Meal Period
When personnel are required by their duties to work more than five consecutive hours without a one-half hour uninterrupted meal period, one half hour at double time rate will be charged in addition to any applicable overtime for actual hours worked.
Shift Differential (Applies to Regularly Scheduled Shifts Only) A $1.00 per hour shift differential premium will be charged for all inspection hours that fall outside of the 5:00 a.m. to 5:00 p.m. time period. Twining will require 48-hour notice along with the General Contractors approved shift letter prior to beginning a shift that will include hours falling outside this time period. Should this notice not be provided, all work performed on that shift will be billed at the applicable overtime or double time rate.
If three shifts per day are required, the first shift will be billed at the standard rate. The second shift shall be billed in accordance with the previous paragraph.
The third shift shall be billed at 8 hours for the first 6 1/2 hours worked and appropriate overtime or double time for all hours thereafter.
Travel Time and Mileage
For projects outside a 50-mile radius from the nearest Twining facility, $0.70 per excess mile to and from the project will be charged for inspectors and technicians.
Other than small tools, whenever project related equipment is required to be transported to and from the project site, time and mileage for inspectors and field technicians will be billed on a portal to portal basis. For all projects, $0.70 per mile rate and applicable travel time will be charged portal to portal for engineers, consultants, supervisors, and laboratory technicians from the laboratory to the project site and return.
For work locations located 100 miles or more from Twining, travel time will be charged at the relevant rate for inspectors and technicians in addition to a subsistence allowance.
Weekend Sample Pick-Ups
In order to be in strict conformance with testing standards, it may be required that weekend pick-ups be performed (e.g. concrete specimens cast on Friday must be picked up on weekend in order to be in conformance with ASTM C31 requiring specimens to be moved to their final curing location within 48 hours of casting.) Applicable charges for weekend work will apply when this is required. Should these charges not be authorized, Twining will not be liable for any negative consequences.
Reimbursable Expenses
Parking, air fare, car rental, food, lodging and project specific software/applications (e.g. PlanGrid, Procore, etc.) will be charged at cost plus 20% per processed invoice, unless provided by client.
Project Specific Documents
Costs presented assume that client will provide project specific documents (plans, specifications, submittals, RFIs, etc.) for all inspection personnel. Should project specific documents be provided electronically through a "for fee" service, the client will be responsible for providing access and paying any fees for the service.
Project Site Facilities

15 CITY OF MONTEBELLO | RFP NO.22 -8 FOR ON -CALL ARCHITECTURAL AND ENGINEERING DESIGN SERVICES
SCHEDULE OF BILLING RATES
General Conditions, Continued
Limit of Liability
Client agrees to limit Twining's aggregate liability to all entities for alleged or actual errors and omissions in the performance of its professional services under this agreement to $50,000.00 or the fees actually paid to Twining, whichever amount is greater. Higher limits may be available by quotation.
Certified Payroll
Certified payroll will be provided, upon request, at an additional charge of $150.00/month. Fee applies to every month that certified payroll must be submitted regardless of whether or not services were provided for any given month.
Final Reports Required by Jurisdiction
If a final report or affidavit is required, we must first review all inspection and testing reports and clear up any unresolved issues on these reports. These issues will typically require approval by the engineer or architect of record. This process can take several weeks or just a day, depending on the number and complexity of the issues. Cost for final reports will be billed hourly.
Terms of Payment
Fees charged are for professional and technical services and are due upon presentation. If not paid within 30 days from date of invoice, they are considered past due and the maximum legal finance charge will be added to the unpaid balance.
In addition, should the client require that invoices be submitted through a web based or electronic system, the client will be responsible for all costs associated with the use of the system.
A 3% fee will be applied for payments processed by credit card.
All invoice errors or necessary corrections shall be brought to the attention of Twining within 15 days of receipt of invoice. Thereafter, customer acknowledges invoices are correct and valid. Twining reserves the right to terminate its services to a customer without notice if all invoices are not current. Upon such termination of services, the entire amount accrued for all services performed shall immediately become due and payable. Customer waives any and all claims against Twining, its subsidiaries, affiliates, servants and agents for termination of work on account of these terms.
In the event of any litigation arising from or related to any agreement to provide services whether verbal or written, the prevailing party shall be entitled to recover from the non- prevailing party all reasonable costs incurred, including staff time, court costs, attorney's fees and all other related expenses in such litigation. Additionally, in the event of a non- adjudicative settlement of litigation between the parties or a resolution of dispute by arbitration, that same process shall determine the prevailing party.
Hold Specimens
All "hold" specimens are charged at the applicable test rate whether tested or not.
Specimen Sampling and Disposal
Twining samples materials used in construction in accordance with standard practices, methods, codes and relevant project requirements. Representativeness of sampling and same accuracy of testing are subject to the same probabilistic and precision limitations as governing standards, codes and project technical provisions.
Should samples be provided by others Twining cannot warrant or guarantee that material is representative of material that is or will be used in actual construction of the project.
Specimens will be discarded after testing unless Twining has been notified prior to testing that the customer wishes to retrieve the specimens or storage arrangements are made.
