STAFF REPORT
Meeting: City Council - Jan 20 2026
Agenda Heading: CONSENT CALENDAR
Staff Contact: Diana Perkins, City Manager
Department: City Manager
Title: Authorize the City Manager to Establish Automated Payments for City Hall Utility Bills
Recommendation(s):

Staff recommends that the City Council consider authorizing the City Manager to make automated payments for the City Hall utility bills and no longer include these payments in the Warrant List which is approved by the City Council.

Background Information:

The City of Monte Sereno presents all checks to the City Council on the Warrant List for Council approval before the checks are payments are made. The payments made by the City are mainly for recurring utilities for City facilities and for consulting/professional services which have approved agreements. Most local jurisdictions authorize the City Manager to make the payments and inform the Council of payments made by providing a list of payments as an informational item on the Council agenda.

While the Council authorization process in Monte Sereno is unique, it has been the City’s historical practice and any change to that practice would require approval by the City Council.

Analysis:

The recurring utility bills that could be paid through an automated process are the following:
 PG&E – City Hall (three separate bills are received monthly for the City Hall building, the auxiliary building, and street lights)
 PG&E – Rose Avenue Lighting District
 PG&E – Loma Serena Lighting District
 Comcast Communications
 Frontier Communications
 San Jose Water Company
Automating the payment for these recurring utility bills would reduce the number of checks issued which would result in some staff time savings. By automating these payments, the Council would not have an opportunity to review these utility payments before each would be

Page 10 of 62 ends

made. Also, it would avoid potential late payments for these bills which may happen when Council meetings are canceled and the Council does not have an opportunity to approve a Warrant List.

California Environmental Quality Act:

The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(4) in that it is a fiscal activity that does not involve any commitment to any specific project which may result in a potential significant impact on the environment.

Fiscal Impact:

No fiscal impact is anticipated with transferring to automated payments for utility bills.

Public Noticing:

The City of Monte Sereno's Council meeting agenda was posted on the bulletin board outside of Monte Sereno's City Hall and the agenda with this staff report can be accessed on the City of Monte Sereno's website located at www.montesereno.org.

STAFF REPORT
Meeting: City Council - Jan 20 2026
Agenda Heading: CONSENT CALENDAR
Staff Contact: Diana Perkins, City Manager
Department: City Manager
Title: Consider Establishment of and Appointment to the Monte Sereno City Council Financial Implementation Support and Audit Support Ad Hoc Committee
Recommendation(s):

Staff recommends the City Council consider creation of the Financial Implementation Support and Audit Support Ad Hoc Committee and appoint Council Members Mekechuk and Shannon to the Committee.

Background Information:

The City Council of Monte Sereno utilizes ad-hoc committees as subcommittees of the City Council for special assignments and to complete work tasks on projects which are later presented to the full Council for consideration. Ad-hoc committee assignments are for one-year terms and expire automatically. While ad-hoc committees are not subject to Brown Act requirements regarding agendas and open meetings, any permanent or standing committees created by the City Council are subject to such requirements, even if less than a quorum of the Council sits on such committees. Thus, ad hoc committees should be limited in scope and duration of no more than one year.

At the January 6, 2026 City Council meeting, the Council directed staff to prepare a resolution to establish an ad hoc committee to assist with specific Finance Department issues and that Council members Mekechuk and Shannon would be appointed to the Committee. The draft resolution is attached to this report.

Public Noticing:

STAFF REPORT
Meeting: City Council - Jan 20 2026
Agenda Heading: PUBLIC HEARINGS
Staff Contact: Diana Perkins, City Manager
Department: City Manager
Title: Application 2025-3089 for a Variance application for reduced rear yard setback of 25 feet where 30 feet is required at 18113 Bancroft Avenue. (CEQA: Exempt, Guidelines sections 15302, 15303)
Recommendation(s):

Staff recommends that the City Council deny the Variance for a reduced rear yard setback.

Background Information:

The property owner is proposing a 225 square foot single-story addition tot he house at 18113 Bancroft Avenue. As the addition is less than 750 square feet, no Site Development Permit is required. However, the applicant has submitted an application for a Variance to allow a rear yard setback of 25 feet where 30 feet is required.

The Site and Architectural Commission reviewed this application at their January 7, 2026 meeting. The Commission voted to recommend the City Council deny the application with a 4- 0-1 vote with Commission Lapcevic recusing himself.

Analysis:

Existing Legal Non-Conforming Rear Yard Setback
The existing house was constructed in 1966 according to Santa Clara County Assessor’s Office. At that time, the required rear yard setback for this lot in the R-1-44 zoning district was 25 feet, which is the existing setback of the main house. In the mid-1980s the zoning code standards were modified to require a minimum 30-foot rear setback for the R-1-44 zoning district.

