STAFF REPORT
Meeting: City Council - Dec 03 2024
Agenda Heading: CONSENT CALENDAR
Staff Contact: Diana Perkins, City Planner
Department: Interim City Manager
Title: Approve Warrant List Dated November 26, 2024 in the amount of $132,505.12
Recommendation(s):
Staff recommends the City Council approve the Warrant List.
Background Information:
The attached Warrant List represents City bills that are pending payment until the City Council approves the Warrant List.
Analysis:
At the October 15, 2024 City Council meeting, Council Member Ellahie requested that information about the total revenues and expenditures be provided to the Council with the Warrant List. The following table shows the actual expenditures and revenues for the current fiscal year and how they compare with the budgeted amounts:
FY 24/25 Expenditures and Revenues Compared with Budgeted Amounts Item FY Budget Actual Through
Nov. 22, 2024
(37.5% of FY)
% Spent/Received
of Fiscal Year
Expenditures 4,692,719 $1,674,701 35.7%
Revenues 4,718,200 $780,777 16.5%
Based on this information, the expenditures are in line with the budgeted amounts to date. The revenues to date appear to be low and that is mainly due to the property tax revenues that have not yet been received. Of the total budgeted revenue, property tax is the majority with $2,990,600 (63% of the total revenue). Property tax revenues are received in December/January of each year and also in April/May.
Fiscal Impact:
There are no unbudgeted fiscal impact with this agenda item.
Public Noticing:
The City Council’s agenda was posted at City Hall and the agenda and this report appears on the City’s website.

Title: Adopt a Resolution Accepting Funds from the California Supplemental Law Enforcement Service Fund (SLESF)
Recommendation(s):
Staff recommends the City Council adopt a Resolution accepting funds from the California Supplemental Law Enforcement Service Fund (SLESF).
Background Information:
In 1996, California State legislation AB 3229 created the Citizens Options for Public Safety (COPS) program allocating $100,000,000 to local governments yearly for front-line law enforcement. These funds are distributed through an established Supplemental Law Enforcement Services Fund (SLESF). The size of the grant award to each jurisdiction is proportionate to their population with the minimum award for all entities set at $100,000 yearly.
The State legislation mandates each municipality will receive funds annually and such funds are to be spent on “front line law enforcement services.” The funds cannot be used to supplant resources, but instead, must be used to supplement existing resources or funding. SLESF funds cannot be diverted into an entity’s general fund and must instead be used for the aforementioned front line law enforcement services. Additionally, administrative overhead costs may not exceed .05 percent of the total award.
The State legislation also specifies a City Council must approve the disposition of the funds each year and submit a spending plan outlining the use of these funds. Funds must be encumbered or liquidated within two years.
Analysis:
Pursuant to AB 3229, the City of Monte Sereno receives a share of the state SLESF of $100,000 annually. The current Agreement for Law Enforcement Services with the Town of Los Gatos requires that Monte Sereno transfer these funds to the Town within 30 days of receipt of each installment. The Agreement requires that the Los Gatos Monte Sereno Police Department use the funds to provide 416 hours of additional traffic enforcement within the Monte Sereno city limits.
Fiscal Impact:
No fiscal impact is anticipated as the grant funds received will be passed along to the Town of Los Gatos for the agreed upon additional traffic enforcement from the Los Gatos Monte Sereno Police Department.
Public Noticing:
The City Council’s agenda was posted at City Hall and the agenda and this report appears on the City’s website.

ACCEPTING SUPPLEMENTAL LAW ENFORCEMENT SERVICE FUNDS (SLESF) GRANT ALLOCATION FOR FY 2024-25 AND APPROVE USE OF THE FUNDS WHEREAS, pursuant to Chapter 6.7 of Division 3 of Title 3 of the Government Code, the City of Monte Sereno is entitled to receive approximately $100,000 which will be disbursed from the County Supplement Law Enforcement Services Account (SLESA) if specified requirements are met; and
WHEREAS, such funding cannot be used to replace other City funding for law enforcement and must be expended exclusively for front line law enforcement services; and
WHEREAS, the City Council has considered the written request separate and apart from the allocation of general funds for police services.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Monte Sereno, as follows:
1. The City Council hereby accepts the allocation of funding set forth above and directs the City Manager to take all necessary actions for receipt and disbursement of money received from the County SLESA Account, and to cause such funding to be deposited into the City’s Supplement Law Enforcement Services Account (SLESF) account.
2. The City Manager is directed to promptly remit to the Town of Los Gatos all funding deposited in the SLESF fund to be used for an additional 416 hours of traffic enforcement within the city limits of Monte Sereno.

