Staff Contact: Diana Perkins, City Planner
Department: City Planner
Title: Accept the 2021 Annual Housing Element Progress Report and Direct Staff to File the Report with the State of California by April 1, 2022 Recommendation(s):
Staff Recommends the City Council accept the 2021 Housing Element Annual Progress Report and direct staff to file the report with the State of California by April 1, 2022.
Background Information:
Since 1969, California has required that all local governments adequately plan to meet the housing needs of everyone in the community. California’s local governments meet this requirement by adopting Housing Elements as part of the General Plan. The General Plan serves as the city’s "blueprint" for how the city will grow and develop.
In accordance with Government Code section 65400, each jurisdiction must prepare an Annual Progress Report (APR) on the status and progress in implementing the Housing Element using forms and definitions adopted by the California Department of Housing and Community Development (HCD). Each jurisdiction’s APR must be submitted to HCD and the Governor’s Office of Planning and Research by April 1 of each year covering the previous calendar year.
The 2021 APR (attached) provides an update on the City’s progress in implementing the 2015- 2023 Housing Element. The APR describes the City’s accomplishments from January 1, 2021 to December 31, 2021 that contribute toward meeting its Regional Housing Needs Allocation (RHNA), as described further in the Analysis section below.
Analysis:
For the 2021 calendar year, the city issued building permits for 14 new accessory dwelling units and a net increase of three new single-family detached dwellings units (does not include projects where an existing house was demolished and a new house constructed). The city approved final inspections for 14 new accessory dwelling units and 17 new single-family detached dwellings.
Table B of the attached APR is the summary of the City’s progress in meeting the current RHNA allocation for the current Housing Element planning period of 2015-2023. Following is a
summary of the RHNA allocation and number of building permits issued for new housing units through 2021.
Income Level RHNA Allocation Number of Building
Permits Issued 2015-2022
Very Low 23 65
Low 13 1
Moderate 13 1
Above Moderate 12 67
Total 61 134
As shown above, the number of new housing units constructed has greatly exceeded the RHNA allocation for the 2015-2023 planning period of the current Housing Element. This is largely due to new ADUs (68 total) as well as the Montalvo Oaks project (36 new housing units). The table below summarizes the total number of ADUs permitted each year of this Housing Element cycle.
Year Number of ADUs Receiving a Building
Permit
2015 6
2016 5
2017 12
2018 8
2019 14
2020 9
2021 14
Total 68
The income level categories for new single-family houses are all considered Above Moderate as none of these for-sale housing units permitted have been deed-restricted for lower income categories. However, ADUs are considered rental units as they are secondary units to the main house and not available for sale separately. As none of the ADUs permitted are deedrestricted as an affordable category, the affordability level is determined based on the rent charged. In order to obtain this information, staff surveys the property owners who constructed ADUs in the previous year to obtain the current rent charged to determine the income levels.
The following table shows the current monthly rental levels for each income category as determined annually by the California Department of Housing and Community Development in accordance with state law:

The attached Annual Progress Report also reports on the status of the programs in the Housing Element, Table D of the attachment. Specific program implementation that is noteworthy includes Program H-2.1 related to the administration of the Second Unit Program (now referred to as ADUs). The City has streamlined the requirements and review process for ADUs, which can be considered as successful in that a total of 67 ADUs have been permitted in the City since 2015.
Additionally, the success of Program H-3.2, regarding the maintenance of public infrastructure in residential neighborhoods is important to note. In 2017-2018, the City embarked on a fiveyear Pavement Management Program to improve the overall condition of the City's streets from a Pavement Condition Index rating of 63 (fair) to a rating of 70 (good). In Fiscal Year 2019-2020 this goal was revised to meet the Metropolitan Transportation Commission’s goal of for the average PCI on local roads to be a rating of 75. As of December 2021, the City’s PCI rating is 72. A total of 59 of the City’s 87 street segments have been resurfaced since Fiscal Year 2017-2018.

H-2.1
The City will continue to administer and
improve the Second Unit Program in order
to encourage the construction of additional
Second Units affordable to lower income
households. Specific tasks that the City will
undertake include:
* Continue to survey affordability and use
of Second Units at time of construction as
well as conduct a survey of existing
Second Units at least twice during the
Planning Period to determine affordability
and use of the unit. The first survey and
results of that survey shall be completed
by the end of 2019.
* Revise the approval process for Second
Units so that it is ministerial, rather than
discretionary,
* Review and revise Second Unit Program
to remove constraints to Second Unit
development, such as reducing setback
requirements for Second Units in all R-1
zones and eliminating the existing policy in
the R-1-8 zone that deducts Second Unit
square footage from the allowable
maximum size of the principal dwelling on
lots of less than 12,000 square feet;
* Explore other innovative uses of Second
Units such as providing housing for multigenerational uses (small families, aging in place, etc.) and develop programs as
feasible, and
* Further amend the Second Unit Program
Ongoing

The City continues to administer and improve the Second Unit Program, now referred to as Accessory Dwelling Units, and has taken the following actions:
*Continue to survey affordability and use of Second Units; *Continue to publish incentives for Second Units through the City website and at City Hall front counter (ongoing);
*Provide direct to the residents the Accessory Dwelling Unit Handbook published by the State Department of Housing and Community Development (HCD) Additionally, the City has adopted an ordinance to allow an additional residential unit on each single-family lot in accordance with the State SB-9 legislation.