Monte Sereno Municipal Code 10.07.010 states:
“No non-conforming structure and/or use shall be increased or enlarged, nor shall any such non-conforming structure and/or use be extended to occupy a greater land area or floor area than that occupied by such non-conforming structure and/or use at the time of the adoption of this Chapter except as otherwise provided in this Chapter.”

Page 22 of 62 ends

While the existing house with the non-conforming setback may remain, the non-conforming condition (the rear setback) cannot be enlarged or extended to occupy additional floor area.

The proposed addition would increase the non-conformity by increasing the floor area that does not conform to the current zoning standards.

Variance
This application is requesting a Variance to allow an addition to be constructed that aligns with the back wall of the house, which would provide a 25-foot rear yard setback where 30 feet is required. The proposed addition would bump-out the existing side wall of the house by approximately 6 feet, which would add approximately 175 square feet to this portion of the house. The portion of the proposed addition which would encroach into the rear yard setback is approximately 30 square feet.

The applicant has submitted a letter of support from the adjacent property owner nearest the proposed addition (attachment 2).

A Variance is intended to address practical difficulties of the lot characteristics which result in unnecessary hardships, or result in inconsistencies with the general purposes of the zoning district, which may occur through the strict application of standard zoning requirements due to a unique circumstance of the lot.

In order to grant a Variance, the Monte Sereno Municipal Code section 10.10.020 and the California Government Code section 65906 require specific findings to be made. Staff is not able to make the required findings for the Variance and recommends denial of the Variance.

Following are the required findings with the staff comments in italics:
a. Variances from the terms of the zoning ordinances shall be granted only when, because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification.

Special circumstances are not applicable to this property as it is of similar size and topography as other lots in the vicinity. While the lot does have a unique shape, the shape does not deprive the lot of privileges enjoyed by other properties in the vicinity as the floor area of the proposed addition can be accommodated in a different configuration while also meeting the required development standards.

Although the existing house has a legal non-conforming condition where the existing rear yard setback is 25 feet where 30 feet is required, the addition could be redesigned to meet the setbacks requirements and provide the same additional floor area as proposed.
b. Any variance granted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privileges

Page 23 of 62 ends

inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated.

The granting of this variance would result in a special privilege for the property not enjoyed by other properties as it would enable this property to have a reduced rear yard setback, which is not approved for other lots in the vicinity. c. A variance shall not be granted for a parcel of property which authorizes a use or activity which is not otherwise expressly authorized by the zone regulation governing the parcel of property. The provisions of this section shall not apply to conditional use permits.

The variance does not affect the existing use of the property as a single-family house within a single-family zoning district.

California Environmental Quality Act:

This project is categorically exempt from CEQA per CEQA Guidelines section 15302 – Replacement or Reconstruction (Class 2) and section 15303 – New Construction (Class 3).

None of the exceptions to the use of a categorical exemption, as identified in CEQA Guidelines section 15300.2, applies to this project:
 The project is not located in a sensitive environment such that the project may impact an officially mapped and designated environmental resource of hazardous or critical concern;
 The cumulative effect of successive projects of the same type in the same place, over time, is not likely to be significant, in light of the permitted zoning;  The project does not have a significant environmental impact due to unusual circumstances, in that the project is not unusual in light of the scope of similar permitted projects within the zoning district;
 The project will not damage scenic resources (i.e. trees, historic buildings, or rock outcroppings) within an officially designated state scenic highway;  The project is not located on a listed hazardous waste site; or  The project will not cause substantial adverse change in the significance of a historical resource.

Public Noticing:

A public notice was mailed on December 19, 2025 to property owners and residents within 300 feet of the subject property. A hearing notice was posted at three locations within the City and on the subject property on December 22, 2025. An agenda for this meeting was posted on the City’s webpage on January 15, 2026.

11 CONSTRUCTION SECTIONS CONSTRUCTION DETAILS Page 34 of 62 November 4, 2025
To Whom it May Concern,
We are writing to you as supportive neighbors of Dan Casetta and his family, with whom we have shared a back fence for 10 years. It has come to my attention that the rear setback of the Casetta home on Bancroft Ave is non-compliant with current building code, which has raised some questions regarding the remodel they are proposing. Our home on Serena Vista Court is over 100 years old and long predates the current code, as does the Casetta home (although by somewhat less).

