FROM: Andrea Renny, P.E., PTOE, Public Works Director
Prepared By: Cody Hennings, Engineering Assistant I
SUBJECT: Open a Public Hearing to Confirm Alvarado Street Maintenance District 85-1 Area and Receive Protests Related to the Collection of the Assessment Proposed in Engineer’s Report for Fiscal Year 2025/2026 and Authorize the Assessment if a Majority Protest Does Not Exist (Not a Project under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) RECOMMENDATION:
That the Council adopt the attached resolution
confirming the area to be assessed for the Alvarado
Street Maintenance District 85-1; confirm the
assessments set out in the attached Engineer’s Report;
and order the same to be filed with the County of
Monterey’s Auditor-Controller’s Office.
This is a property based district in which liability for the assessment is premised upon a person’s property
ownership.
VALUE DRIVERS:
Serve as stewards of the City’s financial resources
through sound economic vitality efforts, streamlining
operations, reasonable revenue enhancements,
visionary long-term planning, fiscal transparency, and
community partnerships.
In collaboration with our community partners, work to
improve the quality of life of all of our community
members by fostering diversity, equity, and inclusion;
championing equitable access to affordable housing;
and maintaining a safe environment.
POLICY IMPLICATIONS:
This action continues a process the City has followed
since 1985 that establishes an annual assessment to
repair and maintain improvements, and to add to these
improvements as necessary, to meet the original intent
of the districts established to repair and maintain
improvements.
Agenda Report Highlights
Public hearing scheduled to confirm
the Alvarado Street Maintenance
District 85-1 assessment for FY
2025/2026 and address protests.
Proposed assessment rate is $4.65
per linear foot per month, totaling
$151,564, with the City covering
$43,650.16 in general benefit costs
and $2,000 for City-owned parcels.
Stakeholder meetings led to
recommendations for increased
sidewalk cleanings (27 annually)
and hiring a falconer to address
bird-related issues.
Majority protest is determined by
weighted ballots based on parcel
size; protests must be submitted in
writing before the hearing
concludes.
The action supports economic
vitality and quality of life by
maintaining Alvarado Street
improvements above standard
levels.
Date: 6/25/2025
Item No.: 1.
Council Special Meeting, 6/25/2025, Item No. 1., Item Page 1, Packet Page 3 №10/24
This action supports the Council’s value drivers of “working to improve the quality of life of our residents,” and “ensuring a level of economic vitality sufficient to support our quality of life and municipal infrastructure requirements” by maintaining Alvarado Street at a high standard conducive to commerce and public enjoyment of the downtown area.
CAMPAIGN DISCLOSURE REQUIREMENT (LEVINE ACT) APPLIES: No.
FISCAL IMPLICATIONS:
The Alvarado Street Maintenance District funds maintenance above and beyond normal maintenance activities, with the cost of the improvements reasonably apportioned among the benefitted parcels. The FY25/26 assessment rate will be $4.65 linear foot/month for a total cost of $151,564.00 to be assessed.
Fees collected under this process must be for services that are over and above fees attributed to the general public. Prior to the establishment of the district, the City performed services and provided enhanced facilities in the Alvarado Street assessment area. The City continues to pay for its "general benefit" maintenance costs. For the next fiscal year, the City’s "general benefit" portion will amount to $43,650.16. In addition to the general benefit costs, the City will be responsible for paying for the assessments levied on City-owned parcels within the district. This will cost approximately $2,000.00.
ENVIRONMENTAL DETERMINATION:
The City of Monterey determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA)(CCR, Title 14, Chapter 3 (“CEQA Guidelines”), Article 20, Section 15378). In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project. Because the matter does not cause a direct or any reasonably foreseeable indirect physical change on or in the environment, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.
ALTERNATIVES CONSIDERED:
The City Council may confirm the engineer’s report, as submitted, or it may modify the report in any particular and approve it as modified (Streets & Highways Code section 22623).
The City Council could choose to suspend the collection of an assessment for this district for another year.
The City Council could initiate dissolution proceedings at a future meeting by adopting a resolution of intention (Streets & Highways Code section 22610.) This is not recommended as the assessment pays for maintenance and improvements that benefit the property owners by adding to the character of Alvarado Street.
Council Special Meeting, 6/25/2025, Item No. 1., Item Page 2, Packet Page 4 №10/24
DISCUSSION:
Background
The Alvarado Street Maintenance District 85-1 was formed on May 7, 1985, pursuant to the Landscaping and Lighting Act of 1972 (Streets & Highways Code section 22500 et seq.). The purpose of the District is to make minor improvements along the length of Alvarado Street identified in the report. All parcels that receive a special benefit have been identified and included in the report. The District has operated continuously since its inception; however, the collection of the assessment was suspended for Fiscal Year 2024-2025 after it was determined that ballots may not have been received by the property owners.