Title: Discussion and Consideration of the Future Use of the City Hall Auxiliary Building and Site
Recommendation(s):
Staff recommends that the City Council discuss and consider the future use of the City Hall auxiliary building and site.
Background Information:
Over the past several years, the City Council has considered various options for remodeling the former Post Office building next to the City Hall into a Community Center. Most recently, the City Council rejected the bids for two different options that would have remodeled the existing building by a 3-2 vote.
The City Council may want to discuss how to move forward and consider options for the use of the auxiliary building and site. For discussion purposes, the Council may want to consider one or more of the following options:
Forming an Ad Hoc Committee to look into options for re-use of the auxiliary building and site.
Forming a standing Committee made up no more than two Council Members and Monte Sereno residents to consider options for re-use of the auxiliary building and site. Developing a city-wide survey of residents to get feedback on how the community would like to use the space.
Depending on the direction provided by the Council, staff will return with any necessary action at the January 21, 2025 meeting.
Fiscal Impact:
There is no fiscal impact for this discussion item. The fiscal impact of any potential re-use of the auxiliary building and site can be determined as directed by the City Council.
Public Noticing:

Diana - thank for your very prompt reply, even on the eve of Thanksgiving..........Dena and are very disappointed to learn nothing has been done to care for and display this one-of-a-kind nugget of Monte Sereno's history. The design prepared by Monte Sereno's architect is a four foot square frame about 6" in depth which accommodates the sign as well of a few of Steinbeck's novels he has written. A very simple and elegant approach. I know you have a copy of that design.
We understand your plan was to incorporate this display in the new community center.
We also understand due to budget constraints, the new construction has been postponed into some future date when funds are available. This all makes good sense, however it seems to us you should be able to find one 4'x4' area of wall space to accommodate the display in the exiting city hall. A wall space smaller than 4'x4' could be acceptable to us if that was all that was now available.
The donation of the sign and funds to create a frame were not predicated on the construction of a new community center - that was an after-thought The gift was for the city to display the sign in the best way possible, but not to store it away in some obscure place where it will languish unseen or appreciated by anyone for an indeterminate period of time.
In a creative manner, I feel confident your architect could come up with an alternate place in the current building, . I hope you will stay focused on the object of the exercise - it get the sign in a place where it is readily visible to the citizens of Monte Sereno. - not some future to-be-built facility.
If it is the present view of the council that there is no place in the existing city hall that can be found to display the sign in an appropriate manner, then, with all due respect, we hereby request you return the sign to us along with the $5000 we gave to have it framed. We hope this can be accomplished in a cooperative and harmonious way.
Dena and I are old folks now, to do a Zoom meeting we need at lest one of our teen age great grand kids to hold our hand while walking us through that modern supertechnology. So, for Diana and I - lets use our emails to exchange ideas of the road ahead in this matter. Or, we can communicate the old fashioned way, with a phone call.
We will look forward to hearing back from you...........thank you, Diana........

Mr. Gambord,
I received your email below. In November 2023 the City Council passed a resolution to accept your donation of the Steinbeck sign and $5,000 for a display at the Community Center. Since the Council accepted your donation, staff cannot return it without action from the Council directing that to happen.
At the City Council meeting last week, the Council voted to not award a contract for the construction of the Community Center at this time due to budget concerns, but not to end the Community Center project all together. The discussion item on the agenda for the December 3, 2024 meeting is for the Council to consider how to move forward.
If you would like to request the donation of the sign and money be returned, you can speak at the Council meeting next week (participation is available remotely through Zoom) or you can send us written comments before the meeting that those will be provided to the Council Members. If you would like us to use your email below as your comments on this subject, please let me know and we will pass that along to the full Council.
Let me know of any other questions or comments.

Subject: Re: 12/03/2024 Regular Meeting of the City Council Agenda Good Afternoon.............please forward this to the City Manager and the current Mayor.
Joel Gambord here. A number of months ago, I gave the Steinbeck sign "Arrojo del Ajo" to the city of Monte Sereno along with $5000 to cover the cost of an appropriate frame for mounting at the city hall.
I have heard nothing from you about the progress of getting this done. I will plan to send someone to pick up the sign since you are apparently unable or unwilling to complete your agreement. The Steinbeck Center in Salinas would love to have that piece of history and are prepared to display it properly.
Please get back to me promptly so Dena and I can redirect the effort for the safe keeping and display of the sign.
