14 Primary, non-contributory coverage endorsements. The general liability and professional liability (if required) policies must be endorsed to provide that each policy shall apply on a primary, non-contributing basis with any insurance or self- insurance, primary or excess, maintained by or available to the City or its officials, employees, and agents.
Waiver and Modifications of Insurance Requirements
To the extent permitted by law, the City may modify these insurance requirements at any time and at its sole discretion.
In general, any contract deemed sole source, professional/professional services, involves the disclosure of proprietary information, and/or a public works project may require revisions to the City's standard insurance requirements. Any revisions to the insurance requirements will be identified within the associated service contract terms and conditions.
Vendors may request a waiver or modification of these insurance requirements. Waiver or modification requests must be submitted in writing. The request should state the specific insurance requirement that is being considered for waiver or modification and provide a brief explanation for the request. Requests will be reviewed on a case-by- case basis, and the decision will ultimately depend on the scope of services. The final decision to approve or deny a request will be at the City's legal authority and/or an authorized designee's discretion.
12.0 Use of Federal Funds
The City may elect to use funding from Federal sources for a portion of or all expenses related to this project. The United States Federal Government requires purchases of items and services to meet specific standards when using Federal funds, including grants, cooperative agreements, contracts, and Federal funds "passed-through" to the City from a non-Federal entity (i.e., sub-recipient agreements). These requirements are codified under the Code of Federal Regulation's (CFR) Title 2, Subtitle A, Chapter II, Part 200 (also referred to as "2 CFR 200" or "Uniform Guidance") and the Federal Acquisition Regulations (FAR), as applicable.
The following standards apply to all purchases of items and services using Federal funds:
•Transactions shall be conducted lawfully and ethically •Unnecessary/duplicative purchases are not permitted
•Utilizing a vendor or supplier on the U.S. Federal Government's Debarred and Suspended List (available at SAM.gov) is prohibited
15 •All individuals involved in the expenditure of federal monies must avoid any actual or apparent conflict of interest
•Procurement transactions must be conducted in a manner providing full and open competition
•Opportunities should be provided to minority businesses, women's business enterprises, and labor surplus area firms when possible •Contracts and purchase orders should include the contract provisions required by 2 CFR 200 Appendix A
•Purchases of goods and services must include documentation detailing the procurement history
In addition to Federal standards, purchases must adhere to applicable local policies and procedures as defined in Montebello Municipal Code Chapters 3.20 and 3.21 and any relevant administrative policies. The most restrictive terms prevail when a conflict is present.
13.0 Non-Commitment of City
While the City intends to select a vendor through this process, this intention is subject to change at any time during the process. The City does not commit to awarding an agreement, paying any costs incurred in preparing the proposal for this request, and/or procuring or contracting any items or services.
14.0 Labor Requirements

B.Health: All personnel engaged in the performance of this work shall be in good health and free of contagious diseases. Any person found to be objectionable
16 shall be discharged immediately and not re-employed for this work.
15.0 Records
The vendor agrees to permit the City Manager or designee access to records, reports, files, and other papers or property of the Vendor to audit any performance aspect under this agreement.
16.0 Subcontractors
The vendor shall be responsible for all work performed under the final agreement and shall keep all work under his control. No portion of the work may be subcontracted without the prior written consent of the City. All subcontractors used on this work shall be under the direct supervision of the Vendor and shall be considered as their employees. Any approved subcontractors must provide insurance indemnifying the City with limits at or exceeding the limits of the Contractor's insurance.
17.0 Modifications/Changes
Changes in the areas serviced and/or specifications may be necessary during the agreement term. Changes in the agreement’s requirements and corresponding changes in compensation may be implemented upon mutual understanding between the City and the Vendor. These changes will be processed by the City Manager.
18.0 Disclosure of Information
A. The Vendor agrees that it will not during or after the term of the agreement, disclose any proprietary information or confidential business information of the City, including but not limited to its costs, charges, operating procedures, or methods of doing business to any person, vendor, corporation, association, or other entity or the general public for any reason or purpose whatsoever, without the prior written consent of the City. Such confidential or proprietary information received by the Vendor shall be used exclusively in connection with the performance of services.
