SUBJECT: CONSIDER DECLARING A CIRCUL–AIR FIRE HOSE DRYER AS SURPLUS AND AVAILABLE
FOR DONATION TO THE FIRE DEPARTMENT OF HUATABAMPO, SONORA IN MEXICO REASON FOR CONSIDERATION: The City Council is requested to consider declaring a Circul–Air Fire Hose Dryer as surplus and available for donation to the Fire Department of Huatabampo, Sonora in Mexico.
BACKGROUND: The Montclair Fire Department currently possesses a Circul–Air Fire Hose Dryer (Model No. T6–1T–20, Serial No. 10053), which was purchased in or around 1970.
At the time of purchase, fire hoses were primarily constructed of cotton materials and required drying after use.
Advancements in fire hose technology have resulted in the widespread use of synthetic materials, which do not require the same drying process. As a result, this equipment is no longer needed and has been out of service for an extended period of time.
Although no longer useful to the Montclair Fire Department, the equipment may still provide value to a fire department with fewer resources and the need and ability to utilize it. Upon declaration as surplus by the City Council, a representative of the Huatabampo Fire Department will coordinate the pickup and transportation of the equipment.
The item included in this donation is:
Quantity Item Model Serial No.
1 Circul–Air Fire Hose Dryer T6–1T–20 10053
The representative for the Huatabampo Fire Department has acknowledged that the City of Montclair is not making any warranties or representations as to the condition or functionality of the equipment.
FISCAL IMPACT: Donating the listed item would have no fiscal impact.
RECOMMENDATION: Staff recommends the City Council declare a Circul–Air Fire Hose Dryer as surplus and available for donation to the Fire Department of Huatabampo, Sonora in Mexico.

SUBJECT: CONSIDER AUTHORIZING THE CITY MANAGER TO AWARD A CONTRACT FOR
CONSTRUCTION OF THE ARROW HIGHWAY REHABILITATION AND TRAFFIC SIGNAL
INTERCONNECT PROJECT
CONSIDER AUTHORIZING A $6,500,000 APPROPRIATION FROM THE REDEVELOPMENT PROJECT AREA NO. III TAX ALLOCATION BOND FUND, 2021 LEASE REVENUE
BOND FUND, AND SEWER FUND, AS APPROPRIATE, FOR COSTS RELATED TO
CONSTRUCTION OF THE PROJECT
REASON FOR CONSIDERATION: The City Council is requested to consider authorizing the City Manager to award a contract, and authorizing a $6,500,000 appropriation from Redevelopment Project Area No. III Tax Allocation Bond Fund, 2021 Lease Revenue Bond Fund, and Sewer Fund, as appropriate, for costs related to construction of the Arrow Highway Rehabilitation and Traffic Signal Interconnect Project.
BACKGROUND: The section of Arrow Highway in Montclair, located between Mills Avenue and Benson Avenue, is an important corridor within the City. The Arrow Highway Rehabilitation and Traffic Signal Interconnect Project provides enhancements to Arrow Highway from the San Antonio Creek channel to Central Avenue, and includes sewer upgrades, roadway improvements, new signage and striping, new landscaped center median and parking area islands, and fiber optic traffic signal interconnect improvements.
On March 16, 2026, City Council approved the plans and specifications and authorized staff to advertise the project for construction bid proposals.
The planned and recently completed improvements to Arrow Highway and Fremont Avenue are essential to the City’s North Montclair revitalization initiative, which emphasizes complete streets principles and street beautification. To this end, the plan has been organized into three phases: Arrow Highway and Fremont Avenue intersection improvements adjacent to the Village Partners’ Project (completed), Fremont Avenue improvements from Arrow Highway to Moreno Street (awarded), and the subject Arrow Highway improvements from Central Avenue to the San Antonio Creek Channel. This phased approach facilitates coordination with nearby development activities, such as the Village at Montclair mixed–use development project, anticipated utility upgrades, and available grant funding opportunities.
The Arrow Highway Rehabilitation and Traffic Signal Interconnect Project was included in the City’s 2024–2029 Five–Year Capital Improvement Plan, which was approved by the City Council on November 4, 2024, and last updated on December 15, 2025.