Oversize Specimens
An extra charge will be made when test specimens require more than one person to handle because of size or weight.
Elevated Work Platforms
In the event an elevated work platform is required to safely complete our inspections, the client must provide safe access, including a trained and certified operator, to Twining inspection and testing personnel. Should Twining be required to supply an elevated work platform, we will contract with a qualified vendor and the markups shown above will apply. 6

CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Arlene Salazar, Acting City Manager
BY: Rita Montalvo, Assistant Director
SUBJECT: APPROVE EMERGENCY REPAIRS FOR THE SEWER LIFT STATION AT 348 E. LINCOLN AVENUE
DATE: September 27, 2023
RECOMMENDATION(S):
It is recommended that the City Council:
1. Approve emergency repairs for the Sewer Lift station at 348 E. Lincoln Avenue in the total amount of $250,000 under the authority of Montebello Municipal Code (MMC) Section 3.20.050(A); and,
2. Amend the Fiscal Year 2023-24 budget by increasing appropriations by a total of $250,000 in Account No. 100-30-340-6040.50 (General Fund, Public Works, Sewer Operations, Contract Services Street Maintenance); and
3. Take such additional, related, action that may be desirable.
FISCAL IMPACT:
The required emergency services to repair the Sewer Lift Station at N. 348 Liconln Avenue are estimated to cost an aggregate amount of $250,000. Additional appropriations are needed to fund this emergency work.
A budget amendment is required, increasing appropriations by $250,000 in Account No. 100-30-340-6040.50 (General Fund, Public Works, Sewer Operations,Contract Services Street Maintenance). Funding is still available from the City’s Coronavirus State and Local Fiscal Recovery Fund (CSLFRF) allotment that was earmarked for sewer infrastructure repairs. The $250,000 required for these emergency repairs will come from that source of funding.
CITY COUNCIL AGENDA REPORT - MEETING OF SEPTEMBER 27, 2023
BACKGROUND/DISCUSSION:
On January 26, 2023, a vehicle driving on E. Lincoln Ave between N. Raywood Ave and N. Sanchez Street collided with a Southern California Edison (SCE) power pole (#712841H) located at 348 E. Lincoln Ave. and damaged the Sewer Lift station control panel, electrical equipment, pump base, and volute. Staff is currently pursuing an insurance claim against the driver and the City's property insurance on this matter.
However, the status of the insurance claim is still pending. We are pursuing these claims to mitigate loss as part of this repair.
City staff from the Public Works Department were called to the site to inspect the damage to the pump station. Staff contacted Flo-Services to provide a temporary fix to the sewer lift station to avoid any further damage or blockage to the sewer system. Flo-services provided an assessment of the proper repairs needed to fix the Sewer Lift Station. See attachment A for the proposal of services. Flo-Services is one of the "on-call" vendors that the Public Works Department utilizes to provide minor routine repairs on an as- needed basis.
The repairs necessary to bring the sewer facility back into service to avoid any additional damage to the sewer system are significant and need to be performed as soon as possible. In addition to work to be performed by Flo-Services, the Public Works Department also requested a quote from A-n-W Construction, Inc. for the additional work to replace the sidewalk and excavate and replace the 1-6” vent bollard that was damaged during the collision. See attachment B for the proposed services. A-n-W Construction, Inc. is also on the on-call list that the Public Works Department utilizes.
The following unanticipated and significant repair services are required and considered as emergency procurements under Montebello Municipal Code (MMC) 3.20.050(A).
These repairs are separate from the on-call agreement for minor and routine repairs:
CITY COUNCIL AGENDA REPORT - MEETING OF SEPTEMBER 27, 2023
ENVIRONMENTAL:
The recommended emergency repairs are exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to the California Code of Regulations Title 14 Section 15269.
ANALYSIS:
N/A
SUMMARY:
It is recommended that the City Council approve the emergency repairs for the Sewer Lift Station at 348 N. Lincoln Ave. in the amount of $250,000. It is recommended that a budget amendment in the amount of $250,000 be approved in Account No. 100-30-340- 6040.50 (General Fund, Public Works, Sewer Operations, Contract Services Street Maintenance). A portion of the City's Coronavirus State and Local Fiscal Recovery Funds (CSLFRF) allotment will be utilized to fund these emergency repars.

CITY OF MONTEBELLO
CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Arlene Salazar, Acting City Manager
BY: Rita Montalvo, Assistant Director
SUBJECT: ADOPT CITY COUNCIL RESOLUTION NO. 23-70 NAMING A CERTAIN PUBLIC STREET “TOPGOLF DRIVE’ AND RESOLUTION NO. 23-71
AUTHORIZING THE RENAMING OF THE MONTEBELLO GOLF
COURSE TO BELLA VERDE RESORT AT MONTEBELLO AND
RENAMING A PORTION OF VIA SAN CLEMENTE ROAD, FROM N.
GARFIELD AVENUE TO THE SOUTH ENTRANCE OF THE CITY OF
MONTEBELLO GOLF COURSE, AS “BELLA VERDE DRIVE”
DATE: September 27, 2023
RECOMMENDATION(S):
It is recommended that the City Council:
1. Adopt Resolution No. 23-70 naming a certain public street “Topgolf Drive” and Resolution No. 23-71 renaming a portion of Via San Clemente Road, from N.
