STAFF REPORT
Meeting: City Council - Jun 17 2025
Agenda Heading: CONSENT CALENDAR
Staff Contact: Diana Perkins, City Planner/Interim City Manager Department: City Manager
Title: Receive the Treasurer’s Report for April 2025
Recommendation(s):

Review and accept the Treasurer’s Report for April 2025.

Background Information:

California Government Code Section 41004 requires that general law cities submit a monthly report from the City Treasurer that provides an accounting summary of City funds. The Treasurer’s Report for April 2025 is provided to comply with this requirement.

The Treasurer’s Report has been updated from prior iterations to more directly address the requirements of the Government Code and to provide greater transparency to the City’s financial position. The April 2025 report is the first phase of this transition, which is to provide summary accounting for all of the City’s cash and investment accounts. The second phase of this transition will be to include the cash and investment balance across City funds (General Fund, Gas Tax Fund,etc.). Based on the City’s current practices and financial system, this information is difficult to accurately portray on a monthly basis. With the implementation of the new financial system, balances by fund will be available to incorporate into the monthly Treasurer’s Report during fiscal year 2025-26. This report will also be refined as the City transitions its investments from Wells Fargo and LAIF to the California Asset Management Program.

Analysis:

The attached Treasurer’s report provides details of the City’s cash and investment balances, including receipts and disbursements for the month.

California Environmental Quality Act:

This is not a “project” under the California Environmental Quality Act (“CEQA”) in that it is a governmental organizational or administrative activity that will not result in direct or indirect changes in the environment (CEQA Guidelines section 15378(b)(5)).

Fiscal Impact:

Page 15 of 101 ends

There is no direct fiscal impact for receiving the April 2025 Treasurer’s Report.

Public Noticing:

The City of Monte Sereno's Council meeting agenda was posted on the bulletin board outside of Monte Sereno's City Hall and the agenda with this staff report can be accessed on the City of Monte Sereno's website located at www.montesereno.org.

Title: Adoption of Resolution Establishing and Fixing the Amount of Special Real Property Tax Levy for Police Protection Purposes for the Fiscal Year 2025-2026
Recommendation(s):

Staff recommends that the Council adopt the resolution establishing and fixing the amount of special real property tax levy for police protection purposes for fiscal year 2025-2026.

Background Information:

On the November 8, 1983 election, Monte Sereno voters approved, by more than two-thirds of votes cast, a ballot measure which levied a parcel tax for police services. The same year, the City Council adopted Ordinance No. NS-22 to authorize the Santa Clara County Tax Collector to collect the $150 per parcel tax. Santa Clara County requires an annual resolution requesting the County to collect the parcel tax. Approval of the proposed resolution would authorize the collection of the parcel tax for Fiscal Year 2025-2026 in an amount of $150 per parcel.

California Environmental Quality Act:

The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(4) in that it is a fiscal activity that does not involve any commitment to any specific project which may result in a potential significant impact on the environment.

Fiscal Impact:

No fiscal impact will result from the adoption of this resolution as the parcel tax revenue has been included in the proposed Fiscal Year 2025-26 budget.

Public Noticing:

The City of Monte Sereno's Council meeting agenda was posted on the bulletin board outside of Monte Sereno's City Hall and the agenda with this staff report can be accessed on the City of Monte Sereno's website located at www.montesereno.org.

AND IMPOSING A SPECIAL REAL PROPERTY TAX FOR POLICE

PROTECTION SERVICES
The City Council of the City of Monte Sereno DOES ORDAIN as follows:

SECTION 1. PURPOSE AND INTENT.

At present the City of Monte Sereno (herein referred to as the "CITY"), provides police protection services by contract with another public agency, namely, the County of Santa Clara and the Office of the Sheriff thereof. As a result of the passage of Proposition 13 in June, 1978, the CITY is unable to increase property tax revenues to meet the anticipated annual increases in the cost of obtaining police protection services, either at the present level of service or better by contract with the County of Santa Clara, or with another public agency, as the case may be.