B. The Vendor shall not issue or release for publication any articles, advertising, or publicity matters relating to the services performed by the Vendor hereunder or mentioning or implying the name of the City or its respective personnel without the prior written consent of the City.
19.0 Ex-Parte Communications
Vendor and vendor representatives should not engage in unauthorized communications with elected officials, officers, employees, or agents of the City about this RFP. This requirement also includes any evaluation panel member, except for designated RFP facilitators. This requirement remains in effect until after award notifications have been made.
17 This restriction does not prohibit vendors and their representatives from making oral statements or presentations to City representatives during a scheduled public meeting.
20.0 City of Montebello Rights
At its discretion, the City reserves the right to:
A. Reject any and/or all proposals for no reason or any reason including, but not limited to, the following:
i. The proposal is incomplete, non-responsive, obscure, irregular, or lacking necessary detail and specificity.
ii. The Vendor, in the sole judgment of the City, lacks the qualifications, experience, and/or responsibility necessary to provide the services. iii. The Vendor failed or neglected to complete and submit any information within the time specified by the City and as may be otherwise required herein.
B. Reject any proposal that, in the opinion of the City, is so unbalanced in comparison to other proposals received and/or to the City’s internal estimates that it does not accurately reflect the cost to perform;
C. Accept all or any part of a proposal;
D. Cancel the entire RFP;
E. Issue subsequent RFPs; or

CITY OF MONTEBELLO
CITY COUNCIL AGENDA STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Raul Alvarez, City Manager
BY: John Soria, Acting Director
SUBJECT: ADOPT RESOLUTION NO. 24-49 TO AUTHORIZE SUBMITTING AN
APPLICATION TO THE FEDERAL TRANSIT ADMINISTRATION (FTA)
TO OBLIGATE FUNDING FOR A MOBILE HYDROGEN FUEL CELL
FUELING STATION, AN ASSET MANAGEMENT SYSTEM, AND NON-
REVENUE RELIEF VEHICLES.
DATE: June 26, 2024
RECOMMENDATION(S):
It is recommended that the City Council:
1. Adopt Resolution No. 24-49 to authorize submitting an application to the Federal Transit Administration (FTA) to obligate funding for a mobile hydrogen fuel cell fueling station, an asset management system, and non-revenue relief vehicles; and
2. Take such additional, related action that may be desirable.
BACKGROUND/DISCUSSION:
The City operates MBL to service 14 cities within the Greater Los Angeles Metropolitan Area as well as portions of Unincorporated Los Angeles County. MBL’s service area is comprised of the City of Montebello proper and a .25 radius from any fixed route bus stop, which encompasses a population of 361,624 individuals. The services provided include eight (8) fixed route bus lines comprised of seven (7) local routes and one (1) express route. Correspondingly, a consistent need exists to maintain an efficient and reliable bus fleet to provide superior public transportation services.
A. Mobile Hydrogen Fuel Cell Fueling Station
On October 27, 2021, the City Council adopted Resolution No. 21-80 approving MBL’s
CITY COUNCIL AGENDA REPORT - MEETING OF JUNE 26, 2024
Zero Emission Bus (ZEB) Rollout Plan to serve as a blueprint for how MBL plans to achieve a full transition to zero-emissions (ZE) technologies by 2040. The ZEB Rollout Plan provides information on strategies necessary to address MBL’s current bus fleet composition, future bus purchases, facilities and infrastructure modifications and potential funding sources. Following the ZEB Rollout Plan, MBL identified the 5307 Funding as an additional funding opportunity to assist with the purchase of a mobile hydrogen fuel cell fueling station.
B. Asset Management System
Upgrading the Enterprise Asset Management (EAM) system is a pivotal component to MBL’s strategic transition to a ZE fleet, as detailed in the ZEB Rollout Plan. The proposed upgrade aims to streamline operations by automating key functions such as work order tracking, staff productivity, and warehouse inventory management. The EAM system will support the integration of the new hydrogen fuel cell electric buses (FCEBs) by facilitating preventative maintenance schedules based on mileage and enhancing warranty tracking.
