STAFF REPORT
Meeting: City Council - Oct 21 2025
Agenda Heading: PUBLIC HEARINGS
Staff Contact: Diana Perkins, City Manager
Department: City Manager
Title: Introduction and Waiver of First Reading of Ordinance No. NS-247 an Ordinance of the City Council of the City of Monte Sereno amending the Zoning Code Sections 10.08.040 (Site Development Permit Required) and
10.15.100 (Eucalyptus Tree Removal Required)
Recommendation(s):
Site and Architectural Commission and staff recommends that the City Council adopt the draft ordinance.
Background Information:
The Site and Architectural Commission reviewed the draft ordinance and recommended that the City Council adopt the modifications to the requirements for Site Development Permits and the required removal of eucalyptus trees but did not recommend changes to the story pole certification requirement. The vote by the Commission was 4-1.
Analysis:
The Municipal Code changes proposed address concerns that staff has received from residents and Council Members, address Housing Element Programs requirements, and Council adopted Goals for Fiscal Year 2025-2026.
The following is a description of each proposed change in the draft ordinance.
Project Requiring a Site Development Permit
The Municipal Code currently requires certain projects to obtain approval of a Site Development Permit before a building permit can be issued. A Site Development Permit typically requires approval by the Site and Architectural Commission at a public hearing. The proposed changes would remove the requirement for a Site Development Permit for accessory structures.
Streamlining permitting timeframes and reducing Site Development Permit requirements will also support the requirements of the Housing Element Program A, which requires the City to monitor processing times for residential permits and identify revisions to the City’s procedures to expedite the development review process. The proposed changes below to the Site
Development Permit requirements would reduce the number of permits needed and review timeframes.
The types of projects that require a Site Development Permit are listed below along with staff comments regarding proposed changes:
A. Any new building exceeding one hundred twenty (120) square feet, except any accessory dwelling unit permitted in accordance with Section 10.06.140.
Currently, a new accessory building that exceeds 120 square feet in floor area requires a Site Development Permit. Types of building that are considered accessory buildings include sheds, pool houses, and detached garages. The size, location, and height of accessory structures are regulated by the zoning code based on zoning district as follows:
Zoning Code Standards for Accessory Structures
Zoning District Maximum Floor
Area Required Setbacks* Maximum Height
R-1-8 600 sq.ft. Side Yard – 6’
Rear Yard – 6’ 12’
R-1-20 800 sq.ft. Side Yard – 6’
Rear Yard – 6’
12’ at setback
21’ max. w/additional
setback
R-1-44 1,000 sq.ft. Side Yard – 6’
Rear Yard – 10’
12’ at setback
21’ max. w/additional
setback
*Accessory structures are not allowed in the front yard This requirement for a Site Development Permit has been in the zoning code since 2002 (NS-135). State regulations that have been enacted over the past several years allow accessory dwelling units (ADUs) be to constructed which can be larger, taller, and with smaller setbacks than required for accessory buildings. These State regulations do not allow a discretionary permit for ADUs. Over 100 ADUs have been constructed in the City in the past 10 years, largely without any complaints from neighboring property owners.
Because ADUs can be larger, taller, and have smaller setbacks as compared with accessory buildings, it may no longer be necessary to require a Site Development Permit and a public hearing for smaller accessory buildings with larger setbacks, when no public hearing is required for ADUs.
Staff recommends removing the requirement for detached accessory buildings to obtain a Site Development Permit as these buildings are adequately regulated by the size, height and location requirements in the zoning code.
B. Any addition that adds five hundred (500) square feet or more to an existing building or structure in the R-1-8 zoning district or seven hundred fifty (750) square feet or more to an existing building or structure in the R-1-20 or R-1-44 zoning district.
No change proposed.
C. Any modification to the roof that results in a new or modified roof design or that increases the roof height of an existing structure by more than twenty-four (24) inches.
This requirement was added to the zoning code in 2017 (NS-210) and was intended to ensure design review oversight for modified roof designs or roof modifications that increase the roof height by more than 24 inches. The language of a new or modified roof design is vague and can be widely interpreted. Additionally, modifying a roof design without increasing the height of a roof has minimal impact on surrounding properties.
Staff recommends revising this code section to remove the provisions related to a new or modified roof design but maintain the Site Development Permit requirement for modifications to an existing roof that increases the roof height by more than 24 inches.
D. Any additions that add two hundred fifty (250) square feet or more to the second story of an existing two-story building in the R-1-8 zoning district or five hundred (500) square feet or more in the R-1-20 and R-1-44 zoning district.
No change proposed.
E. Any additions of a second story to an existing single-story building.
No change proposed.
