Title: Consider and Adopt Resolution Extending Teleconferencing of City Council Meetings Pursuant to Government Code Section 54953 (AB 361) Recommendation(s):
Staff recommends that the City Council consider and adopt a resolution extending teleconferencing of City Council meeting pursuant to AB 361.
Background Information:
AB 361 was signed by the Governor of the State of California and went into effect immediately upon signature by the governor. It amends the Brown Act to allow local legislative bodies to continue having purely virtual meetings using teleconferencing and virtual meeting technology as long as there is a gubernatorial “proclaimed state of emergency,” and either (1) state or local officials imposing or recommending measures that promote social distancing or (2) the legislative body finding that meeting in person would present an imminent safety risk to attendees.
The key differences between existing Executive Order N-08-21, which expires September 30, 2021, and AB 361 is that AB 361 imposes particular requirements with respect to public comment, however, the City of Monte Sereno’s current practices with respect to live public comment via Zoom already satisfy all of the new requirements in AB 361. Additionally, public agencies must either make findings by majority vote that the state of emergency still exists and continues to directly impact the ability of the members to meet safely in person, or that health officials continue to impose or recommend measures to promote social distancing.
Determinations by the local agency that the emergency impacts the ability to meet safely inperson must be re-visited every 30 days.
At its September 21, 2021 meeting, the City Council adopted Resolution No. 21-3826 authorizing virtual City Council meetings during declared state of emergency pursuant to Government Code. The City Council determined that the pandemic of COVID-19 creates an imminent safety risk to councilmembers and other potential attendees of City Council meetings. At present, risk of COVID-19 due the delta and omicron variant remains high; the CDC reports that for the period between the period between September 8, 2022 and September 15, 2022 that Santa Clara County had “low” community transmission with 120.5 case rate per 100,000 population, 8.2 new COVID-19 admissions per 100,000 population, and
4.7% staffed inpatient beds in use by patients with confirmed COVID-19. Due to the ongoing state of emergency, staff believes that the City Council can re-adopt its previous findings, and authorize continued virtual meetings for the next 30 days.
Fiscal Impact:
There are no unbudgeted fiscal impacts with this agenda item.

Title: Adopt a Resolution Initiating Annexation Proceedings and Setting a Date for Consideration of the Annexation of an Uninhabited Area of Approximately 0.6 Acres Located Along Lucky Drive, APN 510-31-077.
Recommendation(s):
Staff recommends that the City Council adopt a resolution (Attachment 1) to initiate annexation proceedings and set a date for consideration of the annexation of an uninhabited area of approximately 0.6 acres located along Lucky Drive, APN 510-31-077.
Background Information:
The City received an application from the property owner of a parcel along Lucky Road, APN:
510-31-077, requesting the parcel be annexed to the City of Monte Sereno.
Government Code section 56757 authorizes annexation of territory to the City of Monte Sereno urban service area without the Local Agency Formation Commission’s (LAFCO) review if the proposal meets certain conditions. Under this provision, the City Council serves as the authority for conducting annexation proceedings. To qualify, the City Council must adopt a resolution initiating annexation proceedings, and to complete annexation, the Council must make the following findings:
(1) That the unincorporated territory is within the urban service area of the city as adopted by LAFCO.
(2) That the county surveyor has determined the boundaries of the proposal to be definite and certain, and in compliance with the road annexation policies of LAFCO. (3) That the proposal does not split lines of assessment or ownership. (4) That the proposal does not create islands or areas in which it would be difficult to provide municipal services.
(5) That the proposal is consistent with the adopted general plan of the city. (6) That the territory is contiguous to existing city limits. (7) That the city has complied with all conditions imposed by LAFCO for inclusion of the territory in the urban service area of the city.
On May 5, 2022 the Santa Clara County Surveyor’s Office determined that the boundaries of the subject parcel are definite and certain and that the annexation would be in compliance with the LAFCO’s road annexation policies. Under state law, the City is required to reimburse the county for the actual costs incurred by the county surveyor in making this determination. Such costs were paid by the applicant for this annexation application.
If the Council initiates annexation proceedings, the City is required to give notice and hold a hearing even if the area proposed for annexation is considered as uninhabited (less than twelve registered voters) and all property owners have consented to the annexation. This first meeting and resolution sets the date for the consideration of the annexation and a hearing on any protests received.