Given the modest nature of the project the Casettas are planning, we have no problem at all supporting their improvements. They have provided their plans for us to review in detail and we see no issue with the addition, as proposed. Given that the expansion is completely within the footprint of the existing covered area and the roofline will not be changing, it will not impact our property at all. We can barely see the roof of their home over the fence that we share and the proposed remodel will not change that at all. The Casettas’ plans will have no impact on the lines of sight from our home to the lovely mountains of Monte Sereno.

We wholeheartedly support the Casettas’ plans to renovate and improve their property. We hope that you will take this into consideration when approving their plans, without modifying the rear corner of their addition.

Best,
Sara and Matt Ettus (via email 11/4/2025)

RESOLUTION NO. 25-###

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MONTE SERENO DENYING A VARIANCE TO ALLOW A REDUCED REAR YARD SETBACK OF 25 FEET WHERE 30 FEET IS REQUIRED FOR THE PROPERTY LOCATED AT 18113 BANCROFT AVENUE (APN 510-13-031)
WHEREAS, Daniel Casetta (“Applicant”) applied for a Variance to allow a rear yard setback of 25 feet where 30 feet is required for property located at 18113 Bancroft Avenue.

WHEREAS, a public hearing was held by the Site and Architectural Commission on January 7, 2026 to take evidence on the Application and at the hearing evidence was given both orally and in writing; and
WHEREAS, the Site and Architectural Commission recommended that the City Council deny the Variance for a reduced rear yard setback; and WHEREAS, a public hearing was set and held on January 20, 2026 by the City Council to take evidence on the Application and at that hearing evidence was given both orally and in writing; and
WHEREAS, the City Council has considered all the evidence presented regarding the Application.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MONTE SERENO AS FOLLOWS:

Section 1. In accordance with Government Code section 65906, the City Council hereby finds as follows with respect to the request for a rear yard setback variance:

Page 37 of 62 ends

Although the existing house has a legal non-conforming condition where the existing rear yard setback is 25 feet where 30 feet is required, the addition could be redesigned to meet the setbacks requirements and provide the same additional floor area as proposed.

B. Any variance granted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated.

The variance does not affect the existing use of the property as a singlefamily house within a single-family zoning district.

Section 2. Based upon the findings set out above, the City Council hereby determines, concludes and orders that the Variance application is denied.

Section 3. The City Clerk is hereby directed to give notice of this decision to the Applicant by serving Applicant with a copy of this resolution.

Recommendation(s):

Staff recommends the City Council consider the applicants who applied for the alternate representative and appoint one applicant to the Silicon Valley Clean Energy Authority Board.

Background Information:

Per the request of the Monte Sereno City Council, the city conducted a recruitment for the alternate representative with the Silicon Valley Clean Energy (“SVCE”). The SVCE Board consists of 13 members and meets every month on the second Wednesday at 7:00 p.m. at Sunnyvale Civic Center (456 W. Olive Ave., Sunnyvale, CA), unless otherwise noted. The appointed Alternate shall serve a term expiring December 31, 2026.

The Alternate for the City of Monte Sereno on the SVCE Board shall be a resident of the City of Monte Sereno, a registered voter, and have particular interest in SVCE.

On December 29, 2025 a notice of the recruitment for the seat was posted on the City’s web site, e-mailed to a list of interested parties, and posted in the City’s social media. The following (three) applications from qualified residents were received before the recruitment closed on Monday, January 12, 2026.

Title: Consider and Accept the City Manager's Quarterly Report Covering October 1, 2025 through December 31, 2025
Recommendation(s):

Staff recommends that the City Council consider and accept the City Manager's report Public Noticing:

City Manager’s Highlights
October – December 2026
Potential Police Service Parcel Tax Ballot Measure
In November 2025, the City issued a Request for Proposals for consulting services to assist with polling to determine the feasibility of an additional parcel tax as well as public education and outreach. Three proposals were received and at the January 6, 2026 City Council meeting, the Council approved an agreement with CliffordMoss to provide consulting services including public opinion polling and public outreach. The consultant will work with staff and Council Ad Hoc Committee of Council Members Craig and Mekechuk. The consultant will first conduct polling of the City’s constituents to test proposed parameters and wording for the police services ballot measure. The results of the polling will be presented to the City Council in April 2026. At that time the Council will consider moving forward with the ballot measure or not.

Building Department
Building permit activity for the past three months was as follows:

October – December
2025
Same Range
Last Year
Permits/Inspections
Building Permits Issued 76 62
Construction Valuation $16,221,701 $6,840,858
Building Permit Revenue $390,456 $168,773
Inspection Completed 217 227
The building permit activity continues to be very high throughout 2025. While the number of permits has not increased significantly, the increased construction valuation indicates that the type of building permits being issued are for larger projects (i.e. new ADUs, large additions/remodels, and new houses).