H-2.2
The City will explore and implement if
appropriate other options to provide
additional affordable housing opportunities
within its existing housing stock. For
example, shared housing or renting rooms
would be most appropriate for a
community such as Monte Sereno that has
many large housing units capable of
housing more people. Shared Housing
programs match persons needing housing
with homeowners and others who have
space to rent. At a minimum, the City will
contact shared housing agencies and
publicize opportunities to share housing.
Ongoing The City continues to explore shared housing opportunities and programs.
H-2.3
By the end of 2017, the City will evaluate
progress towards meeting its RHNA, in
particular new construction objectives for
extremely low, very low, low and moderate
income households. If the City determines
that fewer than 12 Second Units are
constructed every two years, the City will
evaluate and implement revisions to the
Second Unit program to meet the City's
objectives. As part of this analysis, the City
will consider revising its multi-family zoning
and density standards. If changes are
required that are inconsistent with the
Housing Element, the City will amend the
Housing Element as necessary.
Ongoing Building permits were issued for 14 new Accessory Dwelling Units in 2021. ADU's no longer require a separate Planning application/approval.
H-2.4
The City will work with nearby communities
to explore countywide housing needs and
solutions. On an annual basis, the City
Manager will provide a summary report of
activities in cooperation with other
jurisdictions/agencies to further increase
the supply of affordable housing in the
County of Santa Clara. Also, included in
this report will be a description of the City's
efforts to meet its RHNA goals. This
information will also be included in the
City's annual Housing Element update to
HCD.
Ongoing
The City currently participates with the Housing Trust of Santa Clara County, the Housing Authority of Santa Clara County and the Santa Clara County Office of Affordable Housing.
H-2.5
The City will revise the Municipal Code
(Section 10.05.045) Public ("P") zoning
district by December 2016 to allow
multifamily residential uses by right on the
First Baptist Church site (17765 Daves
Avenue). Revisions will include
development standards that include those
described in Section 6 of this document
(Site Inventory: "Proposed Guidelines for
Public/Residential Multi Family Zone First
Baptist Church Site)." The City will also
complete any amendments to the General
Plan that may be necessary to allow
multifamily uses in the Public ("P") zoning
district by December 2016. If the
necessary amendments are not adopted
by December 2016 and not successful in
encouraging multi-family development, the
City will provide alternate multi-family
residential opportunities and will amend
the Housing Element as necessary to
correct any inconsistencies.
Further, in conjunction with Program H-4.1,
the City will make specific outreach with
developers of housing affordable to lower
income and special need households,
including incentives such as density
bonuses, fee waivers or other incentives.
The City will also assist with identifying
and/or applying for project funding
from*other sources including but not
2017-2018
Ongoing
The City amended its General Plan and Zoning Ordinance to allow multi-family residential uses on the Hacienda site (18840 Saratoga-Los Gatos Road) in June of 2018. The City repealed the previously amended General Plan and Zoning on the First Baptist Church site (17765 Daves Avenue) in August of 2018. That site is currently zoned for two units an acre.
Modifications to the R-M Zoning District were completed in July and December 2012.
The Final Map for development on the Hacienda Site, now referred to as Montalvo Oaks, was approved on November of 2019. Demolition of the site occurred in fall of 2019 and grading and improvements were approved and began in 2019. Building permits for the model homes and sales office were issued in December of 2019.
Building Permits for the remaining 35 single-family dwellings and one accessory dwelling unit were issued in August and November 2020. Construction has been ongoing and is expected to be completed in late Spring 2022.
H-2.6
The City will revise the Municipal Code to
1) allow employee housing that provides
housing for 6 or fewer employees in all
residential zoned areas, 2) include
residential care homes, supportive housing
and transitional housing as a "use by right"
in RM zones and 3) include Municipal
Code Section 10.05 regarding SRO use as
allowable in RM zones
Competed 2016 Modification to allow for residential care homes, supportive housing and transitional housing completed in November 2016. (Does not include SRO) H-3.1
The City will continue to pursue code
enforcement on homes that are not
maintained in compliance with City codes
Ongoing Ongoing based on staff observations during routine visits and in response to complaints.
H-3.2
The City will review and revise on a
biannual basis the Capital Improvement
Program (CIP) to identify public
infrastructure priorities that will maintain
the community's older residential
neighborhoods.
Bi-annually
Annually the Capital Improvement Program (CIP) and priorities are set and approved by the City Council during the budget setting process. The City Council also conducts mid- year budget review to make adjustments as needed to the CIP.
Beginning with Fiscal Year 2017-2018, the City embarked on a five-year Pavement Management Program to improve the overall condition of the City's streets from a Pavement Condition Index rating of 63 (fair) to a rating of 70 (good).
In Fiscal Year 2019-2020 this goal was revised to meet the Metropolitan Transportation Commission’s goal of for the average PCI on local roads to be a rating of 75. As of December 2021 the City’s PCI rating is 72. 59 of the City’s 87 street segments have been resurfaced since Fiscal Year 2017-2018.