It is the purpose and intent of this Ordinance to impose a special real property tax pursuant to the provisions of California Government Code Section 53978 on real property, other than property owned by governmental agencies, within the CITY for the purpose of augmenting funding of police protection services in order to continue or improve the present level of service, but only to the extent necessary to balance the budget of CITY without the use of any unappro

SECTION 3. SPECIAL TAX LEVY.

There is hereby levied and assessed a special real property tax by the City of Monte Sereno on each parcel of property in the City of Monte Sereno in the sum of One Hundred Fifty Dollars ($150.00) per year for each parcel of property commencing with the fiscal year 1984-85.

The tax imposed by this Section shall be a tax upon each parcel of property, and the tax shall not be measured by the value of the property.

Having suspended all or any part of the tax imposed by this Ordinance, the City Council, by three (3) affirmative votes, is empowered to increase the amount of the tax up to the amount stated in Section 3 of this Ordinance. Under no circumstances may the amount of the tax exceed that set forth in Section 3.

SECTION 5. DISBURSEMENT OF TAX.

The revenue raised by the real property tax levied by this Ordinance shall be placed in a special fund to be used only for the purposes of obtaining, furnishing, operating and maintaining police protection equipmentor apparatus, for paying the salaries and benefits of police protection personnel, and for such other police protection expenses as are deemed necessary by the City Council of the CITY.

SECTION 6. COLLECTION AND ADMINISTRATION.
(a) Liens. and along with, and shall be subject to the same interest and penalties, as general ad valorem property taxes collected by the County of Santa Clara on behalf of the CITY. The taxes on each parcel of property shall be billed on the secured roll tax bills and shall be collected in the same manner as ad valorem property taxes collected by the County of Santa Clara on behalf of the CITY on the secured roll. Failure to pay when due will result in the imposition of penalties and interest in the same manner as if the taxes were ad valorem property taxes. (c) Recovery of County Costs. The County of Santa Clara shall be entitled to deduct the reasonable costs of collection and administration of this Ordinance before remitting the tax revenues collected to the CITY.
(d) Administrative Regulations. The City Council of the CITY by three (3) affirmative votes may from time to time adopt regulations necessary for the enforcement and administration of the special tax provided for herein, and to implement and make effective this Ordinance.

Such regulations shall be consistent with the purpose and intent of this Ordinance.

SECTION 7. APPEALS.

Any person aggrieved by the real property tax imposed pursuant to this Ordinance may, within the time fixed by the City Council, appeal the determination of the officers of the County of Santa Clara

Page 23 of 101 ends

SECTION 8. EXEMPTIONS.

The special real property tax imposed by this Ordinance shall not apply to any parcel of property that is exempt from the real property tax imposed by this Ordinance pursuant to any provision of the Constitution or any paramount law.

SECTION 9. OPERATIVE DATE.

This Ordinance shall become operative only if this Ordinance is adopted by a vote of sufficient number of qualified electors as is required by paramount law to impose the real property tax described in this Ordinance.

Background Information:

The Santa Clara Valley Transportation Authority (VTA)’s 2016 Measure B Program provides funding to local agencies for bicycle and pedestrian education and encouragement (E&E) activities. This sub-category, known as the Bike/Pedestrian E&E Program, covers the development and distribution of materials that are designed and intended to satisfy the following goals within the local agencies: (i) promote, educate, and/or encourage safe walking or bicycling for residents or visitors of every age and ability; (ii) communicate to residents and visitors the benefits of walking and bicycling; and (iii) communicate to school children, residents, and visitors the rights and responsibilities of pedestrians, bicyclists, and motorists.

The City has an established partnership with the Los Gatos‐Monte Sereno Safe Routes to School (LG-MS SR2S), Inc. a 501(c)(3) organization in promoting and encouraging biking and walking to school-age children. On December 21, 2021, City Council authorized an agreement with Los Gatos-Monte Sereno Safe Routes to School. The contract is set to expire on June 30th, 2025 and a new contract is needed to continue obtaining services from Los Gatos-Monte Sereno Safe Routes to School and meet VTA’s E&E Program requirements.

