ITEM # _1_
CITY OF MONTEBELLO
SPECIAL CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: René Bobadilla, P.E., City Manager
BY: Arnold M. Alvarez-Glasman, City Attorney
SUBJECT: California Voting Rights Act (“CVRA”)
DATE: May 2, 2022
RECOMMENDATIONS:
It is recommended that the City Council:
1) Review all draft City Council district maps (Attachment A) and select one (1) or more draft maps to elevate for further consideration and adoption; and 2) Take such additional, related, action that may be desirable.
FISCAL IMPACT
None.
BACKGROUND
Montebello City Councilmembers are currently elected in “at -large” elections, in which each Councilmember is elected by the voters of the entire City. The City received a petition on March 15, 2021 alleging the City’s at-large election system violates the CVRA and requesting that the City voluntarily change its at-large system of electing Councilmembers to a district-based election system. In a by-district election system, a candidate for City Council must live in the district where the candidate wishes to represent, and only the voters of that district are entitled to vote to decide who their representative will be.
DISCUSSION
The CVRA was enacted in 2001 to implement the California constitutional guarantees of equal protection and the right to vote. Under the CVRA, a city is required to hold at least CITY COUNCIL AGENDA REPORT – SPECIAL MEETING OF MAY 2, 2022 California Voting Rights Act (“CVRA”)
two (2) public hearings prior to the drawing of draft City Council district maps, and at least two (2) public hearings after the draft City Council district maps are drawn.
The City Council has held public hearings on October 13, 2021, November 13, 2021 , February 9, 2022, February 23, 2022, April 9, 2022, April 23, 2022, and April 27, 2022. At the April 27, 2022 City Council meeting, Staff received direction to receive and file the staff report and table the matter for future meeting.
