Council
Agenda Report
№08/22
FROM: Nat Rojanasathira, Assistant City Manager
Prepared By: Clementine Bonner Klein, City Clerk
SUBJECT: Interview Qualified Council Vacancy Applicants, Discuss and Deliberate, Appoint to fill the Short-Term At-Large Council Vacant Seat, and Install the Appointed Councilmember (Not a Project under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061)
RECOMMENDATION:
That the City Council interview the eleven qualified Council vacancy applicants, receive public comment, discuss and deliberate, appoint to fill the short-term at-large Council vacant seat, and install the appointed Councilmember.
VALUE DRIVERS:
Foster a local government that is transparent and collaborative; and solicits, welcomes and appreciates input from all.
POLICY IMPLICATIONS:
Monterey Charter Sec. 2.5, “Vacancies,” provides: “A vacancy in an elective office shall be filled by appointment by the Council, such appointee to hold office until the next General Municipal Election and until a successor is elected and installed. Should the Council fail to fill any such vacancy within forty (40) days after the same occurs, then it shall be filled by appointment by the Mayor. Such successor shall be elected for the unexpired term of his/her predecessor at the General Municipal Election next succeeding such appointment.” The City Council’s appointment of a qualified candidate to a vacant seat will be made without regard to race, color, national origin, ancestry, sex, gender, gender identity, gender expression, sexual orientation, religion, mental disability, physical disability, medical condition, genetic information, marital status, military status, veteran status, or age.
FISCAL IMPLICATIONS:
There is no fiscal impact that would result from filling the City Council vacancy by appointment.
ENVIRONMENTAL DETERMINATION:
The City of Monterey determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA) (CCR, Title 14, Chapter 3 (CEQA Guidelines), Article 20, Section 15378). In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant Date: 12/12/2022
Item No.: 1.
Council Special Meeting, 12/12/2022, Item No. 1., Item Page 1, Packet Page 5 to CEQA Guidelines section 15378, this matter is not a project. Because the matter does not cause a direct or any reasonably foreseeable indirect physical change on or in the environment, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.
ALTERNATIVES CONSIDERED:
The Council could use an alternative interview process, though this is not recommended by staff since the interview process outlined below follows the December 6, 2022 direction from Council.
The recommended process was communicated to all qualified applicants in advance of this meeting.
Following interviews, the Council may deliberate on, appoint, and install the appointed Councilmember at this meeting or may defer deliberation, appointment, and/or installation to a future meeting, including the tentative second special City Council meeting on Thursday, December 15, 2022 at 6 p.m.
DISCUSSION:
Vacancy
As discussed at the regular meetings on November 1 and December 6, 2022, pursuant to the Monterey Charter, the current at-large short-term Council vacant seat must be filled by appointment by the City Council by December 19, 2022 (or the Mayor shall appoint). The Council directed an application process to be conducted during the month of November, which resulted in 11 Monterey residents qualifying to be considered for appointment.
Process for Applicant Presentations and Interviews
Pursuant to Council direction on December 6, 2022, during the meeting on December 12 the order of interviews will be determined by blindly selecting the qualified applicants’ names at random. The presentations and interviews will take place in the randomized order pulled out of a clear bowl during the meeting.
As directed by the Council, each applicant will be given a maximum of three (3) minutes to make a verbal presentation outlining their qualifications for, and interest in, the vacant Council seat. Immediately afterward, each Councilmember will ask one question selected from the list of 12 provided interview questions (Attachment 1), and the applicant will have one minute (60 seconds) to answer. If a Councilmember wishes to ask one follow-up question, the applicant will also have one minute (60 seconds) to answer.
In addition to the list of all possible interview questions, applicants are provided in advance with the City Council’s Mission, Vision, Value Drivers, and Strategic Priorities (Attachment 2) and the matrix of the prior City Council’s priorities (Attachment 3).
All qualified application forms are attached for further reference as Attachments 4 through 14, in alphabetical order by last name.
Council Special Meeting, 12/12/2022, Item No. 1., Item Page 2, Packet Page 6 Following the presentations and interviews, the Council will receive public comment. The Brown Act expressly authorizes public entities to put reasonable restrictions on the amount of time a speaker can speak at a meeting.
Process for Deliberation, Appointment, and Installation Following the presentations and interviews, the Council may deliberate and make a motion to appoint an applicant to fill the vacant seat, at which point the City Clerk will give the oath installing the appointed Councilmember. If additional time is needed for further deliberation, the appointment, and/or the installation, the Council has designated Thursday, December 15, 2022 at 6 p.m. as a reserved date for a second special meeting.