Recommendation(s):

Staff recommends that the City Council adopt the draft resolution approving the fiscal year 2025/26 salary schedule.

Background Information:

CalPERS requires that member agencies regularly approve agency-wide salary schedules as pay rates change. Such salary schedules must be approved by the member agency's governing body. The City Council has approved salaries for employees within the Association of City Employees (ACE) bargaining unit on June 6, 2023 as part of the current Memorandum of Understanding (MOU) with the Association of City Employees (ACE) which covers July 1, 2023 through June 30, 2026. The City Council previously approved the City Manager’s salary as part of her employment contract on May 20, 2025.

The draft resolution includes pay rates for all staff in one comprehensive document. This salary schedule includes all relevant information required by CalPERS, including the title and pay range or step schedule for every classification in the City service as well as the effective date of the pay rates. Approval of the Citywide salary schedule will ensure continued compliance with CalPERS regulations concerning the adoption of publicly available pay schedules.

No fiscal impact will result from the adoption of this resolution as the salaries are included in the proposed Fiscal Year 2025-26 budget.

STAFF REPORT
Meeting: City Council - Jun 17 2025
Agenda Heading: PUBLIC HEARINGS

Department: City Clerk
Title: Conduct a Public Hearing to Consider Objections to the Proposed Removal of Brush on Parcels Listed on the 2025 Wildland Urban Interface (WUI) Area Non-Compliant Parcel List and Order Abatement.

Recommendation(s):

Conduct a public hearing to consider objections to the proposed removal of brush on parcels listed on the 2025 Wildland Urban Interface (WUI) Area Non-Compliant Parcel List and order abatement.

Background Information:

On May 20, 2025, the City Council passed Resolution 2025-3929 declaring hazardous vegetation (brush) a public nuisance, ordering abatement, and setting June 17, 2025, as a public hearing to consider objections to the proposed removal of brush. The required posting has been completed and property owners have been notified by mail to remove brush in accordance with fire safety standards. The hearing is an opportunity for those objecting to the potential charges to come forward and be heard.

The City annually declares hazardous vegetation (brush) a nuisance due to fire danger and enters into a contract (along with other municipalities) with Santa Clara County to abate the hazardous vegetation (brush) not removed by property owners. It also authorizes the County, through a contract for services with the City, to remove the brush if the property owner fails to do so and to recover administrative service and abatement costs through an assessment on the property tax bill for each parcel. The focus of this program is the identification of perennial vegetation, brush, trees, and shrub in designated high fire hazard areas.

Fiscal Impact:

There are no unbudgeted fiscal impacts with this agenda item.

Public Noticing:

The City Council's agenda was posted at City Hall and the agenda and this report appear on the City's website. All property owners included on the abatement list were notified of this meeting.

STAFF REPORT
Meeting: City Council - Jun 17 2025
Agenda Heading: PUBLIC HEARINGS
Staff Contact: Gloisy Gonzalez-Langarica, City Clerk
Department: City Clerk
Title: Introduction and Waiver of First Reading of Ordinance No. NS-246, an Ordinance of the City Council of the City of Monte Sereno Amending Municipal Code Sections 12.03.020.A and 12.03.030 to Reduce the Number of Youth Commissioners
Recommendation(s):

Staff recommends the City Council introduce and waive of first reading of Ordinance No. NS246 an Ordinance of the City Council of the City of Monte Sereno Amending Municipal Code Section 12.03.020.A and 12.03.030 to Reduce the Number of Youth Commissioners.

Background Information:

Currently, the Monte Sereno Municipal Code allows for a minimum of five Youth Commissioners and a maximum of 15. Under the Brown Act, a majority of the Commissioners are required to be present in order to hold a public meeting. Currently, a minimum of eight Youth Commissioners are required to make the quorum and hold a meeting.

Over the last couple of years, the City has received fewer applicants for the Youth Commission, making it difficult to obtain a quorum to hold meetings. Last year the City received nine applications for appointment/reappointment to Youth Commission. This year, since the posting of recruitment for the Youth Commission, the City has received six applications.

