STAFF REPORT
Meeting: City Council - May 19 2026
Agenda Heading: CONSENT CALENDAR
Staff Contact: Gloisy Gonzalez-Langarica, City Clerk
Department: City Clerk
Title: Consider Adoption of a Resolution Declaring Hazardous Vegetation (Brush) a Public Nuisance
Recommendation(s):

Staff recommends that the City Council adopt a resolution declaring hazardous vegetation (brush) a public nuisance.

Background Information:

The City annually declares hazardous vegetation (brush) a public nuisance due to fire danger and enters into a contract (along with other municipalities) with Santa Clara County to abate the hazardous vegetation (brush) not removed by property owners. The focus of this program is the identification of perennial vegetation, brush, trees, and shrub in designated high fire hazardous areas.

The Santa Clara County Fire Department implements and manages a hazardous brush abatement program for the Wildland Urban Interface (WUI) areas (hillside areas) within its jurisdictional boundaries, which includes the incorporated areas of Monte Sereno, to provide defensible space for structures.

The City annually adopts the Hazardous Vegetation (Brush) Abatement Program and works with the County who serves as the enforcement agent and conducts their own inspections.

In February of each year, every property owner within a designated fire hazardous severity zone is notified that they must remove brush and vegetation from around their home to create defensible space. The brush abatement program entails inspections of hillside properties by fire crews beginning early April each year. If properties are found to not be in compliance with the regulations found in the California Fire Code and the Enforced Applicable Wildland Fire Safety Regulations relative to vegetation clearance, they are given notice of the violation. If compliance is still not achieved by June 1st each year, then they will be referred to the contractor authorized to perform the necessary work. A public hearing is set for June17th where all property owners in the Wildland-Urban Interface Fire Area in the City of Monte Sereno having any objections to the proposed abatement of brush will be heard and given due consideration. An additional inspection of all identified properties will be conducted after the hearing and prior to ordering any abatement work.

Page 21 of 67 ends

The costs associated with the abatement work are then placed on the property tax bill for that parcel.

Fiscal Impact:

There are no unbudgeted fiscal impacts with this agenda item.

Public Noticing:

The City Council's agenda was posted at City Hall and the agenda and this report appear on the City's website.

OR THE CITY OF MONTE SERENO

DECLARING HAZARDOUS VEGETATION (BRUSH)

A PUBLIC NUISANCE AND PROVIDING FOR ABATEMENT
WHEREAS, Sections 39560 and the following of the Government Code of the State of California authorize the City of Monte Sereno to declare that hazardous vegetation (brush) growing to such size and such type and in such locations as to constitute a fire hazard to the community may be declared a public nuisance and to compel owners, lessees, or occupants of buildings, grounds, or lots to remove or abate the hazardous vegetation (brush) to mitigate the fire hazard from such buildings, grounds, or lots to remove or abate the hazardous vegetation (brush) to mitigate the fire hazard from such buildings, grounds, property, and adjacent sidewalks and parkways, and upon the person’s failure to do so, to remove or abate such hazardous vegetation (brush) at the owner’s expense, making the cost of that abatement a lien upon the property, and

Examples of this type of plant material include California Sagebrush, Greaswood or Chamise, Scotch Broom and Toyon. Unabated growth of brush upon and adjacent to private property within the Wildland-Urban Interface Fire Area and adjacent parkways and sidewalks is a public nuisance, and should be abated. The City Manager or designee shall act as the Superintendent for purposes of giving notice, supervising performance of the agreement with the County of Santa Clara, and evaluating the costs of abatement.

BE IT FURTHER RESOLVED the City Clerk is directed to mail notice of this resolution to the persons designated by the Superintendent in conformance with the Government Code and publish notice of this resolution as provided in the Government Code.

Re: Proposal for Professional Auditing Services
Dear Diana Perkins:

Please allow us to introduce our Firm and share our qualifications and proposed services plan for the City of Monte Sereno (the “City”) according to your Request for Proposals for Professional Auditing Services for the fiscal year ending June 30, 2026.

The Pun Group LLP (the “Firm”) has the knowledge and experience necessary to become the City’s next public accounting firm and the work plan to ensure a smooth process.

This letter is an acknowledgment of the Firm’s understanding of the work to be performed. We are offering our commitment to deliver all of the required work, complete the audit, and issue the necessary auditor’s reports within the periods outlined by the City. No subcontractors will be utilized for this engagement.

