STAFF REPORT
Meeting: Special Meeting of the City Council - Mar 22 2022 Agenda Heading: NEW BUSINESS
Staff Contact: Michelle Estabillo, City Clerk
Department: City Clerk
Title: Consider and Adopt Resolution Extending Teleconferencing of City Council Meetings Pursuant to Government Code Section 54953 (AB 361) Recommendation(s):

Staff recommends that the City Council consider and adopt a resolution extending teleconferencing of City Council meeting pursuant to AB 361.

Background Information:

AB 361 was signed by the Governor of the State of California and went into effect immediately upon signature by the governor. It amends the Brown Act to allow local legislative bodies to continue having purely virtual meetings using teleconferencing and virtual meeting technology as long as there is a gubernatorial “proclaimed state of emergency,” and either (1) state or local officials imposing or recommending measures that promote social distancing or (2) the legislative body finding that meeting in person would present an imminent safety risk to attendees.

The key differences between existing Executive Order N-08-21, which expires September 30, 2021, and AB 361 is that AB 361 imposes particular requirements with respect to public comment, however, the City of Monte Sereno’s current practices with respect to live public comment via Zoom already satisfy all of the new requirements in AB 361. Additionally, public agencies must either make findings by majority vote that the state of emergency still exists and continues to directly impact the ability of the members to meet safely in person, or that health officials continue to impose or recommend measures to promote social distancing.

Determinations by the local agency that the emergency impacts the ability to meet safely inperson must be re-visited every 30 days.

At its September 21, 2021 meeting, the City Council adopted Resolution No. 21-3826 authorizing virtual City Council meetings during declared stated of emergency pursuant to Government Code. The City Council determined that the pandemic of COVID-19 creates an imminent safety risk to councilmembers and other potential attendees of City Council meetings. At present, risk of COVID-19 due the delta and omicron variant remains high; the CDC reports that for the period between the period between March 9, 2022 and March 16, 2022 that Santa Clara County had “substantial” community transmission, with 1,129 cases, 89

Page 3 of 50 ends

new hospital admissions, and 23 deaths. As a result, staff believes that the City Council can re-adopt its previous findings, and authorize continued virtual meetings for the next 30 days.

Fiscal Impact:

There are no unbudgeted fiscal impacts with this agenda item.

Public Noticing:

The City Council’s agenda was posted at City Hall and the agenda, and this report appear on the City’s website.

STAFF REPORT
Meeting: Special Meeting of the City Council - Mar 22 2022 Agenda Heading: NEW BUSINESS
Staff Contact: Steve Leonardis,
Department: City Manager
Title: Annual Council Goal Setting Session for Fiscal Year 2022-2023 Recommendation(s):

After Monte Sereno City Council discussion, Council may select and categorize work items Council would like to pursue in fiscal year 2022-2023.

Background Information:

The City Council of Monte Sereno meets every fiscal year to establish a work plan prior to adopting its annual budget. This process is known as council’s Annual Goal Setting Session.

Monte Sereno City Council decides how best to allocate city resources to provide service delivery to Monte Sereno residents. Upon completion of the public hearing, the city manager will work with city staff to establish the annual operating budget in conjunction with the work plan established by council. Throughout the coming fiscal year (FY 2022-2023), Monte Sereno City Council and city staff work together to complete the workplan and adapt and update the workplan to achieve established goals.

Analysis:

In 2017, Monte Sereno adopted a “City Council Role, Vision and Values Document” (Attachment 1). The City Council Role, Vision and Values Document has been used as a prelude to the annual goal setting session since 2017. Council values listed as Integrity and Professionalism, Transparency and Openness, Performance Accountability, Effective and Efficient Services, Fiscal Responsibility and Quality of Life for all Residents help guide Monte Sereno City Councilmembers’ in achieving goals.

Council Vision is written “The City Council will continue to strengthen our community and promote a strong sense of unity through purposeful and proactive leadership. Together, the Council strives to maintain the unique character and beauty of our city.” Council instructed staff to update the Vison and Values document in 2020 to make the statement more inclusive, by adding language to the last paragraph as stated: “We promote inclusiveness and non-discrimination.” Council further instructed staff to amend the Vison and Values statement for 2021-2022. The proposed amendments are included in Attachment 1.

Page 7 of 50 ends

In Fiscal 2021-2022, The Monte Sereno City Council established five goal categories derived from the Monte Sereno General Plan. These categories are as follows:

1. Quality Public Services

2. Community Character

3. Enhanced Mobility

4. Community Safety

5. Environmental Sustainability
In each category of the FY 2021-2022 goals, there existed a subcategory of tasks or actions for Monte Sereno City staff to complete. Provided is a summary in Attachment 2 of this report of the goals, subcategories, and status of completed work items for FY 2021-2022. To date, significant progress has been achieved in completing the FY 2021-2022 work plan. There are several “in progress” goals which may be delivered soon. The work plan is an evolving document. This year’s Annual Goal Setting session only covered a period of 10 months compared to the normal 12-month period.

For this year’s goal setting session, Monte Sereno City staff recommends continuing adoption of the same “top level goals” derived from the Monte Sereno General Plan.

Subcategories of Fiscal Prudence, Governance/Operations and Community Engagement are listed under Quality Public Services. The purpose of these subcategories is to further define goals outside the spectrum of a land use document.

Attachment 3 represents a “starter list” for council to begin discussion to add new goals.

These work items can be modified, eliminated, or pursued as drafted based on results of Monte Sereno City Council discussion. When completed, the new list of Items chosen by council can be merged with the previous carry over items which are still work in process.

Items marked in red are recommended by staff for elimination. Items marked in green may be accomplished through the Monte Sereno General Plan update process scheduled for 2023.

Supporting documents for a proposed work item regarding “Citizen of the Year” are included in Attachment 4. These documents are provided as examples for discussion purposes and support subcategories and task items of proposed goals from last fiscal year.

Other work item ideas brought forth by staff, the public and councilmembers during FY-2021- 2022 include the addition of a Building Inspector/Code Enforcement Officer position, City of Monte Sereno historical districts, improved attendance policies for boards and commission members, and updated Reach Codes.

Fiscal Impact:

Depending on adoption of goals, Monte Sereno City Council will have to direct associated budget adjustments before adoption of the Annual City of Monte Sereno Budget by June 21, 2022.

Alternatives:

Page 8 of 50 ends

1.Adopt proposed goals and work items.

2.Modify goals and work items and adopt those modifications

3.Take no action on goals and related items in this report Conclusion:

Monte Sereno City Council has an opportunity to create a solid work plan for FY 2022-2023 whilst meeting goals and objectives and enhancing service delivery to residents.

Accomplishing a successful work plan each fiscal year will allow The City of Monte Sereno to achieve progress towards all five guiding principles (goals) in the Monte Sereno General Plan in a fiscally responsible way. Those principles are Quality Public Service, Community Character, Enhanced Mobility, Community Safety, and Environmental Sustainability.

Public Noticing:

The City of Monte Sereno’s council meeting agenda was posted on the bulletin board outside of Monte Sereno City Hall and the agenda with this staff report can be accessed on The City of Monte Sereno’s website located at www.montesereno.org.