Analysis:

Decreasing the number of Youth Commissioners to five would align with the Better Streets Commission and the Site and Architectural Commission membership. The modification to the number of Commissioners would also increase the ability of the Commission to meet the quorum requirements and hold meetings. Currently, Title 12.03 provides that each City Council Member appoints one Youth Commissioner and the remainder of the Commissioners are selected by a majority vote of the City Council. This ordinance would provide that each City Council Member would appoint one of the five Youth Commissioners.

California Environmental Quality Act:

Page 58 of 101 ends

This is not a “project” under the California Environmental Quality Act (“CEQA”) in that it is a governmental organizational or administrative activity that will not result in direct or indirect changes in the environment (CEQA Guidelines section 15378(b)(5)).

Fiscal Impact:

No fiscal impact to the City is anticipated with the adoption of this ordinance.

Public Noticing:

A notice of the public hearing was posted at three locations within the City. The City of Monte Sereno's Council meeting agenda was posted on the bulletin board outside of Monte Sereno's City Hall and the agenda with this staff report can be accessed on the City of Monte Sereno's website located at www.montesereno.org.

STAFF REPORT
Meeting: City Council - Jun 17 2025
Agenda Heading: UNFINISHED BUSINESS
Staff Contact: Diana Perkins, City Planner/Interim City Manager Department: City Manager
Title: Adopt a Resolution Approving the City of Monte Sereno Fiscal Year 2025/2026 Budget
Recommendation(s):

Staff recommends that the City Council adopt the draft resolution approving the City of Monte Sereno Fiscal Year 2025/2026 Budget.

Background Information:

On June 18, 2024, the Council adopted a two-year budget including Fiscal Year 2024/2025 and Fiscal Year 2025/2026. The adopted budget for Fiscal Year 2025/2026 included projected revenues of $4,949,100 in the operating budget and expenditures of $4,803,108. Resulting in $145,992 in surplus revenue.

Although the Fiscal Year 2025/2026 budget was previously approved, there have been several changes in projected revenues and expenditures for the upcoming fiscal year which warrant a review of the adopted budget. Attachment 1 to this report includes the following information:
 Current Fiscal Year 2024/2025 Adopted General Fund Budget and Projected Expenditures
 Fiscal Year 2025/2026 previously adopted budget and proposed revised budget  Fiscal Year 2025/2026 propose project budgets
The City Council reviewed the draft proposed Fiscal Year 2025/26 budget at their meeting on May 6, 2025. No public comments were received during this meeting or since the meeting. The City Council provided directions regarding the desire to see the budget by fund, emphasizing this is an update to the previously approved budget for Fiscal Year 2025/26, and that the midyear budget update and future budgets will have a revised format.

The City is in the process of implementing new financial software and, as part of that effort, the budget for next fiscal year will have a revised format with more transparent information on the various City funds (i.e. general fund, gas tax fund, etc.) and will provide projections for future fiscal years.

Analysis:

General Fund
A comparison of the projected expenses for the current Fiscal Year 2024/2025, the previously adopted Fiscal Year 2025/2026 budget, and the proposed revised Fiscal Year 2025/2026 budget is included in Attachment 1. The changes in the previously adopted and the proposed budgets for Fiscal Year 2025/2026 include a significant increase in expenditures, which results in a deficit $245,729.

Following is a summary of the major changes that have resulted in the deficit.  Increase in cost for the Police Services Agreement – The City Council approved a new five-year agreement for police services with the Town of Los Gatos on April 15, 2025. The cost police services have increased significantly due to the increased costs incurred by the Town for sworn-officer staffing as well as legislatively mandated equipment and reporting requirements. The cost for police services in Fiscal Year 2025/2026 will be $1,458,319, which is an increase of $322,805 from the previous year.  Flock Camera Annual Cost – the City Council authorized an agreement with Flock Safety Group on January 21, 2025 for the installation and annual maintenance of 19 Automated License Plate Reader (ALPR) cameras and one mobile camera with Flock.