This project is part of a SBCTA Active Transportation Planning package, which has a delivery completion date of January 2027. It is important to start construction at the earliest possible date to allow for the longest construction period. As such, staff is requesting the City Council authorize the City Manager to award the contract for construction of the project. A follow–up staff report will be provided to the City Council.
MONTCLAIR CITY COUNCIL MEETING – 05/04/2026 Page 7 of 102 FISCAL IMPACT: The cost of constructing the Project is estimated at $6,500,000, which includes a 15 percent construction contingency and 10 percent for construction management, inspection–testing, and permits. The higher contingency is recommended due to the volatility in oil prices. The Project will be funded by Redevelopment Project Area No. III Tax Allocation Bond Fund, 2021 Lease Revenue Bond Fund, and Sewer Fund.
At this time, it is difficult to determine the allocation cost because construction bids have not been received. The allocation of cost from each fund will be determined with the selected contractor’s bid schedule submittal. For example, costs relating to the construction of sewer replacement will be allocated from the Sewer Fund.
RECOMMENDATION: Staff recommended that the City Council take the following actions in relation to the Arrow Highway Rehabilitation and Traffic Signal Interconnect Project:
1. Authorize the City Manager to award a contract for construction of the Project; and
2. Authorize a $6,500,000 appropriation from the Redevelopment Project Area No. III Tax Allocation Bond Fund, 2021 Lease Revenue Bond Fund, and Sewer Fund, as appropriate, for costs related to construction of the Project.

PREPARER: A. COLUNGA
SUBJECT: CONSIDER APPROVAL OF AGREEMENT NO. 26–22 WITH OMNITRANS TO ACCEPT A GRANT AWARD OF $147,600 TO PURCHASE TWO VANS AND VEHICLE WRAPS FOR
THE GOLDEN EXPRESS SENIOR TRANSPORTATION PROGRAM, SUBJECT TO ANY
REVISIONS DEEMED NECESSARY BY THE CITY ATTORNEY
REASON FOR CONSIDERATION: The City Council is requested to consider approval of Agreement No. 26–22 with Omnitrans to accept a grant award of $147,600 to purchase two new vans and vehicle wraps for the Golden Express Senior Transportation Program.
A copy of proposed Agreement No. 26–22 is attached for the City Council review and consideration.
BACKGROUND: In Fall of 2025, Omnitrans released a call for projects aimed at improving mobility or enhancing the coordination of transportation services with a focus on addressing the needs of Seniors. The City of Montclair submitted an application requesting funding for the Montclair Golden Express Senior Transportation program.
The Montclair Golden Express has provided transportation service for over 22 years. The program provides free curb–to–curb service for seniors 60 years of age and over who reside in Montclair with their errands such as trips to the grocery store, pharmacy, to City events, medical appointments, and visiting friends and relatives. Transportation is also available to medical appointments in the surrounding areas outside of the City of Montclair. Priority is given to individuals who are socially and/or economically disadvantaged.
Throughout the past 22 years that the City of Montclair has provided transportation service, there has been an increasing number of trips provided to the seniors. Between July and October 2025, the Montclair Golden Express provided 2,541 trips to 162 duplicated participants. The large number of trips and duplicated participants demonstrates the need for senior transportation and the high quality of service Montclair’s Golden Express provides.
Previously, the City was awarded federal funding for the current Golden Express sixteen passenger bus in 2015 and received the bus in 2017. The Human Services Department has two Transportation Coordinator positions and over the past six years, the City has been unable to fill the second position. Driving the sixteen passenger bus requires a Class B license with a passenger endorsement. Through the Omnitrans Measure I call for projects, the City applied for two nine passenger vans to expand the applicant pool for drivers and to increase capacity for services to Montclair Seniors.
FISCAL IMPACT: The City was awarded $147,600 to fund two nine–passenger vans with newly designed vehicle wraps. The grant application requires a minimum $16,400 match for the balance of the costs for the vans and vehicle wraps, which was included in the proposed Fiscal Year 2026–27 Human Services Department budget.
MONTCLAIR CITY COUNCIL MEETING – 05/04/2026 Page 10 of 102 RECOMMENDATION: Staff recommends the City Council approve Agreement No. 26–22 with Omnitrans to accept a grant award of $147,600 to purchase two vans and vehicle wraps for the Golden Express Senior Transportation Program, subject to any revisions deemed necessary by the City Attorney.