Analysis:
The subject property is currently in the jurisdiction of Santa Clara County but is in the City of Monte Sereno’s Sphere of Influence and Urban Service Area (Resolution 3665 approved on November 7, 2017). The site currently has a land use designation of Single-Family Residential (1 du/ac) and is pre-zoned R-1-44 (Ordinance NS-190 adopted on October 1, 2013).
If the site is annexed into the City, police service would transfer from the Santa Clara County Sheriff to the Los Gatos-Monte Sereno Police Department.
The following table describes each finding required to be made by the City Council, which are included in the draft resolution, pursuant to Government Code section 56757 to authorize the annexation initiation:
Requirement Finding
That the unincorporated territory is within the
urban service area of the city as adopted by
LAFCO.
This parcel was incorporated into the Monte
Sereno Urban Service Area on November 7,
2017 with Resolution 3665.
That the county surveyor has determined the
boundaries of the proposal to be definite and
certain, and in compliance with the road
annexation policies of LAFCO.
The County Surveyor has made such finding
and it is included in the attached draft
resolution in Exhibit A.
That the proposal does not split lines of
assessment or ownership.
The proposal is to annex one existing parcel;
therefore, assessment or ownership lines are
not split.
That the proposal does not create islands or
areas in which it would be difficult to provide
municipal services.
The subject parcel is adjacent to Monte
Sereno and parcels where municipal
services are currently provided. Therefore,
the annexation will not create an area in
Requirement Finding
which it is difficult to provide municipal
services.
That the proposal is consistent with the
adopted general plan of the city.
The proposed annexation is consistent with
the following General Plan Goal and Policy:
Goal LU-4 Provide for orderly growth
consistent with the City’s existing character.
Policy LU-4.5 Continue annexation of areas
within the City’s Sphere of Influence only
when:
1. The area is contiguous with the city’s
boundaries;
2. Necessary infrastructure and services can
be provided in an efficient manner;
3. The fiscal well-being of the city will not be
adversely impacted
4. The annexation is consistent with State
law and Santa Clara County Local Agency
Formation Commission (LAFCo) standards
and criteria;
5. The annexation is supported by a majority
of affected landowners;
6. The annexation will not adversely impact
the quality of life of city residents or the
character of the community; and
7. The annexation is consistent with the
General Plan.
That the territory is contiguous to existing city
limits.
The territory is contiguous to existing city
limits as the north portion of the property is
adjacent to the city limits.
That the city has complied with all conditions
imposed by LAFCO for inclusion of the
territory in the urban service area of the city.
The proposed annexation has complied with
all conditions imposed by LAFCO for an
uninhabited, 100% consent annexation.
California Environmental Quality Act:
The project is exempt pursuant to the California Environmental Quality Act Guidelines under Section 15061(b)(3): Review for Exemption, in that it can be seen with certainty that the annexation will not have a significant effect on the environment Fiscal Impact:
Once the annexation is certified by the State Board of Equalization, the city can expect to receive less than $200 in property tax revenue annually based on the current assessed value of the property. Any sale of the property or improvements would likely result in a reassessment and additional property tax revenue received.
Public Noticing:
Letters were mailed on August 16, 2022 to the special districts that this property is located within (school districts, fire protection, open space, water service, etc.) to inform those agencies of the annexation consideration. No additional public noticing is required under Government Code section 56662 because the affected property owner has requested the annexation, the parcel is uninhabited (fewer than 10 registered voters), and none of the affected special districts have requested further notice or hearings.
The City of Monte Sereno's council meeting agenda was posted on the bulletin board outside of Monte Sereno City Hall and the agenda with this staff report can be accessed on The City of Monte Sereno's website located at www.montesereno.org.

Title: Discuss and Provide Direction to Staff Regarding Reach Codes for Electrification and Water Efficiency in New Construction Recommendation(s):
Staff recommends the City Council provide direction regarding potential reach codes for electrification and water efficiency in new construction.
Background Information:
With the climate and environmental sustainability concerns at the forefront, many jurisdictions are looking to opportunities to reduce greenhouse gas emissions. Silicon Valley Clean Energy (SVCE) is providing 100% carbon-free electricity and is supporting the elimination of the use of fuel gas, which can greatly reduce greenhouse gas emissions from the building sector.
Additionally, with the current drought conditions, water conservation is also a significant issue for California jurisdictions. Valley Water has developed recommendations for local jurisdictions to reduce the water used within buildings and for landscaping.
With the last building code adoption cycle in 2019, the City Council approved code amendments requiring that electric infrastructure (wiring, circuits, and panel capacity) be provided when a gas-fueled water heater, space heating equipment, or stove is installed in new construction. Additionally, requirements for the pre-wiring for battery storage in new construction was also adopted at that time.
As directed by the City Council, staff has reviewed the recommended modifications to the 2022 California Building Standards Code adoption cycle from both Silicon Valley Clean Energy as well as from Valley Water. This report includes information about these recommendations, staff’s analysis, as well as a staff recommendation regarding which elements should be adopted for the City of Monte Sereno.
Specific direction from Council is needed at this time to allow staff sufficient time to complete the public notification, draft ordinances, and staff reports for the adoption of the 2022 California Building Codes as scheduled in November of this year.
Analysis:
Energy Efficiency Reach Codes
The Silicon Valley Clean Energy staff presented information about the benefits of electrification in buildings and the reach codes they suggest for new construction at the April 19, 2022 City Council meeting. That presentation is available at the online agenda for the meeting at:
https://montesereno.civicweb.net/Portal/MeetingInformation.aspx?Org=Cal&Id=127.
Currently, Monte Sereno requires “electric preferred” for new construction which means that gas-fueled appliances are allowed in new construction; however, when a gas water heater, space heating equipment, or stove is installed, an electric circuit and sufficient capacity shall be available in the electrical panel to allow for future conversion to an electric appliance.
Following is a summary of the other levels of the electrification suggested by Silicon Valley Clean Energy:
Electrification Level How it Works
Mostly Electric Water heating and space heating equipment required to be electric. With electrificationready panel and wiring for other gas-fueled appliances that may be installed.
All-Electric All appliances required to be electric.
Staff suggests that this category can actually
be separated into two sub-categories: inside
the house and outside the house.
Gas Ban All appliances are required to be electric and
any existing natural gas piping would need to
be removed from the property and capped
off at the main connection.
As Monte Sereno does not currently restrict the installation and use of gas-fueled appliances in new construction, moving fully to all-electric would be a significant change from the current standards. If the City Council desires to move towards electrification in new construction, staff recommends that electric appliances be required inside the buildings of new construction, but that exterior appliances would still be allowed as gas fueled. This would allow such exterior appliances as pool equipment, fire pits, and emergency generators to be gas-fueled. As Monte Sereno does not have any current limitations on the use of gas-fueled appliances, restricting their use indoors may be a practical first step compared with a complete prohibition on gasfueled appliances.
In addition to electrification of appliances, Silicon Valley Clean Energy also recommends standards beyond the minimum building codes for electric vehicle (EV) charging equipment.
For single-family houses, the 2022 California Green Building Standards Code requires wiring
and panel capacity be provided for one Level 2 EV Ready (40-amp circuit and wiring) receptacle. Silicon Valley Clean Energy recommends one Level 2 EV Ready receptacle and one Level 1 EV Ready (20-amp circuit and wiring) receptacle be provided in new single-family construction.
Staff recommends that the one Level 2 EV Ready receptacle, as required by the State codes, be maintained as the requirement for Monte Sereno. However, if the City Council would like to modify this requirement, staff would recommend that two Level 2 EV Ready chargers be required. A Level 1 EV Ready charger, which is a 20-amp circuit, is not sufficient to charge most fully electric vehicles in a reasonable amount of time.
The following table summarizes the current requirements for new construction in other West Valley jurisdictions. Changes to these requirements are being considered by some jurisdictions but have not yet been finalized.