The annual service costs for these cameras is $60,500.
 Increased Cost for Attorney Services – Due to pending litigation, the costs for attorney services is expected to increase next fiscal year and the proposed budget includes an additional $80,000 in attorney costs.

Potential General Fund Revenue Increases
Following is a suggestion for Council to consider which would increase revenue in the Fiscal Year 2025/2026 and future budgets.
 Potential Ballot Measure to Increase Police Service Parcel Tax – In 1983, the residents of Monte Sereno approved a ballot measure for annual tax of $150 per parcel to support the cost of police services. In Fiscal Year 2025/2026, the revenue received from this parcel tax is approximately $187,000 and will cover only 13% of the police services costs.

Staff will provide additional information on this potential ballot measure including options for surveying residents to determine support for increasing this tax rate and what increased rate the Council may want to consider. This discussion item is scheduled for the August 5, 2025 City Council meeting.

Potential General Fund Expenditure Reductions
Following are suggestions for Council to consider which would reduce expenditures in the Fiscal Year 2025/2026 and future budgets.

Page 63 of 101 ends

 Staff Levels – The number of full-time staff has increased and some staffing positions have upgraded over the past five years. The process of assessing staffing needs compared with current staff is a longer term process and cannot be completed with this budget review and adoption. However, Council may consider directing staff to assess the staffing needs and return to the Council with the assessment for future discussion and potential reductions.

Capital Improvement Projects
In addition to the operating budget, the proposed Fiscal Year 2025/2026 budget includes the following Capital Improvement Projects (CIP) and special projects:
 Unfunded Pension Liabilities - An Unfunded Accrued Liability (UAL) for the California Public Employees' Retirement System (CalPERS) is the difference between the cost of future benefits and the assets available to pay for them. The approved budget included approximately $58,112 in annual payments for the unfunded liability. At that rate, the current unfunded liabilities will be paid in 10 to 15 years. However, additional unfunded liabilities may accumulate due to a variety of factors including the performance of the CalPERS investment portfolio, changes in actuarial assumptions, and experience changes.

During this upcoming fiscal year, staff will assess the UAL, the budget, and reserves to provide Council with alternatives for possibly paying this liability on an accelerated schedule.
 Green Stormwater Infrastructure (GSI) Project - As part of the Municipal Regional Stormwater Permit, which governs stormwater regulations for Monte Sereno, the City is required to provide treatment of storm water for approximately 9,000 square feet of currently un-treated area (i.e. impervious pavement, building roof area, etc.). Staff is working with a consultant to prepare plans for meeting this requirement at City Hall by modifying the roof drainage, landscaping, and pavement. This project was previously estimated to cost $125,000 and is included in the CIP budget.

Monte Sereno was awarded a grant from the 2018 Parks Bond Act in the amount of $180,171. The original grant application was to use these funds towards the community center at the auxiliary building. However, since Council has tabled that project due to the unexpectedly high project costs, staff was able to gain approval to redirect these grant funds for this GSI project. The revenue of this grant has also been included in the CIP projects for Fiscal Year 2025/2026 which would reduce CIP budget by the grant amount.
 Annual Pavement Management Program - The City receives several sources of revenue that are designated for road improvements. These revenues include the Gas Tax revenue from the State, Vehicle Registration Fees, Santa Clara County Measure B funds, and local construction road impact fees charged as part of building permits. The Fiscal Year 2025/2026 budget includes $441,600 in revenues from these sources. The

CIP project for the Pavement Management Program includes an expenditure of this same amount.