№08/22

Interview Questions
Responses from candidates are to be no longer than one minute (60 seconds) As directed by Council at the December 6, 2022 regular meeting.
1. What are your top three priorities for the City and what do you plan to do as a councilmember to achieve them?
2. How would you address a situation where your personal philosophy or popular opinion in the district in which you reside may be at odds with what is best for the City?
3. The City’s financial position requires the City to continue its Fiscal Health Response Plan strategies, some of which include operational reductions or services where appropriate, addressing pension liability, and investing in aging facilities. What approach would you take as a councilmember to address these issues when community members ask for services and new projects that the City may not be able to afford?
4. Serving on the City Council is a significant time commitment. Public officials often attend and participate in meetings and engage with constituents during business hours, evenings, and weekends. What is your approach to engaging with constituents and balancing other commitments?
5. Please share with us an example on how you approach working with others effectively as a team, particularly when you might disagree with a colleague.
6. In what ways do you agree, or disagree, with the Council’s existing strategic direction, as indicated in the value drivers and Council priorities?
7. For your one of your top priorities, please briefly share one or two specific ideas you have to address that issue in our community.
8. How do you think the City should address two areas where the City is significantly underfunded: over $150 million in unfunded pension liability, and hundreds of millions of dollars in aging infrastructure, including the library, police station, fire stations, community centers, and Sports Center?
9. What previous job experience or skill set do you have that you think would benefit the City Council if you are appointed?
10. What do you see as the role of the City Council? What do you see as the role of City Staff?
11. What have you done to prepare for the important role of City Councilmember? Have you reviewed the City’s budget, General Plan, or participated in City government?
12. Being on City Council takes a time commitment, during business hours, evenings and weekends. Given the amount of time required for this position, how will you handle the time commitment being on City Council?
Council Special Meeting, 12/12/2022, Item No. 1., Item Page 7, Packet Page 11 ANEXO 1

In Support of City Council Application
23 November 2022
In 1951 my parents moved here with the opening of the Postgraduate School where my dad was a professor. I graduated from Monterey High and left to go to college, but my husband Harry and I were married here SO years ago, and in 2014 we retired here. I inherited my mother's home, an older house that we demolished and rebuilt. Since I was elected president of the Del Monte Beach neighborhood, I discovered that my mother also served on its board. We have grandchildren, the youngest born five months ago, making me mindful of the future and the need to prepare for a better tomorrow.
I am _retired from a career as a city planner and social justice advocate. The scarcity of affordable housing threatens the future vltality of our city. I have experience working with the homeless and specialized In housing development, strategic planning, city management, and neighborhood organizing. I supported Tyller Williamson's candidacy for Mayor and his priorities to plan and bulld affordable housing, and to promote greater transparency in local government.
When I was encouraged to apply for this position, I learned that the neighborhoods where I live have not had a representative on City Council since 1975. If I am chosen, I commit to labor hard to bring forward proven approaches to problems facing our communities. I will bring a collaborative approach to our conversations. I look forward to working with City Council, government agencies, residents, and businesses to ensure our historic City thrives as we move forward together. I am grateful for the opportunity to put my name forward for this position. It has been a long-term goal of mine to give back to this community that I care about deeply.