The program serves Seniors 60 years of age and over who reside in Montclair with their errands such as trips to the grocery store, pharmacy, to City events, medical appointments, and visiting friends and relatives. Transportation is also available for medical appointments outside of the City of Montclair.
Throughout the past 22 years that the City of Montclair has provided transportation service, there has been an increasing number of trips provided to the seniors. Since the beginning of the fiscal year, the Montclair Golden Express has provided 2,541 trips to 162 duplicated participants, all occurring between July and October 2025. The large number of trips and duplicated participants demonstrates the need for senior transportation and the high quality of service Montclair’s Golden Express provides. SERVICES TO PROVIDE OUTREACH, DETOXIFICATION, RESIDENTIAL TREATMENT,
AND SUPPORTIVE HOUSING SERVICES FOR CITY OF MONTCLAIR CLIENTS
EXPERIENCING HOMELESSNESS AND SUBSTANCE USE DISORDERS, SUBJECT TO ANY
REVISIONS DEEMED NECESSARY BY THE CITY ATTORNEY
REASON FOR CONSIDERATION: Agreement No. 26–27 would authorize staff to retain the services of Inland Valley Recovery Services (IVRS) to provide outreach, detoxification, residential treatment, and supportive housing services for City of Montclair clients experiencing homelessness and substance use disorders, in coordination with the Montclair Special Operations and Homeless Outreach Team.
A copy of proposed Agreement No. 26–27 with Inland Valley Recovery Services is attached for City Council review and consideration.
BACKGROUND: The City of Montclair, like many communities in the region, faces ongoing challenges connecting unhoused residents experiencing substance use disorder (SUD) with the continuum of services required to stabilize and recover. Field engagement by the Montclair Code Enforcement Division Special Operations and Homeless Outreach Team has consistently identified individuals for whom short–term intervention alone is insufficient; these clients require coordinated access to detoxification, residential treatment, and supportive housing in order to exit homelessness and sustain long–term recovery. To meet this need, the City seeks to retain a licensed service provider capable of delivering these services directly upon referral from the Montclair Code Enforcement Division Special Operations and Homeless Outreach Team.
As such, staff identified the need for a qualified service provider capable of delivering the full continuum of outreach and treatment services required, including field outreach, screening, detoxification, residential treatment, and supportive housing, while meeting the documentation and reporting requirements applicable to county, state, and federally–funded public service activities.
Staff selected Inland Valley Recovery Services based on the organization’s certification as a non–profit substance use disorder treatment provider, its licensed detoxification and residential treatment capacity, its integrated model spanning outreach through supportive housing, its proximity to Montclair, and its established working relationship with other cities in the area.
Scope of Services
Under proposed Agreement No. 26–27, Inland Valley Recovery Services will deliver a coordinated continuum of services to City of Montclair clients referred through the Montclair Special Operations and Homeless Outreach Team. The core service areas include the following:
MONTCLAIR CITY COUNCIL MEETING – 05/04/2026 Page 48 of 102 • Outreach Representative: IVRS will assign a part–time outreach representative to work alongside the Montclair Special Operations and Homeless Outreach Team.
This staff member will conduct field screenings of individuals experiencing homelessness and SUD, coordinate direct intakes, arrange any required medical or psychiatric clearance, and maintain documentation of all contacts, referrals, and placements,
• Detoxification Services: IVRS will provide immediate detox and restorative services to eligible clients, including clinical assessments, medication–assisted treatment (MAT), close monitoring, and medications as necessary for safe detoxification,
• Residential Treatment: IVRS will provide 24–hour residential treatment for eligible clients, including counseling, group education, urinalysis (UA) testing, room and board, laundry, meals, and related supportive services, and • Supportive Housing (Sober Living): IVRS will provide a sober living environment with room and board, meals, laundry, case management oversight, random UA testing, and referrals to workforce development and other supportive services for clients who have achieved 30 days of sobriety. IVRS will also provide periodic training to the Montclair Special Operations and Homeless Outreach Team on Substance Use Disorder and the IVRS treatment process.
