CITY OF MONTEBELLO

CITY COUNCIL AGENDA STAFF REPORT

TO: Honorable Mayor and City Council Members

FROM: Raul Alvarez, City Manager

BY: Paul Espinosa, Police Chief

SUBJECT: REPORT OF EMERGENCY REPAIRS TO THE POLICE DEPARTMENT

BUILDING AND APPROVAL OF CONTRACTS FOR REQUIRED

REPAIR AND REMEDIATION WORK

DATE: February 28, 2024

RECOMMENDATION(S):

It is recommended that the City Council:

1. Receive and file the City Managers report of emergency repairs to the Montebello Police Department headquarters building pursuant to Montebello Municipal Code Section 3.20.140 and Public Contracts Code Section 22035; and

2. Determine and find that the repairs, remediation, and purchases are of an emergency nature and are required for use of the first floor of the Police Departments Men's and Women's locker rooms; and

3. Authorize the City Manager by a four-fifths (4/5) vote of the City Council, to execute professional service agreements with Pro Ceramic Tile, Mr. Rooter Plumbing, and Premier Wall Systems; for the repair of the Montebello Police Department at an estimated total cost of $450,000; and

4. Amend the Fiscal Year 2023-24 budget by increasing appropriations by $450,000 in Account No. 100-80-840-7115 (General Fund, Police, Headquarters Rehab- Repair); and

5. Take such additional, related action that may be desirable.

FISCAL IMPACT:

The necessary emergency repairs, remediation work and purchases necessary to repair and rehabilitate the Police Department building are estimated to cost an aggregate amount of $1,250.000. Previous budget amendments have been made to provide funding for the first two phases of this project. On August 23, 2023, City Council approved $300,000 in funding to assist with initial remediation efforts (Account No. 100-

30-510-6040.60). An additional $500,000 was provided via City Council action on November 8, 2023 (Account No. 100-80-840-7115).

The totality of work to bring the Police Department’s first floor back into operational status will take nine to twelve months to complete. This includes flooring repairs, installation of new furniture and associated technology, rehabilitation of the locker rooms, painting, and other repair work. A project of this scope must be approached in a “phased” method with work needing to proceed in a logical order. In addition, there will be significant lead time for some equipment such as furniture and technology. The initial $800,000 in funding has provided for floor, paint, drywall, plumbing and related improvements, as well as purchase of new lockers and furniture for the rehabilitated areas.

The third phase of the project will include rehabilitation of the men's and women's locker rooms and bathrooms -- the first such major repair work to these facilities in thirty years. In order to accomplish this work an additional $450,000 is being requested (Account No. 100-80-840-7115). The recommended City Council action will approve agreements or increase not-to-exceed amounts on existing agreements with three vendors chosen to perform the next phase of work: Premier Wall Systems, Mr. Rooter Plumbing and Pro Ceramic Tile. The expenses will be recorded in Account No.100-80- 840-7115 (General Fund, Police, Headquarters Rehab-Repair, Building Improvements).

As work progresses, and additional purchase orders are approved, Staff will monitor the budget in this account and recommend additional budget adjustments if necessary.

BACKGROUND/DISCUSSION:

The winter of 2021-2022 saw excessive amounts of rain throughout Southern California.

The large amount of rain caused severe intermittent flooding on the northeast area of the first floor of the City's Police Building (i.e., the area off Victoria Avenue, near the Los Angeles County library building). During the month of March 2022, hallway walls were being prepared for painting as part of routine maintenance and renovation work in the building. During the wallpaper removal, prior to painting, mold was discovered on the walls on the first floor of the Police Building.

The City -- through its insurance company -- engaged an Industrial Hygienist to perform testing of the building to ensure the mold had been eliminated after initial remediation efforts were completed. The industrial hygienist took additional tests to ensure the air was clean and safe on the first floor. On June 28, 2023, the Industrial Hygienist issued a final report indicating the air samples taken were clean and safe. In response to the air assessments and final report, the first floor was reopened with limited access. This limited opening allowed access to the shooting range and gym. The remaining areas of the first floor require additional repairs and rehabilitation of flooring, walls, and the locker rooms/bathrooms. Once these repairs are completed, the remaining areas of the first floor will be opened for use by Police Department staff.

