STAFF REPORT
Meeting: City Council - May 21 2024
Agenda Heading: CONSENT CALENDAR
Staff Contact: Daryl Jordan, City Engineer
Department: City Engineer
Title: Authorize City Manager to Enter into Authorization Agreement with the West Valley Solid Waste Management Authority Authorizing the Authority to Represent the City in the Santa Clara County Edible Food Program Recommendation(s):

Council authorize the City Manager to enter into the Authorization Agreement with the West Valley Solid Waste Management Authority Authorizing the Authority to Represent the City in the Santa Clara County Edible Food Program.

Background Information:

The West Valley Solid Waste Management Authority (“Authority”) was established by the City and the cities of Campbell, Monte Sereno and Saratoga, and the Town of Los Gatos (collectively referred to as the “Member Agencies”) to arrange for and manage the waste reduction, collection, reuse, disposal, recycling, and diversion of discarded materials originating in the participating municipalities.

In addition, the Member Agencies are parties to the Santa Clara County Recycling and Waste Reduction Technical Advisory Committee (“TAC”), which is a separate Committee created to assist the County of Santa Clara Recycling and Waste Reduction Commission (“RWRC or Commission”). The TAC advances the interests of party jurisdictions by performing technical and policy review to inform parties and advise the Commission on solid waste management issues. With the recent implementation of SB 1383, cities are required to increase recovery by 20 percent of currently disposed edible food for human consumption by January 1, 2025. To meet the mandated statewide goal, SB 1383 requires each jurisdiction in California to establish and monitor a food recovery program. The Member Agencies with other local agencies have previously agreed to jointly administer and fund the cost of a countywide edible Food Recovery Program (“the Program”) through the Memorandum of Understanding Among Local Public Agencies in Santa Clara County for Food Recovery Program Costs entered into and covering the time period of July 1, 2023 to June 30, 2024, to satisfy their respective obligations under SB 1383 and the corresponding regulations. Due to the expiration of the MOU, the Parties and other local agencies are currently preparing a successor Memorandum of Understanding for the Program. Based on the expertise of the staff and the purpose of the Authority, the staff of the Member Agencies are recommending that the Authority and its staff serve as its representative in the Program.

Page 28 of 95 ends

Analysis:

The Authority was formed to collectively represent the interests of the Member Agencies in waste reduction, collection, reuse, disposal, recycling, and diversion of discarded materials originating in their jurisdictions. The staff of the Authority is experienced in dealing with these issues which include food recovery and diversion. Currently, the City has limited staff resources to represent the City in the Program. For these reasons, it is in the best interest for the Authority to represent the City in the Program.

In order for the Authority to represent the City in the new Memorandum of Understanding, an authorization agreement must be approved by the Authority Board and the City Council. This authorization agreement will allow the Authority to represent the City in the MOU and the Program and will require the Authority to pay the City’s costs for participation in the Program.

Fiscal Impact:

There is no fiscal impact associated with this agreement. The Authority will be responsible for paying the City’s costs in the Program.

Alternatives:

1. Not approve the agreement in which case, the City will need to enter into the Memorandum of Understanding for the Program and the City’s Public Works Director will be required to represent the City in the Program.

AUTHORIZATION AGREEMENT
THIS AUTHORIZATION AGREEMENT is made and entered into as of May _, 2024, by and between the West Valley Solid Waste Management Authority (hereinafter "Authority") of Santa Clara County, California, a Joint Powers Authority organized under the laws of the State of California, and the City of Monte Sereno, (hereinafter referred to as the "City "). Authority and City shall be referred to collectively as the “Parties”.

This Agreement is entered into with reference to the following facts and circumstances:

WHEREAS, Authority was established by the City and the cities of Campbell and Saratoga, and the Town of Los Gatos (collectively referred to as the “Member Agencies”), pursuant to the provisions of the Joint Exercise of Powers Act (Title 1, Division 7, Article1, Section 6500 et seq. of the California Government Code) to arrange for and manage the waste reduction, collection, reuse, disposal, recycling, and diversion of discarded materials originating in the participating municipalities; and WHEREAS, the Member Agencies are parties to the Memorandum of Agreement (“MOA”) entered into on June 14, 2013 for the Santa Clara County Recycling and Waste Reduction Technical Advisory Committee (“TAC”), which is a separate Committee created to assist the County of Santa Clara Recycling and Waste Reduction Commission (“RWRC or Commission”) that advances the interests of party jurisdictions by performing technical and policy review to inform parties and advise the Commission on solid waste management issues, and bring together varied expertise and viewpoints for planning and implementing the Commission approved annual workplan and budget; and
WHEREAS, California’s Short-Lived Climate Pollutant Reduction law (SB 1383, Lara, Chapter 395, Statutes of 2016) establishes methane reduction targets for California, including a target to increase recovery by 20 percent of currently disposed edible food for human consumption by January 1, 2025; and
WHEREAS, to meet the mandated statewide goal, SB 1383 requires each jurisdiction in California to establish and monitor a robust food recovery program, which will strengthen the relationships between commercial edible food generators and food recovery organizations within their communities, requiring certain food businesses to send the maximum amount of edible food they would otherwise dispose to food recovery organizations and/or services; and
WHEREAS, the Parties with other local agencies have previously agreed to jointly administer and fund the cost of a countywide edible Food Recovery Program (“the Program”) through the Memorandum of Understanding Among Local Public Agencies in Santa Clara County for Food Recovery Program Costs entered into and covering the time period of July 1, 2023 to June 30, 2024 (“Former MOU”) to satisfy their respective obligations under SB 1383 and the corresponding regulations; and

