Title: Adopt a Resolution Declaring Noxious and Dangerous Weeds and Rubbish, Refuse, and Dirt to be a Public Nuisance and Setting a Public Hearing Date and Time and Consider All Objections to the Proposed Destruction or Removal of Weeds, Dirt, Rubbish, or Other Hazardous Material and Rescinding a Previously Adopted Resolution Regarding the Same
Recommendation(s):
Staff recommends the City Council adopt a resolution declaring noxious and dangerous weeds and rubbish, refuse and dirt to be a public nuisance and set February 20, 2024 at 7:00 p.m. as the Public Hearing date and time to hear and consider all objections to the proposed destruction or removal of weeds, dirt, rubbish or other hazardous material and rescind Resolution No. 23-3895 which previously scheduled the Public Hearing for January 16, 2024.
The Public Hearing on February 20, 2024, will be held both virtually via the Zoom application and in the Council Chambers, City Hall, 18041 Saratoga-Los Gatos Road, Monte Sereno, California.
Background Information:
The City has a weed abatement process set forth in the City’s Municipal Code in Chapter 8.02.
As a first step, the City Council adopts a resolution declaring the existence of a nuisance caused by weeds, brush, dirt, and other similar hazards existing on properties within the City (Municipal Code Section 8.02.050). The resolution identifies the problem properties and creates a deadline to address problem conditions (the “Resolution”). The Resolution identifies 17 properties which constitute a nuisance. Per the Municipal Code, those owners must clean up those problem conditions within 30 days, unless that period is extended by written agreement with the City Engineer/Fire Marshal. Notice is given to the property owners by posting and by mailing, once the City Council adopts the Resolution. The Resolution also sets the date for a public hearing for submitting objections by the affected property owners. After the 30-day period has passed, the City Council will conduct a public hearing for considering objections to why the City should not cause abatement to take place on any parcels where the owners have not cleaned up their weeds, brush, dirt, and other hazards.
After the public hearing, the City Council can adopt an order to abate. Under the Municipal Code, City staff or contractors are authorized to enter the properties after the City Council
adopts an order to abate and remove the weeds and to assess the costs of abatement as a lien on the property. Liens are imposed after providing the owner with a report of costs that is confirmed by the City Council following another public hearing. The costs of such abatement can then be collected via the tax roll. This process allows the City to undertake uniform code enforcement simultaneously across all problem parcels in the City. The City contracts with the County of Santa Clara for abatement of weeds and the work will be performed in accordance with a fee schedule adopted by the County.
On December 19, 2023, the City Council adopted a resolution following this process based on information provided by the County of Santa Clara Consumer and Environmental Protection Agency. Unfortunately, the information provided was inaccurate and identified the wrong properties. The Resolution will rescind that resolution and identifies the correct properties.
Fiscal Impact:
There are no unbudgeted fiscal impacts with this agenda item.

The City Council’s agenda was posted at City Hall and the agenda and this report appear on the City’s website.

16.Robert's Rules of Order
The council may elect, by majority vote, to adopt Robert's Rules of Order as a guide to matters of procedure and rules of debate, provided, however, that no provision of Robert's Rules of Order shall be construed to supersede any provision herein or in any other ordinance of this City, if the two provisions are in conflict. If the council so decides, the Mayor shall designate a specific edition of Robert's Rules of Order to be used throughout his/her term, provided, however, that said edition is economical and readily available.
17.Failure to Observe Rules of Order
Rules adopted to expedite the transaction of the business of the council in an orderly fashion are deemed to be procedural only, and the failure to strictly observe such rules shall not affect the jurisdiction of the council or invalidate any action taken at a meeting that is otherwise held in conformity with law.

Title: Consider Establishment of and Appointment to a City of Monte Sereno Council Financial Systems and Technology Program Ad-Hoc Committees Recommendation(s):
Staff recommends The Monte Sereno City Council consider creation of the Financial Systems and Technology Program Ad-hoc Committees and appoint two members of Council to each.
Background Information:
The City Council of Monte Sereno utilizes ad-hoc committees as subcommittees of the City Council for special assignments to complete work tasks on projects later presented for Monte Sereno City Council consideration. Ad-hoc committee assignments are for one-year terms and expire automatically unless renewed annually after their original inception. While ad-hoc committees are not subject to Brown Act requirements regarding agendas and open meetings, any permanent or standing committees created by the City Council are subject to such requirements, even if less than a quorum of the Council sits on such committees. Thus, ad hoc committees should be limited in scope and duration.

STAFF REPORT
Meeting: City Council - Jan 16 2024
Agenda Heading: NEW BUSINESS
Staff Contact: Steve Leonardis,
Department: City Manager
Title: Discuss Selection of Meeting Date for Strategic Goal Setting Recommendation(s):
Staff recommends the Monte Sereno City Council discuss selecting a date for the Annual Strategic Goal Setting meeting and direct staff in organizing this meeting.
Background Information:
Monte Sereno City Council meets annually to establish strategic goals for the staff to create a workplan. Historically, the annual goal setting session is scheduled prior to annual budget adoption so funding for the strategic goals can be incorporated into the annual budget.
In the last two years, council created Special Meetings to host annual Strategic Goal Setting. Last year, the Strategic Goal Session meeting was held on Saturday, April 1, 2023. In 2022, the meeting was held on Tuesday, March 22, 2022. In 2021, Monte Sereno Council met on a regular City Council meeting day and held the Strategic Goal Setting meeting as part of the regular city council meeting.
Staff is looking for direction as to when Monte Sereno City Council prefers to host the annual goal setting session for consistency of process. Staff recommends the annual goal setting meeting to occur on or before the first city council meeting in May each year and be placed into the annual calendar each year at the same meeting time.
Fiscal Impact:
There are no unbudgeted fiscal impacts with this agenda item.