The status of the City’s fund balance is determined with each fiscal year’s audit. The last completed audit was for Fiscal Year 2022/2023 and was accepted by the City Council on June 4, 2024, which showed a fund balance for the General Fund, the City's main operating fund, of $5,276,896. This entire amount is considered "Unassigned", which means it can be used for any governmental purpose determined by the Council and is not otherwise, restricted, assigned, committed, or non-spendable.
 Fund Balance as of June 30, 2023: $5,276,896
 Estimated Fiscal Year 2023/2024 Deficit: ($20,628)
 Estimated Fiscal Year 2024/2025 Surplus: $318,000
 Estimated Fund Balance as of June 30, 2025: $5,574,268 Council may consider transferring a portion of the Fiscal Year 2024/2025 surplus, anticipated to be approximately $250,000, to cover the deficit projected for Fiscal Year 2025/2026.

The fiscal impact is noted above, due to increased costs for police services and Flock cameras, the proposed budget requires approximately $250,000 to be taken from the City’s’ reservices to balance the budget. While this will be largely off-set by the projected surplus from Fiscal Year 2024/25, staff will continue to look for opportunities to reduce expenditures throughout the year as directed by the Council to reduce the reserve expenditures.

Public Noticing:

The City of Monte Sereno's Council meeting agenda was posted on the bulletin board outside of Monte Sereno's City Hall and the agenda with this staff report can be accessed on the City of Monte Sereno's website located at www.montesereno.org.

Why do you want to be on the
selected Commission?:

I want to be on the Youth Commission because I care about our community and want to contribute to making Monte Sereno even better for kids, families, and seniors. I believe it’s important for young people to have a voice, and I want to share ideas that can make a difference.

Tell us about your skills,
experience, or interests that

you feel would assist us in
considering your application:

I have been playing volleyball for years, which has helped me learn how to work as a team and listen to others. I’ve also been playing the flute for a long time, which has taught me the importance of patience and perseverance through challenges. I love art and being creative, and I’ve performed music at senior homes, which showed me how great it feels to help people and our community.

What strengths do you possess
that you believe will make you a
successful commissioner?:

I’m a creative thinker. I care deeply about others and always strive to be responsible and do my best. I’m not afraid to share my ideas, and I work hard to make things happen. I believe that my teamwork, creativity, and love for helping others would make me a good Commissioner.

What do you see as the
important issues in Monte
Sereno?:

I think one important issue is ensuring that everyone in Monte Sereno feels connected, especially kids and seniors. There aren’t many activities for young people to help or spend time with older adults, and I think we could do more to bring generations together. In addition, I think it’s important to keep our neighborhoods safe, peaceful, and clean.

You Have Belonged To:

Please include organization name, position/office held, and dates.

Education: Los Gatos High School- still enrolled going into junior year Why do you want to be on the
selected Commission?:

I was on youth comission for around 3 years now, we did quite a bit planning last year and plan executing events more this year. I want to help the entire community by helping out and attending these events to spread awareness that the youth commission exists to the newer parents of Monte Sereno. I always want to help with my points of view on matters regarding the city. Also, we are planning on starting the podcastnext year and me and Johan are planning on leading that subcommittee/group in the right direction to make it fun, knowledgeable, and well known in the near future.

Tell us about your skills,
experience, or interests that
relate to the Commission that
you feel would assist us in
considering your application:

I really like helping people. I was, like i said, a very active member the last years and i am not planning on stopping until I have finished High school, passing down my legacy, the other ex seniors legacy and old members down to the new generation. I am also very persistent and really take other thought from people into account to make the entire group happy. I also try to do everything i can for the youth commission during my free time.

Please list your current
commitments:

Color/winter guard
Taekwondo
What strengths do you possess
that you believe will make you a
successful commissioner?:

I am very persistent, if I am set on a goal, I will try to achieve it with mine and other peoples interests at heart and mind. I will always have a youth commissioner mind and try to speak with other youth commissioners in our free time like school for topics we could discuss further in the upcoming meetings.

What do you see as the
important issues in Monte
Sereno?:

Monte Sereno is a very small city surrounded by big towns. I see that a lot of changes for the better has happened these past few years. I still feel like Winchester though, is unclear when and what speed limits are present.

Whenever I drive i feel like people go either too fast or too slow since there are so little posted speed limit signs.

What strengths do you possess I am very persistent, if I am set on a goal, I will try to achieve it with mine and