Staff continues to anticipate the permitting activity to remain high for the remainder of the fiscal year as the number of projects in the review process is higher than average.

Spring Peaceful Mountain Monitor Newsletter
The planning for the Spring edition of the Peaceful Mountain Monitor newsletter is underway. If Council Members have any suggestions for articles or information to be shared, please let staff know by February 6, 2026. The newsletter is scheduled to be mailed to residents in April.

General Plan Update
California state law requires each city and county to adopt a general plan “for the physical development of the county or city, and any land outside its boundaries which in the planning agency's judgment bears relation to its planning” (Government Code 65300). The State also requires the General Plans to include the following eight elements (sections): land use, circulation, housing (on a separate, 8-year, cycle), conservation, open space, noise, safety, and environmental justice (new for general plans adopted after 2020).

Page 49 of 62 ends

The process to update the General Plan is underway and information is available on the project website at: https://www.monteserenogpu.com/
The updated Health and Safety Element was adopted by the City Council in December 2025.

Work on the remainder of the General Plan is underway with the third and final survey online (https://www.monteserenogpu.com/survey) seeking input from residents.

Staffing Updates
The City’s new City Engineer, Michael Weisz, started part-time in December and is now fulltime. Michael has an extensive amount of experience with land development from working at both public agencies and private engineering firms. He also has experience working on capital improvement projects as well as the stormwater regulations for plan review, inspections, and reporting. Mike is a great addition to the City and we are excited to have him aboard.

A recruitment for a permanent part-time City Planner will be posted at the end of this month. In December 2025 the City Council approved an updated staff salary schedule to include a salary for this part-time position. The position will work 21-24 hours a week and be a permanent City employee.

7 Goals Status 12/31/2025
I. Provide Quality Public Service

1. Plan the Green Stormwater Infrastructure project required by State law. This project is on-going. Preliminary plans have been developed to modify the landscape and hardscape at City Hall to meet this State requirement. Plans are being reviewed by the Santa Clara Valley Urban Runoff Pollution Prevention Program to ensure compliance with State requirements before construction plans are developed.

2. Review and amend City of Monte Sereno Financial Policies:
a. Review and amend, if required, the City of Monte Sereno’s investment policy. b. Develop and implement timely updates to the financial transparency system for residents.

This work is on-going. Staff will be working with our finance consultant to update the investment policy before the end of the fiscal year. The Council authorized the purchase of financial transparency software as part of the Tyler Technologies financial software package. The implementation of the online transparency system will begin before the end of the fiscal year.

3. Implement a cloud-based, fully integrated financial reporting and human resource information system for government entities to:

This work is on-going and is part of the Tyler Technologies financial software package approved by Council.

7 Goals Status 12/31/2025
a. Improve financial reporting and human resources management at the City of Monte Sereno.
b. Utilize time reporting functionality for all personnel and support human resources requirements.
c. Address and resolve internal control weaknesses. d. Develop, document, and implement financial accounting policies and procedures with the new financial reporting system.
e. Convert and migrate minimal, yet sufficient, data to the new financial reporting system and human resources information system.

Implementation of the accounting/finance module is nearing completion. Staff will begin implementation of the HR/payroll module in January 2026. The implementation of the online transparency module will begin in the next couple of months. Staff is working with our finance consultant to address the internal control weaknesses and to develop accounting policies/procedures for the Tyler software.

4. Increase civic engagement and resident involvement in the community, including possible partnership with leadership Los Gatos.

This was discussed at the October 7, 2025 City Council meeting including ideas about a Veteran’s memorial, community benches, and birdhouses. A Veteran’s group has been in contact with the Council Member Craig about a potential memorial. The birdhouse initiative will be undertaken by the Youth Commission.

5. Review and improve the City of Monte Sereno website with easier access to historicalminutes and recordings.

A Youth Commissioner volunteered last summer and started to work on gathering/organizing historical data from the City’s records to prepare the data to be placed online. However, due

Page 52 of 62 ends

Page

7 Goals Status 12/31/2025
to staffing constraints further work on this project has not yet occurred.

II. Maintain Community Character

1. Update the General Plan. This work is on-going. Council adopted the updated Safety Element in December 2025. The remaining General Plan Update is on schedule for Council adoption in the Summer 2026.

2. Continue to implement programs in the adopted Housing Element. This work is on-going. To date, ten of the programs have been completed, 13 are annual/on-going programs, and five remain to be completed. The five programs to be completed, include the required rezone to allow for multifamily development. This item is scheduled for a second review by the Site and Architectural Commission in January 2026 and will then will be scheduled for City Council consideration.