H-3.3
• The City will encourage energy
conservation practices for new and
existing residential dwelling units by
enforcing State and local regulations and
encouraging incentives for energy
conservation "best practices." Suggested
actions include:*continue to offer
streamlining and fee waivers for solar
panel installations,*continue the "Build It
Green" program and checklists,*provide
information regarding rebate programs and
energy audits available through PG&E,
and*provide resource materials regarding
green building and conservation programs.
Ongoing
The City has adopted and enforces the California Green Building Code. The City on an ongoing basis provides resource material on green building and conservation programs though the Planning and Building Departments.
In December of 2019 the City adopted the new residential Building Code with a local amendment requiring wiring for electric appliances regardless of the use of gas.
H-4.1
•The City will support special need
households (including physically and
developmentally disabled) in securing
affordable and appropriate housing. The
City will:
* promote the use of Second Units as an
opportunity to provide affordable housing
for special needs individuals, such as
seniors (and their caregivers) and disabled
family members,
* continue to allow transitional housing,
supportive housing and residential care
facilities, including group homes for six or
less persons, as a use by right in all R-1
neighborhoods,
* annually contact nonprofit housing
sponsors to coordinate and implement a
strategy for developing or making housing
available for lower and moderate income
households, including special needs
households, and
* as specified in Program H-2.6, the City
will amend the Municipal Code to allow
supportive housing, transitional housing
and residential care facilities in the RM
zone
Ongoing
The City continues on an ongoing basis to promote the use of second units to potential applicants. The City continues to allow transitional housing, supportive housing and residential care facilities in the R-1 zoning districts. Modification to the Municipal Code to allow transitional housing, supportive housing and residential care facilities in the RM zoning district was completed in July 2016.
H-4.2
Working with other local organizations and
agencies, the City will work to develop a
plan to meet the changing needs of
seniors. As Monte Serena's population
ages, issues such as "aging in place" and
better utilization of existing housing
become paramount. The City can take a
lead role in thoughtfully addressing these
important issues while developing some
potentially innovative housing.

The City will review existing procedures
and identify revisions to the City's
procedures in order to expedite the
development review process, especially for
special needs housing and affordable
housing for lower and moderate income
households.
Ongoing
The City implemented a Permit Tracking system for the Building Permit process in July of 2020. The systems enables the electronic tracking of the Building Permit process including multi-departmental review and scheduling of inspections. The system streamlines the review of permits and discemination of comments to the applicants from the various departments' review of the permit.
Additionally, the City an electronic Planning permit tracking system which tracks the status of all Planning applications, pending reviews, and items scheduled for public hearing. This streamlines the application tracking for staff by providing automated project status and reporting.
H-5.1
The City will continue to implement its
"Reasonable Accommodations"
procedures as contained in the Municipal
Code.

STAFF REPORT
Meeting: City Council - Mar 15 2022
Agenda Heading: CONSENT CALENDAR
Staff Contact: Jessica Kahn,

Title: Adopting a Resolution to Affirm Compliance with the Surplus Land Act to Satisfy Requirements of One Bay Area Grant (OBAG) Program Recommendation(s):
Staff recommends that City Council adopt a resolution to affirm compliance with the Surplus Land Act, as exists now or may be amended in the future, to satisfy requirements of the Metropolitan Transportation Commission (MTC) for its One Bay Area Grant (OBAG) program.
Background Information:
The Metropolitan Transportation Commission (MTC) distributes federal transportation funds to Bay Area cities and counties. MTC manages a program called One Bay Area Grant Program (OBAG ), which allocates federal transportation funds in a manner that aligns with state level climate policy and regional land use and housing policies. OBAG Cycle 3 is expected to have a call for projects in early 2022.
In order to receive OBAG funds, cities and counties must adopt a resolution verifying that any disposition of surplus land undertaken by the jurisdiction complies with the State Surplus Land Act. Originally enacted in 1968, the Surplus Land Act requires local public agencies, such as cities and transit agencies, to prioritize affordable housing, as well as parks and open space, when disposing of surplus land. Specifically, local agencies must provide a first right of refusal to entities that agree to use sites for affordable housing or parks and open space.
The City must comply with this State law whether or not a resolution is adopted. Adoption of the resolution simply makes the City eligible for OBAG 3 grant application consideration. At present, the City does not have Surplus Land as defined by the Act.
Fiscal Impact:
The proposed action in itself does not have any General Fund impact, however, adoption of the resolution is required to participate in the OBAG 3 grant program, the City is ineligible for consideration to receive funds from the program without it.
Public Noticing:
The City Council’s agenda was posted at City Hall and the agenda and this report appear on the City’s website.

Title: Consider to Approve and Adopt a Resolution for Application 2022-3008 for a Site Development Permit and Tree Removal Permit at 16016 Greenwood Road for a 191 Square-Foot Addition, 528 Square-Foot of New Covered Rear Yard Patios, a New 416 Square-Foot Detached Accessory Structure, and Removal of Five Trees
Recommendation(s):
Staff recommends that the City Council adopt a resolution to approve the Site Development Permit and Tree Removal Permit with the conditions in the attached draft resolution.
Background Information:
Site and Architectural Commission Recommendation
This project was heard by the Site and Architectural Commission at their March 2, 2022 meeting. The Commissioners asked a few questions regarding the trees proposed for removal.
Staff and the project applicant both confirmed that the trees proposed for removal are located in the areas of the proposed construction and that eight replacement trees, as shown on sheet L2.01, are included in the proposed project.