Compensation and Service Rates
Compensation under the Agreement No. 26–27 is structured as a not–to–exceed amount per fiscal year, with specific per–service rates applied to each category of care. Payments will be made on a monthly billing basis upon submission of invoices documenting services rendered. The schedule of charges is as follows:
• Not–to–Exceed Annual Amount: The total amount payable to IVRS shall not exceed $75,000 per fiscal year, inclusive of all service categories listed below, • Outreach Representative: Salary and benefits for the IVRS Outreach Representative shall not exceed $24,960 per fiscal year, based on up to 16 hours per week at an hourly rate of $30.00 over 52 weeks. Any portion of these funds not used for the Outreach Representative may be applied to the service categories listed below, • Detoxification Services: Medically appropriate detoxification services will be billed at a daily rate of $425 per client,
• Residential Treatment (Initial 30 Days): Residential treatment services will be billed at a daily rate of $190 per client for the first 30 days of treatment, • Residential Treatment (Extended Care): When continued residential treatment is clinically necessary beyond the first 30 days, services will be billed at a daily rate of $140 per client for up to an additional 30 days, and • Supportive Housing (Sober Living): Supportive housing will be provided to clients who have achieved 30 days of sobriety and are experiencing homelessness at a daily rate of $55 per client, for a maximum of 180 days.
Payments to IVRS will be made on a monthly billing basis. IVRS will submit a monthly invoice itemizing outreach hours worked, services rendered by category (detoxification, residential treatment, and supportive housing), and the rate and duration of each service, with all protected client information redacted in accordance with HIPAA. The term of the Agreement shall be from May 4, 2026 through June 30, 2027.
MONTCLAIR CITY COUNCIL MEETING – 05/04/2026 Page 49 of 102 Inland Valley Recovery Services
Inland Valley Recovery Services is a certified non–profit corporation headquartered at 1260 E. Arrow Highway in Upland, California, that provides a full continuum of substance use disorder treatment and recovery services to residents of the Inland Empire. IVRS is licensed and certified by the California Department of Health Care Services (DHCS) to provide residential treatment, detoxification, and recovery services, and operates in accordance with applicable state and federal regulations governing substance use disorder treatment providers.
IVRS operates an integrated service model that spans field outreach through long–term supportive housing, allowing a single organization to carry clients through the full recovery continuum without the service gaps that often occur when clients must be handed between providers. The organization’s clinical team delivers assessments, medication–assisted treatment (MAT), counseling, group education, case management, and random urinalysis testing, and maintains the documentation and reporting protocols required of licensed substance use disorder treatment providers.
IVRS has an established working relationship with the City of Montclair through prior engagements during which IVRS staff worked directly with the Montclair Special Operations and Homeless Outreach Team to conduct field outreach and place clients into treatment. This operational experience in Montclair, combined with the geographic proximity of IVRS’s Upland facilities, allows IVRS to respond quickly to referrals from MSOHOT and to maintain continuity of care for Montclair clients.
In addition to its work in Montclair, IVRS serves a range of partner agencies and municipalities across San Bernardino County and the broader Inland Empire, providing detoxification, residential treatment, and supportive housing services to clients referred through law enforcement outreach teams, county behavioral health programs, and community–based organizations. This regional service footprint enables IVRS to draw on a stable network of clinical staff, treatment beds, and sober living capacity to meet referral volume from the City of Montclair.
FISCAL IMPACT: Proposed Agreement No. 26–27 would authorize staff to retain the services of Inland Valley Recovery Services for a total amount not to exceed $75,000 per fiscal year for Fiscal Year 2026–27, payable from Community Development Block Grant – CV (CDBG–CV) funds allocated to the City of Montclair under the federal CARES Act to prevent, prepare for, and respond to the impacts of the COVID–19 pandemic and to address homelessness.
RECOMMENDATION: Staff recommends the City Council approve Agreement No. 26–27 with IVRS to provide outreach, detoxification, residential treatment, and supportive housing services for City of Montclair clients experiencing homelessness and substance use disorders, subject to any revisions deemed necessary by the City Attorney.