The staff recommendation continues a legal process, which began at the Council's meeting of February 4, 2025, when the Council ordered the preparation of the Engineer's Report to establish the annual assessment for the maintenance of Alvarado Street improvements. The Engineer’s Report separates the general benefits to the public from the special benefits the assessed parcels will receive. Property-based assessments may only be used to pay for the special benefits provided by the improvements and activities of a district and may not be used for general benefits (California Constitution Art XIIID 4(a)). Therefore, the Engineer’s Report separates and quantifies special and general benefits and assesses property owners only for the portion of the costs representing special benefits.
General Benefit Charges
The City provides several services to the maintenance district that would be provided to the same area regardless of the existence of the District. These services are referred to as general benefit services and are not assessed to the District. General benefit services include tree maintenance, touch-up maintenance, sewer, and street maintenance. These are itemized in the report to reflect the City’s cost burden and are subsequently deducted from the total cost of the district.
Stakeholder Meetings
Staff met with the stakeholder Property Owners a total of three (3) times, on February 21, March 28, and April 11, 2025. At the meetings, staff presented information on the current assessment district services. The current level of service for sidewalk cleaning is approximately one (1) pressure washing session every three (3) weeks. The District services include charging City administrative costs that would not be incurred were it not for the existence of the businesses in the district. The assessment district maintains current contractual and capital outlay items as well. These services include an assessment district coordinator, landscaping, sidewalk cleanings, plant material and pots, tree light maintenance and utility costs, and minor painting (of pots and light poles). Members of the District recommended adding 11 additional sidewalk cleanings for a total of 27 sidewalk cleanings throughout the year and a falconer in addition to the current level of service. Property owners requested the additional sidewalk cleanings to account for more frequent cleaning in the summer months, and the falconer was requested to mitigate issues with bird droppings that make up a significant portion of mess on the sidewalks.
Conclusion
The assessment to be levied, based on the Engineer’s Report, is proposed to be $4.65 per linear foot per month. To meet noticing requirements, a legal notice and ballot was mailed to Council Special Meeting, 6/25/2025, Item No. 1., Item Page 3, Packet Page 5 №10/24
each property owner 45 days prior to the scheduled meeting on June 25, 2025. After the public hearing, if a majority protest is not received, Council will be asked to adopt a resolution certifying compliance with state law concerning the assessment and ordering that it be filed with the County Auditor-Controller's office prior to the County’s August 1, 2025 deadline. A majority protest is measured by the areas of the parcels owned by those who are not in favor of the assessment. In other words, ballots received are weighted so that parcels proposed to have a larger assessment count more. It is not a “one parcel, one vote” proceeding. Unless a majority of the weighted ballots are in favor of the proposed assessment, the City may not impose the assessment. A majority protest exists if 50% plus one of the record owners of the parcels subject to the change submit a timely written protest. To be timely, the written protest must be submitted prior to the conclusion of the public hearing.
All interested persons shall be afforded the opportunity to be heard. The City Council shall consider all oral statements and all written protest made by any interested person. Protest must be in writing.

METHOD OF ALLOCATING COSTS ON THE BASIS OF BENEFIT
ALVARADO STREET MAINTENANCE DISTRICT 85-1
FISCAL YEAR 2025/2026
The method utilized to allocate the costs associated with the benefits of the district shall be based upon lineal footage of frontage. The total cost necessary to be collected will be divided by the total frontage of the district. This will result in a cost per lineal foot. This amount will be multiplied by the lineal footage of each property frontage on Alvarado Street and Alvarado Mall.
The cost per lineal foot of frontage for the FY 2025/2026 is $4.65 per month.

Agenda Report
№11/25
FROM: Andrea Renny, P.E., PTOE, Public Works Director
Prepared By: Cody Hennings, Engineering Assistant I
SUBJECT: Open and Public Hearing to Confirm Calle Principal Maintenance District 00-1 Area and Receive Protests Related to the Collection of the Assessment Proposed in Engineer’s Report for Fiscal Year 2025/2026 and Authorize the Assessment if a Majority Protest Does Not Exist (Not a Project under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) RECOMMENDATION:
That the Council adopt the attached resolution confirming the area to be assessed for the Calle Principal Street
Maintenance District 00-1; confirm the assessments set
out in the attached Engineer’s Report; and order the
same to be filed with the County of Monterey’s AuditorController’s Office.
This is a property-based district in which liability for the assessment is premised upon a person’s property
ownership.
VALUE DRIVERS:
Serve as stewards of the City’s financial resources
through sound economic vitality efforts, streamlining
operations, reasonable revenue enhancements, visionary
long-term planning, fiscal transparency, and community
partnerships.
In collaboration with our community partners, work to
improve the quality of life of all of our community
members by fostering diversity, equity, and inclusion;
championing equitable access to affordable housing; and maintaining a safe environment.
POLICY IMPLICATIONS:
This action continues a process the City has followed
since 2000 that establishes an annual assessment to
repair and maintain improvements, and to add to these
improvements as necessary, to meet the original intent of the districts established to repair and maintain
improvements.