Other than the project applicant, no members of the public spoke during the Public Hearing.
The Commissioners expressed concern with the large amount of impervious coverage at the site; however, given the existing conditions are legal non-conforming and the proposal does reduce the overall impervious coverage. The Commission recommended that the City Council approve the draft resolution as presented 3-0-2 with Commissioner Sharma absent and Commissioner Balasubramanian recusing himself (as he owns property approximately 500 feet from this project site).
The existing conditions on the site have impervious coverage in excess of what is currently permitted under zoning district regulations. These conditions were created before the zoning requirements changed to limit impervious coverage. Where a lawful but non-conforming condition with zoning regulations exists, Monte Sereno Municipal Code 10.07.060.B allows an applicant to change the existing non-conforming conditions only if the City Council determines that the changes proposed would result in conditions that are more compatible with the particular zoning district. Accordingly, the Site and Architectural Commission has rendered a
recommendation to Council that it make such findings and approve the required permits for the project.
Project Background
The existing house and site improvements (including the tennis court, pool, driveways, and walkways) were approved in 1993. The single-story house is 6,317 square feet (including the attached garage), the detached garage is 610 square feet, the existing pool pavilion is 331 square feet, and the existing covered porch area totals 457 square feet.
On January 28, 2022 the property owner of 16016 Greenwood Road submitted an application for a Site Development Permit and a Tree Removal Permit which includes the following main elements:
• A first story addition of 191 square feet at the back of the house; • A net increase of 528 square feet in of covered porch area at the back of the house; • Demolition of an existing 331 square foot accessory structure and construction of a new 416 accessory structure for a pool pavilion;
• Removal of five significant trees; and
• Site alterations to reduce the overall reduction in impervious coverage from 46.6% to
45.3%.
The existing impervious coverage is 46.6%, which exceeds the current standard of 30% for the R-1-44 zoning district. This is a legal non-conforming condition as it was legal when it was first constructed but does not confirm with the current zoning standards.
In accordance with Municipal Code section 10.07.060.B, the City Council is the decisionmaking body for requests to change an existing non-conforming condition to another nonconforming condition, which may be allowed if the Council determines that the changed conditions will be more compatible with the zoning district.
The property is located on Greenwood Road not far from Saratoga-Los Gatos Road and is zoned R-1-44. The subject site has a net lot area of 14,001 square feet with a circular driveway facing Greenwood Road as well as vehicular access from a shared driveway off a Greenwood Road that accesses the side of the lot.
Analysis:
Site Development Permit
The current application includes a 191 square foot addition at the back of the house which would expand the Kitchen and Family Room areas. The project also includes a net increase of 528 square feet in covered porch area at the back of the house for a new Outdoor Kitchen and Dining areas. The existing Pool Pavilion of 331 square feet is proposed to be demolished and replaced with a 416 square foot Pool Pavilion.
All work is proposed at the back of the house and will not affect the streetscape. The existing site exceeds the maximum allowed impervious coverage and is an existing non-conforming
condition. As part of this project, the overall impervious coverage is being reduced through removal of impervious pavement and the use of permeable pavers.
Tree Removal Permit
The application includes a request to remove a total of five trees that are defined as “Significant Trees” based on the Monte Sereno Municipal Code section 10.15.015 as they are each over 25 inches in circumference as measured four feet above grade. The removal of these trees require approval by the City Council as part of the overall application. Other trees on the site that are proposed for removal have a smaller trunk size that do not require approval by the City.
The following table summarizes the Significant Trees proposed for removal:
Tree Number Species Circumference
T4 Crepe Myrtle 38 inches
T5 Crepe Myrtle 38 inches
T9 Chinese Pistache 31 inches
T12 Crepe Myrtle 28 inches
T16 Indian Hawthorn 31 inches
The reason for the removal of these five trees is that they are located within the footprint or near the proposed new construction or hardscape.
Legal Non-Conforming Condition - Impervious Coverage
Following is a summary of the existing and proposed impervious coverage:

• Actual area is twice the amount shown as only 50% of the area of pervious pavers is counted towards the impervious coverage.
As part of the proposed additional building area and covered patio, the structural coverage at the site will increase by 572 square feet. The applicant is proposing to demolish 1,467 square feet of impervious walkways and patios area in the backyard and construct an additional 593 square feet of pervious pavers (of which, 50% is counted towards the impervious coverage).
The overall result is a decrease in site impervious coverage by 599 square feet.
While the overall impervious coverage at the site is decreasing, the project would still result in a non-conforming condition. The Municipal Code section 10.07.060.B allows an existing legal non-conforming condition to be changed to another non-conforming condition if the City Council determines that the proposed condition is more compatible with the particular zoning district. Here, the project would result in an increase in structural coverage that is within structural coverage limits allowed under existing zoning regulations, and the proposed project would result in an overall net decrease in non-structural impervious coverage. Accordingly, the Council may find that the changed conditions created by the project are more compatible with the current zoning regulations than the existing conditions.
Recommendation on the Site Development Permit
Per Section 10.08.050(B) of the City of Monte Sereno Municipal Code, no Site Development Permit shall be issued unless the following findings are made;
1. Whether the proposed improvement and/or use is compatible with the character of the surrounding neighborhood in which it would be located.