III. Enhance Mobility for Residents

1. Improve walkability throughout the City.

This was discussed at the October 7, 2025 City Council meeting and determined to be a long-term goal. No immediate action has been taken, but the item remains a Council goal in the

Page 53 of 62 ends

Council Adopted Goals for Fiscal Year 2025-2026

event an opportunity to improve walkability arises.

IV. Maintain Community Safety

1. Improve
wildfire prevention and preparedness:

A. Establish evacuation routes, inform the community of these locations, and plan for their maintenance.

Staff is currently coordinating with the Town of Los Gatos staff to consider a combined evacuation plan based on simulation-based modeling. The Town has issued an RFP and is assessing proposals. Once their assessment is complete, the optional consulting costs for inclusion of Monte Sereno will be provided and presented to the City Council for consideration.

B. Increase awareness of fire danger due to poorly maintained vegetation and promote the importance of defensible space around structures.

Staff has made, and will continue to make, multiple social media posts, emails to interested parties, and placed information on the City’s web page about the importance of defensible space around structures.

C. Work with Saratoga, Los Gatos, and elected officials to coordinate efforts to reduce fire hazard risks on Highway 9.

The City Council and community have worked extensively to raise awareness of the potential fire danger of trees, particularly in the median along Highway 9. The City Council authorized the Mayor to send a letter to the Assemblymember Pellerin regarding this topic. And, the Santa Clara County Fire

Page 54 of 62 ends

Page

Department Fire Chief sent a letter expressing concerns about Highway 9 fire safety to Caltrans. Several Councilmembers also raised this concern to Santa Clara County Supervisor Abe-Koga, who reached out to Caltrans on the City’s behalf.

D. Consider requiring any eucalyptus trees on a property to be removed when an application for a new house is received.

This issue was presented to the City Council in October and Council requested additional information about the cost for removal of eucalyptus trees and to provide more public outreach. Staff plans to return to Council in March 2026.

E. Consider expanding the exterior home hardening requirements of the California Residential Code to apply to all properties in the City and not just those within the High or Very High Fire Hazard Severity Area.

This item has been completed. With the adoption of the updated building codes, the Council approved an ordinance to require the exterior home hardening requirements from the Fire Hazard Severity Areas to apply city-wide for new construction.

F. Adopt an updated Annex to the Santa Clara Wildfire Protection Plan to plan for programs in Monte Sereno.

This has not yet been completed.

G. Recruit 10 additional CERT members, with a focus on residents that live near City Hall. This effort is on-going. The effort was previously led by a former Councilmember. Staff will continue to promote CERT through social media

Page 55 of 62 ends

Council Adopted Goals for Fiscal Year 2025-2026

posts and providing information at the front counter of City Hall.

H. Consider outfitting the shed at City Hall to serve as an NICP. This has been placed on hold until additional CERT members are active who can support a new NICP.

I. Consider establishing a commission or committee to work on wildfire prevention and preparedness issues.

The City Council discussed this topic at the April 15, 2025 meeting and decided not to move forward with a specific advisory committee at this time as there was already a Wildfire Community Advisory Group that includes participants from Los Gatos, Saratoga, and Monte Sereno.

2. Install of Flock cameras citywide. This was completed in July 2025 with the installation of 19 Flock cameras throughout the City.

3. Finalize the agreement with Los Gatos for law enforcement services. This was completed in April 2025 when the City Council approved a new fiveyear agreement with the Town of Los Gatos for law enforcement services. The agreement was effective on July 1, 2025.

V. Enhance Environmental Sustainability
A. Promote low-water and low-fire landscaping alternatives for residents. The City promotes low-water landscaping through the implementation of the State mandated Water Efficient Landscape Ordinance

Page 56 of 62 ends

Council Adopted Goals for Fiscal Year 2025-2026
Page
7 of
7 Goals Status 12/31/2025
which limits water usage for new landscape areas. Staff anticipates the State will provide guidance on wildfire safety defensible spaces and fire smart landscaping in early 2026.

B. Encourage water conservation and support the move to lower carbon emissions in Monte Sereno.

The Council has adopted a local amendment to the building code to require a hot water recirculation pump in all new construction. These reduce water usage by quickly supplying hot water to all fixtures to reduce water that is wasted waiting for hot water to reach the faucet. Additionally, the City has streamlined the permitting process for the installation of electrical water heating and space heating equipment as well an EV chargers by allowing such permits to be obtained online in real-time.