F. The addition of an architectural element to a legally existing light post or entry column if such addition would cause the total height of the light post or entry column to exceed the height limitations outlined in Section 10.17.040. An architectural element may be added to an existing light post or entry column with a site development permit if the height of the architectural element does not exceed one-half of the height (up to nine (9) feet) of the legally existing light post or entry column. The proposed architectural element shall be setback one (1) foot from the property line for every two (2) feet in height of the architectural element and light post or entry column.
This requirement was added in 2011 (Ordinance NS-178) as a result of a property that had entry columns on either side of a driveway gate. Staff is not aware of any other project that has proposed light posts or entry columns subject to this code section.
Since this section was enacted, Council reviewed the fence height requirements in 2021 and revised front yard fences, including columns, to be a maximum of six feet in height if approved by the Site and Architectural Commission (NS-225). A front yard fence of up to three feet in height is allowed without a permit.
Staff recommends removing this code section and maintaining the current requirements of section 10.06.130 allowing fences/columns up to six feet in the front yard with a Site Development Permit approved by the Site and Architectural Commission.
G. The construction of a light post or entry column which includes an architectural element if the total height of the light posts or entry column with the architectural element exceeds the height limits outlined in Section 10.17.040. In no event shall the total height of the light post or entry column with the architectural element exceed eight (8) feet. In no event shall the architectural element be taller than one-half of the light post or entry column.
This section was added when section F above was added and applies to the same types of projects. For the same reasons described above, staff recommends removing this code section.
H. The addition of a pedestrian arbor that exceeds seven (7) feet in height to any fence, or a fence greater in height than three (3) feet in any part of any front yard, within ten (10) feet of any side corner property line of a lot in the R-1-8 zoning district, or within fifteen (15) feet of any side corner property line of a lot in the R1-20 and R-1 44 zoning district.
No change proposed.
I. Residential development projects pursuant to Section 10.05.080.
No change proposed. This section was added in 2023 (NS-240) to conform to State laws requiring ministerial review for certain housing development projects subject to SB9 legislation.
Eucalyptus Tree Removal Required
One of the City Council’s adopted goals for Fiscal Year 2025-2026 is to consider requiring that eucalyptus trees be removed from a property when a new house is constructed.
Eucalyptus trees are prone to fire as their bark and oil make them highly flammable. As noted by the National Park Service publication:
“Constant shedding of bark is part of what makes these trees a fire hazard. The bark catches fire readily, and the loose strips tend to carry fire up into the canopy, casting embers outward. Despite the presence of volatile oils that can produce a hot fire, leaves
of blue gum eucalyptus are classed as intermediate in fire resistance when green, and juvenile leaves are highly resistant to flaming. . It is the litter—the accumulation of dead, dry, oily leaves and debris—that is especially flammable. Carried by long swaying branches, fire spreads quickly in eucalyptus groves. When there is sufficient dead material in the canopy, fire moves easily through the tree tops.” (https://www.nps.gov/pore/learn/nature/upload/firemanagement_fireeducation_newslett er_eucalyptus.pdf).
Fire Safe Marin notes:
“You can make a eucalyptus tree much more resistant to ignition during a wildfire. Remove vegetation around the base of the trees
Remove small-diameter lower limbs up to at least one-third of the tree’s height Remove limbs within 10 feet of the ground
Remove all dead wood, peeling bark, and twiggy growth REGULARLY Provide canopy separation so that no limbs touch nearby trees or plants Remove all “ladder fuels“
(https://firesafemarin.org/articles/everything-you-need-to-know-about-eucalyptus-trees/) Due to their fast growth rate, eucalyptus should be maintained annually. However, maintenance is often not done at that frequency.
The most fire prone of the eucalyptus trees are the Gum varieties. The Municipal Code section
10.15.015 defines Blue Gum and Red Gum eucalyptus trees are ‘undesirable species’ because they are non-native, invasive, and fire-prone. The ‘undesirable species’ designation allows a property owner to remove these varieties of eucalyptus trees without any stated reason or assessment of the health of the tree.
Staff recommends adding the following requirement to the Municipal Code:
“Eucalyptus Tree Removal Required. All existing Blue Gum Eucalyptus (Eucalyptus globulus) and Red Gum Eucalyptus (Eucalyptus camaldulensis) trees shall be removed at the time of construction of a new primary residence. Exceptions shall be made for eucalyptus trees greater than 150 feet from any roadways or structures.” Story Pole Certification Requirements
Story poles are currently required for certain types of projects that require Site Development Permits and provide the Site and Architecture Commission, City Council, staff, and neighbors a representation of the height, bulk, and mass of a proposed project. Story poles are currently required for the following types of projects which require a Site Development Permit:
Second story addition
Construction of any new structure exceeding 500 square feet Any addition exceeding 500 square feet
In 2009, the City Council adopted an ordinance (NS-166) to require the story poles to be certified by a civil engineer or land surveyor to ensure they are located at the proper height and layout of the roof areas. At that time, there had been concerns that the story poles may not accurately reflect the proposed structure’s height and location.