The proposed improvements retain the existing character of the neighborhood in that the alterations are all proposed for the back yard and retain the single-story design and character of the house.
2. Whether the orientation and location of the buildings take into consideration the visual impact which could result from the proposed improvement and/or use.
The proposed additional square footage is a minor expansion of the first floor and a new accessory structure at the rear yard, thus reducing any visual impact the resulting construction would have on the street and neighborhood.
3. Whether the proposed improvements, including architecture, are consistent with the City's design guidelines.
The proposed improvement is consistent with the City’s Guidelines in that the design of the proposed home is not altered and is compatible with the surrounding neighborhood as the streetscape is not changed.
4. If applicable, whether the proposed improvement and/or use will provide for minimum grading and retention of the natural contours of the land then existing in order to protect the natural slope of the lot.
The proposed addition and improvements do not alter the grading of this flat lot.
5. If applicable, whether the proposed improvement and/or use provides for:
a. Retention of significant trees as defined elsewhere in the Code, unless the findings required bySection 10.15.080of the Code can bemade;
The proposed site plan retains 20 trees at the site. See findings for Tree Removal Permit below.
b. Preservation of solar access.
The proposed addition does not increase the existing height of the one-story house and does not block solar access at surrounding properties.
Staff recommends approval of the Site Development Permit application with the conditions included in the draft resolution.
Recommendation on the Tree Removal Permit
Per Section 10.15.070 of the City of Monte Sereno Municipal Code, no Tree Removal Permit shall be approved unless the following findings are made:
A. The significant tree or trees need to be removed to allow reasonable economic enjoyment of the property or the significant tree or trees need to be removed due to disease, danger of falling or threat to owner or surroundingresidents.
The proposed for removal are located in areas proposed for construction or other site improvements.
Removal of significant trees has been minimized and are necessary to allow for reasonable economic enjoyment of the property.
B. If the topography of the land and the effect of the removal of the significant tree will have a significant effect on erosion, soil retention and diversion or increased flow of surface waters.
The effect of the removal of the significant trees will not have a significant effect on erosion, soil retention or diversion or increased flow of surface waters in that the subject site is mostly flat. Most of the perimeter trees are to remain.
C. The number of trees existing in the neighborhood on improved property and the effect the removal would have on the established standard of the area and the property values; and
The proposed project would increase the number of trees in the existing neighborhood through a net increase of four trees on this site.
D. The number of trees the particular parcel can adequately support according to good forestry practices.
The subject site is 1.1 acres and is more than able to accommodate the replacement trees proposed with the landscape plan. Nine replacement trees will be planted, each a minimum size of 24-inch box, as shown on sheet L2.01 of the approved plans.
Staff recommends approval of the Tree Removal Permit application with a condition that the nine replacement trees shown on sheet L2.01 each be a minimum of a 24-inch box in size.
Recommendation on the Legal Non-Conforming Condition – Impervious Coverage Per Section 10.07.060.B of the City of Monte Sereno Municipal Code, the existing nonconforming amount of impervious coverage can be changed to another non-conforming condition when the City Council determines the alteration is more compatible with the zoning district. The Municipal Code does not provide any specific findings required to make this determination.
While the amount of impervious coverage proposed will still exceed the current limit of 30% in R1-44 zoning district, the application includes an overall reduction of impervious area at the site. Staff recommends approval of the altered non-conforming impervious coverage as the proposal reduces the total impervious coverage, thereby making the condition more compatible with the zoning district.
California Environmental Quality Act:
This project is categorically exempt from CEQA per CEQA Guidelines section 15302 – Replacement or Reconstruction (Class 2) and section 15303 – New Construction (Class 3).
None of the exceptions to the use of a categorical exemption, as identified in CEQA Guidelines section 15300.2, applies to this project:
• The project is not located in a sensitive environment such that the project may impact an officially mapped and designated environmental resource of hazardous or critical concern;
• The cumulative effect of successive projects of the same type in the same place, over time, is not likely to be significant, in light of the permitted zoning; • The project does not have a significant environmental impact due to unusual circumstances, in that the project is not unusual in light of the scope of similar permitted projects within the zoning district;
• The project will not damage scenic resources (i.e. trees, historic buildings, or rock outcroppings) within an officially designated state scenic highway; • The project is not located on a listed hazardous waste site; or • The project will not cause substantial adverse change in the significance of a historical resource.
Public Noticing:
A public notice was mailed on March 4, 2022 to all property owners and residents within 300 feet of the subject property. A hearing notice was posted at three locations within the City and on the subject property on March 4, 2022. An agenda for this meeting was posted on the City’s webpage on March 11, 2022.

Definition: Practices to preserve and protect desirable trees from damage during project development.
Purpose: To preserve and protect trees which have present or future value for the use in protection from erosion, for their landscape and aesthetic value, or for other environmental benefits.
I. The tree canopy/root zones of trees designated to be preserved shall be protected during the entire construction process.
II. Prior to the start of any site work, the contractor will erect [semi- permanent fencing / Driven posts when possible] around trees which are to be preserved and sensitive root zones which are to be protected within the construction site. The fence shall be placed around the trees to be protected with a radius determined by the superintendent of grounds or college arborist.
III. The Contractor shall be responsible for installation and maintenance of all tree protection fencing.
IV. Protective fencing shall remain undisturbed until ALL site work has been completed.
The Contractor shall remove fencing at completion of project. If protective fencing is damaged, the Contractor shall IMMEDIATELY execute the necessary repairs to reestablish the protective fencing to original configurations.