The Pun Group is the right choice for the City of Monte Sereno because:

We Understand the Demographics and Your Needs. The Pun Group is reputable for its governmental practice. We are the principal auditors for cities in California such as Ventura, Coachella, Corona, Fresno, Gilroy, Lakewood, Montebello, National City, Salinas, San Mateo, Santa Clarita, Tracy, and several others. Accordingly, the proposed engagement team has a deep understanding of the current issues that municipalities are facing, such as varying demographics, economic environments, and the constantly changing landscape of laws and regulations.

Recognized Leader in the Governmental Industry. We are a small national Firm with licenses in the States of California, Arizona, and Nevada and a proven leader in professional services to the government sector. All key engagement team professionals are licensed to practice as Certified Public Accountants and meet the Continuing Professional Education requirements under US GAO’s Government Auditing Standards to perform the proposed audits. The partners and all employees proposed to perform the requested services do not have a record of substandard audit work nor have any outstanding claim of substandard practice or unsatisfactory performance pending with the State Board of Accountancy or other professional organizations. In addition, we are members of the national AICPA Audit Quality Center.

We strongly believe that part of our success is credited to our professionals’ participation in various industry-leading organizations. Such affiliations are critical to addressing emerging accounting and auditing issues within the industry environment.

You’ll Work with a Team that Embraces Innovation and Continuous Improvement. Our Firm is committed to continuous improvement as it relates to service delivery. We embrace innovation and identify areas of technological enhancements in our audit and project management approaches. For example:

Secure Data File Transfer System. In order to improve audit efficiency, workflow management software plays an essential role between your organization and our engagement team. We employ a secure data file transfer system called Suralink. Suralink’s dynamic request list is integrated with our secure file hosting system for seamless documentrequest coordination, including the upload of large-size files. It means all our requests are in one place, updated in real-time, and accessible by everyone working on the engagement. Not only makes the operation more cost-efficient, but it also enables you and your team to spend your time getting the job done, not reconciling a messy list of outstanding items. In addition, Suralink’s dashboard allows you to visualize the process of document-request fulfillment.

AI Auditor. The Pun Group leverages the technology and research tools required to provide excellent services to its clients. With the usage of Artificial Intelligence (AI) technology, the Firm is capable of issuing all reports requested faster than other audit firms without exposing the City to unnecessary risks.

Remote and Hybrid Auditing Capability. At our firm, we have fully embraced a hybrid approach to auditing, combining the flexibility of remote work with the benefits of on-site engagement. While we are fully equipped with advanced technology to perform audits remotely when needed, our preferred method is a hybrid model — balancing remote efficiency with in-person collaboration to deliver the highest quality service to our clients. We continue to offer on-site auditing as needed to best meet client needs.

Knowledge is Shared with You. As part of our commitment to keeping clients informed of emerging technical accounting and financial reporting issues, we offered a 2025 Virtual Government Accounting Conference, providing up to 15 hours of CPE at no additional cost.

The 2025 webinars provided are listed in the Appendices to this proposal. Our 2026 training schedule will be announced later this year.

The Pun Group is proud of its inclusive values and is an avid promoter of equality and diversity. In addition, the Firm is an equal-opportunity employer and complies with all federal and state hiring requirements. We’re proud of supporting affirmative-action philosophies and work hard to provide opportunities for self-enhancement to members of disadvantaged groups.

This proposal is a firm and irrevocable offer valid for ninety (90) days following the closing date for the receipt of all proposals.

Finally, we would like to emphasize one additional point: We want to earn your trust and your business! We are confident that the energetic and experienced team we have assembled is the right one for the City.

Our commitment to serving the City of Monte Sereno cannot be adequately conveyed in a letter, and I look forward to continuing the discussion with you. I’m assigned as your primary contact for contract negotiations. I’m also authorized to legally bind the Firm. Should you have any questions or wish to discuss this proposal, please do not hesitate to contact me at (949) 777-8805 or by email at [email protected].

Sincerely,
Frances J. Kuo, CPA, CGMA | Managing Partner | The Pun Group LLP 6 Hutton Centre Drive, Suite 1200, Santa Ana, CA 92707

STAFF REPORT
Meeting: City Council - May 19 2026
Agenda Heading: NEW BUSINESS
Staff Contact: Diana Perkins, City Manager
Department: City Manager
Title: Receive an Update from the Two Monte Sereno Residents Who Participated in the 2025-2026 Leadership Los Gatos Program Recommendation(s):

Staff recommends that the City Council Receive an update from the two Monte Sereno residents who participated in the 2025-2026 Leadership Los Gatos Program.