Page 30 of 95 ends

WHEREAS, due to the expiration of the Former MOU, the Parties and other local agencies are currently preparing a successor Memorandum of Understanding for the Program (“Successor MOU”); and
WHEREAS, based on the expertise of the staff of the Authority, the City desires to authorize the Authority and its staff to act on its behalf, serve as its representative, enter into the Successor MOU and fund City’s participation in the Program; and WHEREAS, the Authority is willing to act on the City’s behalf, serve as the City‘s representative, enter into the Successor MOU and fund City’s participation in the Program.

NOW, THEREFORE, for good and valuable consideration, the adequacy and sufficiency of which is hereby acknowledged, the Parties agree as follows:

AGREEMENT

1. AUTHORIZATION. The City hereby authorizes the Authority to enter into the Successor MOU on its behalf, perform all obligations and requirements under the Successor MOU and serve as the City’s representative in the Program.

2. FINANCIAL OBLIGATIONS. The Authority shall pay, on behalf of the City, all fees owed by the City or its proportional share of the amounts owed by the Member Agencies due under the Successor MOU.

3. TERM OF AUTHORIZATION. This authorization shall be valid until such time the City revokes the authorization by providing written notice to the Authority.

STAFF REPORT
Meeting: City Council - May 21 2024
Agenda Heading: NEW BUSINESS
Staff Contact: Steve Leonardis,
Department: City Manager
Title: Evaluate, Consider, and Accept Community (CBO) Grant Application Submittals
Recommendation(s):

Staff recommends the City Council evaluate and accept Community Based Organization Grants (CBO) according to policy guidelines. Staff recommends the following funding allocations for Fiscal Year 2024-2025:

Art Docents of Los Gatos $4,500
AWO $0
Los Gatos Community Concert Association $4,000
Los Gatos Youth Park $5,000
Los Gatos Lion’s Charities $1,500
Los Gatos Public Media - KCAT TV $5,000
West Valley Community Services $5,000
Background Information:

The City of Monte Sereno City Council adopted a Community Based Organizations, or CBO’s grant application, criteria, and process on February 18, 2020. The intention of adopting policy language was to establish fair guidelines and direction for requestors so councilmembers can better accommodate the public with grant requests. The City Council of Monte Sereno established and funded $25K in total CBO grant funding for the 2024-2025 budget. The maximum grant request established was $5,000. Current grant requests, if accepted by Monte Sereno City Council, will be incorporated into the FY 2024-2025 annual budget.

Analysis:

A total of seven grant requests were received by staff. The total requested dollar amount of the CBO grant requests exceeds $25K. Eligibility criteria was evaluated by staff. A summary of the requesters and requested grant amounts are listed below:

1. Art Docents of Los Gatos $4,500

2. AWO $5,000

3. Los Gatos Community Concert Association $5,000

4. Los Gatos Lions Charities, Inc. $1,500

Page 37 of 95 ends

5. Los Gatos Public Media - KCAT TV $5,000

6. Los Gatos Youth Park $5,000

7. West Valley Communtiy ServicesCare Initiative $5,000 Fiscal Impact:
$25,000 to the City of Monte Sereno General Fund account.

Alternatives:

1. Fund $25,000 worth of the $31,000 in CBO requests.

2. If less than $25,000 is funded, consider adding the balance of funds to next year’s CBO pool of funds.

3. If less than $25,000 is funded, consider adding the balance of funds to requestors who requested less than the maximum ($5,000) grant.

4. Fund more than the $25,00 worth of CBO grant requests by exception.

Conclusion:

A fair and equitable grant policy was adopted by the Monte Sereno City Council to better serve the community with CBO grant requests. The Monte Sereno City Council must decide how to best allocate funding according to established guidelines and remain within the $25K annual budget limit.

Public Noticing:

The City of Monte Sereno’s council meeting agenda was posted on the bulletin board outside of Monte Sereno City Hall and the agenda with this staff report can be accessed on The City of Monte Sereno’s website located at www.montesereno.org.

Building Community The Art Docents have been part of the community for close to 51 years now. The Docents serve nearly 3000 students in the Los Gatos Union School District which includes 4 elementary schools and one middle school. We provide ongoing programs and
activities in art history, art criticism, and art techniques.

Membership is drawn throughout the community. A
comprehensive 8 week training and mentoring is provided.