V. All work conducted in the ground within the protection zone of any protected tree should be accomplished with hand tools only.
VI. The Contractor shall be held liable for any damages to protected trees and root zones caused by unauthorized intrusions into the protected areas during construction activity. Additionally, the Contractor shall be held liable for damages incurred to any tree

branches that extend over protective fencing and to any trees or other plant material located on the site and indicted on the plan to remain. The Contractor shall be held liable for all remedial measures required to treat broken limbs, or damaged trees and roots, or for unauthorized removal of existing trees or plant material, etc. All tree surgery and remedial treatments will be accomplished by a Certified Arborist (Richard Mathey).
VII. The Contractor shall notify the Project Manager when any overhanging branches or other plant materials interfering with or risks damage due to construction activity.
VIII. No removal or encroachment into Tree Protection Enclosures shall be permitted unless coordinated with the arborist.
IX. Any grading, construction, demolition, remedial measures or other work that is expected to encounter tree roots shall be made in consultation with the Wellesley College arborist.
X. No machine digging shall take place within a radius of one and one-half foot for each 1-inch diameter at breast height (DBH) of the tree.
XI. Any pruning of protected trees that may be required during the course of construction shall be performed by the arborist. Coordinate pruning requests with the Project Manager.
XII. For construction projects requiring access or haul roads that must pass over the root area of trees to be retained, a roadbed shall be installed using 4 inches (minimum) of mulch or wood chips covered with approved logging mats. The roadbed shall be replenished and maintained as necessary to provide desired root zone protection. For projects requiring materials storage within the root area of trees to be retained or protected, this area shall be constructed using an approved Geotextile base covered with 4 inches (minimum) of coarse wood mulch or chips. The area shall be replenished as necessary to maintain a 4 inch (minimum) depth.
XIII. There shall be no vehicular traffic, parking, or stock piling of materials permitted under the drip line/canopy of ANY tree to be retained or protected within the construction site unless approved tree root protection measures have been installed.
Foot traffic shall be kept to a minimum under the drip line/canopy. If temporary foot traffic must be directed over the root zone of trees to be retained or protected, a pathway shall be installed using an approved
Geotextile base covered with 3 inches (minimum) or mulch or wood chips. The pathway material shall be replenished as necessary to maintain a 3-inch (minimum) depth.
XIV. “Natural" or pre-construction grade should be maintained for as great a distance from the trunk of each tree as construction permits. At no time during or after construction should soil be in contact with the trunk of the tree above natural grade.
XV. When removing pavement, as little disruption of soil as necessary should be attempted.
XVI. Any required trenching which has options as to the trench path should be routed in such a manner as to minimize root damage. Radial trenching (radial to the tree trunk) is less harmful than tangential trenching because it runs parallel to tree roots rather than diagonal or perpendicular to them. If roots can be worked around, cutting of roots should be avoided (i. e. place pipes and cables below uncut roots whenever possible).
Whenever possible utilize the same trench for as many utilities as possible.
XVII. Where structural footings are required and major roots will be impacted, the
Page | 37
footing depth should be reduced to 12". This may require additional "rebar" for added strength. An alternative would involve bridging footings over roots and covering each root with plastic cloth and 2-4" of Styrofoam matting before pouring concrete.
XVIII. Plans must be reviewed by the arborist signed off before commencement of work.
Protective fencing must be approved in place before any construction will be allowed to begin.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MONTE SERENO
APPROVING A SITE DEVELOPMENT PERMIT AND TREE REMOVAL PERMIT (2022-3008) FOR THE PROPERTY LOCATED AT 16016 GREENWOOD ROAD (MICHAEL HEFFERNAN)
WHEREAS, Michael Heffernan (referred to as “Applicant”) applied for a Site Development Permit and Tree Removal Permit Applications (No. 2022-3008) at 16016 Greenwood Road for a 191 square foot addition at the back of the house, new 528 square feet of covered rear yard patios, and a new 416 square foot detached accessory structure (pool pavilion) and the removal of five trees.
WHEREAS, a public hearing before the Site and Architecture Committee was set and held on March 2, 2022 to take evidence on the Application and at that hearing evidence was given both orally and in writing; and
WHEREAS, on __________, 2022, the City Council held a public hearing and the City Council has considered all the evidence presented regarding the Application, including reports, written submissions, and testimony made by the applicant, staff, and members of the public.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MONTE SERENO AS FOLLOWS:
Section 1. In accordance with Monte Sereno Municipal Code section
10.08.040(A) and the criteria set forth in 10.08.050(B), the City Council hereby finds as follows with respect to the Site Development Permit, Application No. 2022-3008:
5. If applicable, whether the proposed improvement and/or use provides for:
a. Retention of significant trees as defined elsewhere in the Code, unless the findings required by Section 10.15.080 of the Code can be made; The proposed site plan retains 20 trees at the site. See findings for Tree Removal Permit below.
b. Preservation of solar access.
The proposed addition does not increase the existing height of the one-story house and does not block solar access at surrounding properties.