Garfield Avenue to the south entrance of the City of Montebello Golf Course, as “Bella Verde Drive"; and
2. Authorize the Acting City Manager to execute certificates and any other related documents to consummate the acceptance of naming and renaming the subject streets, in a form approved by the City Attorney; and
3. Authorize the renaming of the Montebello Golf Course to Bella Verde Resort at Montebello as part of Resolution No. 23-71; and
4. Take such additional, related, action that may be desirable
FISCAL IMPACT:
The recommendations to name the subject street “Topgolf Drive” and rename Via San Clemente Road to “Bella Verde Drive” have no immediate fiscal impact, nor have any impact on the construction or future maintenance other than street name blade changes (signage). The renaming of the golf course will result in costs associated with the
CITY COUNCIL AGENDA REPORT - MEETING OF SEPTEMBER 27, 2023
branding efforts including website domain, graphic design work, way-finding signs, and other related branding treatments. The costs are estimated at no more than $50,000 and will be included in the current fiscal year budget and subsequent budgets as necessary. If required, action will be presented to the City Council to amend the Fiscal Year 2023-24 budget for branding and related expenses.
BACKGROUND/DISCUSSION:
On November 10, 2022, a construction contract was awarded to McCarthy Building Companies, Inc. ("McCarthy") for the construction of the Topgolf Montebello Project. The construction started on January 3, 2023, and it is estimated to be completed by the Spring of 2024.
On February 8, 2023, the City Council approved Resolution 23-10, accepting certain roads and streets into the City Street System. The subject new street was one of the streets adopted as part of the City's Public Street System. This new street is the main entrance to the Topgolf facility and provides connectivity directly off Via San Clemente Road. The new public street is described in the legal description in Exhibit A of the recommended resolution No. 23-70 (Attachment B). Via San Clemente is a public street that generally runs north to south, from North Garfield Avenue to the end of the street at the Edison parcel.
As part of the Topgolf branding process, Topgolf is requesting that the City Council consider naming the new street "Topgolf Drive." To further the renaming efforts of the golf course to Bella Verde Resort at Montebello, it is proposed that a portion of the existing Via San Clemente Road from N. Garfield Avenue to the south entrance of the City of Montebello Golf Course is renamed, as “ Bella Verde Drive."
At the June 14, 2023 City Council meeting, direction was provided to Staff for consideration of renaming the Montebello Golf Course to "Bella Verde Resort at Montebello." This name change is intended to honor the importance of Montebello within the new name to signify a brand-new future of the property. The branding associated with the renaming of the golf course will begin by the end of the calendar year. This branding effort will feature a new website, brand image (logo), and other branding treatments as part of the updated golf and entertainment complex.
ENVIRONMENTAL:
The City has reviewed the proposed actions pursuant to the California Environmental Quality Act (“CEQA”) and the City’s local CEQA Guidelines and has concluded that there is no substantial evidence that the actions will have any significant effect on the environment. The action is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment (14 CCR 15061(b)(3)), and the dedication, acceptance, and naming of a public street does not result in a physical change to the environment. The environmental impacts of the golf course projects, of which the subject street is only an incidental component, were previously analyzed and disclosed in accordance with the requirements of CEQA in that certain Initial Study / Mitigated Negative Declaration and Addendum thereto certified by
CITY COUNCIL AGENDA REPORT - MEETING OF SEPTEMBER 27, 2023
the City on March 15, 2022.
ANALYSIS:
The Topgolf Montebello project is located on the southwest side of Via Campo and Garfield Avenue. The new street connects to Via Campo on the north side and extends to Via San Clemente on the South Side. Via San Clemente runs generally north-south from Garfield Ave to Beverly Blvd (refer to the Site plan shown in Attachment A). The street is between the Topgolf parking lot on the west side and Topgolf facilities on the east side. In addition, the new street provides access to the parking lot and the (yet to be constructed) clubhouse on the south side of the street.
The City recognizes the importance of enhancing its image and promoting economic development through effective branding. To ensure that the modern and contemporary style of the new Topgolf is shown throughout the area, Topgolf is seeking City Council approval to name the new street “Topgolf Drive,” a street name that will hold significant potential for enhancing the City’s identity and will assist in attracting visitors to the new golf and entertainment complex. At the same time, Staff recommends the City Council authorize renaming a segment within the Golf Course facility, Via San Clemente Road, as “Bella Verde Drive.”
In accordance with California Government Code Sections 34091.1 and 34092, the City Council may adopt a resolution assigning a name to any public street. Therefore, if the City Council adopts the proposed Resolutions No. 23-70 and No. 23-71 (Attachments B and C), they will be forwarded to the County of Los Angeles for processing and recordation.
SUMMARY:
Upon approval by the City Council of the recommended actions, including adoption of Resolution No. 23-70 and Resolution No. 23-71, staff will coordinate the execution of all documents and file them with the appropriate Los Angeles County offices for the naming and renaming of the aforementioned public streets.
