Agenda Report
FROM: Andrea Renny, PE, PTOE, Public Works Director
Prepared By: Rex VanSlyke, Fleet Manager
SUBJECT: Approve Purchase of Four (4) 2023 Ford Police SUV Interceptors in the amount of $200,563.36 from Folsom Lake Ford and Increase the FY 2022-23 Budget in the Equipment Replacement Fund. (Not a project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061) RECOMMENDATION:

That the City Council adopt a resolution approving the purchase of four (4) 2023 Ford Police SUV Interceptors in the amount of $200,563.36 from Folsom Lake Ford.

VALUE DRIVERS:

In collaboration with our community partners, work to improve the quality of life of all of our community members by fostering diversity, equity, and inclusion; championing equitable access to affordable housing; and maintaining a safe environment.

POLICY IMPLICATIONS:

The action is consistent with the City policy to replace City vehicles and equipment when they have fulfilled their useful life cycle and are no longer economical to operate or maintain.

In accordance with Chapter 28-Purchasing of the City Municipal code, equipment purchases exceeding $75,000 require City Council approval.

FISCAL IMPLICATIONS:

The equipment replacement fund has adequate funding for the replacement of four additional Police Patrol vehicles, approved through the FY23 budget process. The Equipment Replacement Fund will increase the appropriation of $200,563.36 in account 705-110-1130- 2120.

ENVIRONMENTAL DETERMINATION:

The City of Monterey determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA) (CCR, Title 14, Chapter 3 (CEQA Guidelines), Article 20, Section 15378). In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities, which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project. Because the matter does not cause a direct or any reasonably foreseeable indirect physical change on or in the environment, Date: 2/23/2023
Item No.: 1.

Council Special Meeting, 2/23/2023, Item No. 1., Item Page 1, Packet Page 3 this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.

ALTERNATIVES CONSIDERED:

The City Council could choose not to purchase the police vehicles.

DISCUSSION:

On June 7, 2022, Council adopted Resolution 22-066, awarding the purchase of four (4) 2022 Ford Police SUV Interceptors to be purchased from National Fleet Auto Group, a Division of Chevrolet of Watsonville, CA under the Sourcewell Contract number 091521-NAF. Due to a national police vehicle industry shortage, the acquisitions were rolled over from vehicle model year 2022 to vehicle model year 2023, resulting in a price increase of $33,504.52. This additional cost was ratified by Council on December 6. 2022 (Resolution 22-155). Due to manufacturing unreliability, the vehicles were ordered with no anticipated delivery date.

The City received correspondence on February 21, 2023 that the encumbered National Auto Fleet Group order for Resolution 22-066 is either going to be terminated or at the very least subject to a pricing and/or vehicle model year change as Ford Motor Company is facing challenges with filling vehicle orders. The unofficial word throughout the industry is that numerous police agencies with pending Ford vehicle orders are being notified of order termination with no explanation or alternative plan being furnished.

On February 17, 2023, Staff was notified of four (4) 2023 Ford Police SUV Interceptors that were available for immediate purchase from Folsom Lake Ford under State of California Contract No. 1-22-23-14C. Folsom Lake Ford is the current DGS State Contract vendor for Ford law enforcement vehicles with the contract pricing structure adhering to the State Wide Contract 1-22-23-14C terms. This State Wide Contract pertains to law enforcement vehicles & equipment only; therefore, there is no MSRP to compare to. The request for a cooperative purchase per Monterey City Code 28-14 (a) was approved by the Finance Department on February 21, 2023.

This purchase is in addition to the four (4) 2023 model vehicles described above from National Fleet Auto Group, as there is no estimated delivery date and it is in the best interest of the City to retain that order due to the above mentioned national police vehicle shortage.

Therefore, Staff recommends that Council adopt the attached resolution approving the purchase of four (4) 2023 Ford Police SUV Interceptors in the amount of $200,563.36 from Folsom Lake Ford and authorizing the Finance Director to increase the FY 2022-23 budget by appropriating $200,563.36 in the Equipment Replacement Fund account number 705-110-1130-2120 RV/mb
