in the Budget.
During the past year, Investigations has increased its staffing to include a newly created detective position for the HIDTA 50 Task Force assignment. Unit 452 will continue to be used by the detective assigned to HIDTA 50 until another vehicle is purchased as a new addition to the Police Department’s fleet at another time. At that undetermined date, Unit 452 will be declared surplus and made available for parts or for sale at auction.
The vehicle identification information is as follows:
Year and Model Unit No. Mileage VIN Estimated Value

No fiscal impact to the City would result from declaring an existing vehicle in the Police Department fleet as surplus and making it available for parts or sale at auction. However, the City could receive up to $5,000 from the auction of said vehicle. Proceeds from the sale would be credited to the State Asset Forfeiture Fund 1140.
RECOMMENDATION: Staff recommends the City Council take the following actions:
1. Authorize a $48,500 appropriation from the Equipment Replacement Fund for the purchase of a 2025 Honda Pilot from Metro Honda for the Police Department; and
2. Declare a 2017 Nissan Pathfinder (Unit 452) as surplus and available for parts or for sale at auction.

SUBJECT: CONSIDER AUTHORIZING A $109,491.14 APPROPRIATION FROM THE EQUIPMENT REPLACEMENT FUND FOR THE PURCHASE OF TWO 2026 FORD POLICE INTERCEPTORS FROM FRITTS FORD FOR THE POLICE DEPARTMENT CONSIDER DECLARING A 2011 FORD CROWN VICTORIA (UNIT 426) AND A 2018 FORD POLICE INTERCEPTOR (UNIT 423) AS SURPLUS AND AVAILABLE FOR PARTS OR
FOR SALE AT AUCTION
REASON FOR CONSIDERATION: The City Council is requested to consider authorizing the purchase of two 2026 Ford Police Interceptors to replace two vehicles currently being used by Police Department Patrol personnel. The City Council is also requested to consider declaring one 2011 Ford Crown Victoria vehicle (Unit 426) and one 2018 Ford Police Interceptor (Unit 423) as surplus.
BACKGROUND: The City Council approved the purchase of two 2025 Ford Police Interceptors for patrol use in the Police Department Fiscal Year 2025–26 Budget. The new vehicles would replace a 2011 Ford Crown Victoria (Unit 426) and a 2018 Ford Police Interceptor (Unit 423) in the Police Department’s fleet.
Unit 426 is a 2011 Ford Crown Victoria with high mileage, and is the oldest unit in the fleet. The vehicle has a worn interior with a ripped seat. The exterior has several small dents and scratches along with sun–damaged headlights. This vehicle is currently out of service due to the fact that replacement parts are not easy to find and the cost of replacement parts are expensive. This vehicle is also out of warranty and mechanical repairs could result in significant costs.
Unit 423 is a 2018 Ford Police Interceptor with high mileage and with interior rips and tears near the driver’s seat and door panel. There are several small dents and scratches along the exterior of the vehicle along with tears in the exterior graphics. The sun– damaged headlights make it difficult to see while driving at night. Throughout its service life, this vehicle has had several mechanical issues, including a transmission rebuild, and both water pump and electrical issues. In speaking with the City’s mechanic, the PTU and transfer case will soon need replacement due to high mileage. This unit is currently out of warranty, and new issues could result in substantial costs in repairs.
Fritts Ford has been the chosen vendor for Police Department vehicles for the past several fiscal years, and its pricing has been consistently the lowest for patrol black– and–white Police Interceptor vehicles. During the process to requests bids, Fritts Ford was the first dealer contacted. Fritts Ford confirmed they had 2025 Ford Police Interceptors available at $55,281.12 each, for a total of $110,562.24 for two. However, they are not keyed alike to the Department’s existing fleet, and to complete the re– keying would be an added expense. Fritts Ford advised that the window to order 2026 Ford Police Interceptors was currently open; however, they could not be sure as to how much longer. The total estimated cost for two 2026 Ford Police Interceptors is MONTCLAIR CITY COUNCIL MEETING – 09/15/2025 Page 31 of 118 $109,491.14. This is approximately $1,000.00 less than the 2025 vehicles, which does not include the extra cost for re–keying.
During the last bidding process for black–and–white Police Interceptors, bid quotations were sent out to three vendors; of these three vendors, only Fritts Ford responded with a bid and was the chosen vendor due to their history of competitive pricing. Staff believes this further justifies using Fritts Ford as a sole–source vendor for this vehicle purchase.
Due to concerns that the purchasing window could close, staff obtained a purchase order to secure the purchase of these two vehicles from Fritts Ford prior to City Council approval, as the vehicles are included in the approved FY 2025–26 Budget.
Additionally, Units 423 and 426 are proposed to be declared as surplus and made available for parts to support vehicles currently in service in the Police Department’s fleet, or for sale at auction. The vehicles’ identification information is as follows:
Year and Model Unit No. Mileage VIN Estimated Value
2011 Ford Crown Victoria 426 113,546 2FABP7BV4BX159622 $5,000 2018 Ford Police Interceptor 423 122,629 1FM5K8AR2JGA83592 $7,000 FISCAL IMPACT: If authorized by the City Council, funding for the purchase of two black–and–white 2026 Ford Police Interceptors for patrol use would result in an expenditure of $109,491.14 from the Police Department Fiscal Year 2025–26 Budget from Equipment Replacement Fund Account No. 1750–4426–62020–400–00000.
No fiscal impact to the City would result from declaring existing vehicles in the patrol fleet as surplus and making them available for parts or sale at auction. However, the City could receive up to $12,000 from the auction of said vehicles. Proceeds from the sale would be credited to the Equipment Replacement Fund.
RECOMMENDATION: Staff recommends the City Council take the following actions:
1. Authorize a $109,491.14 appropriation from the Equipment Replacement Fund for the purchase of two 2026 Ford Police Interceptors from Fritts Ford for the Police Department; and
2. Declare a 2011 Ford Crown Victoria (Unit 426) and a 2018 Ford Police Interceptor (Unit 423) as surplus and available for parts or for sale at auction.