C. Non-Revenue Relief Vehicles
MBLs aging fleet of non-revenue relief vehicles have met or exceeded FTA’s useful life benchmark (ULB). Replacing these vehicles is crucial for maintaining operational reliability and efficiency. These vehicles are essential for supporting day-to-day operations, including staff transportation, to ensure services go uninterrupted during each operator shift change.

PROGRAM PURPOSE: The Urbanized Area Formula Funding program (49 U.S.C. 5307) makes Federal resources available to urbanized areas and to Governors for transit capital and operating assistance and for transportation related planning in urbanized areas. An urbanized area is an Census-designated area with a population of 50,000 or more as determined by the U.S. Department of Commerce, Bureau of the Census.

atutory References: 49 U.S.C. Section 5307 and 5340 / FAST ACT Sections 3004, 3016 Program Requirement: https://www.transit.dot.gov/regulations-and-guidance/fta-circulars/urbanized- area-formula-program-program-guidance-and
Eligible Recipients: Funding is made available to designated recipients, which must be public bodies with the legal authority to receive and dispense Federal funds. Governors, responsible local officials and publicly owned operators of transit services are required to designate a recipient to apply for, receive, and dispense funds for urbanized areas pursuant to 49 U.S.C. 5307(a)(2). The Governor or Governor’s designee is the designated recipient for urbanized areas between 50,000 and 200,000.
E
ligible Activities: Eligible activities include planning, engineering, design and evaluation of transit projects and other technical transportation-related studies; capital investments in bus and bus-related activities such as replacement of buses, overhaul of buses, rebuilding of buses, crime prevention and security equipment and construction of maintenance and passenger facilities; and capital investments in new and existing fixed guideway systems including rolling stock, overhaul and rebuilding of vehicles, track, signals, communications, and computer hardware and software. All preventive maintenance and
ATTACHMENT A
some Americans with Disabilities Act complementary paratransit service costs are considered capital costs. For urbanized areas with populations less than 200,000, operating assistance is an eligible expense.
For urbanized areas with 200,000 in population and over, funds are apportioned and flow directly to a designated recipient selected locally to apply for and receive Federal funds. For urbanized areas under 200,000 in population, the funds are apportioned to the Governor of each state for distribution.
What’s Changed?
The 100 Bus Rule has been expanded to include demand-response service, excluding ADA complementary paratransit service. An exception to the 100 Bus Rule has been added as well. If a public transportation system executes a written agreement with one or more other public transportation systems within the urbanized area to allocate funds by a method other than by measuring vehicle revenue hours, each public transportation system that is part of the written agreement may follow the terms of the written agreement instead of the measured vehicle revenue hours.
Under Grant Recipient Requirements, a provision has been added that directs recipients to maintain equipment and facilities in accordance with their transit asset management plan.
Recipients are no longer required to expend 1% of their funding for associated transit improvements.
However, recipients are still required to submit an annual report listing projects that were carried out in the preceding fiscal year.
Funding:
Federal Share: The Federal share is not to exceed 80 percent of the net project cost. The Federal share may be 90 percent for the cost of vehicle-related equipment attributable to compliance with the Americans with Disabilities Act and the Clean Air Act. The Federal share may also be 90 percent for projects or portions of projects related to bicycles. The Federal share may not exceed 50 percent of the net project cost of operating assistance.
Formula Details: Funding is apportioned on the basis of legislative formulas. For areas of 50,000 to 199,999 in population, the formula is based on population and population density. For areas with populations of 200,000 and more, the formula is based on a combination of bus revenue vehicle miles, bus passenger miles, fixed guideway revenue vehicle miles, and fixed guideway route miles as well as population and population density.
Passenger Ferry Grant Program: $30 million is set aside for passenger ferry grants, to be allocated through competitive selection.
Anything else relevant: Funds are available the year appropriated plus five years.
Other:
• Match can come from other Federal (non-DOT) funds. This can allow local communities to implement programs with 100 percent federal funding.
• Agencies that receive Section 5307 funding must offer half fare or reduced fare to people with disabilities and seniors during off-peak hours for fixed-route services.