CITY COUNCIL
AGENDA REPORT
DATE: MAY 4, 2026
SECTION: CONSENT - RESOLUTIONS
ITEM NO.: 1
FILE I.D.: FLP180/SEW075
DEPT.: PUBLIC WORKS
PREPARER: R. HOERNING
SUBJECT: CONSIDER ADOPTION OF RESOLUTION NO. 26–3513 ADJUSTING THE EQUIVALENT
DWELLING UNIT MONTHLY FEE FOR SEWER SERVICE
REASON FOR CONSIDERATION: The City Council is requested to consider adoption of Resolution No. 26–3513 adjusting the equivalent dwelling unit monthly fee for sewer service.
BACKGROUND: The Inland Empire Utilities Agency (IEUA) provides sewage treatment for seven regional contracting agencies, including the City of Montclair. Treatment costs are passed on to City residents and businesses via a monthly fee based on an equivalent dwelling unit (EDU). The IEUA Board of Directors approved a rate increase for the fee charged to the contracting agencies for this sewage treatment (IEUA Resolution No. 25– 4–8) effective July 1, 2026. In order to cover the cost of the rate increase by IEUA as well as continuing to cover the City’s own sewer maintenance costs, the City must increase the rates charged to its customers. Annual adjustments in these rates may be made by City Council resolution under the requirements of Proposition 218.
On August 19, 2024, the City Council conducted a public hearing in accordance with Proposition 218 requirements. As a result of that hearing process, rate caps were approved by the City Council for a five–year period ending June 30, 2029. For Fiscal Year (FY) 2026–27, the maximum rate established by the City Council was $43.67 per EDU per month, of which $30.00 and $13.67 per EDU was projected to be the cap for IEUA and City sewer component portions, respectively. IEUA recently approved its component portion of the rate for FY 2026–27 at $29.45 per EDU effective July 1, 2026. Altogether, the total proposed sewer rate for July 1, 2026, is $43.12, which is under the $43.67 maximum rate established by the City Council for FY 2026–27.
The current rate and the proposed rate are as follows:
Effective
Date
Part 1
IEUA Sewer
Treatment
Fee
Part 2
City Sewer
Maintenance
Fund
Part 3
City Sewer
Replacement

Part 4

July 1, 2025 $27.02 $10.38 $1.75 $0.50 $39.65
July 1, 2026 $29.45 $11.42 $1.75 $0.50 $43.12
FISCAL IMPACT: Adoption of Resolution No. 26–3513 will allow the City to collect sufficient funds to pay the higher treatment rate being assessed by IEUA, increased sewer maintenance costs, and continue to contribute to the sewer replacement fund.
Regardless of the City Council’s decision to adopt Resolution No. 26–3513, the City would still be obligated to pay the increased IEUA treatment rate and identify a source of funds for the increases, or operate the sewer program at a deficit.
RECOMMENDATION: Staff recommends that the City Council adopt Resolution No. 26– 3513 adjusting the equivalent dwelling unit monthly fee for sewer service.

SUBJECT: CONSIDER ADOPTION OF RESOLUTION NO. 26–3514 AUTHORIZING THE SALARIES
AND CLASSIFICATION TITLES FOR CITY EMPLOYEES ON A CONSOLIDATED SALARY
SCHEDULE
REASON FOR CONSIDERATION: California Public Employees’ Retirement Law, the Government Code, and California Code of Regulations Section 570.5 require public entities to maintain a single, duly approved and adopted pay schedule that identifies the positions for every employee classification.
The City Council is requested to consider Resolution No. 26–3514 authorizing the salaries and classification titles for City employees on a consolidated salary schedule, a copy of which is attached for the City Council’s review and consideration.
BACKGROUND: The amended Consolidated Salary Schedule is included as Exhibit “A” to Resolution No. 26–3514. The schedule reflects the creation of positions since the previous salary schedule’s approval, as described below. • On January 7, 2026, the Personnel Committee/City Manager approved the creation of a part–time Assistant City Manager/Director of Human Services position, which went into effect January 21, 2026.
• On March 16, 2026, the Personnel Committee/City Manager approved the creation of the Senior Engineer position, effective March 16, 2026. • On March 2, 2026, the Personnel Committee/City Manager approved the creation of a part–time Executive Director of Engineering/Major Projects Manager position, effective March 23, 2026.

FISCAL IMPACT: The City Council's adoption of proposed Resolution No. 26–3514 will not result in any financial impact on the City’s General Fund. Adoption of this Resolution does not independently authorize salary adjustments; rather, it formalizes changes that have already been authorized through the enacted City budget or prior City Council actions.
RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 26–3514 authorizing the salaries and classification titles for City employees on a consolidated salary schedule.

A. Consider Adoption of Resolution No. 26–3511 Reaffirming the Provisions and Recitals of Resolution No. 22–3344 Including, but Not Limited to, the City Council’s Disapproval of Certain Conduct and Behavior by, and Censure of, Council Member Benjamin “Ben” Lopez, Re–Ratifying Protective Actions Taken by the City Manager, and Further Expanding the Censure by Directing that Certain Restrictions and Administrative/Economic Sanctions be Taken Against Council Member Ben Lopez
Carolyn Raft, resident, commented on Council Member Lopez’s lack of accountability and questioned his ability to continue serving effectively on the City Council due to his harassment and ethical liability to the City placing a financial burden on taxpayers. She urged him to accept responsibility for his actions and resign.
Alice Garcia, resident, promoted her effort to recall Council Member Lopez.
Edmund Garcia, Sr. resident, discussed community outreach efforts for Council Member Lopez’s recall and criticized the City Council’s perceived lack of concern and inaction.
Donald Mohr, resident, criticized Council Member Lopez’s previous public statements denying his actions, noting he is directly responsible for the cost of these lawsuits, and demanded his resignation.
Fred Ahrens, resident, expressed disappointment in Council Member Lopez’s conduct and the resulting financial burden on the City for litigation and a potential a recall election. He urged Council Member Lopez to resign in the interest of the City. Janetta Morrisoy, resident, commented on Council Member Lopez’s misconduct and the financial impact of his actions on taxpayers, emphasized the need for accountability, and called for his immediate resignation.
Bruce Culp, resident, emphasized Council Member Lopez was found liable for sexual harassment by a judge in civil court, and the resulting financial and reputational implications for the City.
He asked if any of the penalties have been paid back to the City by Council Member Lopez. He requested Council Member
Lopez’s photo be removed from City buildings so the victims do not have to see their harasser’s face at work every day. He urged the City to review additional avenues of its administrative authority to remove Council Members from office over
employment matters related to egregious misconduct.
Tenice Johnson, resident, submitted a written comment supporting the censure of Council Member Lopez to maintain a workplace free from harassment, noting the negative impacts on the harassed employees’ morale while he remains in office.
City Manager Starr clarified that neither he nor the City Council can remove an elected official from office, as removal is governed solely by state law through criminal conviction, grand jury action, or through limited statutory grounds. He confirmed that Council Member Lopez has not started repaying court–ordered costs, and City expenses related to the case are estimated between $700,000 and over $1 million. He noted that displaying Council Member photos in City facilities is customary, but not legally required.
Mayor Dutrey explained that the actions in the proposed resolution involved multiple closed–session discussions after the court ruling, where legal options and liabilities were assessed. He expressed longstanding concerns about the City’s liability, including settlement costs, legal expenses, and ongoing risks. He warned that continued exposure could trigger more lawsuits and that the City’s liability insurance may no longer cover claims related to his future MONTCLAIR CITY COUNCIL MEETING – 05/04/2026 Page 99 of 102

He implored Council Member Lopez to resign in the City’s best interest to reduce risk and safeguard employees.
Mayor Pro Tem Martinez criticized Council Member Lopez for ongoing violations of the prior censure that is currently in place, including refusing to attend additional harassment training and continuing to attend and engage with staff at City events. She emphasized that the new resolution holds Council Member Lopez accountable with enforceable penalties like pay cuts and benefit suspension. She called for Council Member Lopez’s resignation to protect the City and its staff and restore effective governance.
Council Member Lopez stated he believes public opinion is largely fixed but maintained his innocence, asserting there is more to the story. He described alleged harassment and blackmail attempts against him involving anonymous persons and fake accounts, threatening messages, and fraudulent activity, which he reported to police. He also denied accusations of harassing recall proponents, explaining his actions were related to serving his answer to the recall notice, which were lawful and documented. While acknowledging criticism, he thanked his supporters and reiterated that he would continue to serve, encouraging the City Council to act according to their conscience.
Mayor Pro Tem Martinez moved to include the removal of Council Member Lopez’s photograph from all City facilities as part of the censure in response to residents’ concerns.