Section 2. In accordance with the City of Monte Sereno Municipal Code, Section 10.15.070 and the required findings the City Council hereby finds as follows with respect to Tree Removal Permit, Application No. 2022-3008:
a. The significant tree or trees need to be removed to allow reasonable economic enjoyment of the property or the significant tree or trees need to be removed due to disease, danger of falling or threat to owner or surrounding residents.
Most of the perimeter trees are to remain. c. The number of trees existing in the neighborhood on improved property and the effect the removal would have on the established standard of the area and the property values.
Section 3. In accordance with the City of Monte Sereno Municipal Code, Section 10.07.060.B, the City Council hereby finds that the proposed change in nonconforming impervious coverage to be undertaken by the project is more compatible with the particular zoning district as the overall impervious coverage on the site will be reduced, brining the site in closer compliance with the zoning district standards.
Section 4. In accordance with the California Environmental Quality Act (CEQA), this project is categorically exempt from CEQA per CEQA Guidelines section 15302 – Replacement or Reconstruction (Class 2) and section 15303 – New Construction (Class 3).
None of the exceptions to the use of a categorical exemption, as identified in CEQA Guidelines section 15300.2, applies to this project:
• The project is not located in a sensitive environment such that the project may impact an officially mapped and designated environmental resource of hazardous or critical concern;
• The cumulative effect of successive projects of the same type in the same place, over time, is not likely to be significant, in light of the permitted zoning; • The project does not have a significant environmental impact due to unusual circumstances, in that the project is not unusual in light of the scope of similar permitted projects within the zoning district;
• The project will not damage scenic resources (i.e. trees, historic buildings, or rock outcroppings) within an officially designated state scenic highway; • The project is not located on a listed hazardous waste site; or • The project will not cause substantial adverse change in the significance of a historical resource.
Section 5. Based upon the findings set out above, the City Council hereby determines, concludes and orders that the Site Development Permit and Tree Removal Permit are approved subject to the conditions of approval set forth in Exhibit A.
Section 6. The City Clerk is hereby directed to give notice of this decision to the Applicant by serving Applicant by first class mail, postage prepaid, with a copy of this resolution.

Title: Discuss and Consider Assigning a Councilmember to Serve as Council Liaison to the Better Streets Commission
Recommendation(s):
Staff recommends that the Council discuss and consider assigning a Council Liaison the Better Streets Commission.
Background Information:
Staff received a request from Mayor Pro Tempore Mekechuk to place an item on the City Council meeting agenda to discuss and consider appointing a Council liaison to the Better Streets Commission. Currently, the only Council Liaison assigned to a City Commission is Councilmember Lawler to the Youth Commission. We currently do not have Council Liaisons assigned to either the Site and Architectural Commission or the Better Streets Commission.
Typically at the first meeting in January, the Mayor provides assignment recommendations to Boards/Commissions/Committees for the upcoming calendar year for Council consideration. A Council Liaison to the Youth Commission has historically been included in the Boards/Commissions/Committees assignments and the liaison serves as a mentor to the commissioners and provides guidance on City operations. The Council Liaison to the Better Streets Commission would provide information to the Commissioners on issues regarding road impact issues.
Analysis:
It is important to highlight the role of Council Liaisons to Boards/Commissions/Committees.
The City Council relies on the expertise and recommendations of Boards/Commissions/Committees in advising the Council as it sets City policy. The Council liaison function serves to facilitate and enhance this work. Their principal function is to provide information to the advisory body, such as information about Council discussions, policies and actions. This helps provide an historical perspective and thereby place the Boards/Commissions/Committees' work in context. However, the Boards/Commissions/Committees should act independently in formulating recommendations
for the City Council to consider. Therefore, Council liaisons should not direct, guide or influence the policymaking work of the City's advisory bodies. Council liaisons have flexibility in discharging their duties. They may serve with or without attending the meetings of their advisory bodies. However, at minimum, they should be available for contacts with members of advisory bodies, and particularly with the chairs.
Fiscal Impact:
There are no unbudgeted fiscal impacts with this agenda item.
Public Noticing:
The City Council’s agenda was posted at City Hall and the agenda and this report appear on the City’s website.

Subject: Better Streets Commission - Liaison with City Council Hi Jessica,
As you may know, I am Chair of West Valley Solid Waste Authority and they are putting the contract for hauling out to bid to start services in January 2024. I’m also on the Ad Hoc Committee with Paul Resnikoff, Mayor of Campbell, working on the RFP for the contract.
We’re starting to get going on this and that is why I was asking you for information on the road impact study, etc. from a couple years ago.
After Barry Chaffin was reappointed to Better Streets Commission at our last meeting, I offered to be City Council liaison with the Better Streets Commission and Sergio Rudin recommended that this be on a City Council agenda.
I’d like the road impact decision to involve our Better Streets Commission and I’d like to get this moving ahead.
Accordingly, I would like to have my appointment as City Council liaison with the Better Streets Commission to be a Consent item at the March 1, 2022 City Council meeting and that agenda must go out tomorrow (February 24).
Since you are the staff member on Better Streets Commission and you are the contact for West Valley Solid Waste Authority then it would be appropriate for you to put together a couple paragraphs in a report stating that there should be at least one City Council liaison with the Better Streets Commission.
Since I am the only one that has expressed an interest and, given my role with the Ad Hoc Committee for the hauling contract, it makes sense for me to be the City Council liaison. As Steve was the Los Gatos representative (and maybe even former Chair) on West Valley Solid Waste, he can help you with this.