On August 23, 2023, the Police Department submitted a report to City Council detailing the need to approve emergency repairs and remediation to the first floor of the Police Building. During this meeting, the City Council approved the work to move forward, approving $300,000 in funding. In that time, staff has worked to repair a major broken

pipe which was discovered to be the source of the water intrusion into the Police Building . During this repair, a “smoke test” was performed in order to trace the source and route of the water intrusion. The outcome was positive, and it is believed the subsequent repairs to plumbing corrected the issue of leaks and continued water damage. The other major tasks completed include removal of tile, carpet, wallpaper, and furniture.

Additionally, drywall installation has been completed as well as painting throughout the first floor and polishing and finishing of the floors.

On November 8, 2023, Staff submitted an agenda report requesting funding for the second phase of the repair and remediation project. During this meeting, the City Council approved the work to move forward, along with $500,000 in additional funding. The second phase included demolition and removal of the existing lockers, purchase of new lockers and cosmetic and technology updates to the briefing room.

The remaining repairs and maintenance work will address the following concerns:

• Officers unable to use the cot room to sleep prior to court appearance after working at night or an extended watch.
• Officers unable to use shower facilities due to current condition of the female and male locker rooms and shower areas.
• Re-establish the evidence room, currently located on another floor in a secured portion of the station.
• Re-establish use of the mat-room for training purposes.

ENVIRONMENTAL:

ANALYSIS:

The first floor of the Police Building is critical to the Police Department's functionality. It hosts the briefing room, locker rooms/bathrooms, shooting range, gym, Explorer meeting room, and Special Response Team’s equipment and training room. These rooms are important to not only law enforcement operations but to community engagement efforts.

During the extensive mold remediation, most of the furniture was removed due to it being unsalvageable. Items like lockers, chairs, and tables saw severe water damage and could not be repaired or re-used. Many of the items were several decades old and were already in poor condition prior to the mold infestation. The furniture was deteriorated and no longer suitable or safe for employee use.

The Police Department has worked with staff from Public Works and the Division of Information Technology (DoIT) to gather quotes for the furniture and equipment that should be replaced. Additionally, Public Works has been assisting in the completion of the repairs, which includes painting, furniture installation and other cosmetic finishes.

CITY COUNCIL AGENDA REPORT - MEETING OF FEBRUARY 28, 2024

Page 4 of 5 ends

The City is prepared to proceed with the emergency repairs and purchases required to bring the Police Building back to full operational use. Pursuant to Montebello Municipal Code (MMC) Section 3.20.140, the City Manager has the authority in cases of emergency “to order any direct and immediate action necessary to repair or replace a public facility, procure the necessary equipment, services and supplies for the purposes of addressing the emergency, without giving notice for bids to let contracts….” Upon taking such action, the City Manager is required to provide a report to the City Council of such action at the next regular City Council meeting.

This agenda report provides such a notice and serves as a recommendation to approve the necessary contracts with the vendors needed to restore the Police Building to full operational use (i.e., Pro Ceramic Tile, Mr. Rooter Plumbing, and Premier Wall Systems).

Cost estimates for the work to be performed by each vendor are as follows:

Premier Wall Systems – $49,600
Mr. Rooter Plumbing - $235,550
Pro Ceramic Tile – $164,850
TOTAL -- $450,000

Per the Municipal Code, approval of these contracts for this purpose requires a four-fifths (4/5) approval vote by the City Council. Given the exigent circumstances, it was prudent to engage the various vendors through the authority of MMC Section 3.20.140.

SUMMARY:

The City Council is being asked to receive and file the City Manager’s report regarding the emergency repairs required to bring the Police Building back to full operational use.

Additionally, the City Council is being asked to authorize the City Manager to approve agreements with Pro Ceramic Tile, Mr. Rooter Plumbing, and Premier Wall Systems in a total aggregate amount not-to-exceed $450,000 for the required and necessary remediation repairs and purchases (see "Analysis" section above for contract amounts per vendor detail). Approval of these contracts -- by a four-fifths (4/5) vote of the City Council -- is accomplished by utilizing the emergency contracting process per California Public Contract Code Section 22035 and Montebello Municipal Code Chapter 3.20.140.

Approval of the contracts noted above requires amending the Fiscal Year 2023-24 budget by increasing appropriations by $450,000 in Account No. 100-80-840-7115 (General Fund, Police, Headquarters Rehab-Repair, Building Improvements).