Background Information:

The Town of Los Gatos administers the Leadership Los Gatos program to educate, engage, and encourage participants to find leadership roles in the community. Participants are given the opportunity to view local government from the inside out, engage with community leaders and special interest groups, and challenge themselves in new ways while strengthening their leadership skills and community network. After completing the program, graduates are encouraged to use their new skills and knowledge to further their participation in civic, community, service, and non-profit organizations.

Last year, the Town of Los Gatos offered to designate up to two seats in the 2025-2026 Leadership Los Gatos program for Monte Sereno residents so long as the city covers the additional program costs beyond the tuition, which is $2,650 per participant. This cost includes the speakers (a fee is not charged for speakers who are Town staff), buses for an area tour, breakfast and lunch at each meeting, and the Town’s staff time to support the program.

In August 2025, the City Council authorized the sponsorship of up to two residents to participate in the 2025-2026 Leadership Los Gatos Program.

Analysis:

Monte Sereno residents Allison Zeidler and Robert Lapcevic participated in the 2025-2026 Leadership Los Gatos program, which concluded in early May. Both residents will be at the Council meeting to report to the Council on their experience with the program.

California Environmental Quality Act:

Fiscal Impact:

No fiscal impact is anticipated from the City Council receiving this report.

Public Noticing:

Agenda Heading: NEW BUSINESS

Department: City Manager
Title: Review the Fiscal Year 2026/2027 City Manager’s Proposed Budget and Provide Direction to Staff
Recommendation(s):

Staff recommends that the City Council review the Fiscal Year 2026/2027 City Manager’s proposed budget and provide direction to staff.

Background Information:

The proposed budget for Fiscal Year 2026/2027 is attached to this staff report. This includes the anticipated expenditures and revenues for the upcoming fiscal year. The proposed budget is submitted to the City Council for consideration and comments. This budget will be revised as directed by the City Council with the final budget scheduled to be approved by the City Council at the June 16, 2026 City Council meeting.

Analysis:

General Fund
A comparison of the draft actual financial position for Fiscal Year 2024/2025, adopted budget for Fiscal Year 2025/2026, and proposed budget for Fiscal Year 2026/2027 is summarized in the table below:

Monte Sereno Budget Comparison
Fiscal Year Total Revenue Total Expenditures
and Transfers Out Net
FY 2024/2025 Actual
(Draft) $4,729,702 $4,895,118 -$165,416
FY 2025/2026
Adopted Budget $4,769,928 $5,076,798 -$279,870
FY 2026/2027
Proposed $5,098,310 $5,293,500 -$195,190
General Fund Expenditure Reductions

Page 51 of 67 ends

The General Fund expenditures (excluding transfer out to other funds) for next year are proposed to decrease from the current year. This is mainly due to the following factors:
 Staff Levels – The Engineering Department position was previously budgeted as a Public Works Director. This position has been hired as a City Engineer and that classification is included in the proposed Fiscal Year 2026/2027 budget. This resulted in savings of about $30,000 in salary and benefits.

Additionally, the City Planner position has been reduced to a part-time position, resulting in savings of approximately $80,000 in salaries and benefits.  General Plan Update Project Complete – Over the past two years, the City has been working with M-Group consultants to update the General Plan. As this project is scheduled to be completed this Summer, there are no expenses that need to be budgeted in Fiscal Year 2026/2027. This is a savings of $87,500 from the last fiscal year.

General Fund Expenditure/Operating Transfer Out Increases Following is a summary of the major General Fund expenditure increases as compared with the current fiscal year budget.
 Police Services Agreement – The current agreement with the Town of Los Gatos for police services sets the annual cost of service increase based on the U.S. Department of Labor, Bureau of Labor Statistics Employment Cost Index for State and Local Government Workers plus 2%. Based on this, the anticipated cost increase for Fiscal Year 2026/2027 is 5%, or $80,000, for a total of $1.53 million.  Flock Camera Annual Cost – The City Council authorized an agreement with Flock Safety Group on January 21, 2025 for the installation and annual maintenance of 19 Automated License Plate Reader (ALPR) cameras and one mobile camera. The annual service cost for these cameras is $60,500.
 Operating Transfers Out – The General Fund currently transfers funds to the Law Enforcement and Public Safety funds to cover the cost of service for the Los Gatos police department. As per the new contract, these costs will increase in Fiscal Year 2026/2027 by 5%. In addition, the General Fund will also be transferring funds to cover a deficit fund balance in both the Loma Serena Street Lighting Fund and the Storm Drain Fund.