Oh, I was thinking that Barry could send in a brief note as Chair of Better Streets supporting me to be the City Council liaison.
Many thanks for your prompt action.
Best,
Bryan

STAFF REPORT
Meeting: City Council - Mar 15 2022
Agenda Heading: NEW BUSINESS
Staff Contact: Michelle Estabillo, City Clerk
Department: City Clerk
Title: Discussion and Direction to Staff Regarding Conduct of City Council and Board/Commission Meetings, Including Councilmember and Staff InPerson Presence and Methods of Public Participation Recommendation(s):
Staff recommends that the Council hold discussion on conduct of City Council and Board/Commission meetings and provide direction to staff.
Background Information:
At its March 1, 2022 meeting, the City Council adopted Resolution No. 22-3843 that enabled the City Council to continue to meet remotely in accordance with provisions of the Brown Act as enacted by AB361 (Government Code section 54953(e)). This provision of state law allows local legislative bodies (such as city councils and other local commissions) to meet without making a physical location open to the public or complying with other teleconference requirements in the Brown Act as long as (1) there is state of emergency proclaimed by the Governor of the State of California and (2) the local legislative body determines that either: (A) state or local public health officials have required or recommend social distancing; or (B) the emergency continues to directly impact the ability to meet safely in person. A legislative body operating under this authority must review the situation every thirty (30) days to determine if the circumstances continue to exist. The adoption of Resolution No. 22-3843 allows the Monte Sereno City Council to hold virtual meetings through the end of March in accordance with Government Code section 54953(e).
At the March 1, 2022 meeting, the City Council requested that the staff place on the March 15 meeting a discussion on returning to in-person City Council Meeting. The City Council also requested that staff look into what other jurisdictions are doing in regard to in-person meetings given that the Santa Clara County indoor mask mandate expired on March 3, 2022. The City Clerk conducted an informal poll of local nearby cities on their timeline for returning to inperson meetings and the results are included as Attachment 1.
Analysis:
A Governor’s State of Emergency typically continues until such time as it is terminated by proclamation of the Governor. On March 4, 2020, Governor Gavin Newsom declared a State of Emergency with respect to the COVID-19 pandemic, which remains in effect. On March 4,
2022, the Governor issued Executive Order No. N-04-22 continuing certain prior issued Executive Orders through June 30, 2022, which indicates that the State of Emergency is likely to be continued until at least such time. The City Council may continue to meet in a purely virtual fashion under the provisions of AB361 until the Governor’s State of Emergency is terminated by action of the Governor, as long as the required findings are made by the City Council. Government Code section 54953(e) provides that a local agency may continue to hold purely virtual meetings if state or local public health officials have required or recommend social distancing; or the local agency determines that the emergency continues to directly impact the ability to meet safely in person. While the Santa Clara County Health Department's mandate on wearing masks indoors have expired, both the State and County Orders continue to recommend social distancing.
If the Council does not want to proceed under Government Code section 54953(e) by making the required findings, then there must provide a physical location for members of the public to provide public comment. Additionally, if any members of the Council are appearing via teleconference would need to comply with normal teleconference requirements under the Brown Act, which include: (1) publishing the location they are participating from on the agenda; (2) making that location open to the public, for purposes of public comment; (3) The Brown Act imposes the above requirements on how public officials (elected and appointed) of the legislative body (i.e. City Councilmembers, Site and Architectural Commissioners, etc.) participate in public meetings, and also provides minimum requirements with respect to public participation. There are not similar requirements with respect to how City staff are required to participate in public meetings, and thus Council should provide direction with respect to any requirements it might want to impose on City staff.
The options for conduct of future Council meetings are:
1. In-Person: Council may direct staff to resume in-person meetings beginning April 1, 2022 for all City of Monte Sereno bodies with no option for the public to participate virtually beginning April 1, 2022. The Council should provide direction regarding how staff should participate in such meetings.
2.In-Person for Public Officials with Option for Public to Comment By Zoom: Council may direct resume in-person meetings beginning April 1, 2022 for all City of Monte Sereno Brown Act bodies with an option for the public to participate in-person or virtually. Unless the Council continues to make findings as required by AB 361, the City must have an in-person location for public comment and all public officials will have to appear in-person or comply with normal Brown Act requirements for teleconferencing, including agenda notification, posting, and opening their teleconference location to the public. The Council should provide direction regarding how staff should participate in such meetings.
3.Continue Virtual Meetings Under AB361: Direct staff to continue virtual meetings for all City of Monte Sereno Brown Act bodies and place appropriate items to reconfirm the safety findings required by AB361 to allow the City Council the option to change course as the Council determines appropriate in the future. Under this option, Council can also direct staff to make
available an in-person option at City Hall for those Councilmembers who wish to attend inperson, without requiring that all public officials appear in-person.
Staff recommends that in-person meetings be postponed until after June 30, 2022 and does not recommend holding hybrid meetings where the council and/or public participates remotely.
Staff further recommends the Council and public participate in-person collectively as was done prior to March 16, 2020. The only exception would be for staff to participate remotely as staff is not subject to Brown Act requirements regarding location. City staff has the cability to participate remotely when the Council and public in the Council Chambers. This staff recommendation will be applicable for all our commissioners as well.