Concern has recently been raised that the certification by a civil engineer or land surveyor may be more costly and time-consuming for a project applicant than the benefit it provides.
Staff reached out to designers and architects who frequently work in Monte Sereno and received a response that the story pole certification adds approximately $500 to the cost of the story pole installation.
The Site and Architectural Commission did not recommend removing the certification requirement for story poles; therefore, this modification is not included in the draft ordinance. If the City Council is interested in modifying this requirement, an ordinance amendment would need to be considered at a future meeting.
California Environmental Quality Act:
This ordinance is not a “project” as defined by CEQA Guidelines Section 15378: “Adoption of the ordinance does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Further projects subject to the ordinance will require a discretionary permit and CEQA review, and will be analyzed at the appropriate time in accordance with CEQA.” Therefore, no environmental assessment is required.
Public Noticing:
The meeting agenda was also posted on the bulletin board outside of Monte Sereno City Hall and the agenda with this staff report can be accessed on The City of Monte Sereno's website located at www.montesereno.org.

1. City Manager’s Quarterly Report July-September 2025
City Manager’s Highlights
July – September 2025
2025 Annual Monte Sereno Picnic in the Park
On August 24, 2025, the City hosted the annual Picnic in the Park for Monte Sereno residents.
The event was successful with approximately 240 residents attending. The number of service providers at the picnic also expanded this year with the addition of the Santa Clara County Weed Abatement Program and the Peninsula Humane Society.
This was the second year the picnic was at the site near the Boat Center rather than the Circle Group Area and staff received several compliments on the new location. Next year’s picnic will be at the same location near the Boat Center.
Building Department
Building permit activity for the past three months was as follows:
July – September
2025
Same Range
Last Year
Permits/Inspections
Building Permits Issued 76 62
Construction Valuation $16,221,701 $6,840,858
Building Permit Revenue $390,456 $168,773
Inspection Completed 217 227
The building permit activity has continued to be very high, which has been the trend during this calendar year. While the number of permits has not increased significantly, the increased construction valuation indicates that the type of building permits being issued are for larger projects (i.e. new ADUs, large additions/remodels, and new houses).
Staff anticipates the permitting activity to remain high for the remainder of the year as the number of projects in the review process continues to be higher than average.
Two Monte Sereno Residents Participating in Leadership Los Gatos The Town of Los Gatos administers the Leadership Los Gatos program to educate, engage, and encourage participants to find leadership roles in the community.
Participants are given the opportunity to view local government from the inside out, engage with community leaders and special interest groups, and challenge themselves in new ways while strengthening their leadership skills and community network. After completing the program, graduates are encouraged to use their new skills and knowledge to further their participation in civic, community, service, and non-profit organizations.
As part of the City Council Strategic Goal to increase civic engagement, the City Council had approved sponsoring two seats in the 2025 Leadership Los Gatos programs for Monte Sereno residents. The two Monte Sereno resident participating in the program are Bob Lapcevic and Allison Zeidler.
Fall Peaceful Mountain Monitor Newsletter
The fall edition of the Peaceful Mountain Monitor newsletter is being printed and will be mailed to residents by the end of October. Articles include a letter from the mayor, information on the upcoming enforcement of the gas-powered leaf blower prohibition, photos from the picnic, and information from the West Valley Sanitation District and the West Valley Stomrwater Authority.
Emergency Preparedness Training
The Town of Los Gatos invited Monte Sereno employees to participate in Emergency Operation Center (EOC) training provided to the Town’s employees. Staff participated in five different Standardized Emergency Management Systems (SEMS) training courses in the five primary functions of management, operations, planning/ intelligence, logistics and finance/administration.
The EOC is located at the Los Gatos Monte Sereno Police Department offices and would be activated in the event of a declared emergency. The Center would be used to coordinate emergency response efforts and serve as a central command post for various agencies to strategize and manage resources in the event of an emergency.
General Plan Update
California state law requires each city and county to adopt a general plan “for the physical development of the county or city, and any land outside its boundaries which in the planning agency's judgment bears relation to its planning” (Government Code 65300). The State also requires the General Plans to include the following eight elements (sections): land use, circulation, housing (on a separate, 8-year, cycle), conservation, open space, noise, safety, and environmental justice (new for general plans adopted after 2020).
The process to update the General Plan is underway and information is available on the project website at: https://www.monteserenogpu.com/
Part of the General Plan includes the Health and Safety Element, which will include identification of wildfire evacuation routes, emergency operations, and hazard mitigation. The Site and Architectural Commission reviewed the final draft of the updated Health and Safety Element at their meeting on October 8, 2025 and recommended that the City Council adopt the document with a few additions.
The updated Health and Safety Element will be presented to the City Council at their meeting on December 2, 2025 for consideration of final adoption.