Agenda Report Highlights
Council will confirm the Calle
Principal Maintenance District 00-1
area and authorize assessments for
FY 2025/2026 if no majority protest
exists.
Assessment rate is $0.57 per linear
foot per month, totaling $19,348.00,
with $700.00 allocated for Cityowned parcels.
The District funds maintenance
beyond general services, including
sidewalk cleaning and grounds
upkeep, benefiting specific parcels.
Stakeholder meetings affirmed
support for continuing current
service levels within the District.
Public hearing allows written
protests, with weighted ballots
determining approval; majority
protest prevents assessment
implementation.
Date: 6/25/2025
Item No.: 2.
Council Special Meeting, 6/25/2025, Item No. 2., Item Page 1, Packet Page 16 №10/24
This action supports the Council’s value drivers of “Working to improve the quality of life of our residents” and “Ensuring a level of economic vitality sufficient to support our quality of life and municipal infrastructure requirements” by maintaining Calle Principal at a high standard conducive to commerce and public enjoyment of the downtown area.
CAMPAIGN DISCLOSURE REQUIREMENT (LEVINE ACT) APPLIES: No.
FISCAL IMPLICATIONS:
The Calle Principal Street Maintenance District funds maintenance above and beyond normal maintenance activities, with the cost of the improvements reasonably apportioned among the benefited parcels. General benefits to the public at large are not paid from special assessments.
The assessment rate will be $0.57 per linear foot per month and a total amount of $19,348.00 will be assessed in FY 25/26. The City of Monterey will be responsible for paying for the assessments for the City owned parcels within the District. This will cost approximately $700.00.
Funds to pay the assessment levied on City-owned parcels within the district will come from:
The Parking Fund for the Calle Principal garage and surface lot; The General Fund for the park parcel frontage; and the City-owned portion of the assessment for 408 Alvarado Street (Monterey Hotel).
The City Council may approve the engineer’s report, as submitted, or it may modify the report in any particular and approve it as modified (Streets & Highways Code section 22623).
The City Council could choose to suspend the collection of an assessment for this district for another year.
The City Council could initiate dissolution proceedings at a future meeting by adopting a resolution of intention (Streets & Highways Code section 22610). This is not recommended as the assessment pays for maintenance and improvements that benefit the property owner by adding to the character of Calle Principal.
Council Special Meeting, 6/25/2025, Item No. 2., Item Page 2, Packet Page 17 №10/24
DISCUSSION:
Background
The Calle Principal Maintenance District 00-1 was established in 2000 under the 1972 Landscape and Lighting Act (Streets and Highways Code section 22500 et seq.), which authorizes assessments to install, construct, and maintain landscaping, lighting, and park and recreation facilities, including graffiti removal. The boundaries of the District include the entire length of Calle Principal. All parcels that receive a special benefit have been identified and included in the engineer’s report. The Calle Principal Maintenance District has been in effect since it was created in 2000; however, the collection of the assessment was suspended for Fiscal Year 2024-2025 after it was determined that ballots may not have been received by the property owners.
The staff recommendation continues a legal process, which began at the Council's meeting of February 4, 2025, when the Council ordered the preparation of the Engineer's Report to establish the annual assessment for the maintenance of Calle Principal Improvements. The Engineer’s Report separates the general benefits to the public from the special benefits the assessed parcels will receive. Property-based assessments may only be used to pay for the special benefits provided by the improvements and activities of a district and may not be used to pay for general benefits (California Constitution Art XIIID §4(a)). Therefore, the Engineer’s Report separates and quantifies the special and general benefits and assesses property owners only for the portion of the cost representing special benefits.
General Benefits Charges
The City provides several services to the maintenance district that would be provided to the same area regardless of the existence of the District. These services are referred to as general benefit services and are not assessed to the District. General benefit services include tree maintenance, touch-up maintenance, sewer, and street maintenance. These are itemized in the report to reflect the City’s cost-burden and are subsequently deducted from the total cost of the district.
Stakeholder Meetings
Staff met with the stakeholder Property Owners a total of three (3) times, on February 21, March 28, and April 11, 2025. At the meetings, staff presented information on the current assessment district services. District services include quarterly sidewalk cleaning, grounds maintenance, and City staffing costs that would not be incurred save for the existence of the assessment district.
The assessment district maintains current contractual services. Members of the District recommended continuing the current level of service.
Conclusion
The assessment to be levied, based on the Engineer’s Report, is proposed to be $0.57 per linear foot per month. To meet noticing requirements, a legal notice and ballot was mailed to each property owner 45 days prior to the scheduled meeting on June 25, 2025. After the public hearing, if a majority protest is not received, Council will be asked to adopt a resolution certifying compliance with state law concerning the assessment and ordering that it be filed with the County Auditor-Controller's office prior to the County’s August 1, 2025 deadline. A majority protest is measured by the areas of the parcels owned by those who are not in favor of the Council Special Meeting, 6/25/2025, Item No. 2., Item Page 3, Packet Page 18 №10/24
assessment.