Page 40 of 95 ends

Our goals are to -
Introduce visual art as a tool for self expression
Develop visual arts literacy
Provide an opportunity for exercising critical thinking and judgment
Develop an understanding and appreciation for world cultures Provide opportunities and training for developing art skills and experiencing creations of art
We do monthly art presentations for each classroom, host an annual art show, guest artist visits from local artists to schools and hands-on workshops. Our mission is to expand students' educational and cultural experiences and to foster more flexible and creative individuals.

Outside of teaching in the classroom our organization also has monthly Continuing Education events, monthly movie nights, museum visits and docent community events which all active and sustaining Docents are welcome to attend.

The Art Docents celebrated our 50th Anniversary this past year.

We had a “Community Cat Mosaic'' where people from the Los Gatos/Monte Sereno community were able to work on a small piece of mosaic. We then had local Los Gatos artist, Nilgun Kurdi, put together all the mosaic pieces to form a beautiful mosaic cat that is now permanently displayed at Raymond Fisher Middle School.

Although we focus on the students of LGUSD, we also try to have public facing events when possible. This past fall, we had tables at the Los Gatos Town Plaza Park during the LGEF 40th Anniversary Event where adults and children could color posters which we then used during the annual Los Gatos Holiday
Parade.

Since the pandemic, the number of active Docents was reduced.

Our program is heavily based on trained volunteers. This upcoming year we plan to focus on recruiting and training more active volunteers. We plan to expand our search beyond the schools and reach out to more local Senior Communities. We have had a few new Docents this past year who come from our senior citizen community. They have been a wonderful addition to our organization. We feel this is a community where both the Seniors and the Art Docents can benefit.

We deeply appreciate the support over the years from the City of Monte Sereno and look forward to your response. Please let us know if you have any questions.

Building Community Step inside, and you’ll see a “media playground” buzzing with meaningful, cross-generational activity! We’re providing digital media technology tools for self-expression in a safe, teamoriented environment; uplifting youth through storytelling; creating media projects they look forward to; and building a community of older adult volunteers who help produce our station’s programming and facilitate our cross-generational

Page 50 of 95 ends

structure of learning and mentoring.

The critical need for post-pandemic resources put a spotlight on KCAT's role as a community relationship builder and on our studio as a place where people of all ages can engage in a safe, supportive environment while exploring their creativity through digital media arts. During the pandemic, student support systems had to be re-envisioned, and teachers, parents and caregivers were stressed and stretched thin. Older adults felt the negative mental health effects of isolation, and KCAT was there as an essential resource to leverage multimedia technology as a means to communicate.

KCAT's programs for youth really epitomize our mission to educate, entertain, inform and inspire. Not only are we employing and mentoring college and high school students as creators, directors, producers and counselors, but they, in turn, are teaching next gen youth how to tell stories, run live TV and podcast shows, scriptwriting, filming, and editing—skills transferable to college and industry. Equally important, we're providing youth with opportunities for much needed in-person socialization, which also supports their well-being and mental health. This year we have 14 campers signed up from Monte Sereno so far… a record!
Similarly, we're building a community of older adult volunteers (55+) and many Monte Sereno residents have joined The
Producers Network. Through meaningful cross-generational experiences, youth and older adults (several are 90+) are developing skills and creating content together in our TV and radio studio. KCAT's multimedia arts staff are enabling more than the typical senior center connections; we're providing an often ignored group a way of "artful aging" in a truly fulfilling and meaningful way.

Effectively engaging with our community is a key value as KCAT Public Media considers programming. Monte Sereno residents are engaging more and more with KCAT by volunteering at events, attending lectures, participating in tech training, and producing original TV shows. We are proud of our partnerships with the City of Monte Sereno, Town of Los Gatos, local music and performing arts organizations, museums, schools, athletic and recreational programs, as well as many community service groups and business associations. Our KCAT TV and YouTube channels, as well as our social media and podcast platforms, facilitate community storytelling far beyond any boundary. We offer opportunities to create deep connections and the potential to bring together diverse communities. With the continued support from the City of Monte Sereno, KCAT Public Media will continue to expand media opportunities for youth, teens, young adults, and the 55+ community to share their stories while

Page 51 of 95 ends

developing transferable life skills at our TV studio.

Enjoy these perks with your generous sponsorship:

Building Community This program is based on the notion of people helping people.

Children in low-income or homeless households face so many challenges - educational, emotional, and economic - placing them at a significant disadvantage as compared to their peers.

According to the American Psychological Association, povertyinduced stress can cause permanent changes to developing brains that negatively impact “children’s working memory, problem-solving, and other executive function skills.” Our annual

Back to School with Dignity Project brings community members together during August to sort, organize, and distribute new clothing, shoes, backpacks, and school supplies to 300 K-12 students whose families are in economic crisis. Because the average cost to purchase clothing, shoes, backpacks, and supplies in Silicon Valley can average $100-$150 or more per child, receiving assistance through the Back to School Project is critical to families who must preserve their limited income to pay for rent, utilities, and food.