CITY COUNCIL
AGENDA REPORT
DATE: SEPTEMBER 15, 2025
SECTION: CONSENT - RESOLUTIONS
ITEM NO.: 1
FILE I.D.: PKG275
DEPT.: PUBLIC WORKS
PREPARER: U. MCKENZIE
SUBJECT: CONSIDER ADOPTION OF RESOLUTION NO. 25–3497 RESCINDING AND REPLACING RESOLUTION NO. 25–3492 DESIGNATING RESTRICTED PARKING ON PUBLIC STREETS
AND ALLEYS TO INCLUDE RESTRICTED OVERNIGHT PARKING ON THIRD STREET
BETWEEN RAMONA AND SILICON AVENUES
REASON FOR CONSIDERATION: The Mission and Ramona Business Park Project (Tract Map No. 20381) involves the construction of eight buildings that provide approximately 513,295 square feet of new flexible space for light manufacturing and distribution uses.
The site improvements include buildings with loading docks, trailer stalls, on–site parking spaces, and landscape improvements.
The project site is located adjacent to fully–improved streets that will provide good access and allow for appropriate internal pedestrian and vehicular circulation. The proposed public streets within the project boundaries will be fully improved and serve to link the project to adjacent fully improved streets.
Per Condition No. 121(d) of Resolution No. 22–1974 relating to Tract Map No. 20381, the developer is required to install “NO OVERNIGHT PARKING” signs on Third Street from Ramona Avenue to the end of the project site limits.
BACKGROUND: Section 22658 of the California Vehicle Code sets forth parking regulations by towing or citation. Chapter 8.36 of the Montclair Municipal Code (MMC) outlines a time limit to the stopping, standing, and parking of vehicles on City streets and other public properties. Additionally, MMC Section 8.36.150 authorizes the City Engineer to impose parking time limits or prohibit parking on designated streets with signs or markings on curbs. Finally, MMC Section 8.16.010 recognizes that the City Council may adopt a Resolution citing parking restrictions.
The proposed resolution imposes a permanent restriction on overnight parking on both the north and south side of Third Street between Ramona Avenue and Silicon Avenue.
Approval of Resolution No. 25–3497 would allow enforcement actions related to violations after the regulations have been posted on the street.
FISCAL IMPACT: The cost to purchase signs, posts, and hardware to implement the recommendations in Resolution No. 25–3497 would be approximately $500. Funds for the proposed changes are available in the Public Works Fiscal Year 2025–26 General Fund Budget.
RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 25–3497 rescinding and replacing Resolution No. 25–3492 designating restricted parking on Public Streets and Alleys to include restricted overnight parking on Third Street between Ramona and Silicon Avenues.

RESOLUTION NO. 25–3497
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MONTCLAIR RELATED TO RESTRICTED PARKING
ON PUBLIC STREETS AND ALLEYS
WHEREAS, the State of California provides, under Division 11, Chapter 9, Section 22507 of the Vehicle Code, that the City may adopt regulations by resolution or ordinance; and
WHEREAS, Section 8.16.010 of the Montclair Municipal Code provides that parking restrictions may be adopted by Resolution; and
WHEREAS, parking restrictions that were adopted by the City Council's adoption of Resolution No. 25–3492 are being rescinded by the adoption of this Resolution to incorporate all restricted parking on public streets in one Resolution; and WHEREAS, an exemption from these parking restrictions may be granted by the Public Works Director on one or more of the following grounds:
9 A residence that has alley access only to the garage (and residents are unable to park in the garage) or has no garage;
9 A residence that has alley access only to the garage (the size of which can only accommodate two or fewer vehicles) at which two or more vehicles are registered;
9 A residence at which a family member with a physical disability resides and such resident possesses a State of California Department of Motor Vehicles Disabled Person Parking placard and/or license plate;
9 Any other situation that would demonstrate a hardship created by the posting of restricted parking signs as determined by the City Engineer; and WHEREAS, execution of an agreement with the City would be required for any resident issued the parking exemption. The agreement will require that the resident be responsible for clearing the gutter in front of his/her home.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Montclair does hereby rescind Resolution No. 25–3492 and adopt the following parking restriction districts in conformance with Section 8.16.010 of the Montclair Municipal Code:
