STAFF REPORT
Meeting: Special Meeting of the City Council - Feb 23 2023 Agenda Heading: UNFINISHED BUSINESS
Staff Contact: Reynold Samoranos,
Department: Finance Manager
Title: Accept the Treasurer's Report for the Period Ending November 30, 2022 Recommendation(s):
Staff recommends the City Council accept the Treasurer's Report for the period ending November 30, 2022
Background Information:
In a letter dated December 14, 2022, the 2022 Santa Clara County Civil Grand Jury transmitted to the City of Monte Sereno and all other municipalities in Santa Clara County its Final Report, "Show Me the Money": Financial Transparency Needed. The Final Report mentioned seven out of the nine General Law Cities in Santa Clara County as Noncompliant of Section 41004.
Government Code, Section 41004 California Government Code section 41004 states:
“Regularly, at least once each month, the city treasurer shall submit to the city clerk a written report and accounting of all receipts, disbursements, and fund balances. The city treasurer shall file a copy with the legislative body.”
In the Grand Jury Report, The Civil Grand Jury found for City of Monte Sereno the following:
The City of Monte Sereno does not have an elected city treasurer. The Monte Sereno Municipal Code section 2.04.010 designates the city manager as the director of finance and tasks the city manager with “performing all duties of City treasurer as set forth in Government Code sections 41000 et seq.” At the time of inquiry in June 2022, six treasurer’s reports were received by the Civil Grand Jury. While the reports did contain the required fund balances, the receipts and disbursements were not compliant with the Section 41004 requirement.
In compliance with the Civil Grand Jury’s findings, City staff will consolidate into the new compliant monthly Treasurer’s Report the following previously provided information in four parts.
NEW COMPLIANT TREASURER’S REPORT
• Part 1 - Receipts and Disbursement Report
• Part 2 - Significant Variances Actuals versus Budget Narrative • Part 3 - Demand Account Reports
• Part 4 - LAIF Investment Fund and Wells Fargo Custodian Report Fiscal Impact:
There are no unbudgeted fiscal impacts with this agenda item.