Water Efficiency Reach Codes
Valley Water provided a presentation at the May 3, 2022 City Council meeting. The link to that presentation as well as the model ordinance is available in the online agenda from that meeting at:
https://montesereno.civicweb.net/Portal/MeetingInformation.aspx?Org=Cal&Id=128. The following table summarizes the water efficiency standards in the model ordinance provided by Valley Water related to new single-family houses as well as staff’s comments:
Model Ordinance Item Staff Comments
Provide either a compact hot water
distribution system or a hot water system
volume limit
Both of these options are designed to reduce
the amount of water that come outs of a
fixture before the warm/hot water is
delivered, saving both water and energy.
Since the 2016 code cycle, these systems
are offered in the California Title 24 Energy
Efficiency Standards as options to meet the
allowed energy budget. When used, these
systems require the homeowner to hire a
Home Energy Rating System (HERS)
certified inspector to inspect and verify the
system is functioning as designed.
Based on information collected State-wide
for new construction that has been permitted,
less than 1% of new single-family houses
have used this credit.
Staff does not recommend this be mandated
for all new construction as it has been in the
California Energy Efficiency Standards as an
optional credit since 2016 but has not been
widely accepted in the marketplace. This is
likely due to the cost and time needed for the
additional HERS verifications.
Gray Water Dual Drainage Plumbing for at
Least One Clothes Washer and at Least One
Tub/Shower
This type of dual drainage system allows
drain water to be diverted to a landscape
area rather than directed to the sanitary
Model Ordinance Item Staff Comments
sewer system. The California Plumbing Code
limits this type of dual drainage to only the
clothes washer, tub/shower, or a bathroom
lavatory.
As a dual drainage system, piping is
provided to the standard sanitary sewer
system as well as to the gray water system.
An accessible diverter value is provided to
allow the resident to adjust the drainage
direction. The California Plumbing Code
allows this type of untreated drain water to
be piped to an outdoor landscaped area (with
non-edible plants) with a below grade
perforated pipe to allow the water to infiltrate
into the ground.
Staff recommends that the gray water dual
drainage system not be required for all new
construction. These systems require the
resident to be diligent in how they use their
appliances in order to avoid potential ground
contamination. For example, soaps,
shampoos, detergents, and cleansers need
to be biodegradable and safe for gray water
use. Additionally, when using the clothes
washer to wash diapers or other materials
that contain hazardous chemicals, the
resident must ensure the diverter value is set
to the sanitary sewer for such washings.
Irrigation Water Efficiencies The suggested irrigation efficiencies are substantially the same as the current Model
Water Efficient Landscape Ordinance
(MWELO) which is the current standard for
landscape irrigation in new construction.
The Valley Water model ordinance is not
substantially different that the current
requirements mandated by the State for new
construction, staff does not recommend
incorporating the Valley Water model
ordinance language for irrigation efficiencies.
Model Ordinance Item Staff Comments
Swimming Pool/Spa Covers The California Title 24 Energy Efficiency Standards require a cover be provided for all
new swimming pools/spas that are heated
with electric or gas-fueled equipment. The
purpose of this code energy efficiency and
having a swimming pool/spa cover saves
reduces the energy to heat pool/spa that is
not being used.
This recommendation from Valley Water
would expand the requirement to provide a
cover for all swimming pools and spas, even
those that are not heated in order to reduce
the loss of water through evaporation. As it is
very uncommon for a new swimming pool or
spa in Monte Sereno to be un-heated;
therefore, this recommendation by Valley
Water would not have much effect on
projects in Monte Sereno.
The following table summarizes the water conservation reach codes that will be considered by other West Valley jurisdictions; note these are current planned staff recommendations which have not yet been acted upon by their City Councils:
Jurisdiction Planned/Staff Recommendation but Not
Adopted
Town of Los Gatos Staff recommendations are pending.
City of Saratoga New construction required to pre-plumb for gray water and include a water recirculation
system.
City of Cupertino None planned at this time.
City of Campbell Staff recommendations are pending.
Staff Recommendation
Following is a summary of the staff recommendation:
• If the City Council desires to move towards electrification in new construction, staff recommends that electric appliances be required inside the buildings of new construction, but that exterior appliances would still be allowed as gas-fueled. • Staff recommends that the one Level 2 EV Ready receptacle, as required by the State codes, be maintained as the requirement for Monte Sereno. However, if the City Council would like to modify this requirement, staff would recommend that two Level 2 EV Ready chargers be required.