Potential General Fund Revenue Increases
The cost for police service has increased significantly over the years and similar increases are likely to occur in the future. The City does receive revenue from an annual parcel tax of $150 per parcel that was established in 1983. As approved, the parcel tax does not allow for an inflationary adjustment. The $150 parcel tax currently results in approximately $190,000 in revenue to the City. The cost for police services for Fiscal Year 2026/2027 will be

Page 52 of 67 ends

approximately $1.53 million. The revenue from this parcel tax accounts for about 12% of the total cost for police services.

As the City Council has discussed at previous Council meetings, and will be discussed at a Special City Council meeting on May 18, 2026, a new parcel tax measure may be necessary to continue to fund the police service costs without the use of reserve funds.

Capital Improvement Projects
In addition to the operating budget, the proposed Fiscal Year 2026/2027 budget includes the following Capital Improvement Projects (CIP):
 Green Stormwater Infrastructure (GSI) Project - As part of the Municipal Regional Stormwater Permit, which governs stormwater regulations for Monte Sereno, the City is required to provide treatment of storm water for approximately 9,000 square feet of are that is currently un-treated (i.e. impervious pavement, building roof area, etc.). Staff is working with a consultant to prepare plans to modify the roof drainage, landscaping, and pavement at City Hall to meet this requirement. Funds of $125,000 was previously set aside for this project and is included in the Fiscal Year 2026/2027 budget.

Monte Sereno was awarded a grant from the 2018 Parks Bond Act in the amount of $180,200. The original grant application was to use these funds towards the community center at the auxiliary building. However, since Council has tabled that project due to the unexpectedly high project costs, staff was able to gain approval to redirect these grant funds for this GSI project. The revenue of this grant has also been included in the Fiscal Year 2026/2027.
 Annual Pavement Management Program - The City receives several sources of revenue that are designated for road improvements. These revenues include the Gas Tax revenue from the State, Vehicle Registration Fees, Santa Clara County Measure B funds, and local construction road impact fees charged as part of building permits. The Fiscal Year 2026/2027 budget includes approximately $415,000 in revenues from these sources. The CIP project for the Pavement Management Program includes an expenditure of this same amount.

Unfunded Pension Liabilities
An Unfunded Accrued Liability (UAL) for the California Public Employees' Retirement System (CalPERS) is the difference between the pension plans obligations and the current value of its assets. This liability is calculated by CalPERS annually based on an actuarially study. The current liability is approximately $650,000. The annual payment for this liability is approximately $73,500. However, these annual payments will increase over time as additional unfunded liabilities will accumulate due to a variety of factors including the performance of the CalPERS investment portfolio, changes in actuarial assumptions, and experience changes.

As the interest rate paid to CalPERS for this liability is higher than the interest rate earned on the City’s investment portfolio, the proposed budget includes the currently required annual payment of $73,500 plus an additional payment of $150,000 towards this liability. This will

Page 53 of 67 ends

reduce the future annual payments and help to maintain the relatively low liability Monte Sereno has compared with other jurisdictions.

Status of Reserve Funds
The status of the City’s fund balance is determined with each fiscal year’s audit. The last completed audit was for Fiscal Year 2023/2024 and was accepted by the City Council on August 5, 2025, which showed a fund balance for the General Fund, the City's main operating fund, of $5,982,986. This entire amount is considered "Unassigned", which means it can be used for any governmental purpose determined by the Council and is not otherwise restricted, assigned, committed, or non-spendable. The ending City’s General Fund balance for Fiscal Year 2026/2027 is estimated at $5,342,510.

Fiscal Impact:

The fiscal impact is noted above for the proposed budget as well as for other areas that can be considered for revenue and expenditure adjustments. The final impact will be determined once the final proposed Fiscal Year 2026/2027 budget is prepared for adoption.

Public Noticing:

The City of Monte Sereno's Council meeting agenda was posted on the bulletin board outside of Monte Sereno's City Hall and the agenda with this staff report can be accessed on the City of Monte Sereno's website located at www.montesereno.org.
